NTE ANIMAL PROTECTION AND CONTROL ACT LOI SUR LA PROTECTION ET LE CONTRÔLE DES ANIMAUX The Commissioner of Yukon, by and with the advice and consent of the Legislative Assembly, enacts as follows: La Commissaire du Yukon, sur l'avis et avec le consentement de l'Assemblée législative, édicte : PART 1 (PARTIE 1) PART 1 PARTIE 1 INTERPRETATION AND APPLICATION (DÉFINITIONS, INTERPRÉTATION ET CHA MP D'A PPLICATION) INTERPRETATION AND APPLICATION DÉFINITIONS, INTERPRÉTATION ET CHAMP D'APPLICATION 1 Interpretation (Définitions et int erprétat ion) 1 Interpretation 1 Définitions et interprétation (1) In this Act (1) Les définitions qui suivent s’appliquent à la présente loi. “abandoned animal” means an animal that (a) is left for more than 24 hours without adequate food, water, or shelter, (b) is left for five days or more after the animal is to be retrieved from a veterinarian or from a person who, for consideration, stables, boards or cares for the animal, (c) is left on premises for which a tenancy agreement has been terminated, or (d) is found in any circumstances prescribed by the regulations for the purposes of this definition; « animal abandonné » “allowed species” means a species of animal prescribed as an allowed species in the regulations; « espèce admise » “animal” means « agent adjoint de protection et de contrôle des animaux » Particulier nommé à ce titre en vertu b) membre de la Gendarmerie royale du Canada. Animal Protection and Control Act Loi sur la protection et le contrôle des animaux CHAPTER 13 PART 1 CHAPITRE 13 PARTIE 1 Section 1 Article 1 Page 2 UNOFFICIAL CONSOLIDATION OF THE STATUTES OF YUKON CODIFICATION NON OFFICIELLE DES LOIS DU YUKON c (a) a vertebrate, except for (i) a human, and (ii) wildlife within the meaning of the Wildlife Act, unless the wildlife is kept in captivity; and (b) an animal belonging to any species prescribed by the regulations; « animal » “animal protection and control officer” means (a) an individual appointed as an animal protection and control officer under subsection 5(1) or belonging to a class of individuals appointed under subsection 5(1), and (b) a member of the Royal Canadian Mounted Police; « agent de protection et de contrôle des animaux » “animal rescue organization” means an organization operated by one or more persons that keeps animals on a temporary basis for the purpose of the protection, care, rescue or re-homing of the animals and includes an animal shelter, a pound, an animal rescue network and any other organization operated for a similar purpose; « organisme de secours animal » “at large”, in respect of an animal, means that the animal is off the premises of its owner and is not restrained or under the control of any person; « en liberté » “boarding facility” means a business that keeps animals in exchange for the payment of a fee; « pension pour animaux » “caretaker” means a person who, in relation to an animal, (a) has an appropriate facility to care for that animal, and (b) is able to care for that animal temporarily until other arrangements for the care of that animal can be made or the animal can be returned to its owner; « préposé aux animaux » “chief veterinary officer” has the same meaning as in the Animal Health Act; « vétérinaire en chef » “companion animal” means (a) an animal belonging to an allowed species, and (b) an animal belonging to a restricted species; « animal de compagnie » “deputy animal protection and control officer” means “animal protection and control officer” « animal » a) Vertébré, à l’exclusion : (i) d’une part, d’un humain; (ii) d’autre part, d’un animal sauvage, au sens de la Loi sur la faune, à moins qu’il soit gardé en captivité b) animal qui appartient à toute espèce animale prévue par règlement. “animal” « animal à haut risque » Animal prévu comme tel par règlement. “high-risk animal” « animal abandonné » Animal qui, selon le cas : a) est laissé pendant plus de 24 heures sans suffisamment de nourriture ou d’eau, ou sans abri adéquat; b) est laissé, pendant au moins cinq jours après le moment où on devait le récupérer, auprès d’un vétérinaire ou d’une personne qui, contre rémunération, le garde dans une écurie, l’héberge ou en prend soin; c) est trouvé dans des lieux qui font l’objet d’un contrat de location résilié; d) est trouvé dans toutes circonstances prévues par règlement pour l’application de la présente définition. “abandoned animal” « animal de compagnie » a) animal qui appartient à une espèce admise; b) animal qui appartient à une espèce faisant l’objet de restrictions. “companion animal” « animal féral » Animal qui, à la fois : a) n’est la propriété ou sous le contrôle de personne; b) est capable d’établir une population qui peut être viable à l’état sauvage. “feral animal“ « animal nuisible » a) Insecte ou rongeur qui comporte des risques pour la santé humaine ou animale, ou pour l’intégrité d’une structure ou de cultures; b) animal ou animal sauvage qui appartient à une espèce prévue comme telle par règlement. “pest” « animal sauvage » S’entend au sens de la Loi sur la faune; est exclu de la présente définition le bétail. « agent adjoint de protection et de contrôle des animaux » “director” means a director appointed under paragraph 4(1)(a); « directeur » “feral and high-risk animal control officer” means an individual designated under subsection 46(2), or an individual belonging to a class of individuals designated under subsection 46(2); « agent de contrôle d’animaux féraux ou à haut risque » “feral animal“ means an animal (a) that is not owned or controlled by any person; and (b) that has the capacity to establish a population that may be sustained in the wild. « animal féral » “high-risk animal” means an animal prescribed by the regulations as a high-risk animal; « animal à haut risque » “livestock” means an animal (a) raised for food or fibre, or (b) belonging to a species prescribed by the regulations as livestock; « bétail » “Minister” means the member of the Executive Council to whom the administration of this Act is assigned; « ministre » “motor vehicle” means a vehicle that is self propelled, except by muscular power, including (a) a vehicle designed to be operated on a roadway, (b) an all-terrain vehicle, (c) a utility-terrain vehicle, (d) a motorized trail bike, (e) a snowmobile, (f) a vehicle operated on rails, and (g) a vehicle operated for the purposes of road maintenance or construction, mining, forestry or farming; « véhicule automobile » “owner”, in respect of an animal, means (a) a person who has a property right in the animal, “wildlife” « animalerie » Entreprise qui offre des animaux de compagnie en vente au public; b) appartiennent à une espèce animale prévue comme tel par règlement. “livestock” « danger déclarable » S’entend au sens de la Loi sur la santé des animaux. “reportable hazard” « directeur » Directeur nommé en vertu de l’alinéa 4(1)a). “director” « en liberté » S’agissant d’un animal, qui n’est pas sur les lieux de son propriétaire et n’est pas maitrisé (immobilisé) ou sous le contrôle de toute personne. “at large” « endroit » Notamment tout bien-fonds, bâtiment, véhicule, aéronef ou embarcation. “place” « espèce admise » Espèce animale prévue comme telle par règlement. “allowed species” « espèce faisant l’objet de restrictions » Espèce animale prévue comme telle par règlement. “restricted species” « espèce interdite » Espèce animale prévue comme telle par règlement. “prohibited species” « ministre » Le membre du Conseil exécutif à qui est confiée l’administration de la présente loi. “Minister” « norme de soins » Norme de soins prévue ou adoptée par règlement. “standard of care” « organisme de secours animal » Organisme qu’exploite une ou plusieurs personnes qui garde temporairement des animaux pour les protéger, en prendre soin, les secourir ou les placer; la présente définition inclut tout refuge pour animaux, fourrière, réseau de secours animal ou autre organisme exploité dans un but similaire. “animal rescue organization” « pension pour animaux » Entreprise qui garde les animaux moyennant le paiement d’un frais. “boarding facility” « préposé aux animaux » Personne qui, relativement à Animal Protection and Control Act Loi sur la protection et le contrôle des animaux CHAPTER 13 PART 1 CHAPITRE 13 PARTIE 1 Section 1 Article 1 Page 4 UNOFFICIAL CONSOLIDATION OF THE STATUTES OF YUKON CODIFICATION NON OFFICIELLE DES LOIS DU YUKON c (b) a parent of a minor who has a property right in the animal, (c) a person who has possession or control of the animal, (d) a person who occupies premises containing the animal, and (e) a person who is in possession or control of the animal, or occupies premises containing the animal, immediately before the animal is seized or taken into custody; « propriétaire » “pest” means (a) an insect or rodent that poses a risk to human or animal health or to the integrity of a structure or crops, and (b) an animal or wildlife belonging to a species prescribed by the regulations as a pest; « animal nuisible » “pet store” means a business that offers companion animals for sale to the public, but does not include an animal rescue organization, even if that animal rescue organization accepts donations or requires the payment of a fee for the adoption of animals; « animalerie » “place” includes any land, building, vehicle, aircraft, or vessel; « endroit » “prohibited species” means a species of animal prescribed as a prohibited species in the regulations; « espèce interdite » “reportable hazard” has the same meaning as in the Animal Health Act; « danger déclarable » “restricted species” means a species of animal prescribed as a restricted species in the regulations; « espèce faisant l’objet de restrictions » “standard of care” means a standard of care prescribed or adopted in the regulations; « norme de soins » “veterinarian” has the same meaning as in the Animal Health Act; « vétérinaire » “wildlife” has the same meaning as in the Wildlife Act, except that it does not include livestock. « animal sauvage » un animal : a) d’une part, dispose des installations appropriées pour prendre soin de l’animal; (3) For the purposes of this Act, the owner of an animal abandons that animal if the owner causes the animal to fall within the definition of an abandoned animal.
