(Compte) “farm business” means a farming operation registered as a farm business under section 3. (entreprise agricole) “Minister” means the Minister of Agriculture, Aqua culture and Fisheries. (ministre) “register” means the register of farm businesses estab lished under section 2. (registre) “Registrar” means the Registrar of Farms appointed under section 19. Use of the designation “Registered Professional Agricultural Producer” Utilisation de la désignation « producteur agricole professionnel inscrit » 4(1) A person who carries on a farm business shall be entitled to use the designation “Registered Professional Agricultural Producer”, “RPAP” or “R.P.A.P.”. 4(1) L’exploitant d’une entreprise agricole peut utiliser la désignation « producteur agricole professionnel ins crit », « PAPI » ou « P.A.P.I. ». 4(2) No person, other than a person who carries on a farm business, shall use the designation “Registered Pro fessional Agricultural Producer”, “RPAP” or “R.P.A.P.”. 4(2) Il est interdit à toute personne, autre qu’un exploi tant d’une entreprise agricole, d’utiliser la désignation « producteur agricole professionnel inscrit », « PAPI » ou « P.A.P.I. ». 4(3) Any person who violates or fails to comply with subsection (2) commits an offence punishable under Part II of the Provincial Offences Procedure Act as a category C offence. 4(3) Quiconque contrevient ou omet de se conformer au paragraphe (2) commet une infraction punissable en vertu de la partie II de la Loi sur la procédure applicable aux infractions provinciales à titre d’infraction de la classe C. Accreditation of farm organization Agrément d’un organisme agricole 6(1) Any organization representing farmers in the Prov ince that meets the criteria prescribed by regulation may apply to the Registrar to be accredited as a farm organiza tion for the purposes of this Act. 6(1) Tout organisme représentant des agriculteurs de la province qui remplit les critères prescrits par règlement peut faire une demande d’agrément auprès du registraire comme organisme agricole pour les fins de la présente loi. 6(2) The application for accreditation shall be made on a form provided by the Registrar and shall contain the in formation that the Registrar considers necessary. 6(2) La demande d’agrément est faite au moyen de la formule fournie par le registraire et doit contenir les ren seignements qu’il estime nécessaires. A-5.6 Loi sur l’enregistrement des producteurs agricoles et le financement des organismes agricoles 4 Renewal of accreditation Renouvellement de l’agrément 7(1) An accredited farm organization may apply to the Registrar, within the time prescribed by regulation, for re newal of accreditation. 7(1) Tout organisme agricole agréé peut faire une de mande de renouvellement d’agrément auprès du regis traire dans le délai prescrit par règlement. 7(2) An application for renewal of accreditation shall be made on a form provided by the Registrar and shall contain the information that the Registrar considers necessary. 7(2) Une demande de renouvellement d’agrément est faite au moyen de la formule fournie par le registraire et doit contenir les renseignements qu’il estime nécessaires. 7(3) Notwithstanding section 11, if a farm organization applies for renewal of accreditation, the accreditation of the farm organization remains valid until the Registrar ad vises the farm organization in writing of the Registrar’s decision to accept or refuse to accept the application for renewal of accreditation. 7(3) Malgré l’article 11, l’agrément d’un organisme agricole qui fait une demande de renouvellement demeure valide jusqu’à ce que le registraire avise l’organisme agri cole par écrit de sa décision d’accepter ou de refuser la demande de renouvellement d’agrément. Notice of application for accreditation or for renewal of accreditation Avis de demande d’agrément ou de renouvellement d’agrément 8 The Registrar shall advise the accredited farm organi zations in writing of any application for accreditation or for renewal of accreditation made under this Act. 8 Le registraire avise par écrit les organismes agricoles agréés de toute demande d’agrément ou de renouvellement d’agrément faite dans le cadre de la présente loi. Hearing Audience 9(1) The Registrar may, within a reasonable time, hold a hearing with respect to an application for accreditation of an organization representing farmers in the Province or with respect to an application for renewal of accreditation of a farm organization. 9(1) Le registraire peut, dans un délai raisonnable, tenir une audience au sujet de la demande d’agrément d’un or ganisme représentant des agriculteurs de la province ou de la demande de renouvellement d’agrément d’un orga nisme agricole. 9(2) The Registrar shall publish a notice of the hearing 9(2) Le registraire publie un avis d’audience aux en droits suivants : (a) at least once in each of 2 consecutive weeks in a newspaper or newspapers having general circulation in areas in which, in the Registrar’s opinion, the notice is likely to come to the attention of a person who is car rying on a farming operation that is a farming business within the meaning of the Income Tax Act (Canada) or that is a start-up farming operation that is following a management plan approved by the Minister, and a) dans un journal ou des journaux qui ont une diffu sion générale dans les localités où, de l’avis du regis traire, il est probable que l’avis soit porté à l’attention de tout exploitant d’une exploitation agricole qui est une entreprise agricole au sens qu’en donne la Loi de l’impôt sur le revenu (Canada) ou qui est une opération de dé marrage d’exploitation agricole qui suit un plan admi nistratif approuvé par le ministre, au moins une fois par semaine pendant deux semaines consécutives; (b) in one issue of The Royal Gazette. b) dans une édition de la Gazette royale. 9(3) The notice of the hearing shall 9(3) L’avis d’audience comprend les renseignements suivants : (a) state the name of the organization applying for accreditation or for renewal of accreditation, a) le nom de l’organisme qui fait la demande d’agré ment ou de renouvellement d’agrément; Agricultural Producers Registration and Farm Organizations Funding Act Chap. Decision of Registrar Décision du registraire 10 The Registrar shall advise the applicant in writing, within the time prescribed by regulation, of the Registrar’s decision to accept or refuse to accept the application for accreditation or for renewal of accreditation. 10 Le registraire avise le demandeur par écrit de sa dé cision d’accepter ou de refuser sa demande d’agrément ou de renouvellement d’agrément, et ce dans le délai prescrit par règlement. Accreditation period Durée de l’agrément 11 Accreditation of a farm organization given under this Act shall be valid for a period of 4 years from the date the Registrar grants the accreditation. 11 L’agrément d’un organisme agricole donné en vertu de la présente loi est valide pour une période de quatre ans à partir de la date à laquelle le registraire accorde l’agré ment. Organization deemed to be accredited farm organization Organisme réputé être un organisme agricole agréé 12 Any organization representing farmers in the Prov ince and that is prescribed by regulation is deemed to be an accredited farm organization for the purposes of this Act for a period of 4 years from the date on which this section comes into force. 12 Tout organisme représentant des agriculteurs de la province qui est identifié par règlement est réputé être un organisme agricole agréé pour les fins de la présente loi pour une période de quatre ans à partir de la date d’entrée en vigueur du présent article. Review of accreditation Révision de l’agrément 13(1) If the Registrar is of the opinion that an accredited farm organization no longer meets any of the criteria pre scribed by regulation, the Registrar may undertake a re view of the accreditation of the farm organization. 13(1) Si le registraire est d’avis qu’un organisme agri cole agréé ne satisfait plus aux critères prescrits par règle ment, il peut procéder à une révision de l’agrément de cet organisme. 13(2) The Registrar may, within a reasonable time, hold a hearing to determine if an accredited farm organization meets or does not meet any of the criteria prescribed by regulation. 13(2) Le registraire peut, dans un délai raisonnable, tenir une audience afin de déterminer si un organisme agricole agréé satisfait ou non aux critères prescrits par règlement. 13(3) The Registrar shall publish a notice of the hearing 13(3) Le registraire publie un avis d’audience aux en droits suivants : Ch. Voluntary withdrawal of accreditation Retrait volontaire de l’agrément 14(1) An accredited farm organization may, upon ap plication to the Registrar, seek the withdrawal of the ac creditation of the farm organization. 14(1) Un organisme agricole agréé peut faire une de mande de retrait de son agrément auprès du registraire. 14(2) The Registrar shall, within 30 days after the re ceipt of the application, withdraw the accreditation of the farm organization and notify the farm organization in writ ing that the accreditation of the farm organization has been withdrawn. 14(2) Le registraire retire l’agrément dans les trente jours qui suivent la réception de la demande et avise l’or ganisme agricole par écrit que son agrément a été retiré. 14(3) The Registrar shall send a copy of the written no tice referred to in subsection (2) to all other accredited farm organizations. 14(3) Le registraire envoie une copie de l’avis écrit mentionné au paragraphe (2) aux autres organismes agri coles agréés. Financial statements, books, records and accounts États financiers, livres, registres et comptes 15(1) An accredited farm organization shall, within 90 days after the end of its fiscal year, forward to the Registrar a copy of the farm organization’s audited financial state ments for the preceding fiscal year. 15(1) L’organisme agricole agréé doit, dans les quatre vingt-dix jours qui suivent la fin de son exercice financier, faire parvenir au registraire une copie de ses états finan ciers vérifiés pour l’année financière précédente. 15(2) An accredited farm organization shall provide the Registrar with access, during regular business hours, to the books, records and accounts of the accredited farm orga nization. 15(2) L’organisme agricole agréé doit, durant les heures régulières d’ouverture, mettre tous ses livres, registres et comptes à la disposition du registraire.
