Prohibitions Interdictions 2 (1) No person shall manufacture or import a product set out in column 1 of Schedule 1 if its concentration of 2 butoxyethanol exceeds the limit set out in column 2 for that product unless (a) the product is to be diluted before it is used, in ac cordance with the manufacturer’s written instructions, to a concentration equal to or less than the limit set out in column 2 for that product and that product is either labelled with or accompanied by those instruc tions in both official languages and those instructions would not result in dilution of the product to a con centration greater than the limit set out in that column for that product; or (b) the person has been issued a permit under section 5 and, in the case of a product that is to be diluted be fore it is used, that product is either labelled with or accompanied by the manufacturer’s written dilution instructions in both official languages. 2 (1) Il est interdit de fabriquer ou d’importer un pro duit mentionné à la colonne 1 de l’annexe 1 dont la concentration en 2-butoxyéthanol dépasse celle prévue pour ce produit à la colonne 2, sauf dans les cas suivants : a) le produit doit, selon les instructions écrites du fa bricant, être dilué avant utilisation à une concentra tion égale ou inférieure à celle prévue pour ce produit à la colonne 2 et il est étiqueté ou accompagné de ces instructions dans les deux langues officielles, les quelles ne doivent pas prévoir un mode de dilution qui résulterait en une concentration supérieure à celle prévue à cette colonne pour ce produit; b) la personne est titulaire d’un permis délivré en ver tu de l’article 5 et, dans le cas où le produit doit être dilué avant utilisation, les instructions écrites du fa bricant sur le mode de dilution dans les deux langues officielles doivent figurer sur l’étiquette du produit ou accompagner celui-ci. (2) The Minister shall refuse to issue a permit if the Min ister has reasonable grounds to believe that the applicant has provided false or misleading information in support of their application. (3) A permit expires 24 months after the day on which it is issued unless, before its expiry date, the applicant sub mits a new application in accordance with section 4. Q-2, as amended from time to time, and the scope of whose accreditation in cludes the analytical method used to make the deter mination. Record Keeping Registres 8 (1) Every person that submits the information set out in Schedule 2 shall keep a copy of that information, the certification and any documents supporting the informa tion for a period of at least five years, beginning on the date of the submission of the information. 8 (1) Toute personne qui présente les renseignements prévus à l’annexe 2 en conserve copie dans un registre, avec l’attestation et les documents à l’appui, pendant au moins cinq ans à compter de la date de leur présentation. (2) Every person that manufactures or imports a product set out in column 1 of Schedule 1 shall keep a record of the results of any analysis conducted to determine the concentration of 2-butoxyethanol in the product, either as diluted in accordance with the manufacturer’s written instructions — in the case of a product that is to be dilut ed — or as it is manufactured, the name and civic address of the laboratory that performed the analysis and any supporting documents related to the analysis for a period of at least five years, beginning on the date of the analy sis. (3) The information, certification, results of analysis and supporting documents that are required to be kept by the person shall be kept at their principal place of business in Canada or at any other place in Canada where the infor mation, certification, results and supporting documents can be inspected. If those records are kept at any place other than the person’s principal place of business, the person shall provide the Minister with the civic address of the place where they are kept.
