Bhutan Fishing Rules, 1974

NOTIFICA.TION DA TEO 1sr JANUARY 1974 BHUTAN FISHING RULES These rules shall be called the Bhutan Fishing Rules and It shall come Into force with effect from 1st January 1974, It shall extend to the whole of Bhutan. 2. Catching offish In any stream, river, l"ond or lakes In Bhutan la strictly prohibited without pone• 11lon of a valid Fishing Licence. 3 Fishing Licence shall be luueo bv the Fore,t Department, Director of Foresta, Olvi1lonal Fore■t Officers of the area or any other authority duly empowered for 1h11 purpose by the Royal Govern• ment of Bhutan. The Fishing Licence shall be Issued on a prescribed form on payment of the pre• 1crlbed fees, 4, Fishing shall be prohibited during the followlng periods and Licence holtlers shall not engage themselves In the catchln!J of fish during the prohl· bltory periods. 1) During the months of October, November and Dectmber every year for fl 1hlng trout, 2) Fishing on 8th, 15th and 30th of each Shu• tanese month Is prohibited. 5. Fishing by the followfng means Is strictly prohlblted 1) Fishing by poisoning or dynamiting rl•ers, streams, ponds or lakes. 2) Erection of weirs. dams for diverting rlveri/ streams to trap the fish. 3) Fishing by flre•arms, closed nets, large nets. puglep, Phen•Phen or splaahlng or laving of waters J. The Licence holder shall not catch fish which are fess than eight Inch In length. 7. FJ1hlng within one mile of a Gompa, Templr, Dzong or Lama School and within twenty yards of the main road is strictly prohibited, 8. The Licence holder shall carry his Fishing Licence with him at the time of fishing, Persons not holding a valid Fishing Licence shall not assist the Licence holder In fishing, The Licence holder shall p,oduce his Fishing Licence on demand by any Police Officer or an Officer of the Foreat Department of the Royal Governmenl of Bhutan 9, Refusal to show his Fishing Licence on demand by a Police Officer or a Forest Officer, the Individual engaged In fishing shall be punish• able with a fine, which may extend up to Nu. 50 The person so fined shall give his name, address and also the address of the Issuing authority of his Fishing Licence, to enable the Government Officers to check whether the oerson so fined possesses • valid Fishing Licence. In case It Is found on chec• king that the pers~n so fined did not posse1111 a Fishing Licence. he shall be liable to a fine which may extend up to Nu 500 or with Imprisonment which may extend up to one month or with both, 10, Persons engaged In fishing without obtaining a valid Fishing Licence shall be liable to a fine which may extend up to Nu. 500 or with Imprison• men! which may extend up to one month or with both, 11 The Licence holder shall not tran1ler or endo• ree his Fishing Licence In favour of any other person for fishing. 12. The Licence holder shal! not sell, barter or loan his catch of fish In any place In Bhutan or outside 13. The offences under this Act 1hall be cognlz· abfe and bailable and Police officers/Forest officers are 11uthorlsed to arrest any person who 11 found commlttlrg a breach of any of the provision, of these Rules 14 Whoever commits an offence under any of the above provl■lons shall be liable to a tine, which may extend up to Nu,500 or with Imprisonment which •ay extend up to one month or with both. 15. In case of fishing by polaonlng or dynamiting, the fine shall extend up to Nu. 1000 or Imprison• ment for two months or both. 16, Breach of any of the provisions of !hi~ Act shall render the Licence holder liable to eancella• lion of hi■ Fishing Licence In addition to the penal· ties provided under this Ate.
