Regulation on the procedure for payment of the fees collected pursuant to the Act on the Safe Use of Nuclear Energy

Article 1. The regulation establishes the procedure for payment of the fees pursuant to the Act on the Safe Use of Nuclear Energy (ASUNE).

Article 2. (1) Fees shall be deposited into the budget of the Nuclear Regulatory Agency (NRA). (2) Fees shall be paid by bank transfers to the NRA bank account. (3) Bank transfers shall be proven by a certified copy of the payment document. (4) Any fee, paid by mistake, is a subject of refunding by NRA.

Article 3. (1) The fee for review of an application for issuing of a license or a permit, for amendment of a license or a permit, and for extension of the term of validity of a license or a permit shall be paid by the applicant prior/with the submission of the respective application. (2) In the case of submission of more than one application for issuing of licenses or permits, a separate fee shall be paid for the documentation review of each application. (3) A certified copy of the payment document shall be attached to the applications under Paragraphs 1 and 2.

Article 4. (1) The fee for issuing of a permit shall be paid by the applicant prior/with the issuing of the respective permit. (2) Each permit issued shall be served upon the permit holder or a legally authorised representative if a copy of the payment certifying document has been submitted.

Article 5. (1) Initial licensing fee shall be paid by the licensee prior/with the issuing of the respective license. (2) Annual licensing fee shall be paid as follows: 1. in the case of a license under Article 15, Paragraph 3, Subparagraph 1 of the ASUNE – in 4 equal instalments which shall be paid not later than the 15th day of the first month of the respective 3-month period within any calendar year included in the license term of validity; 2. in the case of a license under Article 15, Paragraph 3, Subparagraphs 2, 3, 4, 5, 6 and 7 of the ASUNE – in 2 equal instalments which shall be paid not later than the 15th day of the first 2 month of the respective 6-month period within any calendar year included in the license term of validity. (3) Annual licensing fee for the year of issuance, if it is not a full calendar year, shall be calculated proportionally to the time period from the issuing of date of the license to the end of the calendar year. (4) Annual licensing fee for the last year of license validity, if it is not a full calendar year, shall be calculated proportionally to the time period from the beginning of the calendar year to the end of the term of validity of the license. (5) Each license issued shall be served upon the licensee or a legally authorised representative if a copy of the payment certifying document has been submitted.

Article 6. (1) Fees specified in Article 28, Paragraph 2, Subparagraphs 4 and 5 of the ASUNE shall be paid by the licensee or permit holder in the case of license or permit amendment or in the case of license or permit extension. (2) Fees under Paragraph 1 shall be paid in 2 equal instalments due as follows: 1. upon receiving the license or permit amendment or extension order; 2. within 3 months after the date of receiving the order under Subparagraph 1.

Article 7. (1) Examination fees under Article 66, Paragraph 2 of the ASUNE for examinations before a qualification examination commission appointed by the NRA Chairman shall be paid prior/with the submission of the individual license application or prior/with the submission of an application for future examination. (2) Fees for issuing by the NRA Chairman of an individual license shall be paid prior/with the issuing of the individual license. (3) Each individual license issued shall be served upon the licensee if a copy of the payment certifying document under Paragraph 2 has been submitted. Final provision Paragraph One. The Regulation has been approved on the grounds of Article 31, Paragraph 1 of the Act on the Safe Use of Nuclear Energy.
