Presidential Decree on enforcement of the Law of Azerbaijan Republic on amelioration and irrigation

1 DECREE OF THE PRESIDENT OF AZERBAIJAN REPUBLIC "ON ENFORCEMENT OF THE LAW OF AZERBAIJAN REPUBLIC "ON AMELIORATION AND IRRIGATION". In connection with entry into force of the Law of Azerbaijan Republic "On Amelioration and Irrigation", in order to ensure application of the Law I decree: 1. The Cabinet of Ministers of Azerbaijan Republic within one month period is to: submit to the President of Azerbaijan Republic proposals on bringing the acting legislative acts (including the Law of Azerbaijan Republic "On Entrepreneurial Activity") in line with the Law of Azerbaijan Republic "On Amelioration and Irrigation": ensure bringing the regulatory-legal acts of the Cabinet of Ministers and the relevant bodies of the executive power in line with the above mentioned Law and inform the President of Azerbaijan Republic about this. 2. To charge the Cabinet of Ministers of Azerbaijan Republic to inform the President of Azerbaijan Republic regarding fulfilment of the following: preparation and approval, within two-month period, rules l of the paid use of water; preparation and approval, within two-month period, rules of acceptance for amelioration and irrigation systems and protective forest-plantations; solution, within its competence, other issues arising from the provisions of the Law of Azerbaijan Republic "On Amelioration and Irrigation". 3. To establish, that the authority provided by Article 9 of the Law of Azerbaijan Republic "On Amelioration and Irrigation" shall be carried out by the Cabinet of Ministers of Azerbaijan Republic. 4. To establish that, the authority provided by Article 10 of the Azerbaijan Republic shall be carried out by the Cabinet of Ministers of Azerbaijan Republic. 5. To establish that the local bodies of the executive power are authorized in the field of amelioration and irrigation: to prepare and approve ameliorative and irrigation programmes for district (city) territory based on Republican programmes in the field of amelioration and irrigation; to organise control of their implementation; to take part in financing of ameliorative and irrigation measures undertaken by means of state owned "amelioration and irrigation systems at the territory of a district (city); to organise works on rehabilitation of amelioration and irrigation systems damaged or destructed as a result of natural calamity at the territory of a district (city). 6. To establish that functions of "the relevant body of the executive power on amelioration and irrigation provided by Article 12; Article 13; Article 14, part 2; Article 16, part 2; Article 18, part 1; Article 19, part 1; Article 26, parts 2 and 3; Article 27, parts 1 and 3; shall be carried out by the State Amelioration and Irrigation Committee at the Cabinet of Ministers of Azerbaijan Republic, 7. To charge the State Amelioration and Irrigation Committee at the Cabinet of Ministers of Azerbaijan Republic: to prepare, within two-month period, the rules of introducing of passport (technical certificate) for amelioration and irrigation systems and approve them in agreement with the Ministry of Justice; to prepare, within three-month period, rules of amelioration and irrigation systems operation and protective forest-plantation maintenance; to approve them in agreement with the State Ecology Committee, the Production Association "Azerbmesha" (Forestry Association), the State Land Committee of Azerbaijan Republic and the Ministry of Justice of Azerbaijan Republic.
