NORTHERN TERRITORY OF AUSTRALIA Regulations No. 3 of 2005* Barramundi Fishery Management Plan Amendment (No. 2) 2005 I, KONSTANTINE VATSKALIS, the Minister for Primary Industry and Fisheries, pursuant to section 25A of the Fisheries Act, approve the following amendments to the Barramundi Fishery Management Plan. Citation This instrument may be cited as the Barramundi Fishery Management Plan Amendment (No.2) 2005. 2. Principal Plan amended This instrument amends the Barramundi Fishery Management Plan. 3. Amendment of clause 4 (Interpretation) (1) Clause 4(1), definitions of "river", "river closure line" and "river mouth" – omit (2) Clause 4(1) – insert (in alphabetical order) "coast" means – (a) if a closure line is specified in Schedule 5 for a river or part of the coastline – the closure line; (b) in relation to any other river – the mouth of the river; and (c) in relation to any other area – the point where the water meets the shore at Mean High Water Springs; "closure line" means an imaginary line drawn between the co-ordinates specified in Schedule 5 for a river or part of the coastline; "mouth", of a river, means an imaginary line drawn from the most seaward extremity at Mean High Water Springs of one bank of the river to the most seaward extremity of the next bank at the same height of tide; "river" has the meaning in clause 4A; 4. New clause 4A After clause 4 – insert 4A. Meaning of "river" (1) A river includes– (a) a creek, stream or tidal arm; and Barramundi Fishery Management Plan Amendment (No. 2) 2005 3 (b) a billabong, lake or other body of water, whether fresh or brackish, that, seasonally or consistently, flows directly or indirectly into the sea. (2) For subclause (1), a tributary, branch, anabranch, channel or division of a river, or a river flowing into a river, is taken to form part of and be one river. 5. Amendment of clause 8 (Fishery area) (1) Clause 8(1)(a) – omit or a river mouth (2) Clause 8(1)(b) – omit all the words after "low-water mark" substitute and generally parallel to the shore or mouth of any river (3) After subclause (1) – insert (1A) Despite subclause (1)(a), if a seven inch net line is specified in Schedule 6 for a river, a barramundi licensee may fish under a barramundi licence in the part of the river seawards of the line. 6.
