ANTIGUA & BABUDA THE JBARBUDA LAND (AMIENDMIENT) ACT, 2016 No. 12 of2016 AN ACT to amend the Barbuda Land Act, 2007 No. 23 of 2007. ENACTED by the Parliament of Antigua and Barbuda as follows 1. Short Title This Act may be cited as the Barbuda Land (Amendment) Act, 2016. 2. Amendment of section 2-Ilnterpretation Section 2 of the Barbuda Land Act, 2007 No. 23 of 2007, in this Act referred to as the Principal Act, is amended by the deletion of paragraph (a) of the definition of "major development" and the substitution of the following "(a) a development which will cost in excess of forty million dollars or" 3. Amendment of section 6- Leases of land for major developments Section 6 of the Principal Act is amended by the repeal of subsection (4) and the substitution of the following No. 12 of2016 The Barbuda Land (Amendment) Act, 20 I 6. "(4) Subject to subsection(]), the Cabinet, or the Council with the approval of the Cabinet, may grant a lease of land in Barbuda for a maximum period of ninety-nine (99) years." 4. Amendment of section 8- Conversion olf rights ffnto leases Section 8 of the principal Act is amended by the repeal of subsections (I) and (2) and the substitution of the following "(!) A person to whom an exclusive right of occupation has been granted by the Council may, after five years of occupancy, apply to the Council for the grant oflease for the purposes for which the exclusive right was granted. (2) The Council may grant a lease under this section for a maximum term of ninety-nine years and any term so granted may be subject to renewal." 5. A.me.,dment of section 11-Administration and development of land Section 11 of the Principal Act is amended by the repeal of paragraph (c) of subsection (I) and the substitution of the following "(c) the granting oflease of!and in Barbuda in accordance with provisions of this Act".
