The purpose of this Regulation is to establish a regulatory framework for designing, installing, operating and maintaining decentralized wastewater treatment system to ensure efficient, effective and affordable wastewater treatment services in Rwanda. L’objet du présent règlement est de mettre en place un cadre réglémentaire pour l’élaboration, installation, fonctionnement et maintenance des systèmes décentralisés de traitement des eaux usées pour assurer les services efficaces, durables et abordables de traitement des eaux usées au Rwanda. 4° Amazi yamenwe: amazi asohoka aho batunganyiriza amazi yakoreshejwe; 4° Effluent: liquid discharged from a wastewater treatment unit; 4° Effluent: liquide rejeté par une unité de traitement des eaux usées; 5° Umwubatsi: umuntu, ikigo cy’ubucuruzi cyangwa koperative yubaka cyangwa isana ibikorwaremezo bitunganya amazi yakoreshejwe; 5° Installer: a person, company or cooperative that constructs or repairs wastewater treatment systems; 5° Installateur : personne, société commerciale ou une coopérative qui construit ou réfectionne les systèmes de traitement des eaux usées ; 6° Uruhushya : inyandiko itangwa n’ubuyobozi yemerera umuntu, ikigo cy’ubucuruzi cyangwa koperative kubaka ibikorwaremezo byegerejwe abaturage bitunganya amazi yakoreshejwe no kubikoresha mu gihugu ; 6° License: an official document which confirms that the person, company or cooperative can legally install and operate decentralized wastewater treatment facilities in the country; 6° Licence : un document officiel qui autorise une personne, une société commerciale ou une coopérative à installer et rendre opérationnel légalement des infrastructures décentralisées de traitement des eaux usées dans le pays ; 7° Nyiribikorwaremezo : umuntu uwo ari we wese harimo n’ukodesha, wemerewe kubaka, gufata neza, gukoresha, gusana, kunoza cyangwa kwagura ibikorwa byo gutunganya amazi yakoreshejwe ; 7° Owner: any person, including the tenant, having the authority to construct, maintain, operate, repair, improve or extend wastewater treatment works; 7° Propriétaire : toute personne, y compris le locataire, autorisée à construire, faire la maintenance, rendre opérationnel, réfectionner, améliorer ou faire l’extension des travaux de traitement des eaux usées ; 8° Operator: any person employed or appointed by the owner of wastewater treatment system for the operation and maintenance of the wastewater treatment system; 8° Opérateur : toute personne employée ou désignée par le propriétaire d’un système de traitement des eaux usées pour le rendre opérationnel et l’entretenir ; 9° Utanga serivisi wemewe : Umuntu uwo ari we wese wahawe uruhushya n’Urwego Ngenzuramikorere rwo gutanga serivisi zo gutunganya amazi yakoreshejwe ; 9° Qualified service provider: Any person licensed by the Regulatory Authority to provide wastewater treatment services; 9° Prestataire de services qualifié: Toute personne autorisée par l’Autorité de Régulation à fournir les services de traitement des eaux usées ; 10° Urwego Ngenzuramikorere: Urwego rw’Igihugu rushinzwe kugenzura imikorere y’inzego zimwe z’imirimo ifitiye Igihugu akamaro ; 11° Service provider: natural persons, enterprises or organizations which provide wastewater treatment related services in terms of design, installation, operation and maintenance; 11° Prestataire de Services : personnes physiques, entreprises ou organisations qui fournissent des services liés au traitement des eaux usées en termes de conception, d'installation, d'exploitation et de maintenance ; 12° Amazi y’umwanda : umwanda utwawe n’amazi uvuye mu bwiherero, mu gikoni, aho bamesera, mu rwogero cyangwa mu bwiherero, waba ari wonyine cyangwa uri kumwe n’andi mazi akomoka mu butaka, atemba ku butaka, amazi y’imvura y’amahindu, cyangwa andi mazi yakomoka mu mazu atuwe, mu nyubako nini, mu binyabiziga, mu nganda n’ahandi hantu hose agatwarwa n’urusobekerane rw’amatiyo manini 12° Sewage: the water-carried waste containing human waste, kitchen, laundry, shower, bath or lavatory wastes, either separately or together with such underground, surface, storm and other water and liquid industrial waste as may be present from residences, buildings, vehicles, industrial establishments or other places and carried by sewer network to the treatment or disposal site; Article 11: Performance security The system installer shall provide to the owner commissioning wastewater treatment system installation services a performance security equivalent to 10% of the total cost of the system installation before he starts the work. The performance bond will cover any cost related to remedies that remained unattended by the installer. At the final reception if parties are satisfied, the performance security is returned to the installer. To instruct the owner's operating personnel in the operation and maintenance of the system and to adjust the equipment for satisfactory operation after installation; e. To attend to any request for a redress of the system failure; f. To avoid any effect of the system failure where the wastewater treatment system requires electrical power. a. a. The Licensee may apply for renewal of the License within two (2) months before the previous license expires. The application for license renewal shall be composed of: (i) Application letter addressed to the Director General of the Regulatory Authority; (ii) Copy of the expiring license; (iii) A registration certificate for a Company, legal personality for a Cooperative; (iv) Clearance certificate from Rwanda Social Security Board; (v) Application form. When determining either to grant or reject an application to renew the License, the Regulatory Authority shall take into consideration the licensee’s compliance with license conditions and the licensee performance during the previous license term. La demande de transfert de licence se fait en remplissant un formulaire approprié établi par l’Autorité de Régulation tout en spécifiant les motifs d’un tel transfert et qui doit être accompagnée par ce qui suit : a. a. Kopi iriho umukono wa noteri y’impapuro ziranga uwakira uruhushya n’aho atuye ku buryo buhoraho mu Rwanda ; b. c. b. Kopi ziriho umukono wa noteri z’ibyangombwa by’iyandikwa ry’uwakira uruhushya ; d. c. Ikimenyetso ko amafaranga yose asabwa ateganywa n’itegeko yishyuwe n’ukora ihererekanya ; e. d. Imiterere y’imigabane y’uwakira uruhushya niba ihari ; f. e. Andi makuru yose ya ngombwa Urwego Ngenzuramikorere rwasaba. a. a certified copy of the transferee's identity documents and permanent residence in Rwanda; b. certified copies of the transferee's registration documents; c. proof of payment of all fees and levies required by law by the transferor; d. shareholding structure of the transferee if any; e. any other relevant information the Regulatory Authority may require. a. a. Licensee submittal of false or deliberately misleading data or information to the Regulatory Authority in response to the Regulatory Authority request or in response to its monitoring reporting inspection or audit requirements; a. a. Ingingo ya 40 : Uburyo bw’ivanwaho ry’uruhushya e. Licensee failure to provide timely access to the Regulatory Authority or inspection or audit of licensee facilities and corporate records; f. Bankruptcy, financial insolvency or liquidation of licensee; g. Licensee failure to pay the Regulatory Authority Regulatory fees. Article 40: License revocation proceedings e. Le titulaire de licence ne parvient pas à accorder à temps opportun un accès à l’Autorité de Régulation ou refuse que des infrastructures et des archives de la société commerciale soient inspectées ou auditées ; f. Faillite, insolvabilité ou liquidation de la société ; g. Le non-paiement par le titulaire de la licence des frais de régulation. The Regulatory Authority shall commence a license revocation proceeding by sending written notice to the licensee advising the licensee of the commencement of a revocation proceeding, and requiring licensee to file a response; b. If the licensee contests the revocation or fails to respond to the Regulatory Authority notice, the Regulatory Authority shall hold a hearing on the license revocation; c. If during the course of the revocation proceedings, the licensee cures the violation that gave rise to the revocation a. a. Article 41: Suspension of business activities The licensee who wishes to suspend or stop the business of installation of decentralized wastewater treatment systems service provision shall notify the Regulator Authority and return the license and shall ensure that he or she has fully paid the regulatory fees for the period he or she possessed the license. Article 41 : Suspension des activités commerciales Le titulaire de licence qui désire suspendre ou interrompre le commerce de prestation de services d’installation de systèmes décentralisés de traitement des eaux usées doit le notifier à l’Autorité de Régulation et remettre la licence et doit aussi prouver qu’il a complètement payé les frais de régulation pendant la période au cours de laquelle il était titulaire de la licence. Article 44: Reporting submission obligation The licensed installer of wastewater treatment systems must submit an annual report in the format to be prescribed by the Regulatory Authority and in accordance with the reporting guidelines for sanitation service provision. Article 44 : Obligation de soumission de rapport L’installateur de systèmes de traitement des eaux usées ayant reçu la license, doit soumettre un rapport annuel dans le format conçu par l’Autorité de Régulation conformément aux lignes directrices d’élaboration de rapports pour la fourniture de services d’assainissement. The installer, operator or owner of a wastewater treatment system shall ensure that technicians are aware and understand all the health and safety practices or advices given in the Operation and Maintenance Manual. The operator shall give considerations to the safety of wastewater treatment works personnel and visitors.
