This order shall not apply to pharmaceutical products as stipulated for by Law no 12/99 of 02/07/1999 in its article 2. Cet arrêté concerne les suppléments alimentaires commercialisés et présentés comme tels. Il ne s'applique pas aux produits pharmaceutiques tels que définis par la loi n ° 12/99 du 02.07.1999 en son article 2. For the purpose of this order a food supplement is a product that: is intended to supplement the diet that bears or contains one or more of the following dietary ingredients: vitamins; minerals; amino acids; a herb or other botanical product, a dietary substance for use by humans to supplement the diet by increasing the total daily intake, or a concentrate, metabolite, constituent, extract, or combinations of these ingredients; is intended to be taken orally in the form of tablet, capsule, powder, soft gel, gel cap, granules or liquid; is not represented for use as a conventional food or as a sole item of a meal or the diet; is labelled as dietary supplement Aux termes du présent arrêté, un complément alimentaire est un produit qui: est destiné à compléter le régime alimentaire qui contient un ou plusieurs ingrédients alimentaires suivants: les vitamines, les sels minéraux, les acides aminés, les végétaux ou autres produits botaniques, une substance alimentaire destinée a l’usage humain afin de compléter son régime alimentaire en augmentant la dose quotidienne totale, ou un concentré, métabolite, extrait, ou une combinaison de ces ingrédients; est destiné à être pris par voie orale sous forme de comprimé, capsule, gélule, poudre, suspension, en granulé ou liquide; n'est pas représenté pour l'utilisation comme aliment ordinaire ou comme devant servir d’alimentation; est étiqueté en tant que complément alimentaire. Ingingo ya 4: Izina ry’inyongeramirire Article 4: Product name Article 4: Nom du produit Buri gikombe cyangwa umukebe ugomba kuba wanditsweho izina ry’inyongeramirire n’uruganda rwazikoze mu nyuguti zigaragara kandi zisomeka, zidasibika ziri no mu ndimi zemewe muri Repubulika y’u Rwanda. Every container of any food supplement shall be affixed with a label bearing in clear, legible and indelible letters in at least one of the official languages of the Republic of Rwanda, the brand or trade name of the product. Le conditionnement d’un complément alimentaire doit porter une étiquette en lettre clairement lisible et indélébile, dans les langues officielles de la République du Rwanda, son nom de marque ou son nom commercial. Every container of any food supplement shall identify the product as dietary supplement or describe the type of supplement preceded by the name of the dietary ingredients. Le conditionnement d’un complément alimentaire identifie ce produit comme complément alimentaire ou décrit le type de complément précédé du nom des ingrédients alimentaires. Ingingo ya 5: Urutonde rw’ibikubiye mu nyongeramirire Article 5: List of ingredients Article 5: Liste des ingrédients Urutonde rw’inyongeramirire rugomba kuba rugaragara mu nyandiko, n’uko izo nyongeramirire zingana keretse ari ubwoko bumwe bukubiye muri iyo nyongeramirire. Except for single ingredient food supplements, a list of ingredients shall be declared on the label with the corresponding quantities per specified unit of measure. Sauf pour un seul ingrédient alimentaire, la liste des ingrédients doit être déclarée sur l'étiquette avec les quantités par unité de mesure spécifiée. All ingredients shall be listed in descending order by weight at time of manufacture of food supplement. Tous les ingrédients sont énumérés en ordre décroissant de poids au moment de la fabrication du complément alimentaire. Inyandiko iranga inyongeramirire igomba kuba yerekana ingano y’inyongeramirire ifatwa igihe iriwe cyangwa inyowe, imitere yayo n’icyo ikomakaho. Labelling must include the quantity per intake for each ingredient, the form and source. L'étiquetage doit comporter la quantité par prise de chaque ingrédient, sa forme et son origine. Ibindi bivangwa mu gukora inyongeramirire ubwazo (nk’isukari, ibihindura ibara, ibirungo ….) ; n’uruganda rwabikoze; bigomba kuba bigaragara mu rutonde rw’uburemere n’ubunini bwabyo ku bifuniko. Additives or ingredients such us fillers, artificial colours, sweeteners, flavours or binders shall be listed by their specific names and qualified by words “natural” or “artificial” in descending order in weight or volume. Les additifs ou excipients tels que les colorants artificiels, édulcorants, odorisants ou liants doivent être énumérés sous leurs noms spécifiques et qualifiés par les mots “naturel” ou “artificiel” dans l'ordre décroissant de poids ou de volume. Ingingo ya 6: Ibikwiye kumenyekana ku mirire Article 6: Nutritional information. Article 6: L'information nutritionnelle. Inyandiko iranga inyongeramirire igomba kugaragaza mu mibare intungamubiri ziri mu gipimo cy’iyo nyongeramirire cyakoreshwa n’umuntu ku munsi cyangwa cyafatirwa rimwe. Label(s) must declare, in numerical form, the amount of nutrients present in the product per portion of the product as recommended for daily consumption or amount per unit for single use. L’étiquette doit indiquer sous forme numérique la quantité de nutriments présents dans le produit par portion du produit tel que recommandé pour la consommation journalière ou la quantité par dose unique. The net contents shall be declared in the metric system by weight for solid or powdered products, volume for liquid or number for tablets and capsules. Ingingo ya 7: Umwihariko mu gupfunyika inyongeramirire Article 7: Packaging Particulars Article 7: Les particularités du conditionnement Icyo inyongeramirire zifunzemo, kigomba kugaragaza izina, aho uruganda rubarizwa n’igihugu zikomokamo. The package shall contain the name and address of the manufacturer including country of origin of the food supplement. L’emballage des compléments alimentaires doit indiquer le nom, l’adresse du fabricant, et le pays d'origine. Icyo inyongeramirire ifunzemo kigomba guhora kigaragaza umubare uranga iyo nyongeramirire cyangwa uburyo bushobora kumenyekanisha uruganda rwayikoze na nomero zayo. Each product shall be permanently marked in code or in clear expression to identify the producing factory and the batch/lot number. Chaque complément alimentaire est marqué de façon permanente par son code ou dans l'expression claire permettant d'identifier l’usine productrice et par son numéro de lot. Buri nyandiko ziranga inyongeramirire zigomba guhora zigaragaza italiki izo nyongeramirire zakoreweho n’iyo zizateraho agaciro, kandi zikagaragaza byibura ukwezi n’umwaka. All product labels shall be permanently marked with date of manufacture and expiry, which shall indicate at least the month and year. Toutes les étiquettes des compléments alimentaires doivent marquer de façon permanente la date de fabrication et d'expiration, et indiquer au moins le mois et l'année. Uburyo bukwiye bwo kubika inyongeramirire, bugomba kuba bugaragara. Appropriate storage conditions recommended for the product shall be declared. Les conditions de stockage des compléments alimentaires doivent être indiquées. Hagomba kubaho amabwiriza yumvikana y’imikoreshereze n’igipimo cyafatwa buri munsi, (ingano, inshuro, imyaka, uburyo bwihariye …); kugira ngo hizerwe ko inyongeramirire izakoreshwa neza. Clear and concise instruction for use (quantity, frequency, age group, special conditions…) and amounts to be taken daily shall be included on the label to ensure correct utilization of the product. Les instructions claires et concises pour l'utilisation (quantité, fréquence, groupe d'âge, conditions particulières ...) et la quantité journalière devant être prise sont inscrites sur l'étiquette afin de garantir la bonne utilisation du produit. Hagomba kugaragazwa ibikwiye kwitonderwa mu gihe hakoreshwa inyongeramirire. State any precautions to be observed when using the food supplements. Les précautions à prendre lors de l'utilisation des compléments alimentaires doivent être indiquées. Any additional information for effective use of the product may be included as package insert. Toute information supplémentaire pour l'utilisation effective du complément alimentaire doit être incluse dans la notice. Ingingo ya 8: Ibyangombwa bisabwa mw’iyemerwa ry’inyongeramirire Article 8: Registration requirements. Article 8: Documents requis lors de l’enregistrement Buri nyongeramirire izacuruzwa mu gihugu igomba kubanza kwemerwa n’urwego rubifitiye ubushobozi. Iyo hasabwa iyemerwa ry’inyongeramirire urwego rubifitiye ubushobozi, ubisaba agomba gukurikiza amabwiriza yishyizweho. Each product intended to be marketed as food supplement must be registered by relevant regulatory authority. When applying for registration to relevant regulatory authority, the applicant is obliged to follow the instructions prescribed in specific guidelines. Chaque complément alimentaire destiné à être commercialisé doit être enregistré par l’autorité compétente. Lors de la demande d'enregistrement, le demandeur est tenu de suivre les directives en vigueur. Ibyangombwa biri kumwe n’inyandiko isaba iyemerwa ry’inyongeramirire bigomba kugaragaza ko ntacyo itwaye ku mubiri, ko icyo itanga koko ari inyongeramirire n’ubuziranenge byazo. Ibi byangombwa bitangwa haba ku nyongeramirire zikorerwa mu gihugu cyangwa iziva mu mahanga. The information submitted to the authority in the form of product dossiers should normally substantiate the safety, effectiveness performance and quality of the product seeking registration. This requirement applies to both locally manufactured and imported products. Les informations transmises à l'Autorité compétente sous la forme de dossiers des compléments alimentaires doivent normalement garantir la sécurité, la performance et la qualité du produit à enregistrer. Ces exigences s'appliquent à la fois aux compléments alimentaires fabriqués localement ou importés. Iyemerwa ry’inyongeramirire rigomba gukoreshwa na buri wese wiyemeje gucuruza inyongeramirire mu gihugu. Igihe iryo yemerwa ritarashyirwa mu bikorwa, hashobora gutangwa ibyemezo byerekana ko izo nyongeramirire zemewe mu bindi bihugu zakorewemo noneho zigashobora kwigwaho n’urwego ribifitiye ubushobozi. Product registration is a regulatory requirement that must be fulfilled by all those engaged in putting the specific products on the market. Before the system becomes operational, registration certificates from other countries can be provided and be examined at the regulatory authority’ officers’ discretion. L'enregistrement du complément alimentaire est une exigence réglementaire qui doit être remplie par tous ceux qui désirent les mettre sur le marché. Avant que le système ne devienne opérationnel, des certificats d'enregistrement d'autres pays peuvent être fournis et être examinés par l'autorité compétente. Ingingo ya 9: Ibyangombwa bikenewe Article 9: Safety requirements Article 9: Exigences de sécurité Uruganda rufite inshingano zo kugaragaza ko inyongeramirire rukora nta ngaruka zifite ku buzima bw’umuntu mbere y’uko zishyirwa ku isoko. The manufacturer is responsible for ensuring that his food supplement products are safe before they are marketed. Le fabricant doit garantir la sécurité des compléments alimentaires avant qu'ils ne soient commercialisés. The manufacturers and distributors of food supplements are required to record, investigate or forward to relevant regulatory authority any information or reports they receive of injuries or illnesses that may be related to the use of their products. Les fabricants et distributeurs de compléments alimentaires sont tenus de consigner, d'enquêter ou de transmettre à l'autorité compétente toute information ou rapports qu'ils ont reçus sur les effets néfastes liés à l'utilisation de leurs produits. Urwego rubifitiye ubushobozi rukora igenzura ku makuru yatanzwe mu ikoreshwa ry’inyongeramirire. Iyo habonetse ingaruka zitewe n’iryo koreshwa, iryo genzura ryongererwa umurego. The relevant regulatory Authority has the mandate to make a passive surveillance on the use of food supplements. Yet when necessary, active surveillance can be triggered by an alert caused by adverse effects. L'autorité de régulation a pour mandat de faire une surveillance passive sur l'utilisation de compléments alimentaires. Pourtant, lorsqu’il s’avère nécessaire, une surveillance active peut être déclenchée par une alerte causée par les effets indésirables occasionnés par la prise de ces compléments alimentaires. Igihe inyongeramirire igeze ku isoko, urwego rubishinzwe rugomba kwerekana ko inyongeramirire ifite ingaruka ku bayikoresheje mbere yo guhagarika ikoreshwa ryayo cyangwa kuyikura ku masoko. Once the product is marketed, relevant regulatory Authority has the onus of proving that a food supplement is "unsafe," before it can take action to restrict the product's use or removal from the market. Une fois que le produit est commercialisé, l'Autorité de régulation a la responsabilité de démontrer que le complément alimentaire est «dangereux», avant de pouvoir prendre des mesures restrictives sur son utilisation ou son retrait du marché. Ingingo ya 10: Gutumiza no gukwirakwiza inyongeramirire Article 10: Import and distribution requirements Article 10: Importation et Distribution Buri tumiza cyangwa ikwirakwiza ry’inyongeramirire rigomba gukurikiza amategeko n’amabwiriza y’ubucuruzi ariho mu gihugu. Any import and distribution of food supplements shall follow commercial laws and guidelines effective in the country. Toute importation et distribution de compléments alimentaires doit suivre les lois et les lignes directrices commerciales en vigueur dans le pays. Ingingo ya 11: Kubika, gufunga no gutanga inyongeramirire Article 11: Storage, packaging and delivery requirements Article 11: Stockage, emballage et livraison. Inyongeramirire zigomba kubikwa mu buryo bukurikije amabwiriza agena ibikwa ryazo. Food supplements should be stored complying with good practices of their storage. Les compléments alimentaires doivent être stockés en respectant les bonnes pratiques de leur stockage. Inyongeramirire zigomba gufungwa hakurikijwe ibisabwa muri aya mabwiriza. Food supplements should be packaged in accordance with the requirements of these regulations. Les compléments alimentaires doivent être emballés conformément aux exigences du présent arrêté. Food supplements shall be delivered to the ultimate consumer only in a pre-packaged form. Les compléments alimentaires ne doivent être délivrés au consommateur que sous la forme préemballée.
