CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines mission, responsibilities, organisation and functioning of Rwanda Environment Management Authority, hereinafter abbreviated as “REMA”. Article 2: Category REMA falls within the category of non commercial public institutions. Article 3: Supervising authority of REMA REMA is under supervision of the Ministry in charge of environment. Article 4: Head office The head office of REMA is located in the City of Kigali. It may be relocated elsewhere on the territory of Rwanda if considered necessary, upon approval by the Cabinet meeting. CHAPITRE PREMIER: DISPOSITIONS GÉNÉRALES Article premier: Objet du présent arrêté Le présent arrêté détermine la mission, les attributions, l’organisation et le fonctionnement de l’Office Rwandais de Protection de l’Environnement, ci-après dénommé “REMA” en sigle anglais. Article 2: Catégorie REMA rentre dans la catégorie des établissements publics à caractère non commercial. Article 3: Autorité de tutelle de REMA REMA est placé sous la tutelle du Ministère ayant l’environnement dans ses attributions. Article 4: Siège Le siège de REMA est établi dans la Ville de Kigali. Il peut, en cas de besoin, être transféré à un autre lieu du territoire du Rwanda, sur approbation du Conseil des Ministres. Ingingo ya 6: Inshingano REMA ifite inshingano zikurikira: 1° gushyira mu bikorwa politiki ya Guverinoma ku bijyanye n’ibidukikije; 2° kugira inama Guverinoma kuri politiki, ingamba n’amategeko byerekeranye n’imicungire y’ibidukikije ndetse n’ishyirwa mu bikorwa ry’amasezerano mpuzamahanga yerekeranye REMA may have branches elsewhere in the country if considered necessary in order to fulfil its responsibilities, upon approval by the Ministry in charge of environment. CHAPTER II: MISSION, RESPONSIBILITIES AND POWERS Article 5: Mission The mission of REMA is to supervise and monitor environmental management and ensure that issues relating to environment receive attention in all national development plans. Article 6: Responsibilities REMA has the following responsibilities: 1° to implement Government environmental policy; 2° to advise the Government on policies, strategies and legislation related to the management of the environment as well as the implementation of environment and climate change related REMA peut avoir des branches en tout autre lieu du territoire national, en cas de besoin, pour accomplir ses attributions, sur approbation du Ministère ayant l’environnement dans ses attributions. CHAPITRE II: MISSION, ATTRIBUTIONS ET POUVOIRS Article 5: Mission La mission de REMA est de contrôler et faire le suivi de la gestion de l’environnement et de veiller à ce que les questions relatives à l’environnement soient prises en compte dans tous les plans de développement nationaux. Article 6: Attributions REMA a les attributions suivantes: 1° mettre en œuvre la politique du Gouvernement en matière d’environnement; 2° conseiller, chaque fois que de besoin, le Gouvernement sur la politique, les stratégies et la législation relatives à la gestion de l’environnement ainsi que sur la mise en application des conventions internationales relatives Official Gazette nº 19 Bis of 09/05/2022 140 n’ibidukikije n’ihinduka ry’ibihe mu gihe bibaye ngombwa; 3° gutegura no gutangaza raporo ku miterere y’ibidukikije mu Rwanda buri myaka ine (4); 4° gushyiraho ingamba zo gukumira no kugabanya ihinduka ry’ibihe no guhangana n’ingaruka zayo; 5° gukora ubushakashatsi, inyigo n’indi mirimo y’ingenzi ku bidukikije n’ihinduka ry’ibihe no gutangaza ibivuyemo; 6° gukurikirana no gusuzuma gahunda n’imishinga by’iterambere harebwa ko amategeko n’amabwiriza yerekeranye n’ibidukikije yubahirizwa mu gihe cy’itegurwa n’ishyirwa mu bikorwa ryabyo; 7° kugira uruhare mu itegurwa rya gahunda z’ibikorwa n’ingamba zigamije gukumira ibiza n’ibindi byago bishobora kwangiza ibidukikije ndetse no guteganya ingamba zo gusubiranya aho ibyo biza cyangwa ibyago byabaye; international conventions as may be required; 3° to prepare and publish a report on the state of environment in Rwanda every four (4) years; 4° to establish measures to prevent and mitigate climate change and adapt to its effects; 5° to carry out a research, studies and other relevant activities in the field of environment and climate change and to publish the findings; 6° to monitor and evaluate development programs and projects to ensure the compliance with laws and regulations on environment in their preparation and implementation phases; 7° to participate in the preparation of action plans and strategies for prevention of disasters and hazards which may degrade environment as well as to propose remedial measures where such risks and catastrophes occurred; à l’environnement et au changement climatique; 3° préparer et publier un rapport sur l’état de l’environnement au Rwanda tous les quatre (4) ans; 4° mettre en place des mesures pour prévenir et atténuer le changement climatique et s’adapter à ses effets; 5° entreprendre des recherches, des études et d’autres travaux pertinents dans le domaine de l’environnement et du changement climatique et en publier les résultats; 6° assurer le suivi et l’évaluation des programmes et projets de développement pour s’assurer du respect des lois et règlements relatifs à l’environnement lors de leur conception et exécution; 7° participer à l’élaboration des procédures et des mesures de prévention des catastrophes et d’autres aléas de nature à causer la dégradation de l’environnement et envisager des mesures correctives dans des lieux où de tels catastrophes et aléas se sont produits; Official Gazette nº 19 Bis of 09/05/2022 141 8° gushyiraho imirongo ngenderwaho ya tekiniki yerekeranye no kubungabunga no gucunga ibidukikije, kugabanya ihinduka ry’ibihe no guhangana n’ingaruka zabyo; 9° gutanga inama n’inkunga ya tekiniki aho bishoboka, ku nzego zirebwa n’imicungire y’umutungo kamere no kubungabunga ibidukikije; 10° gutegura, gutangaza no gukwirakwiza imfashanyigisho zerekeye imirongo ngenderwaho n’amategeko bijyanye n’imicungire y’ibidukikije ndetse no kugabanya ibyabyangiza; 11° guhuza, gukurikirana no kugenzura inyigo y’isuzumangaruka ku bidukikije, inyigo y’igenzurangaruka ku bidukikije, inyigo y’isuzumangaruka ry’ingamba na gahunda ku bidukikije n’indi nyigo yose ku bidukikije. REMA ishobora guha urundi rwego uburenganzira mu nyandiko bwo gusuzuma no kwemeza izo nyigo; 8° to set up technical guidelines related to environment conseration and management as well as climate change mitigation and adaptation; 9° to advise and provide technical support, where possible, to entities engaged in natural resources management and environmental conservation; 10° to prepare, publish and disseminate manuals relating to guidelines and laws regarding environmental management as well as reduction of environmental degradation; 11° to coordinate, monitor and evaluate environmental impact assessment, environmental audit, strategic environmental assessment and other environmental studies. REMA may authorize, in writing, any other institution to examine and approve such studies; 8° mettre en place des directives techniques relatives à la conservation et à la gestion de l’environnement ainsi qu’à l’atténuation du changement climatique et à l’adaptation à ses effets; 9° donner des conseils et fournir l’appui technique autant que possible, aux entités engagées dans la gestion des ressources naturelles et la conservation de l’environnement; 10° élaborer, publier et diffuser des manuels pédagogiques relatifs aux lignes directrices et à la législation concernant la gestion de l’environnement ainsi que la réduction de la dégradation de l’environnement; 11° coordonner, faire le suivi et évaluer l’étude d’impact environnemental, l’audit environnemental, l’évaluation environnementale stratégique et d’autres études environnementales. Ingingo ya 7: Ububasha REMA ifite ububasha bukurikira: 1° gusaba ikigo cyangwa urwego urwo ari rwo rwose bireba gutanga raporo ku miterere y’ibidukikije; 2° gusura, nta nteguza, ahantu aho ari ho hose hakorerwa imirimo, ahakorerwa umushinga, inyubako, uruganda n’ubucuruzi mu rwego rwo gukora igenzura 16° to propose establishment of early warning system for geo-hazards in Lake Kivu and its surroundings and contribute to its establishment and management; 17° to ensure effective management of research and monitoring data; 18° to enhance cooperation between Rwanda and Democratic Republic of Congo or any other organisation with similar mandate in matters related to safe and sustainable management of Lake Kivu. Article 7: Powers REMA has the following powers: 1° to request any concerned institution or organ to provide an environment status report; 2° to visit, without any notice, any office, any project site, a construction, an industry or a factory and trade in the framework 16° proposer la mise en place d’un système d’alerte précoce pour les géo risques dans le Lac Kivu et ses environs et contribuer à sa mise en place et à sa gestion; 17° assurer une gestion efficace des données de recherche et de suivi; 18° renforcer la coopération entre le Rwanda et la République Démocratique du Congo ou toute autre organisation ayant une mission similaire en rapport avec la sûreté et gestion durable du Lac Kivu. Article 11: Powers of the Board of Directors The Board of Directors of REMA is the supreme management and decision making organ. It is vested with extensive powers to make decisions regarding administration, human resources and the property of REMA in accordance with laws. Article 12: Duties of the Chairperson of the Board of Directors The Chairperson of the Board of Directors of REMA has the following duties: 1º to coordinate activities of the Board of Directors; 1º approuver l’avant-projet du budget de REMA et assurer le suivi de l’exécution du budget; 2º soumettre les rapports d’activités trimestriel et annuel au Ministère ayant l’environnement dans ses attributions; 3º décider de toute autre matière relevant des attributions de REMA. Article 14: Reasons for loss of membership in the Board of Directors and modalities for replacement A member of the Board of Directors of REMA loses membership if: 1° his or her term of office expires; 2° he or she resigns in writing; 3° he or she is no longer able to perform his or her duties due to illness or disability certified by a recognised medical doctor; 4° he or she is sentenced to a term of imprisonment equal to or exceeding six (6) months in a judgement rendered at the last instance; 5° he or she is absent in meetings for three (3) consecutive times without valid reasons; 2º accomplir toute autre tâche relevant des attributions du Conseil d’Administration que ce dernier peut lui confier. Article 16: Convening and holding of meeting of the Board of Directors and modalities for decision-making The meeting of the Board of Directors of REMA is held once a quarter and whenever necessary upon invitation by its Chairperson or Vice-Chairperson in case of absence of its Chairperson, at their own initiative or upon request in writing by at least one third (1/3) of its members. The invitation and the agenda of the meeting are submitted in writing to the members of the Board of Directors at least fifteen (15) days before the meeting is held. In every quarter, the Board of Directors of REMA examines also the financial and activity reports relating to the previous quarter and submit them to the Ministry in charge of environment. However, an extraordinary meeting is convened in writing at least three (3) days before the meeting is held. Items to be considered by the Board of Directors in the first quarter of the year include the approval of the financial and activity reports of the previous year. Article 17: Invitation of a resource person to the meeting of the Board of Directors The Board of Directors of REMA may invite in its meeting a resource person from whom it may seek advice on a certain item on the agenda. Article 18: Approval of resolutions and minutes of the meeting of the Board of Directors Resolutions of the meeting of the Board of Directors of REMA are signed by its members immediately after the end of the meeting, and a copy thereof is sent to the Ministry in charge of environment within five (5) days. The minutes of the meeting of the Board of Directors of REMA are signed by the Chairperson and its rapporteur and approved during the next meeting. A copy of minutes of the meeting is sent to the Ministry in charge of environment within fifteen (15) days from the date of approval. Article 19: Rapporteur of the meeting of the Board of Directors The Director General of REMA serves as the rapporteur of the meeting of the Board of Directors but he or she has no right to vote in decision making. The Director General of REMA does not participate in the meetings that make decisions on issues that concern him or her. Le Directeur Général de REMA ne participe pas aux réunions qui prennent des décisions qui le concernent. Dans ce cas, les membres du Conseil d’Administration présents à la réunion élisent parmi eux un rapporteur. Article 20: Personal interest in issues on the agenda A member of the Board of Directors of REMA who has a direct or indirect interest in the issue to be considered immediately informs the Board of Directors about where that interest lies. A member of the Board of Directors who disclosed of his or her interest in the issue to be considered does not attend the meeting deliberating on that issue. If it is evident that many or all members of the Board of Directors have a direct or indirect interest in the issues to be considered in such a way that it is impossible to take decision on the issues, the issues are submitted to the Ministry in charge of environment to decide thereon within thirty (30) days. Article 22: Additional responsibilities of the Executive Organ Subject to the provisions of the Organic Law establishing general provisions governing public institutions, the Executive Organ of REMA has the following additional responsibilities: 1° to monitor and coordinate daily activities of REMA; 2° to perform any other duty falling within the responsibilities of REMA as may be assigned by the Board of Directors. Article 23: Powers and duties of the Director General The Director General of REMA has the power of decision making in the administrative and financial management Section 2: Organe Exécutif Article 21: Composition de l’Organe Exécutif L’Organe Exécutif de REMA est composé du Directeur Général et du Directeur Général Adjoint. Article 22: Attributions additionnelles de l’Organe Exécutif Sous réserve des dispositions de la Loi Organique portant dispositions générales régissant les établissements publics, l’Organe Exécutif de REMA a les attributions additionnelles suivantes: 1º assurer le suivi et coordonner des activités quotidiennes de REMA; 2º effectuer toute autre tâche relevant des attributions de REMA que le Conseil d’Administration peut lui confier. He or she coordinates and directs the activities of REMA. Specifically, the Director General has the following duties: 1º to serve as the legal representative of REMA and publicise its activities; 2º to serve as the spokesperson of REMA; 3º to submit to the Board of Directors the activity report of REMA once a quarter and whenever necessary; 4º to prepare and submit to the Board of Directors a draft action plan and a budget proposal for the following fiscal year as well as the report on the execution of the budget of the previous fiscal year; 5º to prepare the draft internal rules and regulations of REMA; REMA conformément à la législation en la matière. Ingingo ya 24: Inshingano z’Umuyobozi Mukuru Wungirije Umuyobozi Mukuru Wungirije afite inshingano zikurikira: 1º kunganira Umuyobozi Mukuru no kumusimbura igihe adahari; 2º gukora undi murimo wose yahabwa n’Inama y’Ubuyobozi uri mu nshingano za REMA. 6º to approve the annual procurement plan; 7º to ensure the execution of the budget and management of the property of REMA and submit related report to the Board of Directors; 8º to perform any other duty falling within the responsibilities of REMA as may be assigned by the Board of Directors Article 24: Duties of the Deputy Director General The Deputy Director General of REMA has the following duties: 1º to assist the Director General and replace him or her in case of absence; 2º to perform any other duty falling within the responsibilities of REMA as may be assigned by the Board of Directors. 6º approuver le plan annuel de passation des marchés; 7º assurer l’exécution du budget et la gestion du patrimoine de REMA et soumettre un rapport y relatif au Conseil d’Administration; 8º effectuer toute autre tâche relevant des attributions de REMA que le Conseil d’Administration peut lui confier. Umutungo wa REMA ukomoka kuri ibi bikurikira: 1º ingengo y’imari igenerwa na Leta; 2º inkunga z’abafatanyabikorwa; 3º ibituruka ku mirimo ikora; 4º inyungu zikomoka ku mutungo wayo; 5º inguzanyo zihabwa REMA zemewe na Minisitiri ufite imari mu nshingano; 6º impano n’indangano. Ingingo ya 26: Ingengo y’imari REMA itegura ingengo y’imari yayo ya buri mwaka, ikemezwa n’urwego CHAPTER IV: PROPERTY AND FINANCE Article 25: Property and its sources The property of REMA is comprised of movable and immovable assets. The property of REMA derives from the following sources: 1° State budget allocations; 2° partners’ subsidies; 3° income from services rendered; 4° interests from its property; 5° loans granted to REMA as approved by the Minister in charge of finance; 6° donations and bequests. Article 26: Budget REMA prepares its annual budget to be adopted by the relevant authority. CHAPITRE IV: PATRIMOINE ET FINANCES Article 25: Patrimoine et ses sources Le patrimoine de REMA est composé de biens meubles et immeubles. Le patrimoine de REMA provient des sources suivantes: 1º les allocations budgétaires de l’État; 2º les subventions des partenaires; 3º les revenus provenant des services fournis; 4º les intérêts de son patrimoine; 5º les prêts accordés à REMA approuvés par le Ministre ayant les finances dans ses attributions; 6º les dons et legs. UMUTWE WA V: INGINGO ZISOZA Ingingo ya 28: Abashinzwe gushyira mu bikorwa iri teka Minisitiri w’Intebe, Minisitiri w’Abakozi ba Leta n’Umurimo, Minisitiri w’Ibidukikije na Minisitiri w’Imari n’Igenamigambi bashinzwe gushyira mu bikorwa iri teka. Ingingo ya 29: Igihe iri iteka ritangirira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. Article 27: Annual financial report Within three (3) months following the closure of the financial year, REMA submits the annual financial report to the Ministry in charge of environment after its approval by the Board of Directors in accordance with laws governing management of State finance and property. CHAPTER V: FINAL PROVISIONS Article 28: Authorities responsible for the implementation of this Order The Prime Minister, the Minister of Public Service and Labour, the Minister of Environment and the Minister of Finance and Economic Planning are entrusted with the implementation of this Order. Article 29: Commencement This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Article 27: Rapport annuel des états financiers Endéans trois (3) mois qui suivent la fin de l’exercice financier, REMA soumet au Ministère ayant l’environnement dans ses attributions le rapport annuel des états financiers après son approbation par le Conseil d’Administration conformément aux lois régissant les finances et le patrimoine de l’État. CHAPITRE V: DISPOSITIONS FINALES Article 28: Autorités chargées de l’exécution du présent arrêté Le Premier Ministre, le Ministre de la Fonction Publique et du Travail, le Ministre de l’Environnement et le Ministre des Finances et de la Planification Économique sont chargés de l’exécution du présent arrêté. Article 29: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
