Ingingo ya 2: Ibirebwa n’iri tegeko Iri tegeko rireba: 1° imicungire y’imyanda yifitemo imirasire yangiza ikomoka ku bintu bikoreshwa mu rwego rwa gisiviri; 2° igenzura n’imicungire y’ikoreshwa ry’imirasire yangiza mu buryo butagamije intambara harimo gukora, gutunga, gukoresha, kwinjiza mu gihugu no kohereza mu mahanga, gutwara, guhererekanya, gutunganya no gucunga cyangwa ibindi bikorwa bifitanye isano byemejwe n’Urwego Ngenzuramikorere. Ingingo ya 3: Ibisobanuro by’amagambo Muri iri tegeko, amagambo akurikira asobanura: assessing and managing the risks posed by ionising radiations related activities. Article 2: Scope of this Law This Law applies to: 1° the management of radioactive waste resulting from civilian applications; 2° the regulation and management of the peaceful use of ionising radiations including the production, possession, use, import, export, transportation, transfer, handling and management, or other related activities or practices approved by the Regulatory Authority. Article 2: Champ d’application de la présente loi La présente loi s’applique à: 1° la gestion des déchets radioactifs résultant des applications civiles; 2° la régulation et la gestion de l’utilisation pacifique des rayonnements ionisants, y compris la production, la possession, l’utilisation, l’importation, l’exportation, le transport, le transfert, la gestion, ou d’autres activités et pratiques connexes approuvées par l’Autorité de Régulation. 2° ibikoresho bibyara imirasire yangiza: ibintu byose byifashishwa mu mikoreshereze cyangwa imikorere ibyara imirasire yangiza, harimo ibyifitemo cyangwa ibibyara imirasire yangiza ubwabyo n’ikindi kintu cyose cyifashishwa mu gushyigikira cyangwa gukingira ibyo bintu bikoresha cyangwa bibyara imirasire yangiza; 3° ibikorwa bifitanye isano n’imirasire yangiza: gutegura, gukora, kubaka, gutumiza no kohereza mu mahanga, gukwirakwiza, gutira no kuguriza, kugurisha, kwemeza no gusesa ikoreshwa, imikorere n’ imikoreshereze, gufata neza, gusana, guhererekanya, cyangwa 1° safeguards agreement and additional protocol: the Agreement between the Republic of Rwanda and the International Atomic Energy Agency (IAEA) for the Application of Safeguards in connection with the Treaty on the Non Proliferation of Nuclear Weapons; 2° ionising radiations equipment: any equipment or machinery associated with the use or operation of an ionising radiations source, including the ionising radiations sources themselves and any structure used to support or shield such equipment, machinery or ionising radiations sources; 3° ionising radiations related activities: the design, manufacture, construction, import and export, distribution, loan, sell, approve or revoke the use and operation, maintenance, repair, transfer, commissioning and decommissioning or possession of ionising radiations sources for 1° Accord des garanties et protocole additionnel: l’accord conclu entre la République du Rwanda et l’Agence Internationale de l’Energie Atomique (IAEA) pour l’application des garanties en relation avec le Traité sur la Non prolifération des Armes Nucléaires ; 2° équipement de rayonnements ionisants: tous les équipements ou machines associés à l’utilisation ou à l’exploitation des sources de rayonnements ionisants, y compris les sources de rayonnements ionisants elles-mêmes et toute autre structure utilisée comme support ou protection de tels équipements, machines ou sources de rayonnements ionisants ; 3° activités liées aux rayonnements ionisants: la conception, la fabrication, la construction, l’importation et l’exportation, la distribution, le prêt, la vente, l’approbation ou la révocation de l’usage et de l’exploitation, l’entretien, la réparation, le transfert, la mise en service et le Official Gazette nº Special of 25/01/2018 66 gutunga ibintu byifitemo cyangwa bibyara imirasire yangiza igamije gukoreshwa mu nganda, mu burezi, mu bushakashatsi, mu buhinzi n’ubuvuzi; n’ibikorwa byo gucunga imyanda yifitemo imirasire yangiza nko gusukura imiyoboro byagezemo; cyangwa n’ikindi gikorwa icyo ari cyo cyose kibyara imirasire yangiza nk’uko biteganywa n‘amasezerano mpuzamahanga yerekeye ingamba zo kurinda ingaruka z’imirasire yangiza; 4° ibipimo bikabije by’imirasire yangiza: imirasire yangiza irenze igipimo ntarengwa ku muntu utari umurwayi urimo gukorerwa isuzuma mu rwego rwo kumuvura cyangwa kumusuzuma hakoreshejwe iyo mirasire yangiza; 5° ibipimo ntarengwa: ingano y’imirasire yangiza igenwa industrial use, education, research, agriculture and medical purposes; transport of radio-active material; the mining and processing ores; the closing down of associated facilities; the clean-up of sites affected by residues from past activities; and radio-active waste management activities such as the discharge of effluent; any activity involving nuclear material as defined in the safeguards agreement; 4° overexposure: exposure of a person, other than a patient undergoing medical examination or treatment, to radiation in excess of the dose limits of that form of ionising radiations; 5° dose limits: dose of an ionising radiations fixed by the Regulatory démantèlement ou la possession de sources de rayonnements ionisants à des fins industrielles, d’éducation, de recherche, d’agriculture et de médecine; et les activités de gestion des déchets radioactifs tels que la décharge des effluents; toute activité impliquant des matières nucléaires tel que défini dans l’accord de garanties; 4° surexposition: l’exposition d’une personne, autre qu’un patient subissant un examen médical ou un traitement, aux rayonnements ionisants dépassant les limites de la dose de cette forme de rayonnements ionisants ; 2° to grant, amend, temporarily suspend or revoke authorizations, permits and licenses issued, as well as set conditions for ionising radiations related activities; 3° to inspect, monitor and assess ionising radiations related activities; The baseline environmental survey as well as monitoring and surveillance programme must be approved by the Regulatory Authority. Article 13: Disposal of Radioactive waste by the Regulatory Authority Whenever radioactive waste is found in any place and the Regulatory Authority is of the opinion that the radioactive waste is unlikely to be fully disposed of, the Regulatory Authority has power to: 1° dispose of that radioactive waste in such a manner as the Regulatory Authority considers appropriate; 2° recover any expenses incurred by the Regulatory Authority in disposing of the radioactive waste from the person found liable for the act. Article 14: Transportation of radioactive materials Transportation of radioactive materials within the jurisdiction of Rwanda must be subject to the requirements established by the Regulatory Authority. Article 15: Periodical assessment of employee’s health The employer must cater for periodic medical assessment of his/her employees in accordance with regulation established by the Regulatory Authority. If the Regulatory Authority finds that the working environment is detrimental to the health of any employee, it takes measures as provided for in this Law and related regulations. Article 16: Prohibited ionising radiations equipment No person shall use or operate any ionising radiations equipment if its use or operation is prohibited by the Regulatory Authority. Article 17: Ionising radiations exposure limits The licensee with equipment that produces ionising radiations must ensure that exposure of persons to ionising radiations is kept as low as possible. Article 19: Information for employees Any employer must ensure that employees who are likely to be exposed to ionising radiations are informed of the potential risks connected with such radiations and the precautions to be taken to protect them and other persons from those risks. The employer must ensure that the following information is brought to the attention of each employee: 1° the employee’s responsibilities and duties in accordance with this Law and related regulations; 2° the type of ionising radiations which the employee will be using or exposed to and related potential health risks; 3° the radiation protection principles and dose limits for ionising radiations which the employee will be using; surexposition ou l’incident a eu lieu ainsi que l’action prise pour y remédier afin de prévenir une répétition éventuelle. Article 34: Use of ionising radiations sources with the intention of causing death or injury to any person or substantial damage to property Any person who uses ionising radiations sources with an intent to cause death or injury to any person or substantial damage to property commits an offence. He/she shall be liable to a life imprisonment and a fine of not less than one hundred million Rwandan Francs (FRW 100,000,000) but not exceeding one hundred and fifty million Rwandan Francs (FRW 150,000,000). CHAPTER VIII: FINAL PROVISIONS Article 35: Drafting, consideration and adoption of this Law This Law was drafted in English, considered and adopted in Ikinyarwanda. Article 36: Repealing provision All prior legal provisions contrary to this Law are repealed.
