RNRA ishobora kugira amashami ahandi hose mu (NAFA) and determining its responsibilities, organization and functioning; Having Reviewed Law n° 20/2009 of 29/07/2009 establishing the National Land Center (NLC) and determining its responsibilities, functioning, organization and competence; ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Law This Law establishes Rwanda Natural Resources Authority, abbreviated as «RNRA». This Law also determines its mission, organization and functioning. RNRA shall have legal personality, administrative and financial autonomy and shall be governed in accordance with laws governing public institutions. Article 2: Head office of RNRA The head office of RNRA shall be located in Kigali City, the Capital of the Republic of Rwanda. It may be transferred elsewhere in the Republic of Rwanda if deemed necessary. RNRA may have branches elsewhere in the promotion des forêts (NAFA) et déterminant sa mission, son organisation et son fonctionnement; Revu la Loi n° 20/2009 du 29/07/2009 portant création du Centre National de Gestion Foncière (NLC) et déterminant sa mission, son fonctionnement, son organisation et compétence; ADOPTE: CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet de la présente loi La présente loi porte création de l’Office Rwandais des Ressources Naturelles, dénommé «RNRA» en sigle Anglais. Elle détermine également sa mission, son organisation et son fonctionnement. RNRA est doté de la personnalité juridique, de l’autonomie financière et administrative et est géré conformément à la législation régissant les établissements publics. Article 2: Siège du RNRA Le siège du RNRA est établi dans la Ville de Kigali, Capitale de la République du Rwanda. Il peut, en cas de nécessité, être transféré en tout autre lieu du territoire de la République du Rwanda. UMUTWE WA II: INSHINGANO ZA RNRA Ingingo ya 3: Inshingano za RNRA RNRA ni ikigo gikuriye imicungire y’iterambere ry’umutungo kamere ugizwe n’ubutaka, amazi, amashyamba, mine na jewoloji. Ishinzwe kugenzura, gukurikirana no kureba ko ibijyanye n’iterambere no kurengera uwo mutungo kamere byubahirizwa muri gahunda n’ibikorwa by’inzego zose z’igihugu. By’umwihariko RNRA ishinzwe: 1° gushyira mu bikorwa politiki, amategeko, ingamba, amabwiriza n’ibyemezo bya Guverinoma bijyanye no guteza imbere no kurengera umutungo kamere; 2° gukurikirana no gushyira mu bikorwa amasezerano mpuzamahanga u Rwanda rwashyizeho umukono ku birebana no kubungabunga umutungo kamere; 3° kugira inama Guverinoma ku buryo bunoze bwo kubungabunga umutungo kamere n’uburyo bwo kuwubyaza umusaruro; country and abroad if deemed necessary, upon approval by its Board of Directors, in order to fulfil its mission. CHAPTER II: MISSION OF RNRA Article 3 : Mission of RNRA RNRA shall be an authority that leads the management of promotion of natural resources which is composed of land, water, forests, mines and geology. It shall be entrusted with supervision, monitoring and to ensure the implementation of issues relating to the promotion and protection of natural resources in programs and activities of all national institutions. Particularly, RNRA shall be responsible for: 1° implementing national policies, laws, strategies, regulations and government resolutions in matters relating to the promotion and protection of natural resources; 2° making a follow up and implementing international conventions Rwanda ratified on matters relating to the conservation of natural resources; 3° advising the Government on appropriate mechanisms for conservation of natural resources and investments opportunities; Conseil d’Administration, établir des branches en tout autre lieu du territoire national ou à l’étranger pour mieux remplir sa mission. CHAPITRE II: MISSION DU RNRA Article 3: Mission du RNRA RNRA est l’organe responsable de la gestion du développement des ressources naturelles, comprenant la terre, l’eau, les forêts, les mines et la géologie. Il est chargé de la supervision, du suivi et de s’assurer de la promotion et de la protection des ressources naturelles dans les programmes et activités de tous les organes nationaux. RNRA a particulièrement les missions suivantes: 1° mettre en œuvre les politiques, les lois, les stratégies, les règlements et les décisions du Gouvernement en matière de promotion et de protection des ressources naturelles; 2° assurer le suivi et la mise en œuvre des conventions internationales relatives à la conservation des ressources naturelles auxquelles le Rwanda est partie ; 3° conseiller le Gouvernement sur des mécanismes appropriés de conservation et d’exploitation rationnelle des ressources naturelles ; Official Gazette nº10 of 07/03/2011 11 4° kwandika ubutaka, gutanga no kubika impapurompamo zabwo n’andi makuru ku butaka bw’u Rwanda; 5° gutunganya ibipimo by’ubutaka hamwe n’amakarita yabyo; 6° gutanga inama ku mikoreshereze myiza y’umutungo kamere; 7° gukurikirana no kugenzura ibikorwa byo gucunga neza, guteza imbere, kurengera no guha agaciro umutungo kamere; 8° gusana no kubungabunga aho umutungo kamere wangiritse mu gihugu; 9° gukurikirana no kugenzura ibikorwa byo gukoresha neza umutungo kamere; 10° guteza imbere ibikorwa by’ishoramari n’inyongeragaciro mu bikorwa byo gukoresha no kubyaza umusaruro umutungo kamere mu Rwanda; 11° gukora ubushakashatsi n’inyigo ku mutungo kamere no gutangaza ibivuye muri ubwo bushakashatsi; 12° gushyiraho amabwiriza, imirongo ngenderwaho n’uburyo buboneye bwo 4° registering land, issueing and keeping land authentic deeds and any other information relating to land of Rwanda; 5° ensuring proper geological data and their respective maps; 6° providing technical advise on the proper use of natural resources; 7° making follow up and supervising activities relating to proper management, promotion and valuation of natural resources; 8° rehabilitating and conserving where natural resources are damaged in the country; 9° making a follow up and supervising activities relating to the proper use of natural resources; 10° promoting activities relating to investment and added value in the activities of use and exploitation of natural resources in Rwanda; 11° initiating research and study on natural resources and to publish the results; 12° instituting regulations, guidelines and appropriate mechanisms for 4° enregistrer les terres, délivrer et conserver les titres fonciers et autres données sur les terres du Rwanda ; 5° assurer le traitement des données d’arpentage des terres et des cartes d’arpentage y relatives ; 6° donner des conseils sur l’utilisation ration nelle des ressources naturelles; 7° faire le suivi et l’inspection des activités de gestion rationnelle, de promotion et de valorisation des ressources naturelles; 8° assurer la réhabilitation et la conservation des zones connaissant la dégradation des ressources naturelles; 9° faire le suivi et l’inspection des activités d’utilisation rationnelle des ressources naturelles; 10° promouvoir les activités d’investissement et de la valeur ajoutée dans les activités d’utilisation et d’exploitation des ressources naturelles au Rwanda ; 11° réaliser des recherches et des études sur les ressources naturelles et en publier les résultats ; 12° édicter des instructions, des lignes directrices et des mécanismes appropriés de gestion, Official Gazette nº10 of 07/03/2011 12 gucunga, gukoresha no kubungabunga umutungo kamere no gukurikirana ko byubahirizwa; 13° kugirana ubutwererane n’ubufatanye n’ibindi bigo byo mu rwego rw’akarere no ku rwego mpuzamahanga hagamijwe kunoza imikorere n’imikoranire ku bijyanye n’imicungire y’umutungo kamere. UMUTWE WA III: URWEGO RUREBERERA RNRA N’ICYICIRO IRIMO Ingingo ya 4: Urwego rureberera RNRA n’icyiciro irimo Iteka rya Minisitiri w’Intebe rigena urwego rureberera RNRA n’icyiciro irimo. Hagati y’urwego rureberera RNRA n’urwego rufata ibyemezo hakorwa amasezerano yerekeye gahunda y’ibikorwa agaragaza ububasha, uburenganzira n’inshingano za buri ruhande mu kugeza RNRA ku nshingano zayo. Ayo masezerano amara igihe gihwanye na manda y’abagize urwego rufata ibyemezo rwa RNRA. management, use and conservation of natural resources and ensuring their implementation; 13° establishing cooperation and collaboration with other regional and international institutions with an aim of harmonising the performance and relations on matters relating to management of natural resources. CHAPTER III: SUPERVISING AUTHORITY OF RNRA AND ITS CATEGORY Article 4: Supervising Authority of RNRA and its category A Prime Minister’s Order shall determine the supervising Authority of RNRA and its category. There shall be concluded between the supervising Authority of RNRA and its decision making organ a performance contract indicating competence, rights and obligations of each party in order for RNRA to fulfill its mission. Il est conclu entre l’organe de tutelle du RNRA et l’organe de décision un contrat de performance déterminant les compétences, les droits et les obligations de chaque partie en vue de la réalisation de la mission de RNRA. Ce contrat est valide pour une durée égale au mandat des membres de l’organe de décision de RNRA. Iteka rya Minisitiri w’Intebe rishobora kugena izindi nzego za ngombwa kugira ngo RNRA ishobore kurangiza neza inshingano zayo Icyiciro cya mbere: Inama y’Ubuyobozi Ingingo ya 6: Inama y’Ubuyobozi ya RNRA n’abayigize Inama y’Ubuyobozi ya RNRA ni rwo rwego ruyiyobora kandi rufata ibyemezo.Ububasha, inshingano n’imikorere by’Inama y’Ubuyobozi kimwe n’inshingano z’abayigize n’igihe bamara ku mirimo yabo bigenwa n’iteka rya Minisitiri w’Intebe. Iteka rya Perezida rishyiraho abagize Inama y`Ubuyobozi harimo Perezida na Visi-Perezida. Abagize Inama y`Ubuyobozi batoranywa hakurikijwe ubushobozi n`ubuzobere. Nibura mirongo itatu ku ijana (30%) by’abagize CHAPTER IV: ORGANISATION AND FUNCTIONING OF RNRA Article 5: Management organs of RNRA RNRA shall be comprised of the following two (2) management organs: 1° the Board of Directors; 2° the General Directorate. A Prime Minister’s Order may determine other relevant organs in order for RNRA to fulfil its mission. Section one: Board of Directors Article 6: Board of Directors of RNRA and its composition The Board of Directors of RNRA shall be the governing and decision making organ. Its competence, responsibilities and functioning as well as the responsibilities and the term of office of its members shall be determined by a Prime Minister’s Order. A Presidential Order shall appoint members of the Board of Directors including the Chairperson and the Deputy Chairperson. Members of the Board of Directors shall be selected on the basis of their competence and expertise. At least thirty percent (30%) of members of the CHAPITRE IV: ORGANISATION ET FONCTIONNEMENT DU RNRA Article 5: Organes de direction du RNRA RNRA est doté de deux (2) organes de direction suivants: 1° le Conseil d’Administration; 2° la Direction Générale. Un arrêté du Premier Ministre peut déterminer d’autres organes nécessaires en vue de la réalisation de la mission de RNRA. Section première: Conseil d’Administration Article 6: Conseil d’Administration du RNRA et sa composition Le Conseil d’Administration du RNRA est l’organe de direction et de décision. Ses compétences, attributions et son fonctionnement ainsi que les attributions et la durée du mandat de ses membres sont déterminés par arrêté du Premier Ministre. Un arrêté présidentiel nomme les membres du Conseil d’Administration dont le Président et le Vice-Président. Les membres du Conseil d’Administration sont choisis sur base de leur compétence et de leur expertise. Trente pour cent (30%) au moins des membres du Official Gazette nº10 of 07/03/2011 14 Inama y’Ubuyobozi bagomba kuba ari abagore. Ingingo ya 7: Ibigenerwa abagize Inama y’Ubuyobozi bitabiriye inama Abagize Inama y’Ubuyobozi bitabiriye inama z’Inama y’Ubuyobozi bagenerwa amafaranga agenwa n’iteka rya Perezida. Ingingo ya 8: Ibitabangikanywa no kuba mu bagize Inama y’Ubuyobozi Abagize Inama y’Ubuyobozi ntibemerewe gukora umurimo ugenerwa igihembo muri RNRA. Ntibemerewe kandi, haba ku giti cyabo cyangwa ibigo bafitemo imigabane, gupiganira amasoko atangwa na RNRA. Icyiciro cya 2: Ubuyobozi Bukuru Ingingo ya 9: Abagize Ubuyobozi Bukuru bwa RNRA Abagize Ubuyobozi Bukuru bwa RNRA bagenwa n’iteka rya Perezida. Ububasha, inshingano n’imikorere by’abagize Ubuyobozi Bukuru bwa RNRA bigenwa n’iteka rya Minisitiri w’Intebe. Board of Directors shall be females. Article 7: Sitting allowances for the members of the Board of Directors Members of the Board of Directors present in the meetings of the Board of Directors shall be entitled to allowances determined by a Presidential Order. Article 8: Incompatibilities with membership of the Board of Directors Members of the Board of Directors shall not be allowed to perform any remunerated activity within RNRA. They are also not allowed, whether individually or companies in which they hold shares, to bid for tenders of RNRA. Section 2: General Directorate Article 9: Composition of the General Directorate of RNRA Members of the General Directorate of RNRA shall be determined by a Presidential Order. The competence, responsibilities and functioning of the members of the General Directorate of RNRA shall be determined by a Prime Minister’s Order. Conseil d’Administration sont de sexe féminin. Article 7: Jetons de présence des membres du Conseil d’Administration Les membres du Conseil d’Administration présents aux réunions du Conseil d’Administration bénéficient des jetons de présence dont le montant est déterminé par arrêté présidentiel. Article 8: Incompatibilités avec la fonction de membre du Conseil d’Administration Les membres du Conseil d’Administration ne sont pas autorisés d’exercer des fonctions rémunérées au sein du RNRA. Ils ne sont non plus autorisés, soit individuellement ou les sociétés dont ils sont actionnaires, de soumissionner aux marchés du RNRA. Section 2: Direction Générale Article 9: Composition de la Direction Générale du RNRA Les membres de la Direction Générale du RNRA sont déterminés par arrêté présidentiel. Les compétences, les attributions et le fonctionnement des membres de la Direction Générale du RNRA sont déterminés par arrêté du Premier Ministre. Ingingo ya 11: Imikorere, imiterere n’inshingano by’inzego z’imirimo za RNRA Imikorere, imiterere n’inshingano by’inzego z’imirimo za RNRA bigenwa n’iteka rya Minisitiri w’Intebe. UMUTWE WA V: UMUTUNGO N’IMARI Ingingo ya 12: Umutungo wa RNRA n’inkomoko yawo Umutungo wa RNRA ugizwe n’ibintu byimukanwa n’ibitimukanwa. Ukomoka kuri ibi bikurikira: 1° ingengo y’imari igenerwa na Leta; 2° inkunga zaba iza Leta cyangwa iz’abaterankunga; 3° ibituruka ku mirimo ikora; Article 10: Statute governing the staff of RNRA and benefits of members of the General Directorate and the staff of RNRA The staff of RNRA is governed by the General Statute for Rwanda Public Service. Benefits entitled to the members of the General Directorate and to the staff of RNRA shall be determined in accordance with legal provisions governing benefits to employees of public institutions. Article 11: Functioning, organization and responsibilities of organs of RNRA The functioning, organization and responsibilities of organs of RNRA shall be determined by a Prime Minister’s Order. CHAPTER V: PROPERTY AND FINANCE Article 12: Property of RNRA and its sources The property of RNRA shall be comprised of movables and immovables. It shall come from the following sources: 1° the State budget allocation; 2° State or partners subsidies; 3° income from its services; Article 10: Statut du personnel du RNRA et avantages des membres de la Direction Générale et du personnel du RNRA Le personnel du RNRA est régi par le Statut Général de la Fonction Publique Rwandaise. Les avantages alloués aux membres de la Direction Générale du RNRA et à son personnel sont déterminés conformément aux dispositions légales régissant les avantages alloués au personnel des établissements publics. Article 11: Fonctionnement, organisation et attributions des organes du RNRA Le fonctionnement, l’organisation et les attributions des organes du RNRA sont déteminés par arrêté du Premier Ministre. CHAPITRE V: PATRIMOINE ET FINANCES Article 12: Patrimoine du RNRA et ses sources Le patrimoine du RNRA comprend les biens meubles et immeubles: Il provient des sources suivantes: 1° les dotations budgétaires de l’Etat ; 2° les subventions de l’Etat ou des partenaires; 3° les revenus des services prestés; Official Gazette nº10 of 07/03/2011 16 4° inyungu ku mutungo wayo; 5° inguzanyo zihabwa RNRA zemewe na Minisitiri ufite imari mu nshingano ze; 6° impano n’indagano; 7° umutungo wahoze ari uw’Ikigo cy’Igihugu cya Jewoloji na Mine mu Rwanda (OGMR); 8° umutungo wahoze ari uw’ Ikigo cy’Igihugu gishinzwe gucunga no guteza imbere Amashyamba (NAFA); 9° umutungo wahoze ari uw’Ikigo cy’Igihugu gishinzwe iby’Ubutaka (NLC); Ingingo ya 13: Kwegurirwa umutungo w’ibigo Imitungo yimukanwa, itimukanwa, imyenda n’amazina by’ibigo bikurikira byegurirwe RNRA: 1° uw’Ikigo cy’Igihugu gishinzwe iby’Ubutaka (NLC); 2° Ikigo cy’Igihugu gishinzwe gucunga no guteza imbere Amashyamba (NAFA); 3° Ikigo cy’Igihugu cya Jewoloji na Mine mu Rwanda (OGMR). Ingingo ya 14: Imikoreshereze, imicungire n’imigenzurire by’umutungo Imikoreshereze, imicungire n’imigenzurire by’umutungo wa RNRA bikorwa hakurikijwe amategeko abigenga. Ubugenzuzi bushinzwe 4° proceeds form its property; 5° loans to RNRA as approved by the Minister in charge of finance; 6° donation and bequest; 7° property formely owned by Rwanda Geology and Mines Authority (OGMR); 8° property formely owned by the National Forestry Authority (NAFA); 9° property formely owned by the National Land Center (NLC); Article 13: Transfer of the property of public institutions Movables, immovables, liabilities and denominations of the following institutions are hereby transferred to RNRA: 1° National Land Center (NLC); 2° National Forestry Authority (NAFA); 3° Rwanda Geology and Mines Authority (OGMR). Article 14: Use, management and audit of the property The use, management and audit of RNRA property shall be carried out in accordance with with relevant legal provisions. Article 14: Utilisation, gestion et audit du patrimoine L’utilisation, la gestion et l’audit du patrimoine du RNRA sont effectués conformément aux dispositions légales en la matière. UMUTWE WA VI: INGINGO Z’INZIBACYUHO N’IZISOZA Ingingo ya 17: Igihe cy’inzibacyuho RNRA ihawe igihe kitarenze umwaka umwe (1) uhereye ku munsi iri tegeko ritangarijwe mu Igazeti ya Leta ya Repubulika y’u Rwanda kugira ngo ibe yahuje imirimo yakorwaga n’ibigo bikurikira : audit service shall submit a report to the Board of Directors, with a copy to the Chief Executive Officer of RNRA. Article 15: Approval and management of the budget of RNRA The budget of RNRA shall be approved and managed in accordance with relevant legal provisions. Article 16: Annual financial report Within three (3) months following the closure of the financial year, the Chief Executive Officer of RNRA shall submit to the supervising Authority of RNRA the annual financial report after its approval by the Board of Directors in accordance with laws governing management of State finance and property. CHAPTER VI: TRANSITIONAL AND FINAL PROVISIONS Article 17: Transitional period RNRA is given a period not exceeding one (1) year from the date this law is published in the Official Gazette of the Republic of Rwanda to merge activities formerly performed by the following institutions : d’audit interne du RNRA transmet son rapport au Conseil d’Administration avec copie au Directeur Général en chef du RNRA. Article 15: Adoption et gestion du budget du RNRA Le budget du RNRA est adopté et géré conformément aux dispositions légales en la matière. Article 16: Rapport annuel de l’exercice comptable Dans les trois (3) mois qui suivent la fin de l’exercice comptable, le Directeur Général en chef du RNRA transmet à l’organe de tutelle du RNRA le rapport annuel de l’exercice comptable après son approbation par le Conseil d’Administration conformément aux dispositions régissant les finances et le patrimoine de l’Etat. CHAPITRE VI: DISPOSITIONS TRANSITOIRES ET FINALES Article 17: Période transitoire RNRA dispose d’un délai ne dépassant pas une (1) année à compter de la date de publication de la présente loi au Journal Officiel de la République du Rwanda pour avoir fusionné les activités qui étaient assurées par les établissements suivants : Official Gazette nº10 of 07/03/2011 18 1° Ikigo cy’Igihugu gishinzwe iby’Ubutaka (NLC); 2° Ikigo cy’Igihugu gishinzwe gucunga no guteza imbere Amashyamba (NAFA); 3° Ikigo cy’Igihugu cya Jewoloji na Mine mu Rwanda (OGMR). Abakozi RNRA yaba itagumanye, amasezerano yabo aseswa hakurikijwe amategeko ariho. Article 18: Former personnel of merged institutions At the time this Law comes into force, RNRA shall retain employees of merged institutions and employees in charge of water resources of the Ministry in charge of water resources, that it considers qualified in order to fulfil its mission. The contracts of the personnel, who RNRA shall not retain, shall be terminated in accordance with the existing laws. Article 19: Drafting, consideration and adoption of this law This Law was drafted in English, considered and adopted in Kinyarwanda. Article 20: Repealing provision Law n° 25/2007 of 27/06/2007 establishing Rwanda Geology and Mines Authority (OGMR) and determining its responsibilities, organization 1° le Centre National de Gestion Foncière (NLC); 2° l’Office Rwandais de Gestion et de promotion des forêts (NAFA); 3° l’Office de la Géologie et des Mines au Rwanda (OGMR). Article 18 : Anciens membres du personnel des établissements fusionnés Dès l’entrée en vigueur de la présente loi, RNRA retient les anciens membres du personnel des établissements fusionnés et le personnel chargé des ressources en eau du Ministère ayant les ressources en eaux dans ses attributions qu’il considère être qualifiés pour l’aider à réaliser sa mission. Les contrats des membres du personnel qui ne sont pas retenus par le RNRA seront résiliés conformément aux lois en vigueur. Article 19 : Initiation, examen et adoption de la présente loi La présente loi a été initiée en Anglais, examinée et adoptée en Kinyarwanda.
