Ingingo ya 2: Ibisobanuro by’amagambo Muri iri tegeko, amagambo akurikira organisation and functioning; Pusuant to Law n° 39/2010 of 25/11/2010 establishing National Agricultural Export Development Board (NAEB) and determining its responsibilities, organisation and functioning; ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One : Purpose of this Law This Law governs the manufacturing, importing, distribution, use, storage, sale and disposal and burial of agrochemicals for the protection of human and animal health and the environment, to avoid injury and contamination which may result from their use. Article 2 : Definitions of terms For the purpose of this Law, the following déterminant ses attributions, organisation et fonctionnement; Vu la Loi n° 39/2010 du 25/11/2010 portant création de l’Office National de Développement des Exportations Agricoles (NAEB) et déterminant ses attributions, son organisation et son fonctionnement ; ADOPTE: CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier : Objet de la présente loi La présente loi régit la fabrication, l’importation, la distribution, l'utilisation, le stockage, la commercialisation, l'élimination et l’enfouissement des produits agrochimiques afin d’assurer la protection de la santé humaine, la santé animale et l'environnement, pour éviter tout accident ou contamination pouvant survenir lors de leur usage. terms shall have the following meanings : 1 º advisory council: a committee which establishes instructions for the use of agrochemicals and advises the registrar of agrochemicals ; 2 º code of good agricultural practices: document containing the general or specific requirements for safe use and handling of agrochemicals in accordance with the provisions of this Law; 3 º environment: biodiversity system including plants, humankind, animals as well as water, air and land put to their use; 4 º agrochemical residues: the quantity of residues in terms of active ingredient which is present in food stuffs to which an agrochemical product was applied; 3 º environnement : la biodiversité comprenant entre autre les plantes, la personne humaine, les animaux ainsi que l’eau, l’air et la terre qu’ils utilisent ; 4 º résidus de produits agrochimiques: la quantité de résidus en termes de matière active présents dans les denrées alimentaires dans lesquelles un produit agrochimique a été utilisé; 8 º igikoresho gifasha mu kwirinda: imyambaro cyangwa ibikoresho bikoreshwa mu kwirinda ingaruka mbi z’umuti mu gihe cyo kuwukora no kuwukoresha; 9 º igipimo ntarengwa cy’ibisigazwa by’umuti cyangwa ifumbire (MRL): ingano ntarengwa y’ibisigazwa yemewe n’amategeko ku biribwa bikomoka mu buhinzi cyangwa mu bworozi; 5 º label: written or graphic matter accompanying a pesticide providing instructions on its use; 6 º provisional registration certificate: a provisional use permit for an agrochemical before it is allowed to definively be used; 7 º agrochemical: a chemical product or pesticide used in agriculture, which is formulated and packaged in a manner that is authorized in Rwanda and which is allowed to be sold; 8 º personal protective equipment: clothes, materials or devices that provide protection from pesticide exposure during its manufacture and use; 9 º maximum residue limit (MRL): the maximum concentration of a residue that is legally permitted or recognized as acceptable in or on a food or agricultural commodity or animal feedstuff; 5 º étiquette: motif écrit ou sous forme graphique qui accompagne le pesticide et qui en indique l’utilisation ; Article 5: Registrar of agrochemicals An Order by the Minister shall appoint the registrar of agrochemicals and determine his/her responsibilities. The registrar of agrochemicals shall be one of the inspectors referred to in Article 7 of this Law. CHAPTER III: POWERS AND RESPONSIBILITIES OF AGROCHEMICALS INSPECTOR Article 7 : Appointment of agrochemicals inspectors Inspection of agrochemicals shall be carried out by Inspectors appointed by a Ministerial Order which also determines their responsibilities and powers. Article 11: Agrochemicals Registry The registrar of agrochemicals shall prepare and keep the agrochemicals register. Such register shall bear the name of every authorized manucfactured agrochemical that is their trade name and composition with particular attention to active ingredient, their category or classification and the nature of the licenses thereof. All the data provided by the applicant shall be personal and shall only be recorded in the agrochemicals register. Article 10 : Produits agrochimiques en transit Lorsque les produits agrochimiques ne sont pas autorisés au Rwanda, le registraire de produits agrochimiques accepte leur transit s’il sait que ces produits seront légalement acceptés au pays de destination. Article 11 : Registre de produits agrochimiques Le registraire de produits agrochimiques dresse et tient le registre de produits agrochimiques. Ce registre contient les noms de chaque produit agrochimique manufacturé c'est-à-dire le nom commercial et la composition avec une attention particulière sur la matière active, la catégorie ou la classification du produit ainsi que la nature de son autorisation. After the examination referred to in Paragraph One and 2 of this Article by the Advisory Council, the registrar of agrochemicals shall implement the decisions that are taken. A certificate may be renewed by the registrar of agrochemicals on submission of an application for renewal in the prescribed form, if the Advisory Council is satisfied that the agrochemical remains effective and suitable for use in Rwanda. Article 15 : Modification and cancellation of the registration certificate of an agrochemical After realizing that the concerned agrochemical does no longer comply with terms and conditions of its use in Rwanda while the certificate is still valid, the registrar shall prepare an immediate report thereon to the Advisory Council which may take one of the following decisions: Le permis d’inscription est valable pour une période de trois (3) ans, excepté le permis d'inscription provisoire qui est seulement valable pour six (6) mois. CHAPTER VI: LICENSE AND CERTIFICATE OF AGROCHEMICALS USE Article 17: Granting license No person shall manufacture, import, export, sell, offer for sale, supply, store for purposes of sale, transport or exhibit any thing in connection with agrochemicals unless he/she is licensed to do so. No person shall manufacture, import, export, sell, offer for sale, supply, store for purposes of sale, transport, exhibit any thing in connection with agrochemicals that are prohibited, obsolete or expired. No person shall neither dispose of or burry an agrochemical unless he/she is authorized to do so. A Ministerial Order shall specify modalities for implementing the provisions of the Paragraph 3 of this Article. A Ministerial Order shall specify the requirements for the sale referred to in Paragraph One of this Article. Article 21: Suspension of a certificate for restricted-use agrochemicals When the conditions contained in the certificate relating to agrochemicals are not complied with, the registrar of agrochemicals may, where necessary and for the purpose of protecting human health and environment, suspend in writing the certificate for a period not exceeding twenty one (21) days. He/she shall notify the decision to the Advisory Council. Should the reasons which prompted the certificate suspension persist, the registrar of Article 20 : Autorisation de vente de produits agrochimiques Toute personne désireuse de vendre les produits agrochimiques doit demander une autorisation à cet effet. Toute personne qui importe ou exporte un produit agrochimique doit montrer à l’inspecteur compétent les documents relatifs à ce produit agrochimique. No person shall neither be allowed to: 1 º store or sell an agrochemichal in an area Article 24 : Stockage de produits agrochimiques Personne n’est autorisé à garder un produit agrochimique dans n’importe quel endroit. Un produit agrochimique est gardé : 1 º dans une pièce réservée à cet effet, fermée à clé avec une notification précisant qu’un produit agrochimique y est stocké et interdisant accès aux personnes non authorisées ; 2 º en un endroit qui ne permet pas d’exposer le produit agrochimique à la lumière directe du soleil; 3 º dans un contenant étanche; 4 º à un niveau d’au moins quarante (45cm) centimètres du sol. Article 25 : Transport of agrochemicals No person shall transport any agrochemical in a vehicle transporting people, other living beings or transporting food or animal feed. Article 26 : Protection contre les déversements accidentels des produits agrochimiques Nul ne peut mélanger ou verser un produit agrochimique quel qu’il soit sur une distance de neuf (9) mètres de large d’un terrain ouvert situé le long d’un cours d’eau ou un lac. Any person who carries or uses any agrochemical shall take precautions to prevent its spillage. In case of agrochemical spillage, the person carrying or using it shall report such spillage to the nearest administrative authority within twenty four (24) hours for appropriate measures. Article 27: Labelling and packaging agrochemicals No person shall sell, offer for sale or supply any agrochemical unless it is labelled in accordance with agrochemicals labelling regulations. Agrochemical labels shall conform to international standards. Toute personne qui transporte ou utilise un produit agrochimique doit prendre des précautions pour prévenir le déversement de ce produit. En cas de déversement, celui qui transporte ou utilise le produit agrochimique en informe l’autorité administrative la plus proche endéans vingt quatre (24) heures pour des mesures adéquates. Article 27 : Etiquetage et emballage des produits agrochimiques Personne ne peut vendre, offrir dans le but de vendre ou fournir un produit agrochimique à moins qu’il ne soit étiqueté conformément aux règlements d’étiquetage de produits agrochimiques. Les étiquettes de produits agrochimiques doivent être conformes aux normes internationales. Article 28: Seizing and analyzing agrochemicals Whenever an inspector believes, on reasonable grounds, that an agrochemical, its composition or quality do not conform to the conditions of the registration certificate, he/she may seize some samples for analysis purposes. The inspector may seize and keep the agrochemicals if he/she has reason to believe that their compostion and quality don’t conform to standards indicated in the certificate of registration. Whenever an inspector notices that a condition of agrochemicals use prescribed in the registration certificate has been contravened such that any food or other agricultural product has residues exceeding the prescribed maximum residue limits, he/she shall seize such agrochemicals for analysis. Article 28 : Saisie et analyse de produits agrochimiques Chaque fois qu'un inspecteur a des raisons valables de croire qu’un produit agrochimique, sa composition ou sa qualité n’est pas conforme aux conditions du permis d’inscription, il peut procéder à la saisie de quelques échantillons pour des raisons d’analyse. L’inspecteur peur saisir et garder les produits agrochimiques s’il a des raisons sérieuxes de croire que leur composition et qualité ne sont pas conformes à celles qui sont indiquées dans le permis d’inscription. Chaque fois qu'un inspecteur constate qu’une condition d'utilisation de produits agrochimiques indiquée dans le permis d'inscription a été abusée de façon que les aliments ou autres produits agricoles contiennnent des résidus dépassant les limites maximales prescrites, il saisit de tels produits pour analyse. Article 29: Decisions on seized agrochemicals After analysis, the inspector of agrochemicals may take one of the following decisions: 1 º if the analysis reveals that the samples seized comply with the legal requirements, he/she shall cancel seizure decision within fourteen (14) days; 2 º if the analysis reveals that the agrochemicals seized do not comply with the legal requirement, the decision for seisure shall remain valid for a period not exceeding six(6) months; 3 º if the analysis reveals that the agrochemicals seized irreversibly do not comply with the legal requirements, the inspector of Une telle saisie fait objet d’un procès-verbal qui est soumis au registraire de produits agrochimiques et dont une copie est réservée au propriétaire. Ingingo ya 30: Gusuzuma imiti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi n’ibisigazwa byayo Inama Ngishwanama igena ibigo cyangwa abantu ku giti cyabo bashinzwe gusuzuma imiti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi hagamijwe kureba ubwiza bwabyo no kubigerageza, bagasuzuma n’ibisigazwa byabyo byaba ibiri mu butaka, mu biribwa cyangwa mu bindi bikomoka mu buhinzi n’ubworozi mu rwego rwo gushimangira no kunoza ibikorwa by’igenzura. If agrochemicals seized prove to be harmful to human or animal health, the registrar of agrochemicals shall request the Advisory Council to meet for immediate action. Expenses incurred on examining or disposing of agrochemicals seized shall be born by the owner. Article 30: Examination of agrochemicals and their residues The Advisory Council shall designate legal or natural persons to examine the quality of agrochemicals and their residues whether in soil, in food or other agricultural products in order to enforce and improve controls. Article 31: Claiming against the decision referred under articles 29 and 30 of this Law Any person aggrieved by the decision referred to in Articles 29 and 30 of this Law may submit his/her appeal to the Minister within thirty (30) days; in case the person is not satisfied with the decision taken by the Minister, the matter shall be referred to the competent court. agrochimiques et les analystes, personnes morales ou physiques, sont définies par le Conseil consultatif. Ingingo ya 33: Umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi bidatunganye cyangwa byangiritse Iyo umuguzi agaragaje ko yagurishijwe umuti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi bidatunganye cyangwa byangiritse, agomba gusubizwa amafaranga n’uwo baguze mu gihe atarabikoresha, uwagurishije asabwa kwishyura ibijyanye no kubisenya. Article 32: Authorization to import unregistered agrochemicals The Minister may, in the general public interest or for research purposes, authorize the importation of an unregistered agrochemical and specify the quantity to be imported. Article 33: Defective or spoiled agrochemicals Where a purchaser buys defective or spoiled agrochemicals and has not yet used them, such a person shall be refunded his/her money by the seller and all expenses incurred on disposing of such agrochemicals shall be bone by the seller. If it is established that such agrochemicals have been used, the seller shall bear all expenses resulting from the negative impact of such agrochemichals’ use. Article 32: Autorisation d'importation des produits agrochimiques non enregistrés Le Ministre peut, dans l’intérêt général ou pour des raisons de recherche, autoriser l'importation d'un produit agrochimique non enregistré et déterminer la quantité à importer. Article 33: Produits agrochimiques défectueux ou endommagés Losque l’acheteur prouve avant l’usage qu’il a acheté les produits agrochimiques défectueux ou endommagés, la somme payée par l’acheteur lui est restituée par le vendeur qui couvre également les dépenses relatives à la destruction de tels produits agrochimiques. S’il est constaté que ces produits agrochimiques sont déjà utilisés, le vendeur doit payer toutes les dépenses résultant des conséquences néfastes de l’utilisation de ces produits agrochimiques. Ingingo ya 37: Igihe iri tegeko ritangira gukurikizwa Iri tegeko ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. CHAPTER VI: MISCELLANEOUS AND FINAL PROVISIONS Article 34: Contravening the provisions of this Law Any person contravening the provisions of this Law shall be punished in accordance with the Organic Law governing the Penal Code. Article 35: Drafting, consideration and adoption of this Law This Law was drafted in English, considered and adopted in Kinyarwanda. Article 36: Repealing provision All prior legal provisions contrary to this Law are hereby repealed. Article 37: Commencement This Law shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. CHAPITRE VI : DISPOSITIONS DIVERSES ET FINALES Article 34 : Violation des dispositions de la présente loi Toute personne qui viole les dispositions de la présente loi est punie conformément à la loi organique portant code pénal. Article 35: Initiation, examen et adoption de la présente loi La présente loi a été initiée en Anglais, elle a été examinée et adoptée en Kinyarwanda. Article 36: Disposition abrogatoire Toutes les dispositions légales antérieures contraires à la présente loi sont abrogées. Article 37 : Entrée en vigueur La présente loi entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
