It also provides for strategies meant to control and contain the establishment of pests or diseases and matters connected with living organisms. Article 2: Definitions of terms For the purposes of this Law, the following terms have the following meanings: 1º area: any place of activities; 2º area of low pest prevalence: area, whether on the whole or part of the Rwandan territory, in which a specific pest occurs at low levels and which is subject to surveillance, control or eradication measures; 3º growing medium: anthill or any material in which a plant root is growing; ADOPTE : CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet de la présente loi La présente loi détermine les modalités de protection de la santé des végétaux au Rwanda. Elle prévoit également les stratégies de lutte et d’enrayement de l’établissement d’organismes nuisibles ou de maladies ainsi que toutes les questions relatives aux êtres vivants. Article 2: Définitions des termes Aux fins de la présente loi, les termes repris ci après ont des significations suivantes: 1º zone : tout endroit d’activités; 2º zone à faible prévalence d’organismes nuisibles: toute zone, que ce soit sur tout ou partie du territoire rwandais, dans laquelle un organisme nuisible spécifique est présent à un niveau faible et qui fait l’objet de mesures de surveillance, de lutte ou d’éradication; 8º gufatira: ugufata ikimera hagamijwe kugenzura niba cyujuje ibyangombwa bisabwa; 9º gukumira: ugushyira mu bikorwa ingamba zo kurinda ubuziranenge bw’ibimera mu karere cyangwa hafi aho mu kurwanya ikwirakwira ry’indiririzi cyangwa indwara; 10º gusakara: ugukwirakwira kw’indiririzi cyangwa indwara nyuma yo kwinjira ahantu runaka; 4º point of entry: seaport, road, land border point, airport, railway station or post office; 5º introduction of a pest: entry of a pest into an area where it is not yet present, or present but not widely distributed and being officially controlled; 6º pest free area: area in which a specific pest is absent as demonstrated by scientific evidence and in which this condition is being maintained; 7º quarantine: confinement by a competent authority of plants or plant products for observation, research or inspection and testing of their compliance with phytosanitary regulations; 8º confinement: to keep a plant to verify that it complies with the requirements; 9º containment: application of phytosanitary measures in or around an infested area to prevent spread of a pest or a disease; 10º establishment: perpetuation of a pest or a disease within an area after entry; 4º point d’entrée: port maritime, route, poste frontière terrestre, aéroport, station ferroviaire ou poste; 5º introduction d’un organisme nuisible: entrée d’un organisme nuisible dans une zone où il n’est pas encore présent ou bien y est présent mais n’y est pas largement disséminé et fait l’objet d’une lutte officielle; 6º zone exempte d’organisme nuisible : zone dans laquelle l’absence d’un organisme nuisible a été prouvée scientifiquement et où elle est maintenue; 7º quarantaine : confinement de végétaux ou produits végétaux par l’autorité compétente pour observation, recherche ou pour inspection et analyse de leur conformité à la réglementation phytosanitaire; 8º confinement: garder un végétal pour vérifier sa conformité aux conditions requises ; 9º enrayement: application de mesures phytosanitaires dans ou autour d’une zone infestée afin de prévenir la dissémination d’un organisme nuisible ou d’une maladie ; 12º infested: infected or affected by a pest or a disease; 13º phytosanitary certificate: official document issued by a competent authority, attesting that a plant meets phytosanitary regulations; 14º phytosanitary certificate for re-export: phytosanitary certificate which allows transit status to a plant; 15º pre-clearance: document indicating phytosanitary status of a plant which is issued in advance by the competent authority of the area of origin and which reaches the country of destination before arrival of a plant or plant product; 16º germplasm: plant intended for use in breeding or conservation program; 17º quarantine station: official station for temporarily holding a plant, a plant product or other related regulated article for phytosanitary, research, inspection, 11º agent de lutte biologique: organisme utilisé pour la lutte contre les organismes nuisibles ; 12º infesté: infecté ou affecté par un organisme nuisible ou par une maladie ; 13º certificat phytosanitaire : document officiel délivré par l’autorité compétente attestant qu’un végétal satisfait à la réglementation phytosanitaire ; 14º certificat phytosanitaire de réexportation : certificat phytosanitaire qui accorde à un végétal le statut de transit ; 15º pré-agrément: document indiquant l’état phytosanitaire d’un végétal et qui est délivré au préalable par l’autorité compétente de la zone d’origine et qui doit parvenir dans le pays de destination avant l’arrivée d’un végétal ou de produit végétal ; 21º ikimera: urubuto cyangwa igice cy’ikimera kizima gituma cyororoka; 22º ikinyabuzima ngirakamaro: ikinyabuzima icyo aricyo cyose kijya ako kanya cyangwa kikanyura ku kindi kintu, ku kimera cyangwa ibikomoka ku kimera kikagira akamaro mu kurwanya indiririzi; 23º ikintu kibika cyangwa gikwirakwiza indiririzi cyangwa indwara: ikintu cyose cyaba ububiko, igipfunyikwamo ikimera cyangwa ikibikomokaho, ububiko bukozwe mu biti, igitwarwamo ibintu, itaka cyangwa ikindi gishobora guterwamo ikimera n’ikindi kintu cyose indiririzi cyangwa indwara ishobora monitoring, confinement or destruction purposes; 18º plant product: unmanufactured material of plant origin or any manufactured product that, by its nature or that of its processing, may create a risk for the introduction or spread of a pest or a disease; 19º packaging: material used to carry, store, protect or monitor a plant or a plant product; 20º container: a box, or any other receptacle used to carry any plant or plant product; 21º plant: seed or part of a living plant allowing a plant to grow; 22º beneficial organism: any biological entity which directly or indirectly fixes itself on a material, plant or plant products and which is useful in controlling pests; 23º regulated article: any storage place, packaging of a plant or a plant product, wood packaging material, container, soil or other growing medium and any other material capable of harbouring or spreading a pest or disease, deemed to require phytosanitary recherche, d’inspection, de surveillance, de confinement ou de destruction ; 18º produit végétal: produit non manufacturé d’origine végétale ou produit manufacturé qui, étant donné sa nature ou celle de sa transformation, peut constituer un risque d’introduction ou de dissémination d’un organisme nuisible ou d’une maladie; 19º emballage: matériau utilisé pour contenir, stocker, protéger ou surveiller un végétal ou un produit végétal ; 20º conteneur: caisse ou tout autre récipient utilisé pour transporter tout végétal ou tout produit végétal; 21º végétal: semence ou partie d’un végétal vivant permettant à un végétal de se développer; 22º organisme utile: toute entité biologique qui se fixe directement ou indirectement sur un matériel, un végétal ou sur un produit végétal et qui a l’utilité de lutter contre les organismes nuisibles ; CHAPTER II: IMPORTING PLANTS Article 3: Importing a plant and a plant product Importing any plant, plant product or any other article which can contribute to pest or disease spread is subject to a licence and a phytosanitary certificate issued by the competent authority. CHAPITRE II: IMPORTATION DES VEGETAUX Article 3: Importation d’un végétal et d’un produit végétal L’importation d’un végétal, d’un produit végétal ou de tout autre article susceptible de contribuer à la dissémination d’un organisme nuisible ou d’une maladie requiert une licence et un certificat phytosanitaire délivré par l’autorité compétente. Ingingo ya 9: Gutakaza uruhushya Mu gihe uwahawe uruhushya arutakaje, agomba kubimenyesha mu nyandiko urwego rwarutanze mu gihe uruhushya rugifite agaciro. Article 7: Revocation of a licence A licensee may have his/her licence revoked by the authority which issued it. The person whose licence is revoked is notified in writing within a period not exceeding seven (7) days and is given the grounds for such a revocation. Article 8: Appeal against revocation of a licence Where a licensee has his/her licence revoked, he/she may appeal to the Minister in writing within a period not exceeding thirty (30) days as of the date on which he/she received the written notice of revocation. Article 9: Loss of a licence Where a licensee loses a licence while it is still valid, he/she must inform, in writing, the authority which issued it. Within seven (7) days as of receipt of such notification, the competent authority must issue to him/her a document in lieu of such a licence. Dans un délai ne dépassant pas sept (7) jours à compter de la réception de cette notification, l’autorité compétente est tenue de lui donner un document tenant lieu de cette licence. Ingingo ya 11: Uko bagenza ikimera, ikigikomokaho cyangwa ikindi kintu cyose cyinjijwe mu buryo butemewe n’amategeko Umugenzuzi, amaze kugaragaza ko ikimera cyangwa ikigikomokaho cyinjijwe mu gihugu ku buryo bunyuranije n’amategeko, ashobora gufatira, gufunga, kuvanaho cyangwa gusenya ikimera, ikigikomokaho n’ikindi kintu cyose cyemerewe kwinjizwa ndetse n’ububiko gitwawemo kandi nta ndishyi atanze igihe asanze : 1º cyinjijwe nta ruhushya; Article 10: Phytosanitary inspection of a plant and plant product Any plant or plant products meant for importation into Rwanda or for exportation must be subject to inspection in the relevant area and the inspection is carried out by employees of the competent authority. Any person entering Rwanda by air or by road with plants or plant products whether as accompanied or checked-in baggage, must declare such items to a competent employee at the point of entry. However, any importer of a plant or plant product may request that the inspection be carried out when the plant or plant product has reached its destination and such a request must indicate the reasons thereof. Article 11: Action to be taken with regard to unlawfully imported plant, plant product or any other product An inspector, after establishing that a plant or a plant product has entered the country illegally, may proceed to the confinement, holding, treatment or destruction of a plant, a plant product and any regulated article as well as its container, without compensation where: 1º it is imported without any authorization; Article 10: Inspection phytosanitaire d’un végétal et d’un produit végétal Tout végétal ou produits végétaux en importation au Rwanda ou en exportation, doit être soumis à une inspection effectuée dans un endroit réservé à cet effet et ce, par les agents de l’autorité compétente. Toutefois, tout importateur d’un végétal ou de produit végétal peut demander que l’inspection soit effectuée lorsqu’un végétal ou un produit végétal est arrivé à sa destination, et cette demande en précise les raisons. Article 11: Mesure à prendre contre un végétal, un produit végétal ou tout autre produit importé illégalement Un inspecteur peut, après avoir constaté que l’entrée d’un végétal ou d’un produit végétal est illégale, procéder au confinement, à la détention, au traitement ou à la destruction d’un végétal, d’un produit végétal et de tout autre article réglementé ainsi que son conteneur sans aucune compensation si : 1º l’importation s’est effectuée sans autorisation ; Official Gazette nᵒ 22 of 30/05/2016 68 2º cyinjijwe mu buryo bunyuranyije n’uruhushya yahawe. Ingingo ya 12: Ibikorerwa ikimera cyangwa ikigikomokaho cyagaragayeho indiririzi Ikimera, igikomoka ku kimera cyagaragayeho indiririzi cyangwa indwara cyangwa cyatera isakara ryabyo gifatirwa n’umugenzuzi ari uko hamaze kumeyeshwa nyir’ibintu mu nyandiko cyangwa binyujijwe mu itangazo mu gihe umugenzuzi asanze bishobora guhungabanya ibidukikije Umugenzuzi, ashingiye ku bivugwa mu gika cya mbere cy’iyi ngingo, ashobora gutegeka nyirubwite gutunganya ikimera cye cyangwa ikigikomokaho kubera ko gifite imbogamizi, kugisubiza aho cyaturutse cyangwa kugishyira mu kato. Umugenzuzi asenya mu buryo bwihuse ikimera, igikomoka ku kimera cyangwa ikindi gicuruzwa cyinjijwe nta ndishyi atanze mu gihe ubugenzuzi busanze ko byandujwe n’indiririzi cyangwa indwara yahawe akato. An inspector shall immediately destroy, without compensation, any plant, plant product or any other regulated article where the inspection establishes that such plant, plant product or article is infested with quarantine pest or disease. Sur base des dispositions de l’alinéa premier du présent article, l’inspecteur peut ordonner au concerné d’assurer la maintenance de son végétal ou de son produit végétal présentant certains risques, de le retourner à son lieu d’origine ou de le mettre en quarantaine. Un inspecteur détruit immédiatement et sans aucune compensation un végétal, un produit végétal ou un article autorisé, lorsque l’inspection constate qu’il est infesté d’organisme nuisible ou de maladie de quarantaine. When the owner is not satisfied with the decision taken, he/she appeals to the relevant authorities. Article 13: Treatment of an abandoned consignment The competent authority may dispose of by sale or destroy any monitored or unmonitored consignment imported into Rwanda which, after fourteen (14) days, is not claimed. Article 14: Modalities for inspection of premises, vehicle, vessel, train and aircraft containing a plant An inspector may, by any means, enter in any area where a plant or a plant product was introduced including premises, vehicle, vessel, train or aircraft in order to inspect them and take a decision. Where the inspector suspects that there is a pest or disease introduction in any way, the inspector writes to the owner or carrier of the consignment and provides a copy to the competent authority requesting to allow no entry to consignment, to return it to the place of origin, to allow it transit to another country, to keep it in quarantine, to monitor it or to destroy it in case reasons to do so are provided. Article 13: Traitement d’un envoi abandonné L’autorité compétente peut se débarrasser par vente ou par destruction d’un envoi soumis ou non encore soumis à la surveillance et qui n’est pas réclamé pendant une période de quatorze (14) jours. Article 14: Modalités d’inspection du bâtiment, du véhicule, du bateau, du train et d’avion contenant un végétal Un inspecteur peut, par tout moyen, entrer dans tout endroit où un végétal ou un produit végétal a été introduit, que ce soit dans un bâtiment, un véhicule, un bateau, un train ou dans un avion pour les soumettre à l’inspection et prendre la décision. Lorsque l’inspecteur soupçonne l’introduction d’un organisme nuisible ou d’une maladie d’une manière quelconque, il adresse une lettre au propriétaire ou au transporteur de l’envoi et donne une copie à l’autorité compétente, en demandant que l’envoi n’entre pas dans le pays, soit retourné au lieu de provenance, transite vers un autre pays, soit mis en quarantaine, soit soumis à la surveillance ou soit détruit si les raisons pour le faire sont indiquées. Mu gihe umugenzuzi asanze ububiko, ibicuruzwa n’ibindi biri mu nzira bishobora gukwirakwiza Article 15: Obligations of consignment carrier The owner of a vessel, vehicle, train, aircraft or any other conveyance carrying a consignment as well as his/her conductor and passenger must , upon arrival at the point of entry, do the following: 1° provide an inspector with such documents and other relevant information concerning what he/she carries as the inspector may require; 2° complete an information request form concerning vessel, vehicle, train, aircraft or any other article he/she carries as the inspector may require; 3° prevent any plant or plant product from being unloaded unless otherwise permitted by the inspector. Article 16: Inspection of storage places, goods and other articles in transit that may spread pests and diseases An inspector may inspect any storage place, goods or any other articles in transit in the event they may spread pests or diseases. Dans ce cas, il ordonne à leur propriétaire, au gardien ou au transporteur de prendre les mesures visant à éliminer l’organisme nuisible ou la maladie, à éviter tout risque qu’ils présentent. Le propriétaire est chargé des dépenses encourues à cet effet. Un arrêté du Ministre en détermine les modalités d’exécution. Ingingo ya 19: Gutangaza umwaduko w’indiririzi cyangwa indwara Iteka rya Minisitiri ritangaza umwaduko w’indiririzi cyangwa indwara byagaragaye cyangwa byavumbuwe. Ritangaza kandi akarere byagaragayemo, ingamba n’amabwiriza bigomba gufatwa mu rwego rwo kwirinda iyo ndiririzi cyangwa indwara no kubirwanya mu buryo bwihutirwa. Ingingo ya 20: Kwinjiza indiririzi, ikimera cyangwa ikigikomokaho bishyigikira ubumenyi n’ubushakashatsi Ku mpamvu z’ubumenyi n’ubushakashatsi, indiririzi, ikimera cyangwa ikigikomokaho gishobora kwinjizwa mu Rwanda. Uburyo bikorwa bugenwa n’Iteka rya Minisitiri. Article 18: Prevention of introduction of invasive alien species or diseases Upon advice of the competent authority, the Minister, for the purposes of prevention from the introduction of invasive alien species or diseases into the country, determines conditions at the issuance of plant or plant product import licence. Article 19: Declaration of pest or disease outbreak An Order of the Minister declares a pest or disease outbreak. It also indicates the area concerned with the outbreak, measures and instructions to be made for the purpose of preventing and urgently fighting such a pest or disease. Article 20: Importation of pest, plant or plant product for scientific and research purposes A pest, a plant or a plant product may be imported into Rwanda for scientific and research purposes. Importation modalities are determined by an Order of the Minister. Article 18: Prévention de l’introduction d’espèces exotiques ou de maladies envahissantes Sur avis de l’autorité compétente, le Ministre détermine les conditions lors de l’octroi d’une licence d’importation d’un végétal ou d’un produit végétal, pour des raisons de prévenir l’introduction d’espèces exotiques ou de maladies envahissantes au pays. Article 19: Déclaration de l’apparition d’un foyer d’organisme nuisible ou de maladie Un arrêté ministériel déclare l’apparition d’un foyer d’organisme nuisible ou de maladie. Il indique également la zone d’apparition, les mesures et instructions à prendre dans le cadre de prévention et lutte urgente contre cet organisme nuisible ou cette maladie. Article 20: Importation d’un organisme nuisible, d’un végétal ou d’un produit végétal pour des raisons scientifiques et de recherche Un organisme nuisible, un végétal ou un produit végétal peut être importé au Rwanda pour des raisons scientifiques et de recherche. Les modalités d’importation sont déterminées par un arrêté ministériel. Article 21: Designation of quarantine station of a plant Any quarantine plant or plant product is sent to a station designated by the competent authority. Article 22: Duties of customs officers or any other authorised officer A custom officer or any other authorised officer collaborates with an inspector of the competent authority to check whether the imported products comply with requirements. Article 23: Powers of inspectors in relation to imported plant, plant products or other regulated articles An inspector may, where he/she considers it necessary, enter in any area for the purposes of inspection of and information gathering from an area in which a pest or a disease is suspected and the owner bears the cost of such a pest control activity. Article 24: Modalities to inspect a plant or a plant product An Order of the Minister specifies modalities for inspection, prohibition, restriction and importation of a plant, plant product, quarantine pest, beneficial organisms or any other elements that can contain and spread pests or diseases. CHAPTER III: CONTAINMENT AND ERADICATION OF PESTS AND DISEASES Article 25: Notification of presence of pest or disease Any person who notices or suspects the presence of a pest in a given area must notify the nearest administration so that the latter notifies the competent authority. Article 26: Declaration of a quarantine An Order of the Minister determines a quarantine area and modalities for eradication of a pest, disease or epidemic disease. UMUTWE WA IV: ICYEMEZO CY’UBUZIRANENGE Ingingo ya 31: Icyemezo cy’ubuziranenge Kohereza mu mahanga ikimera cyangwa ikigikomokaho bigomba icyemezo cy’ubuziranenge gitangwa n’urwego rubifitiye ububasha. Icyemezo gihabwa uwujuje ibyangombwa bisabwa n’igihugu ikimera cyangwa ikigikomokaho kigiye koherezwamo. Article 28: Cost for treatment of a pest or disease The cost and responsibility for any action to treat pests or diseases are borne by the owner. For the case of an epidemic disease or a quarantine pest, the cost is borne by the Government. Article 29: Quarantine lifting An Order of the Minister Order lifts quarantine either on a part or on the whole of the area in which a pest or a disease was present. Article 30: Declaration of a pest or disease infested or free area An Order of the Minister declares a pest or disease infested or free area. CHAPTER IV: PHYTOSANITARY CERTIFICATE Article 31: Phytosanitary certificate The export of a plant or plant product requires a phytosanitary certificate issued by the competent authority. The phytosanitary certificate is issued to a person meeting requirements set by the country of destination of the plant or plant product. Article 28: Coût relatif au traitement d’organisme nuisible ou de maladie Le coût et la responsabilité pour toute action de traitement d’organismes nuisibles ou de maladies sont à la charge du propriétaire. En cas d’une épidémie ou d’un organisme de quarantaine, ce coût est à la charge de l’Etat. Article 29: Levée de la quarantaine Un arrêté ministériel lève la quarantaine sur une partie ou l’ensemble de la zone où un organisme nuisible ou une maladie était présent. Article 30: Déclaration d’une zone infestée ou exempte d’organismes nuisibles ou de maladies Un arrêté ministériel déclare une zone infestée ou exemptée d’organismes nuisibles ou de maladies. CHAPITRE IV: CERTIFICAT PHYTOSANITAIRE Article 31: Certificat phytosanitaire L’exportation d’un végétal ou d’un produit végétal requiert un certificat phytosanitaire délivré par l’autorité compétente. Le certificat phytosanitaire est octroyé à une personne remplissant les conditions fixées par le pays de destination du végétal ou du produit végétal.
