ADOPTS: CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Law This Law establishes Rwanda Forestry Authority abbreviated as RFA. It also determines its mission, responsibilities, organisation and functioning. Article 2: Legal personality and autonomy RFA has legal personality and enjoys administrative and financial autonomy. It is also governed in accordance with relevant laws. Article 3: Category of RFA RFA falls within the category of non commercial public institutions. ADOPTE : CHAPITRE PREMIER : DISPOSITIONS GÉNÉRALES Article premier: Objet de la présente loi La présente loi porte création de l’Office rwandais des forêts, dénommé « RFA » en sigle anglais. Elle détermine également sa mission, ses attributions, son organisation et son fonctionnement. Article 2: Personnalité juridique et autonomie Le RFA est doté d’une personnalité juridique et jouit d’une autonomie administrative et financière. Il est également géré conformément à la législation en la matière. Article 3: Catégorie du RFA Le RFA rentre dans la catégorie des institutions publiques à caractère non commercial. Ingingo ya 6: Inshingano za RFA RFA ifite inshingano zikurikira: 1° gushyira mu bikorwa politiki, amategeko, ingamba n’ibyemezo Article 4: Head office of RFA The head office of RFA is located in Ngororero District, Western Province. It may be relocated elsewhere on the Rwandan territory when considered necessary upon approval by a Prime Minister’s Order RFA may, when considered necessary and upon approval by a Prime Minister’s Order, have branches elsewhere in the country. CHAPTER II: MISSION, RESPONSIBILITIES AND POWERS OF RFA Article 5: Mission of RFA The mission of RFA is to ensure growth of forest resources, their management and protection for sustainable development purpose. Article 6: Responsibilities of RFA RFA has the following responsibilities: 1° to implement policies, laws, strategies and Government Article 4: Siège du RFA Le siège du RFA est établi dans le District de Ngororero, Province de l’Ouest. Ingingo ya 7: Ububasha bwa RFA RFA ifite ububasha bukurikira: 1° gusaba ikigo cyangwa urwego bireba raporo ku miterere y’amashyamba n’ishyirwa mu bikorwa ry’ingamba zo kuyarinda no kuyacunga; 2° guhuza no gutanga umurongo ngenderwaho ku mishinga yose ifitanye isano n’amashyamba; 3° gusura nta nteguza abahawe uruhushya rwo gusarura amashyamba n’izindi mpushya mu rwego rwo gukora igenzura ku iyubahirizwa ry’ibisabwa; 4° guhagarika by’agateganyo cyangwa kwambura uruhushya rwo gusarura amashyamba n’izindi 14° to monitor and coordinate the implementation of strategies related to management and utilisation of forest resources; 15° to cooperate with other international institutions and organisations sharing a similar mission. Article 7: Powers of RFA RFA has the following powers: 1° to request a relevant institution or organ for a report on the situation of forests and implementation of measures for protection and management of forests; 2° to coordinate and provide strategic guidance to all initiatives related to forests; 3° to visit, without any notice, holders of forest harvesting licence and other permits in the framework of conducting supervision on the compliance with the requirements; 4° to order for suspension or revocation of a forest harvesting licence and other permits whose 14° faire le suivi et coordonner la mise en œuvre des stratégies relatives à la gestion et l’exploitation des ressources forestières; 15° coopérer avec d’autres institutions et organisations internationales partageant une même mission. Article 14: Duties of the Chairperson of the Board of Directors of RFA The Chairperson of the Board of Directors of RFA has the following duties: 1° to head the Board of Directors of RFA and coordinate its activities; 2° to convene and preside over meetings of the Board of Directors of RFA; 3° to submit minutes of meetings of the Board of Directors of RFA to its supervising authority; 7° approuver le projet de cadre organique du RFA; 8° évaluer le fonctionnement du RFA sur base du plan d’action et du budget; 9° soumettre les rapports d’activités trimestriel et annuel à l’organe de tutelle du RFA; 10° prendre les décisions sur tous les sujets cruciaux relevant des attributions du RFA. Article 16: Incompatibilities with membership of the Board of Directors of RFA A member of the Board of Directors of RFA is not allowed to perform any remunerated activity within RFA. A member of the Board of Directors of RFA is also not allowed, whether individually or through companies in which he or she holds shares, to bid for tenders of RFA. Article 17: Reasons for loss of membership to the Board of Directors and modalities for replacement A member of the Board of Directors of RFA loses membership if: 1° his or her term of office expires; 2° he or she resigns in writing; 3° he or she is no longer able to perform his or her duties due to physical or mental disability 2° effectuer toute autre tâche relevant des attributions du Conseil d’administration du RFA que ce dernier peut lui confier. The invitation is submitted in writing to members of the Board of Directors of RFA at least fifteen (15) days before the meeting is held. However, an extraordinary meeting is convened in writing at least three (3) days before it is held. Items to be examined by the Board of Directors in the first quarter of the year include the approval of the financial and activity reports of the previous year. Article 19: Invitation of a resource person to a meeting of the Board of Directors of RFA The Board of Directors of RFA may invite to its meeting any person from whom it may seek an advice on any item on the agenda. Article 20: Approval of resolutions and minutes of the meeting of the Board of Directors of RFA Resolutions of the meeting of the Board of Directors of RFA are signed by its members immediately after the end of meeting and a copy thereof is sent to the supervising authority of RFA within five (5) working days. The head of the supervising authority of RFA gives his or her views on the resolutions of the meeting of the Board of Directors of RFA within fifteen (15) working days from receipt thereof. If this period expires before he or she gives his or her views, the resolutions of the meeting are deemed definitively approved. Minutes of the meeting of the Board of Directors of RFA are signed by the Chairperson and its rapporteur and approved during the next meeting. A copy of minutes of the meeting is sent to the supervising authority of RFA within fifteen (15) working days from the day of its approval. Article 21: Rapporteur of meetings of the Board of Directors of RFA The Director General of RFA serves as the rapporteur of the meetings of the Board of Directors of RFA, but he or she has no right to vote in decision making. The Director General of RFA does not participate in the meetings that make decisions on issues that concern him or her. In case a meeting examines issues concerning him or her, members of the Board of Directors of RFA elect among themselves a rapporteur. Article 22: Personal interest in an issue under discussion When a member of the Board of Directors of RFA has a direct or indirect interest in an issue under discussion, he or she must immediately inform the Board of Directors of RFA about where his or her interest lies. A member who declares an interest in the issue under consideration does not attend the meeting deliberating on that issue. Article 21: Rapporteur des réunions du Conseil d’administration du RFA Le Directeur général du RFA est le rapporteur des réunions du Conseil d’administration du RFA, mais il n’a pas le droit de voter lors de la prise de décisions. Le Directeur général du RFA ne participe pas aux réunions qui prennent des décisions sur des questions qui le concernent. Au cas où une réunion examine des questions le concernant, les membres du Conseil d’administration du RFA élisent parmi eux un rapporteur. Article 22: Intérêt personnel sur un point à l’examen Lorsqu’un membre du Conseil d’administration du RFA a un intérêt direct ou indirect sur un point à examiner, il doit en informer immédiatement le Conseil d’administration du RFA et montrer où son intérêt repose. Le membre qui informe de son intérêt sur un point à examiner ne participe pas à la réunion qui examine ce point. Article 23: Sitting allowances for members of the Board of Directors of RFA A Presidential Order determines sitting allowances for members of the Board of Directors of RFA. Section 2: Executive Organ Article 24: Composition of the Executive Organ and modalities for appointment The Executive Organ of RFA is comprised of the Director General appointed by a Presidential Order and other staff members recruited in accordance with relevant laws. A Presidential Order may also appoint a Deputy Director General and determine his or her powers and duties. Article 26: Powers and duties of the Director General of RFA The Director General of RFA has the power to make decisions in the administrative and financial management in accordance with relevant laws. He or she coordinates and directs the activities of RFA. Article 27: Responsibilities of other staff members of the Executive Organ of RFA Responsibilities of other staff members of the Executive Organ of RFA are determined by a Prime Minister’s Order. CHAPTER V: PROPERTY AND FINANCE Article 30: Property of RFA and its sources The property of RFA is comprised of movable and immovable assets. The property of RFA derives from the following sources: 1° State budget allocations; 2° State or development partners’ subsidies; 3° income from services rendered; 4° interests from its property; Article 29: Cadre organique, salaires et avantages alloués au personnel du RFA Un arrêté du Premier Ministre détermine le cadre organique, les profils exigés pour les postes, les salaires et avantages alloués au personnel du RFA. CHAPITRE V: PATRIMOINE ET FINANCES Article 30: Patrimoine du RFA et ses sources Le patrimoine du RFA est composé de biens meubles et immeubles. Article 31: Preparation and approval of the budget of RFA RFA prepares its annual budget to be approved by the competent authority and executed in accordance with relevant laws. Article 32: Use, management and audit of property of RFA The use, management and audit of the property of RFA are carried out in accordance with relevant laws. CHAPTER VI: MISCELLANEOUS, TRANSITIONAL AND FINAL PROVISIONS Article 34: Transfer of employees Employees of Rwanda Water and Forestry Authority formerly governed by Law nº 06/2017 of 03/02/2017 establishing Rwanda Water and Forestry Authority and determining its mission, organisation and functioning are transferred to RFA established by this Law in accordance with its organizational structure. Article 35: Transfer of property, liabilities and contracts The property, liabilities as well as contracts of Rwanda Water and Forestry Authority formerly governed by Law nº 06/2017 of 03/02/2017 establishing Rwanda Water and Forestry Authority and determining its mission, organisation and functioning are transferred to RFA established by this Law, in accordance with its responsibilities. Article 36: Transitional period Organs to which this Law applies have a time limit of six (6) months from the publication of this Law in the Official Gazette of the Republic of Rwanda for complying with the provisions of this Law. Article 37: Drafting, consideration and adoption of this Law This Law was drafted in English, considered and adopted in Ikinyarwanda. Article 35 : Transfert du patrimoine, du passif et des contrats Le patrimoine, le passif ainsi que les contrats de l’Office Rwandais des Eaux et des Forêts anciennement régis par la Loi n° 06/2017 du 03/02/2017 portant création de l’Office Rwandais des Eaux et des Forêts et déterminant ses missions, son organisation et son fonctionnement sont transférés au RFA créé par la présente loi conformément à ses attributions. Article 37 : Initiation, examen et adoption de la présente loi La présente loi a été initiée en anglais, examinée et adoptée en Ikinyarwanda.
