Minister; Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, as amended to date, especially in Articles 118, 121 and 201; Pursuant to Law nº 26/2011 of 27/07/2011 on compensation for damages caused by animals; Pursuant to Law n° 52/2011 of 14/12/2011 establishing the Special Guarantee Fund for automobile and damages caused by animals (SGF) and determining its organisation, functioning and mission; On proposal by the Minister of Trade and Industry; After consideration and approval by the Cabinet, in its session of 08 February 2012; HEREBY ADOPTS: ARRETE DU PREMIER MINISTRE N° 26/03 DU 23/05/2012 DETERMINANT LES TAUX, MODALITES DE CALCUL ET CRITERES DE DETERMINATION DES INDEMNITES ALLOUEES A LA VICTIME DES DOMMAGES CAUSES PAR UN ANIMAL Le Premier Ministre; Vu la Constitution de la République du Rwanda du 04 juin 2003, telle que révisée à ce jour, spécialement en ses articles 118, 121 et 201; Vu la Loi n° 26/2011 du 27/07/2011 portant indemnisation des préjudices causés par des animaux ; Vu la Loi n° 52/2011 du 14/12/2011 portant création du Fonds Spécial de Garantie Automobile et des dommages causés par les animaux (SGF) et déterminant son organisation, fonctionnement et sa mission; Sur proposition du Ministre du Commerce et de l‟industrie ; Après examen et adoption par le Conseil des Ministres, en sa séance du 08 Fevrier 2012; ARRETE: Ingingo ya 2: Ibisobanuro by’amagambo Hakurikijwe iri teka, amagambo akurikira afite ibisobanuro bikurikira: 1° Impuguke: ni umuntu ufite ubuzobere mu mwuga w‟ubugoronome, w‟ubuveterineri, CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines the rates, calculation modalities, requirements and other procedures to be followed while awarding compensation and other indeminities to: 1° Any person damaged by any animal listed on the list established by the Minister in charge of conservation of National Parks encountered in the Natonal Park or other protected areas during work or visit authorized by a competent authority; 2° Any person‟s property damaged by any animal on the list established by an Order of the Minister in charge of conservation of National Parks or any animal from the National park according to the list of animal in those national parks encountered outside the park or outside another protected area. Article 2: Definitons In this Order, the following words shall have the following meaning: 1° Experts: persons with expertise in agronomy, veterinary sciences, assessment CHAPITRE PREMIER : DISPOSITIONS GENERALES Article premier : Objet du présent arrêté Le présent arrêté fixe les taux, modalités de calcul, les conditions et autres procédures pour accorder des indemnités et autres frais dus à : 1° Toute personne victime des dommages corporels ou matériels causés par tout animal rencontré dans les Parcs Nationaux ou à un autre endroit protegé, alors qu‟elle est en service ou en visite autorisée par l‟organe compétent ; 2° Toute personne victime des dommages matériels causés par tout animal figurant sur la liste déterminée par arreté du Ministre ayant la Conservation de Parcs Nationaux ou tout animal dont il est prouvé qu‟il est sorti des Parcs Nationaux selon le liste préétablie des animaux s‟y trouvant dans ses attributions, rencontré en dehors du parc ou en dehors de tout autre endoit protégé. Article 2 : Définitions Au sens du présent arrêté, les mots suivants signifient : 1° Experts : Ce sont des personnes spécialisées en agronomie ou en Official Gazette nº 25 of 18/06/2012 8 kubara imitungo yimukanwa n‟itimukanwa, n‟ibindi, kandi bashyirwaho n‟inzego zibifitiye ububasha. 2° Uwahohotewe ukorera umushahara: uwahohotewe ukora akazi ahemberwa cyangwa umaze igihe kitarenze amezi atandatu (6) adakora. 3° Ubumuga ku kazi bw'igihe gito: guhagarika akazi by'igihe gito cyangwa by'igice bitewe n‟ihohoterwa yakorewe n‟inyamaswa. 4° Ubumuga buhoraho: igabanuka ry'ubushobozi bw'umubiri, ryo gutekereza no kumva cyangwa ry'ubwenge, riterwa no kumererwa nabi cyane k'umubiri w'uwahohotewe. Ubumuga butewe no guhohoterwa n‟inyamaswa bufatwa ko buhoraho uhereye ku itariki bwagaragariyeho bwemejwe n'abaganga bemewe na Leta. 5° Indishyi mbonezamusaruro: Indishyi zitangwa zijyanye n`umusaruro w`akazi umuntu yakoraga. UMUTWE WA II: UBURYO BWO GUTANGA INDISHYI Ingingo ya 3: Ibyangombwa bisabwa uwaka indishyi Uwahohotewe, uwangirijwe ibye n‟inyamaswa cyangwa uwo mu muryango we ubifitiye of movable and immovable property, etc. authorized by the competent authority. 2° Salaried victim: a victim carrying out a salaried job or who has spent less than six (6) months without a job. 3° Temporary disability: Temporary suspension of work or part time work due to injury caused by an animal. 4° Permanent disability: reduction of physical capacity, thinking and hearing abilities and of intelligence resulting from victims‟ severe physical injury. Disability resulting from injury caused by an animal shall be considered permanent from the date of its occurrence certified by an authorized medical doctor. 5° Compensation for pecuniary loss: Compensation to be calculated based on income from victim‟s former work. CHAPTER II: MODALITIES FOR AWARDING DAMAGES Article 3: Requirements to be fulfilled by the person requesting compensation The victim, a person whose property has been damaged by animals, or their authorized close sciences vétérinaires, en détermination de la valeur des biens meubles et immeubles, etc. et qui sont autorisées par des autorités compétentes. 2° Victime salariée : Victime exerçant une activité rémunérée ou en cessation d‟activité dans un délai ne dépassant pas six (6) mois. 3° Incapacité temporaire de travail : L‟arrêt temporaire ou partiel de travail issu des préjudices corporels causé par un animal. 4° Incapacité permanente : La réduction du potentiel physique, psychosensoriel ou intellectuel, résultant de l‟atteinte grave portée à l‟intégrité corporelle de la victime. L‟incapacité causée par un animal est considérée comme permanente à partir de la date de son apparution certifiée par un médecin agréé. 5° Indemnités pour préjudice économique : Les indemnités accordées et calculées sur base du revenu professionnel de la victime. CHAPITRE II : MODALITES D’INDEMNISATION Article 3: Pièces requises pour la demande d’indemnités La victime des préjudices corporels ou matériels causés par des animaux ou tout autre ayant droit Official Gazette nº 25 of 18/06/2012 9 uburenganzira ashyikiriza urwego rushinzwe gutanga indishyi inyandiko zikurikira: 1° 1º Ku wapfuye 2° a. a. Inyandiko za ngombwa : i) Ibaruwa isaba indishyi yandikiwe ubuyobozi bw‟urwego rushinzwe gutanga indishyi ; ii) Inyandiko-mvugo igaragaza uko inyamaswa yamuhohoteye ; iii) Inyandiko-mvugo y‟abatangabuhamya babajijwe n‟Ubuyobozi bw‟Akagari impanuka yabereyemo ; iv) Icyemezo cy‟uko yapfuye cyatanzwe na muganga wemewe na Leta ; v) Icyemezo cy‟uko yapfuye gitangwa n‟Umuyobozi ubifitiye ububasha ; vi) Icyemezo cy‟amavuko cy‟uwapfuye ; vii) Icyemezo cy‟imwirondoro wuzuye, cy‟uwapfuye ; viii) Icyemezo cy‟uko ariho ku bafite uburenganzira ku ndishyi ; ix) Icyemezo cy‟umwirondoro wuzuye ku bafite uburenganzira ku ndishyi ; relative shall submit the following documents to the compensation awarding department: 1° 1º For a deceased person a. a. Main documents: i) Letter resquesting for compensation addressed to the head of the compensation awarding department; ii) Statement explaining how the victim was attacked by an animal; iii) Statement of the testimonies made by witnesses interrogated by the authorities of the cell where the accident took place; iv) Death certificate issued by a Government authorized doctor; v) Death certificate issued by competent authority; vi) Birth certificate of the deceased; vii) Full identify certificate of the deceased; viii) Document certifying that the rightful beneficiary is still alive; ix) Full identity certificate for persons entitled to compensation; autorisé doit faire parvenir à l‟organe chargé de payer des indemnités, les documents suivants : 1° 1º Pour une personne morte 1° a. a. Principaux documents : i) La lettre de demande d‟indemnités adressée à la direction de l‟organe chargé de payer des indemnités ; ii) Le procès verbal relatant le déroulement de l‟attaque par l‟animal; iii) Les procès verbaux d‟audition des témoins entendus par les responsables de la Cellule de survenance de l‟accident ; iv) Le certificat de décès délivré par un médecin agrée par le Gouvernement ; v) Le certificat de décès délivré par une autorité de base compétente ; vi) L‟attestation de naissance de la personne défunte ; vii) L‟attestation d‟identité complète de la personne défunte ; viii) Les attestations de vie des ayants droit ; ix) Les attestations d‟identités complètes des ayants droit ; Official Gazette nº 25 of 18/06/2012 10 x) Icyemezo cy‟ubushyingiranwe ku washakanye na nyakwigendera ukiriho. b. b. Izindi nyandiko zisabwa i) Inyandiko zigaragaza amafaranga yo kwivuza, yo gushyirwa mu bitaro, yo kugura imiti, yo gutwarwa mu modoka itwara abarwayi, yo kongera kumenyereza umubiri, yo kugorora ingingo, y'ibyuma bikoreshwa, y'insimburangingo n'ay'ingendo zo kujya kwivuza ; ii) Icyemezo kigaragaza umushahara nyakwigendera yahembwaga cyangwa umwuga yakoraga iyo uzwi neza ; iii) Inyandiko y‟itangabubasha yemejwe n‟ubuyobozi bubifitiye ububasha mu gihe abasaba indishyi badashoboye kwikurikiranira dosiye. 1° 2º Ku wakomeretse i) Ibaruwa isaba indishyi yandikiwe ubuyobozi bw‟urwego rushinzwe gutanga indishyi, ii) Inyandiko-mvugo igaragaza uko inyamaswa yamuhohoteye ; iii) Inyandiko-mvugo y‟abatangabuhamya babajijwe n‟Ubuyobozi bw‟Akagari impanuka yabereyemo ; x) Marriage certificate of the spouse of the deceased that survived the latter. b. b. Other documents i) Invoices for medical treatment, hospitalization, purchase of drugs, transportation in ambulance, physiotherapy, rehabilitation, appliances used, prostheses and transport to hospital to seek medical treatment; ii) Salary certificate of the deceased person or his\her former profession, where it is well known; iii) Power of attorney approved by competent authorities where the persons requesting for compensation cannot personally follow up their case. 1° 2º For the injured person i) Letter resquesting for compensation addressed to the head of the compensation awarding department; ii) Statement explaining how the victim was attacked by an animal ; iii) Statement of the testimonies made by witnesses interrogated by the authorities of the Cell where the accident took place; x) L‟attestation de mariage du veuf survivant de la victime défunte. b. b. Article 4: Statement explaining how an animal injured or damaged somebody’s property The statement explaining how an animal injured or damaged somebody‟s property shall be prepared by the members of the Committee provided for in Article 5 of this Order. Article 6: Procedure followed by a victim Any damages caused by the wild animals must be reported to the Executive Secretary of the Sector where the accident took place within a period not exceding seven (7) days, the receptioin of the notification shall be an element of evidence if considered necessary. If considered necessary, Prime Minister instructions may determine another place where damages can be reported. That committee meets atleast when the 3/5 are present. The expert immediately makes the report that shows the damaged property and its value, that report shall be annexed on the statement. The said report shall be submitted to the Sector authority within three (3) working days from their visit to the place of the event, the victim must get the report free of charge, and the victim shall submit the report to the compensation authority before expiration of the duration stipulated by law. The compasation authority shall conclude an agreement with different hospitals for the victims to get quick and unconditional treatment. Article 7: Medical certificate The victim or his\her legally authorized representative shall submit to the compensation awarding department a medical certificate issued by his/her doctor explaining in details the injuries sustained and how that person is treated or shall be treated. Article 7: Certificat médical La victime blessée ou son mandataire doit faire parvenir à l‟organe chargé de payer des indemnités, une expertise de son médecin traitant détaillant l‟état des blessures ainsi que le cadre actuel ou futur de son traitement. Ce certificat doit bien préciser la date de réception de la victime par l‟hôpital, celle de son hospitalisation ainsi que la durée de son incapacité temporaire. Article 8: Examination of medical certificate Upon receiving the certificate mentioned in the preceding Article, the compensation awarding department may call upon another doctor to examine that certificate, and even re-examine that person, where necessary. That doctor may seek assistance from other doctors. The results of the new medical report must be notified to the person who requested for compensation in a period not exceeding thirty (30) days since the date on which the compensating awarding department was notified of the decision. The victim is required to give his\her opinion on that medical report in a period not exceeding thirty (30) days, or he\she shall be considered to have agreed with the contents of that report. La victime de l‟accident doit notifier sa position sur ce rapport du médecin de l‟organe chargé de payer des indemnités, à défaut de quoi son accord est considéré comme marqué après trente (30) jours. Article 10: Challenging a medical report The medical report may be challenged before competent courts where doctors have: 1° overstepped their powers or capacity; 2° omitted to answer some asked questions 3° filed a report that is incomplete or in an improper manner; 4° submitted a report with contradictory recommendations 5° Violated basic principles, criminal laws or safety regulations. Persons entitled to compensastion shall express their opinion on proposed payment modalities in a period not exceeding thirty (30) days, beyond that period, they shall be deemed to have accepted them. Dans les trente jours (30) à dater de la réception de la proposition faite par l‟organe chargé de payer des indemnités, les ayants droit font connaître de manière expresse leur position quant à ce projet. Passé ce délai, en cas d‟absence de prise de position, l‟accord des ayants droit est présumé. En cas d‟accord des parties sur un règlement des indemnités, ces parties sont irrévocablement liées par ledit règlement. CHAPTER III: MODALITIES FOR CALCULATING THE COMPENSATION AND OTHER INDEMNITIES FOR THE DECEASED PERSON Article 13: Amount of money to be refunded Where a person has died as a result of attack by an animal, the persons requesting for compensation shall be reimbursed all the money spent where the deceased person had been taken to hospital before death, and any proven charges for transportation of the corpse. They are also given funeral fees equal to government employees. As for transport fees, they shall recover the money spent once to follow up their case and transport fees paid on the day their compensation is awarded, based on transport rates applicable in the country. Article 14: Compensation for pecuniary loss Compensation for pecuniary loss shall only be awarded in case of death of a person with the majority age for remunerated or income-generating employment, married or has legitimate dependants. CHAPITRE III : MODALITES DE CALCUL DES INDEMNITES ET AUTRES FRAIS CONSECUTIFS AU DECES D’UNE PERSONNE Article 13: Frais à restituer En cas de décès de la victime suite à l‟attaque par un animal, les ayants droit récupèrent de l‟organe chargé de payer des indemnités, des frais engagés pour tenter de faire soigner le défunt, majorés de frais de transport du cadavre sur présentation des pièces justificatives. Ils bénéficient également des frais funéraires équivalents à ceux alloués pour un agent de l‟Etat décédé. L‟organe chargé de payer des indemnités rembourse aussi les frais de transport engagés pour le premier suivi du dossier ainsi que ceux engagés pour venir toucher effectivement ces indemnités et ce conformément aux taux public en vigueur au pays. Compensation for pecuniary loss shall be calculated as follows: Net annual income x number of years before retirement x 2/3 Compensation= 1+ (savings rate x number of years before retirement) In any case, compensation for pecuniary loss cannot exceed eighty (80) times the minimum annual salary for an unemployed person. Article 15: Net annual income For a business person, the alleged income of the victim shall be conformed to documents submitted to the revenues services. For a remunerated person, the alleged income shall be conformed to documents submitted to the social security services. For a person who can not prove his/her income in a justifiable way as mentioned above or who had no remunerated employment, he/she shall be awarded 1,000 RwF per day times twenty five (25) working days in a month. This amount may be modified by Prime Minister Order. Les indemnités pour préjudice économique sont calculées selon la formule suivante : Revenus annuels nets de la victime x nombre d‟années de survie lucrative x 2/3 Compensation: 1 + (taux de placement x nombre d‟années de survie lucrative Dans tous les cas, cette indemnisation ne pourra excéder au total, quatre vingt (80) fois le salaire minimum garanti annuellement pour une personne sans travail rémunéré. Article 15 : Revenu annuel net Pour une personne menant ses propres affaires, le revenu de la victime est justifié par les documents présentés au service des impôts. Pour une personne ayant un travail rémunéré, le revenu doit être conforme aux documents présentés au service de la sécurité sociale. Pour une personne ne pouvant pas justifier son revenu de la manière présentée ci-haut ou n‟ayant pas un travail rémunéré, elle a droit à 1000 Frw par jour pour les vingt cinq (25) jours du mois. Le montant de ces frais peut être modifié par voie d‟arrêté du Premier Ministre. Article 16: Compensation for moral damage This kind of compensation is awarded to the following people at the following rates: 1° Spouse: 1 x annual compensation allocated to the person who had no remunerated employment; 2° His\Her parents: 0.75x annual compensation allocated to the person who had no remunerated employment; 3° Wedrock or legitimate children: 0.75 x annual compensation allocated to the person who had no remunerated employment; 4° Siblings: 0.5 x annual compensation allocated to the person who had no remunerated employment. CHAPTER IV: MODALITIES FOR AWARDING COMPENSATION TO AN INJURED PERSON Article 17: Amount of money to be refunded In case of an injured person, he/she shall recover all the money spent for medical treatment, admission to hospital, transport to hospital and, for the purchase of drugs, appliances, physiotherapy and prosthesis, and for transportation in ambulance and all transportation related cost, after accounting for all the spending. Article 16: Indemnités pour préjudice moral Ces indemnités ne sont allouées qu‟aux personnes limitativement désignées ci – dessous et dans les limites prévues par le présent Arrêté : 1° Conjoint : 1 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré; 2° Parents : 0.75 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré; 3° Enfant légitime ou reconnu : 0.75 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré; 4° Frères et sœurs : 0.5 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré. CHAPITRE IV : MODALITES DE CALCUL DES INDEMNITES ET AUTRES FRAIS POUR UNE PERSONNE BLESSEE Article 17: Frais à restituer La victime des blessures par un animal récupère tous les frais engagés en soins médicaux, ceux déboursés pour achat des médicaments ou pour acquisition du matériel médical, pour la kinésitherapie et les prothèses, les frais engagés sur l‟ambulance, mais sur présentation des pièces justificatives. Ingingo ya 19: Indishyi mbonezamusaruro ku bumuga bw’igihe gito Igihe hatabayeho itakaza ry‟umushahara, ry‟igihembo cy‟akazi cyangwa ry‟umusaruro ukomoka ku murimo nta ndishyi zitangwa. Itakazwa ry‟umushahara rishyirwaho n‟icyemezo cy‟umukoresha kijyanye n‟impapuro zibimenyesha isanduku y‟ubwiteganyirize bw‟abakozi ku bahohotewe bahembwaga In case of medical treatment performed outside the country, the injured person shall be referred only after the doctor appointed by the compensation awarding department and the medical committee made up of a team of medical doctors appointed by Government to approve referrals outside Rwanda have approved the referral. With regards to transport cost, they shall recover the money spent once to follow up their case with the Fund and transport fees paid on the day their compensation is awarded, based on public transport rates applicable in the country. Article 18: Compensation for pecuniary loss This kind of compensation shall only be awarded to people who have reached the legal age for carrying out a salaried job or an income generating activity. Article 19: Compensation for pecuniary loss in case temporary disability In case of no loss of salary, working allowance or income from employment, no compensation shall be awarded. Loss of salary shall be confirmed by employer‟s certificate together with documents notifying the Social Security Fund of the accident for remunerated victims. Article 18: Indemnités pour préjudice économique L‟indemnisation du préjudice économique se fait exclusivement en faveur des personnes ayant atteint l‟âge légal d‟exercer des activités rémunérées ou productives de revenus. Article 19: Indemnités pour préjudice économique suite à une incapacité temporaire Aucune indemnisation ne sera due s‟il n‟ya pas eu réellement perte partielle ou totale de salaire, traitement ou revenus professionnels. Pour le cas des élèves et des étudiants, s‟il est médicalement établi que l‟accident a eu pour conséquence la perte d‟une année d‟études, il sera alloué une indemnité égale à : 1° 0.5 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré pour les élèves des écoles primaires ; 2° 1 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré pour les élèves des écoles secondaires ; 3° 2 x indemnité annuelle allouée à une personne n‟ayant pas un travail remuneré pour les étudiants des instituts supérieurs et universités. Article 21: Compensation for pecuniary loss due to permanent disability exceeding 30% In case of permanent disability exceeding 30%, compensation for pecuniary loss shall be awarded according to annual net income, age and disability level. Annual income is equal to: 1° Net remuneration for people with a remunerated employment; 2° Latest remuneration for a person who has been unemployed for a period not exceeding six (6) months ; 3° the basic income for a business person victim shall conform to the declaration documents presented to revenue services; 4° An amount of one thousand rwandan francs (1,000) Rwf per day multiplied by 4° 4 pour une victime âgée de 35 à 39 ans ; 5° 3 pour une victime âgée de 40 ou plus. Ingingo ya 22: Indishyi ku ibangamira riterekeye umutungo Izo ndishyi zitangwa hakurikijwe ikigereranyo cy‟inzego enye: 1° Urwego rwa mbere: ubumuga buhoraho kuva kuri 0 kugera kuri 20%; 2° Urwego rwa kabiri: ubumuga buhoraho kuva kuri 21 kugera kuri 40%; 3° Urwego rwa gatatu: ubumuga buhoraho twenty five (25) working days of a month for a person not able to prove his/her income. Damages shall be calculated as follows: 1º Compensation for body injuries: a) First category: 10 % of annual compensation allocated to the person who had no remunerated employment b) 2 nd category: 40 % of annual compensation allocated to the person who had no remunerated employment; c) 3 rd category: 60 % of annual compensation allocated to the person who had no remunerated employment; d) 4th category: 100 % of annual compensation allocated to the person who had no remunerated employment. 1° 2 º For physical damages a) First category: 10 % of annual compensation allocated to the person who had no remunerated employment; b) 2 nd category: 20 % annual compensation allocated to the person who had no remunerated employment; c) 3 rd category: 40 % of annual compensation de 41 à 75% ; 4° 4 ème catégorie : Incapacité permanente supérieure à 75%. Ces documents doivent être remis à l‟organe chargé de payer des indemnités pour règlement des dommages, après examen du dossier conformément à l‟article 11 du présent arrêté. Article 28: Authorities responsible for the implementation of this Order The Minister of Trade and Industry, the Minister of Finance and Economic Planning and the Minister of Local Government are entrusted with the implementation of this Order. Article 29: Repealing provision All prior provisions contrary to this Order are hereby repealed. Article 30: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
