HEREBY ORDERS: CHAPTER ONE: GENERAL PROVISIONS Article One : Purpose of this Order This Order determines the models of land consolidation and its productivity. Article 2: Definition In this order, the following terms shall be defined as follows: 1° Land consolidation is the unification of land parcels with an estimated easier and productive farming than the fragmented plots. 2° Facilitated contract farming is an agreement concluded among a group of farmers to cultivate one or various types of crops, and where there are contractual relationships between those farmers and one or more buyers of all or part of their agricultural production. ARRETE: CHAPITRE PREMIER: DISIPOSITIONS GENERALES Article premier: Objet du présent arrêté Le présent arrêté détermine les modalités de remembrement et d’exploitation des propriétés foncières. Article 2: Définition Aux fins du présent arrêté, les termes ci-après ont les significations suivantes : 1° Remembrement des propriétés foncières signifie l’unification des propriétés foncières dont on estime l’exploitation plus aisée et productive que celle des parcelles morcelées. 2° Contrat d’exploitation agricole facilité signifie une convention par laquelle un groupe d’agriculteurs se conviennent de cultiver une ou un nombre limité de cultures, et où il existe des relations contractuelles entre ces cultivateurs et un ou plusieurs acheteurs de toute ou partie de leur production agricole. Minisiteri ifite ubuhinzi mu nshingano zayo itera inkunga zishoboka ibikorwa byo guhuza amasambu hagamijwe kuyakoresha neza no kuyabyaza umusaruro utubutse. 3° Farming corporation is a legal company of landowners; each owing shares with the value of his/her land and/or other form of capital contributed to the company. CHAPTER II: OBJECTIVES AND MODELS OF LAND CONSOLIDATION Section One: Objectives Article 3: Rural Development and agricultural reforms Land consolidation aims at rural development and promoting agricultural transformation that increases agricultural production and improves the lives of Rwanda’s people in rural areas. The Ministry in charge of agriculture shall facilitate the consolidation of agricultural land with an intention of promoting its effective use and to ensure optimum productivity. 3° Entreprise d’exploitation agricole signifie une entreprise légale des propriétaires fonciers, chacun d’eux possédant des actions ayant la valeur de la propriété foncière et/ou autre forme de capital apporté en contribution à l’entreprise. CHAPITRE II: OBJECTIFS ET MODELES DE REMEMBREMENT DES PROPRIETES FONCIERES Section premier : Objectifs Article 3: Développement rural et transformation de l'agriculture Le remembrement des propriétés foncières vise le développement rural et la transformation de l'agriculture pour l’augmentation de la production agricole et l’amélioration des conditions de vie des populations rurales. Le Ministère ayant l'agriculture dans ses attributions facilite le remembrement des propriétés foncières aux fins d'améliorer leur gestion et leur productivité. Official Gazette n0 52 of 27/12/2010 21 Ingingo ya 4 : Guhitamo uburyo bwo guhuza amasambu Guhitamo uburyo bw’umushinga wo guhuza amasambu hagamijwe kuyakoresha neza no kuyabyaza umusaruro buberanye na buri karere bikorewemo, bituruka ku mikoranire hagati Minisiteri ifite ubuhinzi mu nshingano zayo, ba nyir’ubutaka, ababukodesha n’abandi bafatanyabikorwa bafite aho bahuriye n’ibikorwa by’ubuhinzi. Icyiciro cya 2: Uburyo bwo guhuza amasambu Ingingo ya 5: Uburyo rusange bwo guhuza amasambu Uburyo rusange bwo guhuza amasambu hagamijwe kubukoresha neza no kububyaza umusaruro utubutse n’ubu butatu (3) bukurikira: 1° Amasezerano yo kubyaza amasambu umusaruro w’ubuhinzi agobokamo ubwunganizi; 2° Koperative yo kubyaza ubutaka umusaruro w’ubuhinzi; 3° Sosiyete yo kubyaza ubutaka umusaruro w’ubuhinzi. Article 4: Selection of the model of land consolidation Selection of an appropriate land consolidation model project with intention of promoting its effective use and to ensure optimum productivity relevant to each particular location shall be a result of collaboration between the Ministry in charge of agriculture, land owners, land tenants and other stakeholders concerned with the identified local farming areas. Section 2: Land Consolidation Models Article 5: General land Consolidation Models General models of land consolidation for its farming and productivity are of the following three (3) kinds: 1° facilitated farming contract; 2° Cooperative farming; Article 4: Choix d’un modèle de démembrement des propriétés foncières Le choix d’un modèle qui convient à la mise en œuvre des projets de remembrement des propriétés foncières adéquat pour chaque zone donnée est le résultat de la collaboration entre le Ministère ayant l'agriculture dans ses attributions, les propriétaires ou locataires fonciers et d'autres parties prenantes concernées par les activités agricoles locales. Section 2: Modèles de remembrement des propriétés foncières Article 5: Modèles courants de remembrement des propriétés foncières Les modèles courants de remembrement des propriétés foncières aux fins de leurs exploitation et productivité sont de trois (3) sortes suivantes: 1° Contrat d’exploitation agricole facilité; 2° Coopérative d’exploitation agricole; 3° Entreprise d’exploitation agricole. Official Gazette n0 52 of 27/12/2010 22 Ingingo ya 6: Amasezerano yo kubyaza amasambu umusaruro w’ubuhinzi Ingingo zigize amasezerano yo kubyaza umusambu umusaruro w’ubuhinzi zumvikanwaho hagati y’abahinzi n’umuguzi. Minisiteri ifite ubuhinzi mu nshingano zayo ishobora kubigiramo ubwunganizi bugamije kubafasha no kubumvikanisha. Buri muhinzi agumana uburenganzira bwe bwose ku butaka bwe. Ingingo ya 7 : Kunganira ba nyir’amasambu n’ abayakodesha Minisiteri ifite ubuhinzi mu nshingano zayo yunganira ba nyir’ubutaka cyangwa ababukodesha mu bikurikira: 1° kubafasha gusobanukirwa ku buryo bukwiye icyo guhingira amasoko ari cyo no kubyinjiramo koko; 2° ibyo guhitamo ibihingwa biboneye; 3° ibyo kugena ibiciro; 4° kubarebera uko bagezwaho inyongeramusaruro, 5° inguzanyo; 6° serivisi z’iyamamazabuhinzi; 7° ubufasha bakeneye kugira ngo babonere 3° Farming corporation. Article 6: Farming contract The terms of the farming contract shall be negotiated between farmers and the buyer. The Ministry in charge of agriculture may facilitate in the negotiations to ensure that both parties come to an agreement. Any individual farmer shall retain all the reserved rights on his/her plot. Article 7: Assistance to landowners and land tenants The Ministry in charge of agriculture shall provide assistance to local land owners and land tenants in the following areas: 1° understanding and participating in market-based agriculture; 2° crop selection; 3° determination of prices; 4° provision of inputs; Article 6: Contrat d’exploitation agricole Les termes du contrat d’exploitation agricole facilité sont négociés entre les agriculteurs et l'acheteur. Le Ministère ayant l’agriculture dans ses attributions peut faciliter cette négociation. Les agriculteurs gardent leurs droits de propriété sur des parcelles individuelles. Article 7: Assistance aux propriétaires et locataires fonciers Le Ministère ayant l’agriculture dans ses attributions assiste les propriétaires et locataires fonciers dans des domaines suivants: 1° la compréhension et la participation dans l’agriculture à vocation commercial; 2° la sélection des cultures adéquates, 3° la fixation des prix; 4° l’approvisionnement en intrants, 5° le credit; 6° les services de vulgarisation de l’agriculture; 7° la facilitation de la vente de la Official Gazette n0 52 of 27/12/2010 23 isoko umusaruro wabo. Ingingo ya 8: Kwishyura inyongeramusaruro Umuhinzi ashobora kwishyura inyongeramusaruro akizihabwa cyangwa amaze gusarura, yitabaje amafaranga akomotse ku musaruro agurishije. Ingingo ya 9: Kubyaza amasambu umusaruro w’ubuhinzi bikorewe muri koperative Koperative yo kubyaza ubutaka umusaruro w’ubuhinzi ijyaho hakurikijwe Itegeko rigena amakoperative mu Rwanda, Minisiteri ifite ubuhinzi mu nshingano zayo yorohereza ishyirwaho ry’amakoperative yo kubyaza amasambu umusaruro w’ubuhinzi, haba: 1° mu rwego rwo kuzishyiraho; kuzorohereza mu kugirana umubano n’ubutwererane n’izindi koperative ku rwego rw’Igihugu, urw’akarere u Rwanda rurimo no ku rwego mpuzamahanga; 2° mu kuzigira inama zizifasha guhitamo ibihingwa, kuzigezaho inyongeramusaruro nk’imbuto n’ifumbire; 3° serivisi z’iyamamazabuhinzi; 5° loans; 6° agricultural sensitization services; 7° facilitation of the sale of the crops to buyers. Article 8: Payment for the inputs The farmer may pay for the inputs at the time of purchase or after harvest, using the proceeds of the sale of the crop. Article 9: Cooperative Farming Cooperative Farming shall be established in accordance with the Law on Cooperative Societies in Rwanda. The Ministry in charge of agriculture shall facilitate the establishment of cooperative farming, including: 1° their establishment; facilitating relationship and exchanges with other cooperatives at national, regional and international levels; production agricole. Article 8: Paiement des intrants L'agriculteur peut payer les intrants au moment de leur achat ou après la récolte, à l'aide du produit de la vente de la récolte. Article 9: Exploitation agricole en coopérative La coopérative d’exploitation agricole est créée conformément à la loi sur les sociétés coopératives au Rwanda. Le Ministère ayant l’agriculture dans ses attributions facilite la création et le fonctionnement des coopératives d’exploitation agricole, notamment : 1° en leur apportant l’aide à la création, l’entretien de leurs relations avec d’autres coopératives au niveau national, régional et international; 2° par des conseils sur le choix des cultures, la fourniture d’intrants tels que semences et engrais ; 3° par des services de vulgarisation de l’agriculture ; Official Gazette n0 52 of 27/12/2010 24 4° mu kuzorohereza kugurisha umusaruro wazo; 5° mu kuzitera inkunga mu gutunganya umusaruro wazo, kuwugeza ku masoko, no kugirana amasezerano y’ubucuruzi n’abashoramari. Ingingo ya 10: Kubyaza amamsambu umusaruro w’ubuhinzi muri sosiyete Sosiyete yo kubyaza ubutaka umusaruro w’ubuhinzi ishyirwaho mu buryo bwubahirije amategeko yose ariho yerekeye amasosiyete n’ibigo bifite ubuzimagatozi. Abashoramari bashobora gushyira muri Sosiyete yo kubyaza ubutaka umusaruro w’ubuhinzi imigabane y’amafaranga, bityo abahinzi n’abanyemari, bose bagahurira kuri sosiyete mu buryo bumwe ku bw’iyo migabane yabo, cyangwa se abahinzi bakigirira sosiyete ishingiye ku butaka bwabo, noneho abanyemari, ku ruhande rwabo, bakagira indi sosiyete yabo itunganya umusaruro, iwucuruza, cyangwa se iy’ubwikorezi, cyangwa itanga izindi serivisi. Icyo gihe rero abahinzi n’abanyemari, bose baba ari abafatanyabikorwa bahuriye ku masezerano y’imikorere yabo. 2° advising on crop selection, providing inputs such as seeds and fertilizers; 3° agricultural sensitization services; 4° facilitating in selling of their products; 5° providing support in processing, distribution and marketing of their products and in concluding commercial agreements with investors. Article 10: Farming corporation A farming corporation shall be established in conformity with all applicable laws relating to corporations and entities with legal personality. Investors may contribute cash to the farming corporation as shares such that the farmers and investors own shares in a single corporation; or farmers can own a corporation based on their land, while investors on the other hand may own a separate corporation that provides processing, marketing, transportation or other services. 4° par l'achat de la production par les operateurs commerciaux; 5° par la transformation, la distribution et la conclusion des accords de commercialisation avec des investisseurs commerciaux. Article 10: Exploitation Agricole en entreprise L’établissement d’une entreprise agricole se fait conformément à toutes les lois relatives aux sociétés et aux personnes morales. L’entreprise agricole peut impliquer des actions en espèces versées par des investisseurs privés de telle sorte que les investisseurs et les agriculteurs possèdent au même titre des actions dans une seule et même entreprise, ou alors les agriculteurs sont propriétaires d'une entreprise qui se compose des parcelles comme actions, tandis que les investisseurs possèdent une entreprise distincte qui assure la transformation, la commercialisation, le transport ou d'autres services. Dans de tels cas, les agriculteurs et les investisseurs interviennent comme parties prenantes d’un accord portant sur le Official Gazette n0 52 of 27/12/2010 25 Ingingo ya 11: Gutanga ubutaka cyangwa gukora umurimo bifatwa nk’umugabane mu i sosiyete Muri sosiyete yo kubyaza amasambu umusaruro w’ubuhinzi, ba nyir’ubutaka babuha sosiyete, agaciro kabwo kagafatwa nk’umugabane wemewe mu mutungo fatizo wa sosiyete. Bamwe mu bagize sosiyete, cyangwa se bose bashobora gukorera iyo sosiyete mu mirimo y’ubuhinzi, noneho bakayibonera igihembo kingana n’umurimo buri wese yakoze. Inyungu sosiyete yagezeho igabanwa n’abanyamuryango hakurikijwe umugabane buri munyamuryango yashyize mu mari shingiro. Ingingo ya 12: Kunganira amasosiyete y’ubuhinzi Minisiteri ifite ubuhunzi mu nshingano zayo itanga ubwunganizi bwayo mu rwego rwo korohereza ishyirwaho n’imikorere bya za Sosiyete zo kubyaza amasambu umusaruro w’ubuhinzi, nko: 1° kuzishyiraho no kuzishakira ubuzima gatozi, In such cases, farmers and investors shall be stakeholders who jointly enter into an operation agreement. Article 11: Exchange of land or provision of Labour as a share in the corporation In a farming corporation, land owners give land to the corporation, and the value of the land shall be considered as a share in the corporation’s capital. Certain members of the corporation or all may also provide labour in the corporation agricultural activities for a wage equivalent to the labour each provides. Proceeds and profits acquired by the corporation shall be shared among the members in proportion to the share contributed to the capital by each member. Article 12: Assistance to farming corporation The Ministry in charge of agriculture shall fonctionnement. Article 11: Terres ou travaux considérés comme des actions dans l’entreprise Dans une entreprise d’exploitation agricole, les agriculteurs échangent leurs terres contre des actions dans l’entreprise légale. Certains ou tous les propriétaires de la société peuvent travailler comme ouvriers agricoles dans l’exploitation de l’entreprise agricole, contre rémunération sous forme de salaire équivalant au travail effectué. Les profits réalisés par l’entreprise sont partagés dans les proportions des montants apportés en capital par chaque membre. Article 12: Assistance aux entreprises agricoles Le Ministère ayant l’agriculture dans ses attributions facilite la création et le fonctionnement des entreprises agricoles, notamment : 1° par l'aide à leur création et à la recherche de leur personnalité juridique ; Official Gazette n0 52 of 27/12/2010 26 2° kuzungura inama zifasha guhitamo ibihingwa; 3° kugeza ku bahinzi inyongeramusaruro nk’imbuto n’ifumbire; 4° gutanga serivisi z’iyamamazabuhinzi; 5° gutanga ubufasha bugamije koroshya igurisha ry’umusaruro, 6° gutunganya umusaruro, kuwugeza ku masoko, no kugirana amasezerano y’ubucuruzi n’abashoramari. Ingingo ya 13: Ubundi bwo guhuza amasambu Minisiteri ifite ubuhinzi mu nshingano zayo, ba nyir’ubutaka, ababukodesha n’abandi bafatanyabikorwa bashobora kugena no kwemeza ubundi buryo bwakoreshwa mu guhuza amasambu ngo abyazwe umusaruro. Article 13: Other models of land consolidation The Ministry in charge of agriculture, land owners, land tenants and other stakeholders may determine and approve other models of land consolidation and its productivity. Ces descriptions et procédures doivent être adaptées pour se conformer aux réalités locales et aux besoins, ainsi qu’aux procédures de l'administration des biens fonciers par l’administration locale.
