MINISTERIAL ORDER N°004/11.30 OF 18/08/2010 DETERMING PRICES FOR SERVICES RENDERED IN SEED QUALITY CONTROL The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003 as amended to date, especially in Articles 93, 120 and 201; Pursuant to Law n° 14/2003 of 23/05/2003 on Production, Quality Control and Marketing of plant quality seeds, especially Articles 10 and 12; After consideration and approval by the Cabinet in its session of 14/05/2010; HEREBY ORDERS: Article One: Purpose of this Order This Order determines prices for services rendered in seed quality control. Article 2: Person who is responsible to pay inspection and certification costs for produced and marketed seeds Inspection and certification costs for produced and marketed seeds shall be covered by the beneficiary. ARRETE MINISTERIEL N°004/11.30 DU 18/08/2010 FIXANT LES FRAIS A PAYER POUR LES SERVICES RELATIFS AU CONTRÔLE DES SEMENCES Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda du 04 juin 2003 telle que révisée à ce jour, spécialement en ses Articles 93, 120 et 201; Vu la Loi n° 14/2003 du 23/05/2003 portant sur la Production, le Contrôle de qualité et la Commercialisation des semences végétales, spécialement en ses articles 10 et 12; Après examen et adoption par le Conseil des Ministres, en sa séance du 14/05/2010; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté fixe les frais à payer pour les services relatifs au contrôle des semences. Article 2: Personne à qui revient la charge des frais de contrôle et de certification des semences produites et commercialisées Les frais de contrôle et de la certification des semences produites et commercialisées sont à la charge du bénéficiaire. Official Gazette nº40 of 04/10/2010 20 Ingingo ya 3: Amafaranga y’icyitegererezo Mu rwego rwo guteza imbere ituburwa n’icuruzwa by’imbuto nziza, no mu gihe hagitegerejwe ko abatubuzi n’abacuruzi b’imbuto babigira umwuga, hazatangwa amafaranga make y’icyitegererezo ku mirimo yakozwe. Ingingo ya 4: Amafaranga yishyurwa n’usaba kwemerwa kuba umutubuzi Umuntu wese usaba kwemererwa kuba umutubuzi w’imbuto nziza yishyura amafaranga y’u Rwanda magana atanu (500 Frw), atangwa mu gihe cyo kubisaba. Ingingo ya 5: Amafaranga yishyurwa n’usaba kwemererwa kuba umucuruzi w’imbuto Usaba kwemererwa kuba umucuruzi w’imbuto nziza yishyura amafaranga y’u Rwanda igihumbi (1000 Frw) atangwa mu gihe cyo kubisaba. Ingingo ya 6: Amafaranga yishyurwa ku igenzura ry’imirima y’imbuto Imirimo yo kugenzura imirima ituburirwamo imbuto nziza yishyurwa amafaranga y’u Rwanda igihumbi (1000 Frw) kuri buri hegitari. Ayo mafaranga atangwa mu gihe cyo kumenyekanisha ibihingwa. Article 3: Symbolic cost In order to promote quality seed production and marketing, and while waiting that quality seed producers and trader acquire reasonable experience, a symbolic cost will be applied for services rendered. Article 4: Amount paid when applying to be a quality seed grower Any person who applies for being a quality seed grower shall pay five hundred Rwandan francs (500 Rwf) at the time of application. Article 5: Amount paid when applying for being a trader in quality seeds Any person who applies for being a trader of quality seeds shall pay one thousand Rwandan francs (1,000 Rwf) at the time of application. Article 6: Field inspection cost for quality seed production Inspection cost for quality seed production in the field shall be one thousand Rwandan francs (1,000 Rwf) per hectare. The amount shall be paid at the time of declaring the crops to be produced. Article 3: Prix symbolique En vue de promouvoir la production et la commercialisation des semences de qualité et en attendant que les producteurs et les vendeurs des semences acquièrent une expérience suffisante, le prix de services est symbolique. Article 4: Frais de demande d’agrément en qualité de producteur des semences Toute personne demandant à être agréée comme producteur des semences de qualité doit payer cinq cent francs rwandais (500 Frw) au moment d’introduction de sa demande. Article 5: Frais de demande d’agrément en qualité de commerçant des semences Toute personne demandant à être agréée comme commerçant des semences de qualité doit payer mille francs rwandais (1000 Frw) au moment d’introduction de sa demande. Article 6: Frais de contrôle des champs de production des semences Les frais de contrôle des champs de production des semences de qualité s’élèvent à mille francs rwandais (1000 Frw) par hectare. Ces frais sont payés au moment de la déclaration des cultures. Official Gazette nº40 of 04/10/2010 21 Ingingo ya 7: Amafaranga yishyurwa igihe cyo gufata ingero zijyanwa muri laboratwari Imirimo yo gufata ingero zipimwa muri laboratwari yishyurwa ifaranga rimwe ry’u Rwanda (1 Frw) ku kiro cy’umusaruro atangwa igihe umugenzuzi afata ingero zipimwa. Iyo ari imbuto y’ibirayi ifatwaho ingero zipimwa hishyurwa amafaranga magana atanu y’u Rwanda (500 Frw) ku rugero rupimwa akishyurwa mu gihe cyo gufata ingero zipimwa. Ingingo ya 8: Amafaranga yishyurwa ku mbuto zisuzumwe muri laboratwari Imirimo yo gusuzuma ubwiza bw’imbuto muri laboratwari yishyurwa amafaranga y’u Rwanda ibihumbi bibiri (2000 Frw) ku rugero atangwa mu gihe cyo gutanga ingero muri laboratwari. Iyo ari imbuto y’ibirayi ikorerwa isuzuma mu mangazini hishyurwa amafaranga magana atanu y’u Rwanda (500 Frw) kuri toni isuzumwe akishyurwa mu gihe cyo gukora isuzuma mu mangazini. Ingingo ya 9: Amafaranga yishyurwa igihe cyo gushyira ibyemezo ku bipfunyika by’imbuto Imirimo yo gushyira ibyemezo by’ubwiza ku bipfunyika bibitse imbuto yishyurwa amafaranga magana abiri (200 Frw) kuri buri gipfunyika cy’ibiro mirongo itanu. Ku bipfunyika bitoya by’ibiro cumi (10), bitanu (5), Article 7: Payment for sampling of quality seeds Seed sampling cost shall be one Rwandan franc (1 Rwf) per kilogram of the produce to be paid at the time of taking the sample. For Irish potato seeds, sampling fees shall be five hundred Rwandan francs (500 Rwf) per sample and it shall be paid at the time of sampling. Article 8: Payment for laboratory seed testing Payment for services for laboratory seed control shall paid at the rate of two thousand Rwandan francs (2000 Rwf) per sample. The amount shall be paid at the time of submitting the sample to the laboratory. For Irish potato seeds, quality control in the store, there shall be paid five hundred (500 Rwf) Rwandan francs for each metric ton of seeds inspected, payable at the time of inspection. Article 9: Payment for affixing quality certificates on seed bags Affixing quality certificates on seed bags shall be paid at the rate of two hundred (200 Rwf) Rwandan francs per bag of fifty (50) kilograms. For small bags of ten (10), five (5), two (2) or one (1) kilogram, the cost shall be reduced to one Article 7: Frais d’échantillonnage des semences Les frais d’échantillonnage des semences s’élèvent à un franc rwandais (1 Frw) par kilogramme de la production payable au moment du prélèvement de l’échantillon. Pour les semences de pomme de terre, les frais d’échantillonnage s’élèvent à cinq cent francs rwandais (500 Frw) par échantillon payable au moment de l’échantillonnage. Article 8: Frais d’analyse des semences au laboratoire Les travaux d’analyse des semences au Laboratoire se paient à deux milles francs rwandais (2000 Frw) par échantillon soumis au laboratoire, payable au moment de soumettre l’échantillon au laboratoire. Pour les semences de pomme de terre, les frais de contrôle au magasin s’élèvent à cinq cent francs rwandais (500 Frw) par tonne payable au moment du contrôle. Article 9: Frais de travaux de fixation des certificats sur les emballages des semences Les travaux liés à la fixation des certificats sur les emballages des semences se paient à deux cent francs rwandais (200 Frw) par sac de cinquante kilogrammes. Pour les petits sacs de dix (10), cinq (5), deux (2) et un (1) kilogramme le prix est Official Gazette nº40 of 04/10/2010 22 bibiri (2) na kimwe (1), igiciro kiragabanyuka kigera ku ifaranga rimwe ry’u Rwanda (1 Frw) ku kiro kimwe, ayo mafaranga atangwa mu gihe ibyemezo bishyirwa ku bipfunyika. Ingingo ya 10: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranye na ryo zivanyweho. Ingingo ya 11: Igihe iri teka ritangirira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. Article 10: Repealing provision All prior provisions contrary to this Order are hereby repealed. Article 11: Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Article 11: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
