Ingingo ya 2: Ibirebwa n’iri teka Iri teka rireba ibi bikurikira: 1º ubwoko bwose bw’ibikoresho by’ubwikorezi bikoreshwa na moteri birimo amapikipiki, imodoka, ubwato n’imashini zikoresha ibikomoka kuri peterori nk’isoko y’ingufu; 2º ibikorwa byemewe ariko bitubahiriza amabwiriza y’ubuziranenge y’iyoherezwa mu kirere ry’imyuka ihumanya yemewe. CHAPTER ONE: GENERAL PROVISIONS Article One: Purpose of this Order This Order determines: 1° requirements relating to air pollutants emission; 2° administrative sanctions for violations of provisions of the law governing the preservation of air quality and prevention of air pollution in Rwanda. Article 2: Scope of application This Order applies to the following: 1º all types of motorised means of transport including motorcycles, motor vehicles, motorised boats and machines using petroleum products as a source of energy; 2º permitted activities which do not comply with permissible air pollutants emission standards. CHAPITRE PREMIER: DISPOSITIONS GENERALES Article premier: Objet du présent arrêté Le présent arrêté détermine: 1° les conditions relatives à l’émission de polluants atmosphériques; 2° les sanctions administratives pour les violations des dispositions de la loi régissant la préservation de la qualité de l’air et la prévention de la pollution atmosphérique au Rwanda. Article 2: Champ d’application Le présent arrêté s’applique à ce qui suit: 1º tous les types de moyens de transport motorisés, y compris les motocyclettes, les véhicules automoteurs, les bateaux motorisés et les machines utilisant des produits pétroliers comme source d’énergie; 2º activités autorisées mais qui ne sont pas conformes aux normes d’émission de polluants atmosphériques admissibles. Official Gazette no.39bis of 24/09/2018 30 UMUTWE WA II: IYUBAHIRIZWA RY’URUGERO NTARENGWA RW’IMYUKA IHUMANYA YOHEREZWA MU KIRERE Ingingo ya 3: Amabwiriza y’ubuziranenge akurikizwa Amabwiriza y’ubuziranenge akurikizwa n’urugero ntarengwa rw’imyuka ihumanya yoherezwa mu kirere hakoreshejwe ibikoresho by’ubwikorezi bikoreshwa na moteri n’imashini zikoresha ibikomoka kuri peterori ashyirwaho n’urwego rufite ubuzirange mu nshingano zarwo. Ingingo ya 4: Ibyo utunze cyangwa utwara ikinyabiziga gikoreshwa na moteri agomba kubahiriza Umuntu utunze cyangwa utwara ikinyabiziga gikoreshwa na moteri agomba gufata neza ikinyabiziga cye akurikije uburyo bwa tekiniki bwiza kugira ngo kitarenza urugero rwemewe rw’imyuka ihumanya cyohereza mu kirere. CHAPTER II: REQUIREMENTS FOR COMPLIANCE WITH POLLUTANTS EMISSION LIMITS Article 3: Applicable standards Applicable standards on pollutants emission limits applicable to motorised means of transport and machines using petroleum products are established by the organ in charge of standards. Article 4: Obligations of the owner or operator of a motor vehicle The owner or operator of a motor vehicle must maintain his or her motor vehicle in line with the best technical practices to keep it within the authorised air pollutants emission limit. CHAPITRE II: CONDITIONS DE RESPECT DES LIMITES D’EMISSION DE POLLUANTS Article 3: Normes applicables Les normes applicables sur les limites d’émission de polluants applicables aux moyens de transport motorisés et aux machines utilisant des produits pétroliers sont établies par l’organe ayant la normalisation dans ses attributions. Article 4: Obligations du propriétaire ou de l’opérateur d’un véhicule à moteur Le propriétaire ou l’opérateur d’un véhicule à moteur doit l’entretenir selon les meilleures pratiques techniques pour le maintenir dans les limites d’émission de polluants atmosphériques autorisées. Official Gazette no.39bis of 24/09/2018 31 Ingingo ya 5: Ibyo utunze cyangwa utwara imashini ikoresha ibikomoka kuri peterori agomba kubahiriza Umuntu utunze cyangwa utwara imashini ikoreshwa n’ibikomoka kuri peterori agomba kwita kuri moteri y’imashini ye no kuyifata neza akurikije uburyo bwa tekiniki bwiza kugira ngo itarenza urugero rwemewe rw’imyuka ihumanya yohereza mu kirere. Urwego rufite kurengera ibidukikije mu nshingano zarwo rukurikirana iyubahirizwa ry’ibivugwa mu gika cya mbere cy’iyi ngingo. Ingingo ya 6: Ibisabwa ku ipikipiki itumizwa mu mahanga Ipikipiki yose itumizwa mu mahanga izanywe mu Rwanda igomba kuba ari nshya. Icyakora, bitabangamiye ibiteganywa n’andi mategeko, urwego rufite kurengera ibidukikije mu nshingano zarwo rubisabwe, rushobora kwemera itumizwa ry’ipikipiki itari nshya, iyo yakorewe gukoreshwa mu bya siporo cyangwa gukoreshwa n’abantu bafite ubumuga. Article 5: Obligations of the owner or operator of a machine using petroleum products The owner or operator of a machine using petroleum products must service the machine and maintain it in line with the best technical practices to keep it within the authorised air pollutants emissions limits. The organ in charge of environment protection monitors the compliance with provisions of the Paragraph One of this Article. Article 6: Requirements for a motorcycle to be imported Every motorcycle imported in Rwanda must be brand new. However, without prejudice to provisions of other laws, the organ in charge of environment protection may, upon request, authorise importation of second hand motorcycle if it is designed for sports or for persons with disabilities. Article 5: Obligations du propriétaire ou de l’opérateur d’une machine utilisant des produits pétroliers Le propriétaire ou l’opérateur d’une machine utilisant des produits pétroliers doit l’entretenir et la maintenir selon les meilleures techniques pratiques pour la maintenir dans les limites d’émissions des polluants atmosphériques autorisées. L’organe ayant la protection de l’environnement dans ses attributions surveille la conformité aux dispositions de l’alinéa premier du présent arrêté. Article 6: Exigences pour une motocyclette à importer Toute motocyclette importée au Rwanda doit être neuve. Toutefois, sans préjudice des dispositions d’autres lois, l’organe ayant la protection de l’environnement dans ses attributions peut, sur demande, autoriser l’importation d’une motocyclette d’occasion conçue pour le sport ou pour les personnes handicapées. UMUTWE WA III: URUHUSHYA RWO KOHEREZA IMYUKA IHUMANYA MU KIRERE Ingingo ya 8: Inyandiko isaba uruhushya rwo kohereza imyuka ihumanya mu kirere Inyandiko isaba uruhushya rwo kohereza imyuka ihumanya mu kirere igaragaza ibi bikurikira: 1° umwirondoro w’usaba; 2° ibisobanuro ku gikorwa gihumanya ikirere mu magambo arambuye; 3° aho igikorwa gihumanya ikirere gisabirwa uruhushya kizakorerwa; No person is authorised to import two stroke motorcycle in Rwanda, except that designed for sports. Article 7: Inspection of motorised means of transport The authority in charge of motor vehicle inspection inspects all motorised means of transport with regard to air pollutants emission. CHAPTER III: AIR POLLUTANTS EMISSION PERMIT Article 8: Application for air pollutants emission permit The application of air pollutants emission permit specifies the following: 1° identification of the applicant; 2° description of the air pollutant activity; 3° location of the air pollutant activity where the application applies; Aucune personne n’est autorisée à importer une motocyclette à deux temps au Rwanda, sauf celle conçue pour le sport. Article 7: Inspection des moyens de transport motorisés L’autorité chargée de l’inspection des véhicules à moteur fait l’inspection de tous les moyens de transport motorisés en ce qui concerne l’émission de polluants atmosphériques. CHAPITRE III: PERMIS D’EMISSION DE POLLUANTS ATMOSPHERIQUES Article 8: Demande d’un permis d’émissions de polluants atmosphériques La demande d’un permis d’émission de polluants atmosphériques spécifie ce qui suit: 1° l’identification du demandeur; 2° la description de l’activité polluant l’air; 3° l’emplacement de l’activité polluant l’air visée par la demande; Official Gazette no.39bis of 24/09/2018 33 4° ubwoko n’inkomoko by’ibihumanya; 5° impamvu zo kurenza urugero ntarengwa rw’imyuka ihumanya yoherezwa mu kirere; 6° ingano y’imyuka ihumanya iteganywa koherezwa mu kirere; 7° ingamba zafashwe mu rwego rwo kubika amakuru no gukurikirana uko imyuka ihumanya yoherezwa mu kirere ingana; 8° igihe uruhushya rwasabwe ruzamara; 9° andi makuru ya ngombwa yatuma haba isesengura riboneye. Ingingo ya 9: Amafaranga yo gusaba uruhushya Umuntu usaba uruhushya rwo kohereza imyuka ihumanya mu kirere hakurikijwe ibiteganywa n’iri teka yishyura amafaranga y’u Rwanda ibihumbi mirongo itanu (50.000 FRW) adasubizwa mu kigega gishinzwe ibidukikije n’imihindagurikire y’ikirere. 4° type and origin of pollutants; 5° reasons for exceeding air pollutants emission limits; 6° expected quantities of air pollutants emission; 7° measures put in place to record and monitor air pollutants emission quantities; 8° period for which the permit is applied for; 9° any other information considered necessary for appropriate assessment. Article 9: Application fees for a permit A person applying for air pollutants emission permit in accordance with the provisions of this Order pays fifty thousand Rwandan Francs (50,000 FRW) non refundable to the fund in charge of environment and climate change. 4° le type et l’origine des polluants; 5° les motifs de dépassement des limites d’émissions de polluants atmosphériques; 6° les prévisions des quantités d’émission de polluants atmosphériques; 7° les mesures mises en place pour enregistrer et surveiller les quantités d’émission de polluants atmosphériques; 8° la période pour laquelle le permis est demandé; 9° tout autre renseignement jugé nécessaire en vue d’une évaluation appropriée. Article 9: Frais de demande d’un permis Une personne qui demande un permis d’émission de polluants atmosphériques conformément aux dispositions du présent arrêté verse cinquante mille francs rwandais (50.000 FRW) non remboursables au fonds chargé de l’environnement et du changement climatique. Official Gazette no.39bis of 24/09/2018 34 Ingingo ya 10: Gusuzuma inyandiko isaba uruhushya Mu kwemeza niba uruhushya rwo kohereza imyuka ihumanya mu kirere rwatangwa cyangwa rutatangwa, urwego rufite kubungabunga ibidukikije mu nshingano zarwo rugomba kureba: 1° raporo y’isuzuma ry’ingaruka ku bidukikije cyangwa y’ubugenzuzi bw’ibidukikije byakozwe; 2° amabwiriza y’ubuziranenge bw’umwuka wo mu kirere udukikije akurikizwa; 3° ingaruka z’uruhurirane ku bidukikije zishobora gukomoka ku itangwa ry’urwo ruhushya; 4° niba uburyo bw’imigirire myiza kurusha iyindi buteganyijwe bwubahirijwe. Urwego rufite kubungabunga ibidukikije mu nshingano zarwo rushobora gusaba ko hakorwa inyigo yimbitse mbere y’uko hafatwa icyemezo cya nyuma kirebana n’isabwa ry’uruhushya. Article 10: Assessment of an application for a permit In order to determine whether or not to issue an air pollutants emission permit, the organ in charge of environment protection must: 1° refer to the report of environmental impact assessment or environmental audit conducted; 2° refer to the applicable ambient air quality standards; 3° consider the cumulative effect on the environment likely to result from any such grant; 4° ensure that the prescribed best practicable option is adopted. The organ in charge of environment protection may require a further study before a final decision on the permit application is made. Article 10: Evaluation d’une demande de permis Pour déterminer s’il faut délivrer ou ne pas délivrer un permis d’émission de polluants atmosphériques, l’organe ayant la protection de l’environnement dans ses attributions doit: 1° se référer au rapport d’évaluation d’impact environnemental ou d’audit environnemental effectué; 2° se référer aux normes de qualité de l’air ambiant applicables; 3° examiner l’effet cumulatif sur l’environnement susceptible de résulter d’un tel octroi; 4° s’assurer que la meilleure option prescrite possible est adoptée. L’organe ayant la protection de l’environnement dans ses attributions peut, le cas échéant, exiger une étude approfondie avant de prendre une décision finale sur la demande de permis. Article 11: Person to undertake further study The applicant of a permit hires a person or independent organ to undertake further study at the expense of the applicant. Article 12: Procedure for issuing a permit The organ in charge of environment protection, upon receiving the application for air pollutants emission permit, replies to the applicant within twenty (20) days from the date of the request. In case additional time to days prescribed in Paragraph One of this Article for analysis of the application is required, the organ in charge of environment protection notifies the applicant the expected time it will take. The organ in charge of environment protection issues the air pollutants emission permit in writing which indicates the conditions of use of the permit, and the applicant countersigns it as an agreement to the imposed conditions. Article 11: Personne qui procède à l’étude approfondie Le demandeur d’un permis engage une personne ou un organe indépendant pour procéder à l’étude approfondie sur les frais du demandeur. Article 12: Procédure de délivrer un permis L’organe ayant la protection de l’environnement dans ses attributions, à la réception de la demande d’un permis d’émission de polluants de l’air, répond au demandeur endéans vingt (20) jours à compter de la date de la demande. S’il faut du temps additionnel aux jours prescrits à l’alinéa premier du présent article en vue d’analyser la demande, l’organe ayant la protection de l’environnement notifie au demandeur le délai qu’il faudra. L’organe ayant la protection de l’environnement dans ses attributions délivre par écrit le permis d’émission de polluants atmosphériques qui indique les conditions d’utilisation du permis, et le demandeur le contresigne comme un accord aux conditions imposées. Ingingo ya 14: Igihe uruhushya rumara Uruhushya rwo kohereza imyuka ihumanya mu kirere rumara igihe kitarenze imyaka ibiri (2) ibarwa uhereye ku itariki rwatanzweho kandi rushobora kongerwa. Article 13: Obligations of a permit holder The air pollutants emission permit holder must fulfill the following obligations: 1° to conduct continuous monitoring of air pollutants emissions and other measures to maintain and if necessary, improve ambient air quality; 2° to draw up a report on compliance status of the air pollutant activity and periodically inform thereof the organ in charge of environment protection; 3° to comply with all conditions specified in the permit. Article 14: Duration of the permit The air pollutants emission permit is valid for a period not exceeding two (2) years from the date it is granted and may be renewed. Article 13: Obligations du titulaire d’un permis Le titulaire d’un permis d’émissions de polluants de l’air doit remplir les obligations suivantes: 1° surveiller en permanence les émissions de polluants atmosphériques ainsi que les autres mesures visant à maintenir et, si nécessaire, à améliorer la qualité de l’air ambiant; 2° établir un rapport sur l’état de conformité d’émission de polluants de l’activité et en informer périodiquement l’organe ayant la protection de l’environnement dans ses attributions; 3° se conformer à toutes les conditions définies dans le permis. Article 14: Durée du permis Le permis d’émission de polluants atmosphériques est valable pour une période n’excédant pas deux (2) ans à compter de la date de son octroi et peut être renouvelé. Kopi Article 15: Permit cancellation The organ in charge of environment protection cancels the permit for the following reasons: 1 º the facility fails to comply with terms of use of the air pollutants emission permit; 2 º the facility changes location. Article 16: Notification of the change of the owner or operator The owner or operator holding an air pollutants emission permit notifies in writing the organ in charge of environment protection of the name and address of the new owner or operator within fifteen (15) days after the occurrence of change of the owner or the operator. The notification must be accompanied by a written commitment of the new owner or operator to comply with terms of the existing air pollutants emission permit. A copy of a notification is sent to respective District authority. Article 15: Annulation du permis L’organe ayant la protection de l’environnement annule le permis pour des raisons suivantes: 1 º l’installation ne se conforme pas aux termes d’utilisation du permis d’émissions de polluants atmosphériques. 2 º l’installation change d’emplacement. Article 16: Notification du changement du propriétaire ou de l’opérateur Le propriétaire ou l’opérateur titulaire d’un permis d’émissions de polluants atmosphériques informe par écrit l’organe ayant la protection de l’environnement dans ses attributions du nom et de l’adresse du nouveau propriétaire ou opérateur endéans quinze (15) jours suivant la survenance du changement du propriétaire et de l’opérateur. La notification doit être accompagnée d’un engagement écrit du nouveau propriétaire ou opérateur de se conformer aux termes du permis d’émission de polluants atmosphériques existant. In case the new activity implies air pollutants emissions exceeding permissible standards, the owner or operator applies for air pollutants emission permit as provided for in this Order. Article 18: Fees for air pollutants emission A person who is granted the air pollutant emission permit pays annual fees to the fund in charge of environment and climate change. Article 18: Frais d’émission de polluants atmosphériques Une personne à qui le permis d’émission de polluants atmosphériques est accordé, verse des frais annuels au fonds chargé de l’environnement et du changement climatique. In case a person to whom a notice of air polluting activities has been served is not satisfied with the decision on his or her appeal, he or she may, within two (2) working days after that notification, make a appeal in writing to the organ in charge of environment protection concerning the terms of the notification. The organ in charge of environment protection, having considered such an appeal, may confirm, amend or revoke the notification of air polluting activities. The decision taken is communicated in writing to the claimant and the City of Kigali or the District within fifteen (15) days after the appeal. Article 21: Appeal fees A person exercising the right to appeal against the notification of air polluting activities to the organ in charge of environment protection pays, before lodging his or her appeal, fifty Article 20: Recours contre une notification Une personne à qui une notification des activités polluant l’air a été adressée peut, endéans deux (2) jours ouvrables, introduire un recours par écrit auprès de la Ville de Kigali ou du District qui a délivré la notification. CHAPTER V: ADMINISTRATIVE SANCTIONS Article 23: Violation of air pollutants emission standards Except the operator of a motor vehicle, a person who contravenes any applicable air pollutants emission standards, is liable to an administrative fine of three million Rwandan francs (3,000,000 FRW). An operator of a motor vehicle who does not comply with air pollutants emission standards is liable to an administrative fine of twenty five thousand Rwandan francs (25,000 FRW). Article 24: Non-registration of air polluting activity A person who fails to register an air polluting activity and who does not comply with the air quality standards is liable to an administrative fine of three million Rwandan francs (3,000,000 FRW). CHAPITRE V: SANCTIONS ADMINISTRATIVES Article 23: Violation des normes d’émission de polluants atmosphériques Excepté l’opérateur de véhicule à moteur, une personne qui enfreint des normes applicables en matière d’émissions de polluants atmosphériques, est passible d’une amende administrative de trois millions de francs rwandais (3.000.000 FRW). Un opérateur de véhicule à moteur qui ne se conforme pas aux normes d’émission de polluants atmosphériques est passible d’une amende administrative de vingt-cinq mille francs rwandais (25.000 FRW). Article 24: Non-enregistrement d’une activité polluant l’air Une personne qui omet d’enregistrer une activité polluant l’air et qui ne se conforme pas aux normes de la qualité de l’air est passible d’une amende administrative de trois millions de francs rwandais (3.000. 000 FRW). Article 25: Violation of a compliance order on preservation of air quality A person who violates a compliance order relating to the preservation of air quality and prevention of air pollution is liable to an administrative fine of two million Rwandan francs (2,000,000 FRW). Article 26: Violation of an order to stop activities A person who violates an order to stop air polluting activities is liable to an administrative fine of five million Rwandan francs (5,000,000 FRW). Article 27: Violation of an emergency order A person who violates an emergency order relating to the preservation of air quality and prevention of air pollution is liable to an administrative fine of three million Rwandan francs (3,000,000 FRW). Article 25: Violation d’un ordre de conformité relatif à la préservation de la qualité de l’air Une personne qui enfreint un ordre de conformité relatif à la conservation de la qualité de l’air et la prévention de la pollution atmosphérique est passible d’une amende administrative de deux millions de francs rwandais (2.000.000 FRW). Article 26: Violation d’un ordre d’arrêter les activités Une personne qui viole un ordre d’arrêter des activités polluant l’air est passible d’une amende administrative de cinq millions de francs rwandais (5.000.000 FRW). Article 27: Violation d’un ordre d’urgence Une personne qui viole un ordre d’urgence relatif à la conservation de la qualité de l’air et à la prévention de la pollution atmosphérique est passible d’une amende administrative de trois millions de francs rwandais (3.000.000 FRW). Article 28: Hindrance to inspection A person who: 1 º obstructs an environmental inspector in the execution of his or her duties; 2 º refuses an environmental inspector entry upon a land or into a premise to inspect; 3 º refuses an environmental inspector access to records kept in accordance with the law; 4 º gives environmental inspector false name or false address or misleading information; is liable to an administrative fine of five hundred thousand Rwandan francs ( 500,000 FRW). Ingingo ya 30: Ibyemezo bigamije gusubiza mu buryo ibyangijwe Urwego rufite kurengera ibidukikije mu nshingano zarwo, Umujyi wa Kigali cyangwa Akarere bishobora gutegeka umuntu utubahirije amategeko yerekeye kubungabunga ubwiza bw’umwuka cyangwa gukumira ihumanywa ry’ikirere, gukora ibi bikurikira: 1 º gukuraho, gusana, kugorora cyangwa guhindura icyateye ihumanywa ryʼikirere; 2 º gusubiza ibidukikije byononekaye cyangwa byangijwe n’imyuka ihumanya uko byari bimeze. Article 29: Failure to report accidental or involuntary emission of air pollutant A person who fails to report his or her accidental or involuntary emission of air pollutant within the time specified in the laws, is liable to an administrative fine of one million Rwandan francs (1,000,000 FRW). Article 30: Remedial measures The organ in charge of environment protection, the City of Kigali or the District may order a person who violates provisions of the laws relating to the preservation of air quality and prevention of air pollution, to perform the following: 1 º to remove, remediate, fix or upgrade the source of pollution; 2 º to restore the environment damaged or destroyed by air pollutants. Article 29: Défaut de déclarer des émissions accidentelles ou involontaires de polluants atmosphériques Une personne qui omet de déclarer ses émissions accidentelles ou involontaires de polluants atmosphériques dans le délai prévu par les lois, est passible d’une amende administrative d’un million de francs rwandais (1.000. 000 FRW). Article 30: Mesures correctives L’organe ayant la protection de l’environnement dans ses attributions, la Ville de Kigali ou le District, peut ordonner à une personne qui enfreint la législation en matière de la qualité de l’air et la prévention de la pollution atmosphérique d’effectuer ce qui suit: 1 º enlever, réparer, corriger ou améliorer la source de pollution; 2 º restaurer l’environnement endommagé ou détruit par les polluants atmosphériques. Ingingo ya 31: Igihe cyo kwishyura amafaranga Umuntu wahanishijwe kwishyura ihazabu yo mu rwego rw’ubutegetsi ivugwa muri uyu mutwe, ayishyura mu kigega gishinzwe ibidukikije n’imihindagurikire y’ikirere mu gihe cyʼiminsi irindwi (7) uhereye igihe yabimenyesherejwe. Iyo icyo gihe kirenze, uwo muntu yishyura amafaranga y’inyongera angana na zeru n’ibice bitanu ku ijana (0.5 %) kuri buri munsi w’ubukererwe. Icyakora, ihazabu yo mu rwego rw’ubutegetsi irebana n’imyuka yoherezwa n’ikinyabiziga kigendeshwa na moteri icibwa n’Ishami rya When provisions of Paragraph One of this Article are omitted, the organ in charge of environment protection, the City of Kigali or the District closes the facility temporarily or permanently. Article 31: Payment period The person charged with the payment of administrative fines mentioned in this Chapter, pays them to the fund in charge of environment and climate change, within a period of seven (7) days from the reception of the notification. If the period expires, the person pays an additional payment of five tenths percent (0.5 %) for each day of delay. Article 32: Authorities to impose payments Administrative fine is imposed by the organ in charge of environment protection, the City of Kigali or the District. However, the administrative fine related to a motor vehicle emissions is imposed by Traffic Police. En cas d’omission des dispositions de l’alinéa premier du présent article, l’organe ayant la protection de l’environnement dans ses attributions, la Ville de Kigali ou le District ferme temporairement ou définitivement l’installation. Article 31: Période de paiement La personne frappée de paiement des amendes administratives mentionnées dans le présent Chapitre les paie au profit du fonds chargé de l’environnement et du changement climatique, endéans sept (7) jours à compter de la réception de la notification. Si cette période expire, la personne verse un paiement supplémentaire de cinq dixièmes pour cent (0,5%) pour chaque jour de retard. Article 32: Autorités qui imposent des paiements L’amende administrative est imposée par l’organe ayant la protection de l’environnement dans ses attributions, la Ville de Kigali ou le District. Toutefois, l’amende administrative liée aux émissions d’un véhicule à moteur est imposée par la police de la circulation routière. UMUTWE WA VI: INGINGO Z’INZIBACYUHO N’IZISOZA Ingingo ya 33: Amapikipiki ari mu Rwanda mu gihe iri teka ritangiye gukurikizwa Amapikipiki ari mu Rwanda ku munsi iri teka ritangiye gukurikizwa akomeza gukoreshwa. Icyakora, agomba kubahiriza ibisabwa n’urwego rushinzwe igenzura ry’ibinyabiziga bikoreshwa na moteri bijyanye n’urugero rw’imyuka yoherezwa mu kirere yemewe. Ingingo ya 34: Agaciro k’uruhushya rwatanzwe Uruhushya rwo kohereza imyuka ihumanya mu kirere rwatanzwe mbere y’uko iri teka ritangira gukurikizwa rugumana agaciro karwo kugeza igihe rurangiriye. Ingingo 35: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. CHAPTER VI: TRANSITIONAL AND FINAL PROVISIONS Article 33: Motorcycles already in Rwanda on the date of entry into force of this Order Motorcycles in Rwanda on the date of entry into force of this Order continue to operate. However, they must comply with authorised air pollutants emission limits provided for by the authority in charge of motor vehicles inspection. Article 34: Validity of issued permit Air pollutants emission permit issued before the commencement of this Order remains valid until its expiration. Article 35: Repealing provision All prior provisions contrary to this Order are repealed. CHAPITRE VI: DISPOSITIONS TRANSITOIRES ET FINALES Article 33: Motocyclettes déjà au Rwanda à la date d’entrée en vigueur du présent arrêté Les motocyclettes se trouvant au Rwanda au jour de l’entrée en vigueur du présent arrêté continuent à être utilisées. Toutefois, elles doivent se conformer aux limites d’émissions de polluants atmosphériques autorisées prévues par l’autorité chargée de l’inspection des véhicules à moteur. Article 34: Validité du permis délivré Le permis d’émissions de polluants atmosphériques délivré avant l’entrée en vigueur du présent arrêté reste valide jusqu’à son expiration. Article 35: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées.
