Ingingo ya 2: Uburyo bwo gufatira, gufunga, kuvanaho cyangwa gusenya ikimera, ikigikomokaho cyangwa ikindi kintu cyinjijwe mu buryo butemewe n’amategeko ndetse n’ububiko gitwawemo Ibyemezo bikurikira bifatirwa ikimera, ikigikomokaho cyangwa ikindi kintu kibika cyangwa gikwirakwiza indiririzi cyangwa Article One: Purpose of this Order This Order determines: 1 º modalities for confinement, holding, treatment or destruction of a plant, a plant product or any other product unlawfully imported; 2 º the time limit for confinement, holding, treatment or destruction of a plant, a plant product or any other product unlawfully imported; 3 º modalities for confining a vessel, a vehicle, a train, an aircraft or any other means of conveyance which carries a regulated article. Article 2: Modalities for confinement, holding, treatment or destruction of a plant, a plant product or any other product unlawfully imported as well as its container The following measures are taken on a plant, a plant product or any other regulated Article premier: Objet du présent arrêté Le présent arrêté détermine: 1° les modalités de confinement, de détention, de traitement ou de destruction d’un végétal, d’un produit végétal ou de tout autre produit importé illégalement; 2° le délai de confinement, de détention, de traitement ou de destruction d’un végétal, d’un produit végétal ou de tout autre produit importé illégalement; 3° les modalités de confinement de bateau, de véhicule, de train, d’avion ou de tout autre moyen de transport qui transporte un article réglementé. Article 2: Modalités de confinement, de détention, de traitement ou de destruction d’un végétal, d’un produit végétal ou de tout autre produit importé illégalement ainsi que son conteneur Les mesures suivantes sont prises sur un végétal, un produit végétal ou tout autre 55 Official Gazette n° 32 of 07/08/2017 indwara ndetse n’ububiko bwacyo cyinjijwe mu buryo butemewe n’amategeko: 1° gufatira: iyo umutwaro uketsweho kutubahiriza amabwiriza, ufatirwa n’umugenzuzi mu gihe kitarenze iminsi itatu (3), ugashyirwaho igifungisho, ugashyirwa mu nzu zabugenewe cyangwa ukaguma mu cyo utwawemo mu gihe hategerejwe icyemezo gifatwa n’urwego rubifitiye ububasha; 2° gushyira mu kato: iyo umutwaro utubahirije ibisabwa kandi bidashoboka ko ukosorwa ako kanya, ushyirwa mu gicumbi cy’ibimera byahawe akato mu gihe kitarengeje iminsi cumi n’ine (14) ibarwa uhereye umunsi cyashyizwe mu kato; 3° kuvanaho indiririzi: iyo nyuma yo gusuzuma umutwaro uri mu kato byemejwe ko ufite indiririzi, urwego rubifitiye ububasha rwemeza ivanwaho ry’indiririzi mu gihe kitarenze iminsi cumi n’ine (14) ibarwa uhereye umunsi icyemezo ndakuka cyemeza ko umutwaro ufite indiririzi gifatiwe; article as well as its container illegally imported: 1° confinement: where a consignment is suspected of being non-compliant with regulations, it is confined within three (3) days, locked, placed in a designated location or remains in its container pending a decision taken by the competent authority; 2° to quarantine: where a consignment does not comply with the requirements and the situation cannot be immediately rectified, it is put in quarantine station of plants within fourteen (14) days counted from the day it was quarantined; 3° treatment of pests: if, after the examination of a quarantined consignment, it is established that the consignment contains pests, the competent authority decides on the treatment of the pests within fourteen (14) days counted from the day the final decision on the presence of the pests on the consignment was taken; article réglementé ainsi que son conteneur illégalement importé: 1° confinement: le fait pour un envoi soupçonné d'être non conforme aux règlements, d’être confiné endéans trois (3) jours, bercé, mis dans des lieux désignés ou rester dans son conteneur en attendant une décision prise par l'autorité compétente; 2° mise en quarantaine: le fait pour un envoi qui n'est pas conforme aux exigences et qui ne peut pas être immédiatement corrigé, d’être mis en station de quarantaine des plantes endéans quatorze (14) jours à compter du jour où il a été mis en quarantaine; 3° traitement des organismes nuisibles: lorsque, après l’examen d'un envoi en quarantaine, il est établi que l’envoi contient des organismes nuisibles, l'autorité compétente recommande le traitement des organismes nuisibles endéans quatorze (14) jours à compter du jour où la décision définitive de la présence des 56 Official Gazette n° 32 of 07/08/2017 4° gusenya: iyo umutwaro udashobora kuvanwaho indiririzi kandi udashobora gusubizwa iyo wavuye, urasenywa. Ingingo ya 3: Uburyo bwo gufatira ubwato, imodoka, gari ya moshi, indege cyangwa ikindi gitwaye ibintu Iyo umugenzuzi afatiriye ubwato, imodoka, gari ya moshi, indege cyangwa ikindi gitwaye ikimera, ikigikomokaho cyangwa ikindi ikintu kibika cyangwa gikwirakwiza indiririzi cyangwa indwara kitujuje ibisabwa agomba gukora ibi bikurikira: 1 º kukibika ahantu habugenewe hategerejwe ko urwego rubifitiye ububasha rufata umwanzuro mu gihe kitarenze amasaha makumyabiri n’ane (24) abarwa 4° to destroy: if the consignment cannot be treated of the pests and cannot be re-exported to its origin, it is then destroyed. This is done in a designated location after consultations with other authorities within fourteen (14) days counted from the day the decision of destruction was taken and the cost is borne by the owner of the consignment. Article 3: Modalities for confining a vessel, a vehicle, a train, an aircraft or any other means of conveyance Where the inspector confines a vessel, a vehicle, a train, an aircraft or any other means of conveyance that carries a plant, a plant product or any other regulated article that is non-compliant with regulations, he/she is required to do the following: 1 º to place it in a designated location pending a decision taken by competent authorities within twenty four (24) hours counted from the day it was placed in the designated location; organismes nuisibles à l’envoi a été prise; 4° détruire: lorsque l’envoi ne peut être traité efficacement et qu’il ne peut pas être réexporté, il est alors détruit. Article 3: Modalités de saisir un navire, un véhicule, un train, un avion ou tout autre moyen de transport Lorsque l'inspecteur confine un bateau, un véhicule, un train, un avion ou tout autre moyen de transport qui transporte un végétal, produit végétal ou tout article réglementé non conforme aux règlements, il doit faire ce qui suit: 1 º le placer dans le lieu désigné en attendant une décision prise par les autorités compétentes endéans vingt-quatre (24) heures à compter du jour où il a été placé dans un lieu désigné; 57 Official Gazette n° 32 of 07/08/2017 uhereye umunsi cyashyiriwe aho hantu habugenewe; 2 º kumenyesha mu nyandiko nyir’ikintu gitwaye umutwaro cyangwa ikintu kibika cyangwa gikwirakwiza indiririzi cyangwa indwara, impamvu icyemezo cyafashwe, mu gihe kitarenze amasaha makumyabiri n’ane (24) abarwa uhereye igihe icyemezo ndakuka cyafatiwe amenyeshwa impamvu y’ifatira; 3 º nyuma yo gukora igenzura, umugenzuzi amenyesha nyir’ubwato, imodoka, gari ya moshi, indege cyangwa ikindi gitwaye ibintu icyemezo ndakuka cyafashwe mu gihe kiratenze iminsi cumi n’ine (14) ibarwa uhereye umunsi nyir’umuzigo yamenyesherejwe impamvu yifatirwa ry’ikintu gitwaye umutwaro cyangwa gikwirakwiza indiririzi cyangwa indwara. Ingingo ya 4: Ubujurire Igihe uwinjije ikimera cyangwa ikigikomokaho atemeranyije n’icyemezo yafatiwe n’umugenzuzi hakurikijwe 2 º to inform, in a written notice, the owner of the consignment or a regulated article, the decision taken within twenty four (24) hours counted from the day the final decision was taken, stating reasons for confinement; 3 º after examination, an inspector informs the owner of a vessel, a vehicle, a train, an aircraft or any other means of conveyance the final decision taken within fourteen (14) days, counted from the day the owner of the consignment was informed of the decision of confinement of a consignment or regulated article. Ingingo ya 6: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanweho. Article 5: Administrative fine A person who illegally imports any plant/ plant product or a regulated article is liable to an administrative fine of fifty thousand Rwandan Francs (50,000) payable to the public treasury. Article 6: Repealing provision All prior provisions contrary to this Order are repealed.
