HEREBY ORDERS: Article One: Purpose of this Order This Order determines: 1 º modalities for importation of a pest, a plant or plant product for scientific and research purposes; 2 º modalities for inspection, prohibition, restriction and importation of a plant, plant product, quarantine pest, beneficial organisms and any other elements that can contain and spread pests or diseases; 3 º the format of a phytosanitary certificate. ARRETE: Article premier: Objet du présent arrêté Le présent arrêté détermine: 1 º les modalités d’importation d’un organisme nuisible, d’un végétal ou d’un produit végétal pour des raisons scientifiques et de recherche ; 2 º les modalités d’inspection, d’interdiction, de restriction et d’importation d’un végétal, d’un produit végétal, d’un organisme nuisible de quarantaine, d’organismes bénéfiques et de tout autre élément susceptible de contenir et de disséminer des organismes nuisibles ou des maladies; 3 º le format du certificat phytosanitaire. 23 Official Gazette n° 32 of 07/08/2017 Ingingo ya 2: Kugaragaza ibimera cyangwa ibibikomokaho n’ibindi bintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara byinjira mu gihugu Umuntu wese winjira mu gihugu agomba kwerekana ku mugenzuzi w’ibimera, ibimera byose, ibibikomokaho cyangwa ibindi bintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara, byinjira mu gihugu afite. Article 2: Declaration of plants or plant products and other regulated articles to enter the country Any person who enters the country must declare to the inspector of plants, all plants, plant products or other regulated articles in his/her possession. Article 3: Application for import license for a plant, plant product or other regulated articles Any person or a company intending to import a plant, plant product or any other regulated articles is required to apply for an import license in writing, to the competent authority to do so. Article 2: Déclaration de végétaux ou produits végétaux et autres articles réglementés qui entrent dans le pays Toute personne qui entre au pays doit présenter à l’inspecteur de végétaux, tous les végétaux, produits végétaux ou autres articles réglementés en sa possession. Article 3: Demande de licence d’importation d’un végétal, produit végétal ou autres articles réglementés Toute personne ou entreprise ayant l’intention d'importer un végétal, produit végétal ou autres articles réglementés fait une demande de licence d'importation par écrit, à l’autorité compétente. 24 Official Gazette n° 32 of 07/08/2017 Ingingo ya 4: Ibisabwa mu kwinjiza mu gihugu ikimera, ikigikomokaho cyangwa ibindi bintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara Nta muntu wemerewe kwinjiza mu gihugu ikimera, ikigikomokaho cyangwa ibindi bintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara, keretse iyo agaragarije umukozi ubishinzwe, inyandiko zikurikira: 1 º uruhushya rwo gutumiza mu mahanga rugifite agaciro; 2 º icyemezo cy’igenzura ry’imbuto aho bisabwa; 3 º icyemezo cy’ubuziranenge gitangwa n’igihugu cy’aho biturutsemo cyangwa icyemezo cy’ubuziranenge cyo kongera kubyohereza mu mahanga bitewe n’uko bimeze; 4 º inyandiko igaragaza aho ibintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara byinjira mu gihugu byaturutse nk’uko byanditse mu nyandiko Article 4: Requirements to import a plant, plant product or other regulated articles No person shall import a plant, plant product or any other regulated articles unless he/she presents to the concerned officer, the following documents: 1 º a valid import license; 2 º a cerfiticate of seed quality analysis where applicable; 3 º a phytosanitary certificate from the country of origin or a phytosanitary certificate for re-export as applicable; 4 º a statement of the origin of the regulated articles as it is written in the additional declaration of the phytosanitary certificate from the country of origin or a phytosanitary Article 4: Conditions pour importer un végétal, produit végétal ou autres articles réglementés Nul ne peut importer un végétal, produit végétal ou autres articles réglementés à moins qu'il ne présente à l’agent autorisé, les documents suivants: 1 º une licence d’importation valide; 2 º un cerfiticate d’analyse de la qualité des semences dans le cas échéant; 3 º un certificat phytosanitaire du pays d'origine ou un certificat phytosanitaire pour la réexportation selon le cas; 4 º une déclaration de l'origine des articles réglementés comme il est écrit dans la déclaration supplémentaire du certificat phytosanitaire du pays d’origine ou 25 Official Gazette n° 32 of 07/08/2017 y’umugereka w’icyemezo cy’ubuziranenge cyatanzwe n’igihugu byaturutsemo cyangwa icyemezo cy’ubuziranenge cyo kongera kubyohereza mu mahanga cyangwa uruhushya rwatanzwe n’urwego rubifitiye ububasha. Ingingo ya 5: Imiterere y’icyemezo cy’ubuziranenge bw’ibimera Imiterere y’icyemezo cy’ubuziranenge bw’ibimera gihabwa uwujuje ibyangombwa bisabwa n’igihugu ikimera cyangwa ikigikomokaho kigiye koherezwamo, iri ku mugereka wa III w’iri teka. Ingingo ya 6: Ibyinjira mu gihugu bikenera uruhushya rwo gutumiza mu mahanga kandi bikorerwa igenzura Ibyinjira mu gihugu bikenera uruhushya rwo gutumiza mu mahanga kandi bikorerwa igenzura ni ibi bikurikira: 1 º ikimera/ikigikomokaho; 2 º ingemwe, ibihingwa by’utunyangingo harimo n’ibice by’imboga bikomoka kuri ibyo bihingwa bikoreshwa mu itubura; certificate for re-export, or the license issued by the competent authority. Article 5: Format of the phytosanitary certificate The format of a phytosanitary certificate for plants issued to a person who fulfills the requirements established by the country of destination of the plant or plant product, is in Annex III of this Order. Article 6: Imports that require an import license and subject to inspection Imports that require an import license and subject to inspection are the following: 1 º a plant/plant product; 2 º nursery stocks, plants tissue cultures including vegetative parts thereof used as propagating materials; certificat phytosanitaire pour la réexportation, ou la licence délivrée par l’autorité compétente. Article 5: Format du certificat phytosanitaire Le format du certificat phytosanitaire des végétaux délivré à une personne remplissant les conditions fixées par le pays de destination du végétal ou du produit végétal, est en annexe III du présent arrêté. Article 6: Importations nécessitant une licence d’importation et soumises à une inspection Les importations nécessitant une licence d’importation et soumises à une inspection sont les suivantes: 1 º un végétal/produit végétal; 2 º le matériel de pépinière, les cultures de tissus des plantes y compris les parties végétatives de 26 Official Gazette n° 32 of 07/08/2017 3 º intete, impeke, imbuto zo gutera; 4 º imbuto ziribwa, imboga n’ibindi bikomoka ku bimera, byatangajwe nk’ibitemewe kwinjizwa mu gihugu bitewe n’uko bizwiho kubika indiririzi zahawe akato cyangwa bikomoka mu karere katemewe; 5 º ubuhinzi bw’uduhumyo, bagiteri, virusi, amashanya n’ibindi bitera ibimera indwara; 6 º ubuhinzi bw’ibihumyo biribwa harimo n’uturandaryi tw’ibihumyo; 7 º ubuhinzi bw’inkuriraruzi, ubuhinzi bw’utunyangingo nk’ibinyamisogwe biribwa bikarinda umubiri; 8 º ubutaka n’ibikomoka ku bimera bikoreshwa mu gushyira akanyabuzima ukwako; 9 º ubundi buhinzi bw’ibimera; 3 º grains, nuts, seeds for planting; 4 º fresh fruits, vegetables and other plant products, which have been declared as restricted imports because they are known as hosts of quarantine pests or originate from restricted areas; 5 º pure cultures of fungi, bacteria, virus, nematodes and other phytopathogenic materials; 6 º mushroom cultures including spawn; 7 º algae cultures, rhizobial cultures as legume inoculants; 8 º soil and plant products for isolation of organism; 9 º other plant cultures; celles-ci utilisées comme matériels de multiplication; 3 º les graines, les noisettes, les semences pour la plantation; 4 º les fruits frais, les légumes et autres produits végétaux, déclarés comme interdits à être importés parce qu'ils sont connus comme les détenteurs des organismes nuisibles de quarantaine ou qu’ils proviennent de zones interdites; 5 º les cultures pures de champignons, bactéries, virus, nématodes et autres matériaux phytopathogènes; 6 º les cultures de champignons y compris des mycéliums; 7 º les cultures d'algues, les cultures de rhizobium comme inoculant pour légumineuses; 8 º le sol et les produits végétaux pour l'isolement d’un organisme; 9 º les autres cultures des végétaux; 27 Official Gazette n° 32 of 07/08/2017 10 º amoko amwe y’inyamaswa nk’inigwahabiri, inyoni, inkende n’ibikururanda bishobora kwangiza ibihingwa; 11 º ibinyabuzima bikoreshwa mu kurwanya indwara n’ibinyabuzima byahinduriwe kamere; 12 º indabo zitoshye, umufungo w’indabo n’ibindi bijyanye no gutegura indabo; 13 º imbaho n’ibikoresho bikoze mu mbaho n’imigano; 14 º ibiribwa n’ibindi binyampeke bitatunganyirijwe mu ruganda; 15 º udutanda n’ubundi buryo bwo gutwara ibintu ngo bitangirika n’ibindi bikoresho byagenewe gutwaramo ibintu bikoze mu rubaho; 16 º ibikoresho byagenwe gutwarwamo ibintu bikoze mu bimera. 10 º certain species of animals such as insects, birds, monkeys, reptiles capable of causing injury to agricultural crops; 11 º biocontrol agents and genetically modified organisms; 12 º fresh flowers, bouquets and other floral art; 13 º timber and furniture made of wood and bamboo; 14 º food and feed grains not processed; 15 º pallets and other forms of dunnage and packing materials made of wood; 16 º packing material made from plant fibres. 10 º certaines espèces d'animaux comme les insectes, les oiseaux, les singes, les reptiles capables de causer des dommages aux cultures agricoles ; 11 º les agents de lutte biologique et d'organismes génétiquement modifiés; 12 º les fleurs fraîches, bouquets et autres arts floraux; 13 º le bois et mobilier en bois et bambou; 14 º les céréales fourragères et les céréales fourragères non transformées; 15 º les palettes et autres formes de matériaux de calage et d’emballage en bois; 16 º les matériaux d'emballage en fibres de plante. 28 Official Gazette n° 32 of 07/08/2017 Ingingo ya 7: Uburyo bukoreshwa mu itangwa ry’uruhushya rwo gutumiza mu mahanga Iyo ingaruka zigendana n’ikimera, ikigikomokaho cyangwa ibindi bintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara zitazwi, urwego rubifitiye ububasha rukora isesengura ku ngaruka z’indiririzi rugendeye kuri ibi bikurikira: 1 º urutonde rw’indiririzi rwatanzwe n’urwego rubifitiye ububasha mu gihugu ikimera cyangwa ikigikomokaho byaturutsemo nk’uko byasabwe n’utumiza mu mahanga; 2 º andi makuru yabonetse hagendewe ku byegeranyo ku ndiririzi harimo ibyakozwe n’ibigo by’ubushakashatsi, inyandiko za gihanga zashyizwe ahagaragara, cyangwa ibyatangajwe n’umuntu ku giti cye. Urwego rubifitiye ububasha, rushingiye ku byavuye mu isesengura ku ngaruka z’indiririzi, rushobora kwanga cyangwa kwemerera itumizwa mu mahanga ry’ikimera, ibigikomokaho cyangwa ibindi Article 7: Procedure for issuance of an import license If the risks associated with a plant, plant product or other regulated articles are unknown, the competent authority conducts pest risk analysis based on the following: 1 º the list of pests obtained from the competent authority from the country of origin of a plant or plant product as applied for by the importer; 2 º other information gathered from pest databases including research institutions, scientific publications or personal communication. The competent authority may, basing on the result of the pest risk analysis, issue or reject authorization for importation of a plant, plant product or other regulated articles. Article 7: Procédure de délivrance de licence d'importation Si les risques associés à un végétal, produit végétal ou aux autres articles réglementés sont inconnus, l’autorité compétente effectue une analyse du risque sur base de ce qui suit: 1 º la liste des organismes nuisibles délivrée par l’autorite competente du pays d'origine d’un végétal ou produit végétal conformément à la demande de l'importateur; 2 º autres renseignements obtenus à partir des bases de données sur les organismes nuisibles, y compris les réalisations des instituts de recherche, publications scientifiques ou des communications personnelles. L’autorité compétente, selon le résultat de l'analyse du risque des organismes nuisibles, peut, soit refuser ou autoriser l'importation d’un végétal, produit végétal ou autres articles réglementés. 29 Official Gazette n° 32 of 07/08/2017 bintu bibika cyangwa bikwirakwiza indiririzi cyangwa indwara. Kwinjiza mu gihugu ibinyabuzima ngirakamaro, ibinyabuzima bishobora guhumanya cyangwa byahinduriwe kamere bisaba kwemezwa n’urwego bireba rwo mu gihugu mbere y’uko byinjira, kandi rukabikorera isuzuma n’igenzura rirebana n’ubuziranenge bwabyo. Ingingo ya 8: Abantu bagenerwa kopi y’uruhushya rwo gutumiza mu mahanga Iyo ubusabe bwo gutumiza mu mahanga bwemejwe, uruhushya rwo gutumiza mu For imports that require inspection and evaluation at the point of entry, the following procedures are carried out: 1 º inspection and verification of relevant documents; 2 º establishment of necessary phytosanitary measures required by the competent authority. The importation of beneficial organisms, potentially hazardous biological organisms or genetically modified organisms must be approved by the relevant institution in the country before entry and those orgnisms must be evaluated and monitored by the same institution in regard to biosafety aspects of the said imports. Article 8: Persons to whom a copy of import license is provided Where the application for import license is approved, the import license is issued in Pour les importations nécessitant une inspection et une évaluation au niveau du point d’entrée, les procédures suivantes sont effectuées: 1 º l’inspection et la vérification des documents pertinents; 2 º la mise en place des mesures phytosanitaires nécessaires requises par l’autorité compétente. L’importation d'organismes bénéfiques, organismes biologiques potentiellement dangereux ou organismes génétiquement modifiés doit ȇtre approuvée par l'institution concernée dans le pays avant leur entrée et ces organismes doivent être évalués et contrôlés par la même institution, en ce qui concerne des aspects de biosécurité de ladite importation. The format of import license certificate for plant or plant product is in Annex I of this Order. Imported plants, plant products or other regulated articles are inspected within six (6) hours of their arrival at point of inspection by an inspector of plants to determine the authenticity of the documents provided for in Paragraph One of this Article. Article 10: Plants, plant products or other articles prohibited from importation The following plants, plant products or other regulated articles are prohibited from importation unless permitted under special conditions determined by competent authority: 1 º plants, plant products or other regulated articles designated by instructions of the Minister in charge of agriculture; 2 º any pest; 3 º soil or plants with soil; des marchandises ou d’autres articles réglementés par une inspection visuelle et certains cas de collecte d'échantillons pour les tests de laboratoire, conformément à la loi. Ingingo ya 11: Ibyitonderwa mu kwinjiza mu gihugu ibimera Ibimera bifite icyemezo cy’ubuziranenge cyatanzwe n’urwego rw’igihugu rubifitiye ububasha byaturutsemo cyangwa kopi yacyo ni byo byemerewe kwinjira mu gihugu. Article 11: Special considerations for importation of plants Plants with a phytosanitary certificate issued by the competent authority of the exporting country or copies thereof are allowed to be imported. However, it is not necessary to attach to a consignment a phytosanitary certificate for plants prescribed by an Order of the Minister in charge of agriculture as not for planting use and as having minimal possibility of contamination from quarantine pests. Plants sent via mail shall not be imported as mail unless they are in small packets, parcel post and in letters prescribed in accordance with this Order. Les végétaux envoyés par courrier postal ne peuvent pas être importés comme courrier à moins qu’ils soient dans de petits paquets, colis postaux et dans des lettres prescrites en vertu du présent arrêté. Article 12: Measures to be taken after inspection of imports In case the inspection reveals that a plant and a plant product imported do not comply with the requirements, the following measures are taken: 1 º disinfection; 2 º placement in quarantine; 3 º selection; 4 º incineration; 5 º return to the exporting country. Where disinfection or selection is effectively implemented, plants may be accepted. Si la désinfection ou la sélection est bien effectuée, les végétaux peuvent être acceptés. Article 13: Sealing or unsealing of a consignment A custom officer or any other officer authorized in writing by the competent authority is the only one allowed to seal, unseal or change the seal of a consignment or any other article. However, where it is practically impossible for the authorized customs officer to unseal or break the seal, he/she may delegate such power, in writing, to another customs officer. The owner or the person with possession, or in control of a consignment or of any other article on which the seal is affixed, must ensure that the seal is not removed, broken, tampered with or modified. Cependant, lorsqu’ il est pratiquement impossible pour un agent de douane compétent d’enlever ou casser un sceau, il peut autoriser un autre agent de douane, par écrit, de le faire en son nom.
