MINISTERIAL ORDER No 011/11.30 OF 11/04/2017 DETERMINING THE ORGANISATION AND FUNCTIONING OF THE COMMITTEE RESPONSIBLE FOR EVALUATION, CERTIFICATION AND REGISTRATION OF PLANT VARIETIES AND THEIR WITHDRAWAL FROM THE LIST The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 005/2016 of 05/04/2016 governing seeds and plant varieties in Rwanda, especially in Article 3; After consideration and approval by the Cabinet, in its session of 03/02/2017; HEREBY ORDERS: Article One: Purpose of this Order This Order determines the organisation and functioning of the Committee responsible for evaluation, certification and registration of plant varieties and their withdrawal from the list, ARRETE MINISTERIEL No 011/11.30 DU 11/04/2017 DETERMINANT L’ORGANISATION, ET LE FONCTIONNEMENT DU COMITE D’EVALUATION, D’HOMOLOGATION ET D’ENREGISTREMENT DES VARIETES VEGETALES ET DE LEUR RETRAIT DE LA LISTE Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 121, 122 et 176; Vu la Loi no 005/2016 du 05/04/2016 régissant les semences et les variétés végétales au Rwanda, spécialement en son article 3; Après examen et adoption par le Conseil des Ministres, en sa séance du 03/02/2017; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté détermine l’organisation et fonctionnement du Comité d’évaluation, d’homologation et d’enregistrement des variétés Official Gazette nᵒ 16 of 17/04/2017 163 Ingingo ya 2: Abagize Komite Komite igizwe n’abantu icumi (10) bakurikira kandi bakora ku buryo buhoraho bashyirwaho na Minisitiri ufite ubuhinzi mu nshingano ze: 1° umuntu umwe (1) uhagarariye Minisiteri ifite ubuhinzi mu nshingano zayo, akaba n’umuyobozi wa Komite; 2° umwanditsi w’uburenganzira bw’umushakashatsi ukora ubwoko bw’igihingwa; 3° umwanditsi w’amoko y’ibihingwa, akaba munyamabanga wa Komite; 4° abashakashatsi batatu (3) barimo: a. inzobere imwe (1) mu byo gukora amoko y’ibihingwa; b. inzobere imwe (1) mu by’indwara z’ibihingwa no mu by’udusimba tugabanya umusaruro w’ibihingwa; c. inzobere imwe (1) mu bya tekiniki z’ubuhinzi; 5° impuguke imwe (1) mu by’amategeko agenga imbuto; referred to as “Committee” in the following provisions. Article 2: Members of the Committee The Committee comprises of ten (10) following members working on permanent basis, appointed by the Minister in charge of agriculture: 1° one (1) representative from the Ministry in charge of agriculture, who is the Chairperson of the Committee; 2° a registrar of plant breeder’s rights; 3° the registrar of plant variety who is the secretary of the Committee; 4° three (3) researchers consisting of: a. one (1) plant breeder; b. one (1) pathologist or entomologist; c. one (1) agronomist; 5° one (1) expert in seed legislation; végétales et de leur retrait de la liste, ci-après dénommé “Comité”. Article 2: Membres du Comité Le Comité est composé de dix (10) membres suivants, travaillant d’une façon permanente, nommés par le Ministre ayant l’agriculture dans ses attributions: 1° un (1) représentant du Ministère ayant l’agriculture dans ses attributions, qui est le Président du Comité; 2° un registraire des droits d’obtenteur de variété végétale; 3° le registraire de variétés végétales qui est le secrétaire du Comité; 4° trois (3) chercheurs dont: a. un (1) améliorateur, b. un (1) pathologiste ou entomologiste c. un (1) agronome; 5° un (1) expert en législation semencière; Official Gazette nᵒ 16 of 17/04/2017 164 6° impuguke imwe (1) mu byerekeye iyamamazabuhinzi; 7° umuntu umwe (1) uhagarariye abacuruzi b’imbuto bigenga; 8° umuntu umwe (1) uhagarariye amashyirahamwe y’abahinzi. Ingingo ya 3: Biro ya Komite Biro ya Komite igizwe na Perezida, Visi Perezida n’Umwanditsi. Komite itora Visi Perezida mu nama yayo ya mbere itumizwa ikanayoborwa na Minisitiri ufite ubuhinzi mu nshingano ze. Abagize Biro ya Komite bagira manda y’imyaka itatu (3) ishobora kongerwa inshuro imwe (1) gusa. Ingingo ya 4: Kwigabanyamo udukomite Komite isanze ari ngombwa, ishobora kwigabanyamo udukomite twihariye two kwiga ku bibazo byihariye bya tekiniki. Abagize utwo dukomite twihariye bashyirwaho na Komite. 6° one (1) expert in agricultural extension system; 7° one (1) representative of private seed dealers; 8° one (1) representative of farmers’ organizations. Article 3: Bureau of the Committee The Bureau of the Committee is composed of a Chairperson, a Vice Chairperson and a Secretary. The Committee elects the Vice Chairperson during its first meeting convened and chaired by the Minister in charge of agriculture. Members of the Bureau of the Committee are elected for a term of office of three (3) years renewable only once. Article 4: Subdivision into subcommittees The Committee may, if necessary, form sub committees to deal with any particular technical aspect. Members of subcommittees are determined by the Committee. 6° un (1) expert en système de vulgarisation agricole; 7° un (1) représentant de prestataires privés des services de semences; 8° un (1) représentant des organisations des agriculteurs. Article 3: Bureau du Comité Le Bureau du Comité est composé du Président, du Vice-Président et du secrétaire. Le Comité élit le Vice-Président lors de sa première réunion convoquée et présidée par le Ministre ayant l’agriculture dans ses attributions. Les membres du Bureau du Comité ont un mandat de trois (3) ans renouvelable une seule fois. Article 4: Subdivision en sous-comités Le Comité peut, si nécessaire, être subdivisé en sous-comités pour traiter des aspects techniques d’une certaine particularité. Les membres de tels sous-comités sont déterminés par le Comité. Official Gazette nᵒ 16 of 17/04/2017 165 Ingingo ya 5: Inama za Komite Komite iterana kabiri (2) mu mwaka mu nama zisanzwe. Ishobora kandi guterana mu nama zidasanzwe igihe cyose bibaye ngombwa. Inama zose za Komite zitumizwa kandi zikayoborwa na Perezida wayo. Iyo Perezida adahari, inama za Komite zitumizwa kandi zikayoborwa na Visi-Perezida wa Komite. Iyo Perezida na Visi Prezida ba Komite badahari, Umwanditsi wa Komite afasha abandi bagize Komite bitabiriye inama kwitoramo uyiyobora. Ingingo ya 6: Gutumira mu nama za Komite umuntu ushobora kuyungura inama Komite isanze ari ngombwa, ishobora gutumira mu nama zayo, undi muntu wese ibona ko ashobora kuyungura inama ku ngingo runaka iri ku murongo w’ibyigwa. Uwatumiwe ntiyemererwa gutora kandi akurikirana gusa iyigwa ry’ingingo zerekeranye n’ibyo yasabwe gutangaho inama. Ingingo ya 7: Kwemeza ibyemezo bya Komite Ibyemezo bya Komite bifatwa ku bwumvikane busesuye. Article 5: Meetings of the Committee The Committee meets twice (2) a year in the ordinary sessions. It may also be convened in extraordinary sessions whenever necessary. All meetings of the Committee are convened and chaired by its Chairperson. In the absence of the Chairperson, the meetings are convened and chaired by the Vice Chairperson. In absence of both the Chairperson and the Vice Chairperson of the Committee, other committee members present under the assistance of the Secretary of the Committee, elect among themselves any other person to chair the meeting. Article 6: Invitation of a resource person to the meetings of the Committee Where the Committee finds it necessary, it may invite in its meetings any person from whom it may seek advice on certain issues on the agenda. The invited person shall not be allowed to vote and shall only participate to the discussion on items for which expert advice is sought. Article 7: Approval of the Committee’s resolutions The resolutions of the Committee are adopted by consensus. Article 5: Réunions du Comité Le Comité se réunit deux (2) fois par an en session ordinaire. Il peut aussi se réunir en sessions extraordinaires chaque fois que de besoin. Toutes les réunions du Comité sont convoquées et présidées par son Président. En cas d’absence du Président, les réunions du Comité sont convoquées et présidées par le Vice-Président Lorsque le Président et le Vice-Président sont tous absents, les membres présents élisent parmi eux celui qui préside la réunion sous l’assistance du Secrétaire du Comité. Article 6: Invitation d’une personne ressource aux réunions du Comité Lorsqu’il le juge nécessaire, le Comité peut inviter dans ses réunions toute personne pour l’examen d’un point inscrit à l’ordre du jour. La personne invitée n’a pas de voix délibérative et elle participe uniquement aux débats requérant son expertise. Article 7: Approbation des décisions du Comité Les décisions du Comité sont prises par consensus. Official Gazette nᵒ 16 of 17/04/2017 166 Ingingo ya 8: Ibigenerwa abagize Komite bitabiriye inama Ibigenerwa abagize Komite bitabiriye inama yayo bigenwa hakurikijwe amategeko abigenga. Ingingo ya 9: Amategeko ngengamikorere ya Komite Komite ishyiraho amategeko ngengamikorere yayo. Ingingo ya 10: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. Ingingo ya 11: Igihe iri teka ritangira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. Article 8: Sitting allowances for members of the Committee present in the meeting Sitting allowances allocated to the members of the Committee attending a meeting are determined in accordance with the relevant laws. Article 9: Internal rules and regulations of the Committee The Committee establishes its internal rules and regulations. Article 10: Repealing provision All prior provisions contrary to this Order are repealed. Article 11: Commencement This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Article 8: Jetons de présence alloués aux membres du Comité présents à la réunion Les jetons de présence alloués aux membres du Comité présents à la réunion sont déterminés conformément aux lois en la matière. Article 9: Règlement d’ordre intérieur du Comité Le Comité élabore son règlement d’ordre intérieur. Article 10: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées. Article 11: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
