Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 005/2016 of 05/04/2016 governing seeds and plant varieties in Rwanda, especially in Articles 4 and 5; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles, 121, 122 et 176; Vu la Loi no 005/2016 du 05/04/2016 régissant les semences et les variétés végétales au Rwanda, spécialement en ses articles 4 et 5; Ingingo ya 2: Isuzumwa ry’amoko y’ibihingwa Buri bwoko bushya bw’igihingwa bugomba kubanza gusuzumwa ubudasa, imimerere imwe n’ubudahindagurika mu miterere mbere yo kwandikwa ku rutonde rw’amoko y’ibihingwa uretse igihe ubwo bwoko bw’igihingwa bwasuzumwe nibura mu bihugu bibiri (2) biri mu mu miryango y’akarere cyangwa mpuzamahanga u Rwanda rubarizwamo. Buri bwoko bushya bw’igihingwa bwinjizwa ku rutonde rw’amoko y’ibihingwa ari uko bwakorewe isuzuma rishimishije ry’agaciro kisumbuye mu buhinzi no mu mikoreshereze yabwo cyangwa igeragezwa ry’imyitwarire y’igihingwa ku rwego rw’Igihugu. Inzobere, yaba ikigo cyangwa umuntu ku giti cye, bashobora gukora amageragezwa bayobowe n’ibiro by’umwanditsi w’amoko y’ibihingwa. Umwanditsi w’amoko y’ibihingwa ni we ushinzwe isuzumwa ry’amoko y’ibihingwa kugira ngo 1º procedures for evaluation, certification and registration of plant varieties; 2º procedures for withdrawal of certified plant varieties from the national plant variety list; 3º format of the national plant variety list. Article 2: Plant varieties testing Every new plant variety must pass the test of distinctness, uniformity and stability before its registration on the national plant variety lists unless it has passed these tests in at least two (2) member countries of regional or international organizations of which Rwanda is party. Every new variety is included on the list of plant varieties after satisfactorily undergoing the tests for value of cultivation and use or the national performance trials. An expert, either as an institution or an individual, may carry out experiments under the guidance of the plant variety registrar’s office. The plant variety registrar is responsible for carrying out variety tests for registration in 1º les procédures d’évaluation, d’homologation et d’enregistrement des variétés végétales; 2º les procédures de retrait d’une variété végétale au catalogue national des variétés végétales; 3º le format du catalogue national des variétés végétales. Article 2: Evaluation des variétés végétales Chaque nouvelle variété végétale doit passer le test de distinction, d'homogénéité et de stabilité avant son enregistrement sur les catalogues nationales de variétés végétales à moins qu’elle ait passé ces testes au moins dans deux (2) pays membre des organisations régionales ou internationales dont le Rwanda fait partie. Chaque nouvelle variété végétale est enregistrée sous condition d’avoir satisfait au test de valeur agronomique et technique ou les essais nationaux de performance de variété. Un expert, soit une institution ou un individu, peut effectuer les tests variétaux sous la direction du bureau du registraire des variétés végétales. Le registraire des variétés végétales est responsable de conduire les essais variétaux pour Official Gazette nᵒ 16 of 17/04/2017 139 yandikwe abyumvikanyeho na Komite ishinzwe gusuzuma, kwemeza no kwandika amoko y’ibihingwa. Ingingo ya 3: Amafaranga y’ikiguzi cyo gusuzuma no kwemeza ubwoko bw’igihingwa bushya Umuntu wese usaba ko ubwoko bw’igihingwa bwandikwa agomba kwishyura ikiguzi cyo gusuzuma n’icyo kwemeza ubwoko bushya bw’igihingwa kingana n’amafaranga y’u Rwanda agaragara mu ifishi nº 2 iri ku mugereka wa II w’iri teka. Ingingo ya 4: Igihe isuzuma ry’amoko y’ibihingwa rimara Isuzuma ry’ubwoko bw’igihingwa rigomba gukorwa nibura mu bihe by’ihinga bibiri (2) kandi rigakorerwa nibura ahantu hatari munsi ya hatatu (3). Ku mpamvu zo kugereranya, isuzuma ry’ubwoko bw’igihingwa rigomba kuba rigizwe n’ubwoko bw’icyitegererezo n’andi moko bisa asanzwe akoreshwa yatoranyijwe. Ingingo ya 5: Uburyo bwo kwemeza amoko mashya y’ibihingwa U Rwanda rukurikiza uburyo bukoreshwa na COMESA bwo kwemeza amoko mashya y’ibihingwa n’asanzwe akoreshwa nk’uko biteganywa n’Amasezerano ashyiraho Isoko consultation with the Committee responsible for evaluation, certification and registration of plant varieties. Article 3: Fees for testing and certification of a new plant variety Any applicant for plant variety registration must pay fees for testing and certification of the new plant variety as specified in form no 2 in annex II of this Order. Article 4: Duration for testing plant varieties Plant variety test must be conducted for two (2) growing seasons, at least on three (3) sites. For purpose of comparison, the plant variety tests must include standard and similar varieties from the reference collection of varieties. Article 5: Procedures for certification of new plant varieties Rwanda adopts the COMESA procedures for certification of new and existing varieties as provided for by the Treaty for the Establishment of Common Market of Eastern and Southern Africa. l’enregistrement en consultation avec le Comité d’évaluation, d’homologation et d’enregistrement des variétés végétales. Article 3: Frais d’évaluation et de certification d’une nouvelle variété végétale Tout demandeur d’enregistrement d’une variété végétale doit payer des frais d’évaluation et de certification de la nouvelle variété végétale selon le formulaire nº 2 en annexe II du présent arrêté. Article 4: Durée de test des variétés végétales Un test d’une variété végétale doit être conduit pendant au moins deux (2) saisons culturales et au moins sur trois (3) sites. Pour des fins de comparaison, les tests d’une variété végétale doivent inclure des variétés standard et des variétés similaires à partir de la collection des variétés. Article 5: Procédures d’homologation de nouvelles variétés végétales Le Rwanda adopte les procédures d’homologation de variétés végétales du COMESA pour les nouvelles et les variétés existantes tel que prescrit Official Gazette nᵒ 16 of 17/04/2017 140 Rusange rihuriweho n’Ibihugu by’Afurika y’Iburasirazuba n’iy’Amajyepfo. Ingingo ya 6: Kubungabunga ubwoko bw’igihingwa Kugira ngo buri bwoko bw’igihingwa bwemezwe kandi butangazwe bugomba kubungabungwa na nyirabwo cyangwa umuhagarariye, ushinzwe by’umwihariko: 1º kubungabunga umwimerere w’ubwoko bw’igihingwa; 2º gutanga imbuto ku rwego rubishinzwe igihe cyose zikenewe mu gihe cyo kwandika ubwoko bw’igihingwa. Ingingo ya 7: Gusaba ko ubwoko bw’igihingwa bwandikwa Umuntu wese wifuza kwandikisha ubwoko bw’igihingwa yuzuza ifishi yabugenewe No1 iri ku mugereka wa I w’iri teka akayoherereza urwego rubifitiye ububasha. Usaba kwandikisha ubwoko bw’igihingwa ni we wishingira kugaragaza ko ibiranga ubwoko bw’igihingwa giherekeje ubusabe ari cyo kizagenzurwa mu isuzuma ry’ubudasa, kugira imiterere imwe no kudahindagurika mu miterere. Umwanditsi w’amoko y’ibihingwa yemera ibiranga ubwoko bw’igihingwa nk’uko yabihawe n’usaba, hanyuma akandika ubwoko bw’igihingwa Article 6: Maintenance of plant variety Every plant variety must, for purposes of its certification and publication, be maintained by the owner or his/her representative who is particularly responsible for: 1º maintaining the genetic purity of the variety; 2º providing the seeds to the competent authority at any time during the period of registration. Article 7: Application for plant Variety registration Any person who intends to register a variety of a plant fills an appropriate form No1 in annex of this Order and submits it to the competent authority. The applicant for plant variety registration is responsible for the accuracy of the plant variety description that is submitted on application, which will be verified by distinctness, uniformity and stability. The plant variety registrar accepts the description of the plant variety provided for by the applicant and enrolls the plant variety on the list of plant par le Traité portant création du Marché Commun de l’Afrique Orientale et Australe. Article 6: Maintenance de la variété végétale Pour être homologué et publié, chaque variété végétale doit être maintenue par son obtenteur ou son délégué spécialement chargé de: 1º maintenir la pureté génétique de la variété végétale; 2º fournir les semences à l’autorité compétente à n’importe quel moment lors de la période d’enregistrement. Article 7: Demande d’enregistrement d’une variété végétale Toute personne qui veut faire l’enregistrement d’une variété végétale, complète le formulaire appropriée No1 en annexe I du présent arrêté et le soumet à l’autorité compétente. Le demandeur d’enregistrement d’une variété végétale est responsable de l’exactitude de la description de la variété végétale qui sera vérifiée lors du test de distinction, d’homogénéité et de stabilité. Le registraire des variétés végétales accepte la description de la variété végétale fournie par le demandeur et inscrit cette variété végétale sur la Official Gazette nᵒ 16 of 17/04/2017 141 ku rutonde rw’amoko y’ibihingwa azakorerwa isuzumwa ry’ubudasa, kugira imimerere imwe no kudahindagurika mu miterere hamwe n’isuzuma ku gaciro kisumbuye mu buhinzi no mu mikoreshereze. Ingingo ya 8: Amakuru ahabwa usaba ko ubwoko bw’igihingwa bwandikwa Umwanditsi w’amoko y’ibihingwa amenyesha ibi bikurikira usaba ko ubwoko bw’igihingwa bwandikwa: 1º aho agomba kugeza imbuto cyangwa ibindi bikoreshwa mu gukwirakwiza ibihingwa bikenewe mu igeragezwa, mu gihe igeragezwa rizakorerwa ahandi hatari ku biro by’umwanditsi w’amoko y’ibihingwa; 2º aderesi n’itariki ntarengwa yo kugeza imbuto cyangwa ibindi bikoreshwa mu gukwirakwiza ibihingwa bikenewe mu igeragezwa ahazakorerwa igeregezwa. Ingingo ya 9: Iyandikwa ry’ubwoko bushya Nyuma y’isesengura rya raporo ku isuzuma ry’ubudasa, kugira imimerere imwe no kudahindagurika mu miterere hamwe n’isuzuma ku gaciro kisumbuye mu buhinzi no mu mikoreshereze byatanzwe n’umwanditsi w’amoko y’ibihingwa, Komite ishinzwe gusuzuma, kwemeza, kwandika amoko y’ibihingwa no kuyakura ku rutonde, ifata umwanzuro wo varieties proposed for tests of the distinctness, uniformity and stability; as well as the test for value for cultivation and use Article 8: Information given to the applicant of plant variety registration The plant variety registrar informs the applicant of plant variety registration on the following: 1º where to deliver the necessary quantity of seeds or propagating material for the trials, if the variety test will take place in a site other than the plant variety registrar’s office; 2º the address and the deadline for delivery of necessary quantity of seeds or propagating material for the trials on a test site. Article 9: Registration of a new variety After the analysis of the report on the test for distinctness, uniformity and stability as well as the test of value for cultivation and use submitted by the plant variety registrar, the Committee in charge of evaluation, certification and registration of plant varieties and their withdrawal from the list, decides to certify the new variety if it is distinct, uniform liste des variétés végétales proposées aux tests de distinction, d’uniformité et de stabilité ainsi que le test de valeur agronomique technologique. Article 8: Information donnée au demandeur d’enregistrement d’une variété végétale Le registraire des variétés végétales informe le demandeur d’enregistrement d’une variété végétale sur ce qui suit: 1º le lieu de livraison de la quantité nécessaire des semences ou de matériel de plantation requis pour les essais, si le site d’essai est autre que le bureau du registraire des variétés végétales; 2º l’adresse et la date limite de livraison de la quantité nécessaire des semences ou de matériel de plantation requis pour les essais sur le site d’essai. Article 9: Enregistrement de la nouvelle variété Apres l’analyse du rapport sur le test de distinction, d’uniformité et de stabilité ainsi que le test de valeur agronomique et technologique soumis par le registraire des variétés végétales, le Comité chargé d’évaluation, d’homologation et d’enregistrement des variétés végétales et de leur retrait de la liste, décide d’homologuer la nouvelle variété si elle est Official Gazette nᵒ 16 of 17/04/2017 142 kwemeza ubwoko bushya bw’igihingwa igihe bwujuje ibisabwa ku budasa, ugira imimerere imwe no kudahindagurika mu miterere n’isuzuma ry’agaciro kisumbuye mu buhinzi no mu mikoreshereze. Ashingiwe ku cyemezo cya Komite ishinzwe gusuzuma, kwemeza, kwandika amoko y’ibihingwa no kuyakura ku rutonde kivugwa mu mu gika cya mbere cy’iyi ngingo, umwanditsi w’amoko y’ibihingwa yinjiza ubwoko bushya bw’igihingwa mu gitabo cyandikwamo amoko y’ibihingwa kandi akagaragaza ibiburanga byose n’andi makuru ya ngombwa yerekeye ubwo bwoko bw’igihingwa. Komite ishinzwe gusuzuma, kwemeza, kwandika amoko y’ibihingwa no kuyakura ku rutonde imenyesha mu nyandiko usaba icyemezo yafashe ku isuzuma ry’ubwoko bw’igihingwa mu gihe gitarenze iminsi cumi n’ine (14) icyemezo gifashwe. Ingingo ya 10: Gushyira amoko y’ibihingwa ku rutonde rw’Igihugu rw’amoko y’ibihingwa Amoko yose y’ibihingwa yemejwe kandi yatangajwe mu Rwanda agomba gushyirwa ku rutonde rw’Igihugu rw’amoko y’ibihingwa ruvugururwa buri mwaka kandi rugatangazwa na Minisitiri ufite ubuhinzi mu nshingano ze. and stable and has satisfied the test for value for cultivation and use. Based on the decision of the Committee responsible for evaluation, certification and registration of plant varieties and their withdrawal from the list provided for in Paragraph One of this Article, the registrar of plant variety enrolls the new variety in the register of plant variety with all its characteristics and any other necessary information related to that plant variety. The Committee for evaluation, certification and registration of plant varieties and their withdrawal from the list, notifies in writing the applicant of its decision on the application within a period not exceeding fourteen (14) days from the date of its decision. Article 10: Registration of plant varieties on the national plant variety list All plant varieties certified and published in Rwanda must be registered on the national plant variety list which is updated and published every year by the Minister in charge of agriculture. distincte, homogène et stable et satisfait au test de valeur agronomique et d’utilisation. Le Comité d’évaluation, d’homologation et d’enregistrement des variétés végétales et de leur retrait de la liste notifie par écrit au demandeur, sa décision sur sa demande dans un délai ne dépassant pas quatorze (14) jours à compter de la date de prise de décision. Article 10: Enregistrement des variétés végétales sur le catalogue national des variétés végétales Toutes les variétés végétales homologuées et publiées au Rwanda sont enregistrées sur le catalogue national des variétés végétales qui est mis à jour et publié annuellement par le Ministre ayant l’agriculture dans ses attributions. Article 12: Suspension of a plant variety from the register The registrar of a plant variety may suspend a plant variety from the register for up to two (2) years if: 1º the plant variety has an adverse effects on Rwandan agriculture and the food security due to disease susceptibility or inferior quality; 2º seeds from the plant variety demonstrate significant levels of contamination such that its varietal purity has been compromised; 3º the plant variety has been altered in such a manner that it differs from the representative legal reference sample; 4º the plant variety or its progeny may be detrimental to human, animal or environmental health and safety; Article 11: Contenu du catalogue national des variétés végétales Le catalogue de variétés végétales doit contenir les informations prévues au formulaire no 3 en annexe III du présent arrêté. Article 13: Withdrawal of a plant variety from the national plant variety list The registrar of plant varieties withdraws the registration of a plant variety from the national plant variety list and the register of plant varieties: 1º if the plant variety is altered in such a manner as to convert it to a plant variety that is registered under a different name; 2º if the plant variety is found to be indistinguishable from another plant variety already registered or known to exist; 3º if the plant variety is of a kind of crop or species no longer subject to the plant variety registration requirements; 4º upon the request of the owner of the plant variety with the written permission of the registrar of plant variety; 5º the plant variety registration has been suspended for two (2) years and if the reasons for the suspension are still valid. 5º les informations fausses ou trompeuses ont été fournies lors de la demande de l’enregistrement d’une variété végétale. Article 13: Retrait d’une variété végétale au catalogue national des variétés végétales Le registraire des variétés végétales retire la variété végétale au catalogue national et au registre des variétés végétales: 1º lorsque la variété végétale a été altérée de telle manière qu’il faut la convertir en une autre variété végétale enregistrée sous un autre nom; 2º lorsque la variété végétale a été trouvée non distincte d’une autre variété végétale déjà enregistrée ou reconnue comme existante; 3º lorsque la variété végétale est d’un type de culture ou d’espèce dont la variété végétale ne fait plus l’objet d’enregistrement; 4º à la demande de l’obtenteur de la variété végétale avec une permission écrite du registraire des variétés végétales; 5º si l’enregistrement d’une variété végétale a été suspendu pendant deux (2) ans et que les raisons de sa suspension sont encore valides.
