Ingingo ya 2: Inshingano z’Akanama Akanama gafite inshingano zo: 1° kugaragariza Minisitiri ufite ubuhinzi mu nshingano ze ingamba n’uburyo buri bwoko bw’ibihingwa bugomba kugeragezwa mbere yo kwemezwa; 2° kwakira no gusuzuma inyandiko zagejejwe ku MINISTERIAL ORDER N°001/11.30 OF APPOINTING THE VARIETY RELEASE COMMITTEE The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 04 June 2003, as amended to date, especially in Articles 93, 120 and 201; Pursuant to Law n°14/2003 of 23/05/2003 on Production, Quality Control and Marketing of plant quality seeds, especially in Article 3 ; After consideration and approval by the Cabinet, in its session of 14/05/2010; HEREBY ORDERS: Article One: Establishment of the Committee A Variety Release Committee (VRC), hereafter “Committee”, is hereby established. Article 2: Responsibilities of the Committee The Committee shall be responsible for: 1° suggesting to the Minister in charge of Agriculture the conditions and modalities for testing every variety submitted for release; 2° receiving and processing applications ARRETE MINISTERIEL N°001/11.30 DU 18/08/2010 DESIGNANT LE COMITE D’HOMOLOGATION VARIETALE Le Ministre de l’Agriculture et des Ressources Animales ; Vu la Constitution de la République du Rwanda du 04 juin 2003, telle que révisée à ce jour, spécialement en ses articles 93, 120 et 201; Vu la Loi n°14/2003 du 23/05/2003 portant Production, Contrôle de qualité et Commercialisation des semences végétales, spécialement en son article 3 ; Après examen et adoption par le Conseil des Ministres, en sa séance du 14/05/2010 ; ARRETE: Article premier : Création du Comité Il est créé un Comité d’Homologation Variétale (CHV) ci-après dénommé «Comité». Ingingo ya 3: Abagize Akanama Akanama kagizwe n’abanyamuryango bahoraho icumi (10), bashyirwaho na Minisitiri ufite ubuhinzi mu nshingano ze, bakomoka mu byiciro bitandatu (6) binyuranye aribyo: ubushakashatsi, amategeko n’amabwiriza agenga imbuto, iyamamazabuhinzi, ubutubuzi n’ubucuruzi bw’imbuto n’abakoresha imbuto bibumbiye mu miryango y’abahinzi. Abagize Akanama bigabanyije muri ibyo byiciro ku buryo bukurikira: 1° abashakashatsi batatu barimo; inzobere mu byo kurema amoko y’imbuto, inzobere mu by’indwara z’ibihingwa n’inzobere mu by’udusimba tugabanya umusaruro w’ibihingwa; 2° impuguke imwe (1) mu by’amategeko submitted by variety owners for their variety to be released; 3° supervising tests for DUS ( Distinctness, Uniformity, Stability) and VCU (Value for Cultivation and Use) for new varieties submitted for release and the NVPT ( National Variety Performance Trial) for varieties released in other Countries to be registered on the National Plant Variety List; 4° releasing seed varieties for production of quality seeds; 5° submitting to the Minister in charge of agriculture, for approval, a list of varieties to be registered or withdrawn from the National Plant Variety List (NPVL). Article 3: Members of the Committee The Committee shall comprise of ten (10) permanent members, appointed by the Minister in charge of Agriculture from the six (6) following domains: research, seed policy, extension, seed production and marketing and the use of quality seeds through farmers’ organisations. The Committee members shall be divided up into six (6) domains as follows: 1° three (3) researchers consisting of a seed breeder specialist, a pathologist and an entomologist; 2° one (1) expert in seed policies; d’homologation variétale soumises au comité par les propriétaires ; 3° superviser les tests DHS (Distinction, Homogénéité, Stabilité) et VAT (Valeur Agronomique et Technique) pour les nouvelles variétés proposées à l’homologation, ainsi que les ENPV (Essais Nationaux de Performance Variétale) pour les variétés homologuées dans d’autres pays proposées à l’inscription au catalogue national des variétés de plantes ; 4° homologuer les variétés des semences pour la production des semences de qualité ; 5° soumettre, pour approbation, au Ministre ayant l’agriculture dans ses attributions une liste des variétés à inscrire au catalogue des variétés des plantes ou à rayer annuellement dudit catalogue. Article 3 : Composition du Comité Le Comité est composé de dix (10) membres permanents, désignés par le Ministre ayant l’agriculture dans ses attributions et provenant des six (6) domaines suivants : la recherche, la politique semencière, la vulgarisation, la production et la commercialisation des semences et l’utilisation des semences de qualité à travers des organisations d’agriculteurs. Les membres Comité se répartissent dans les six (6) domaines de la manière suivante : 1° trois (3) chercheurs dont un améliorateur, un pathologiste et un entomologiste ; 2° un (1) expert en politiques semencières ; Official Gazette nº40 of 04/10/2010 7 n’amabwiriza agenga imbuto nziza; 3° impuguke ebyiri (2) mu byerekeye iyamamaza buhinzi harimo umwe w’inzobere mu mashuri akorerwa mu milima; 4° umuntu umwe (1) uhagarariye abatubuzi b’imbuto nziza; 5° Umuntu umwe (1) uhagarariye abacuruzi b’imbuto nziza; 6° abantu babiri (2) bahagarariye amashyirahamwe y’abahinzi barimo umwe ku bihingwa byo mu misozi migufi n’iciriritse n’undi ku bihingwa byo mu misozi miremire. Mu nama zako, Akanama gasanze ari ngombwa, gashobora gutumira undi muntu wese kabona ko ashobora kukungura inama ku ngingo runaka gafite ku murungo w’ibyigwa. Uwatumiwe ntiyemererwa gutora kandi akurikirana gusa iyigwa ry’ingingo zerekeranye n’ibyo yasabwe gutangaho inama. Ingingo ya 4: Biro y’Akanama na manda y’abayigize Biro y’Akanama igizwe na Perezide, Visi Perezida n’umwanditsi batorwa na bagenzi babo mu nama ya mbere itumizwa na ikanayoborwa na Minisitiri ufite ubuhinzi mu nshingano ze. Manda y’abagize biro y’Akanama imyaka itatu (3) ishobora kongerwa inshuro imwe (1) gusa. Ingingo ya 5: Kwigabanyamo amatsinda Akanama gasanze ari ngombwa, gashobora kwigabanyamo amatsinda yakwiga ku bintu 3° two (2) experts in the agricultural extension system, one of them shall be a “farmer field school” expert. 4° one (1) representative of seed producers; 5° one (1) representative of seed dealers; 6° two (2) representatives of small farmers’ organizations, one for the low and middle altitudes crops and the other for high altitudes crops. In its meetings, the Committee may invite any person from him it may seek advice on a certain item on the agenda. The invitee shall not be allowed to vote and shall only follow the debate on items for which an advice is sought. Article 4: Board and term of the Committee The board of the Committee shall be composed by a President, a Vice President and a Secretary designated by the Board members fellows during the first meeting convened and chaired by the Minister in charge of Agriculture. The term of the board members shall be three (3) years, renewable once. Article 4 : Bureau et mandat du Comité Le bureau du Comité est composé du Président, du Vice-Président et du secrétaire désignés par leurs pairs lors de la première réunion convoquée et présidée par le Ministre ayant l’agriculture dans ses attributions. Leur mandat est de trois (3) ans renouvelable une seule fois. Article 5 : Subdivision en sous comités Le Comité peut, si nécessaire, être subdivisé en sous comités techniques pour traiter des aspects techniques d’une certaine particularité. Ingingo ya 7: Inama z’Akanama Akanama gaterana kabiri (2) mu mwaka mu nama zisanzwe buri gihe mbere y’uko igihembwe cy’ihinga gitangira. Ariko hejuru y’izo nama zisanzwe, igihe cyose bibaye ngombwa, hashobora gutumizwa inama zidasanzwe. Inama zisanzwe n’izidasanzwe zitumizwa na Perezida w’Akanama cyangwa na Visi-Perezida, iyo Perezida adahari ariko yamusigiye ububasha. Article 6: Sitting allowances A sitting allowance for members of the Committee attending meetings is fixed at fifty thousand Rwandan francs (50,000 RWF) per day. This amount may be reviewed if necessary, upon approval by the Minister in charge of Agriculture. Article 7: Meetings of the Committee The Committee shall meet twice (2) a year in ordinary sessions before the beginning of each crop season. In addition to the ordinary sessions, extraordinary sessions may be convened whenever deemed necessary. Ordinary and extraordinary meetings shall be convened by the President of the Committee or, in the absence of the President, by the Vice President duly delegated by the President. Article 8: Approval of the Committee’s resolutions The resolutions of the Committee shall be adopted by consensus and submitted to the Minister in charge of Agriculture for final approval. composition de telles sous comités est décidée par le Comité. Article 6 : Jeton de présence pour les participants à la réunion Les jetons de présence alloués aux membres du Comité ayant participé aux réunions sont fixés à cinquante milles francs rwandais (50 000 Frw) par jour. Article 7 : Réunion du Comité Le Comité se réunit deux (2) fois par an en session ordinaire, chaque fois avant le début de la saison culturale. En plus des sessions ordinaires, des sessions extra ordinaires peuvent être convoquées chaque fois que de besoin. Les sessions ordinaires et extraordinaires doivent être convoquées par le Président ou le Vice Président en cas d’absence du Président mais avec l’autorisation du premier. Article 8 : Approbation des décisions du Comité Les décisions du Comité sont prises par consensus et sont soumises au Ministre ayant l’agriculture dans ses attributions pour approbation finale.
