MINISTERIAL ORDER No 009/11.30 OF 11/04/2017 DETERMINING THE REQUIREMENTS FOR A PERSON TO BE AUTHORIZED TO BECOME A QUALITY SEED PRODUCER, CONDITIONER OR DEALER The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 005/2016 of 05/04/2016 governing seeds and plant varieties in Rwanda , especially in Article 11; After consideration and approval by the Cabinet, in its session of 03/02/2017; HEREBY ORDERS: Article One: Purpose of this Order This Order determines the requirements for a person to be authorized to become a quality seed producer, conditioner or dealer. ARRETE MINISTERIEL No 009/11.30 DU 11/04/2017 DETERMINANT LES CONDITIONS REQUISES POUR UNE PERSONNE D’ETRE AUTORISEE A DEVENIR PRODUCTEUR, CONDITIONNEUR OU PRESTATAIRE DES SERVICES DE SEMENCES DE QUALITE Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 121, 122 et 176; Vu la Loi n° 005/2016 du 05/04/2016 régissant les semences et les variétés végétales au Rwanda, spécialement en son article 11; Après examen et adoption par le Conseil des Ministres, en sa séance du 03/02/2017; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté détermine les conditions requises pour une personne d’être autorisée à devenir producteur, conditionneur ou prestataire des services de semences de qualité. Official Gazette nᵒ 16 of 17/04/2017 111 Ingingo ya 2: Ibisabwa mu kwiyandikisha nk’umuntu utubura imbuto Umuntu wese wifuza kwandikwa nk’umutubuzi w’imbuto agomba: 1º kubisaba mu nyandiko ku rwego rubifitiye ububasha; 2º kuba afite inyemezabwishyu y’amafaranga ateganyijwe muri iri teka; 3º kuba afite ubutaka bwo gukoreraho n’inyubako zikenewe zuzuje ibisabwa. Urwego rubifitiye ububasha rugomba kubika urutonde rw’abatubuzi b’imbuto bemewe. Ingingo ya 3: Ibisabwa mu kwiyandikisha nk’umuntu utunganya imbuto Umuntu wese wifuza kwandikwa nk’utunganya imbuto agomba: 1º kwandikisha uruganda rwe ku rwego rubifitiye ububasha; 2º kuba afite abakozi bahuguwe, bafite ubumenyi mu byerekeye imbuto, bumva neza itegeko rigenga imbuto n’amako y’ibihingwa mu Rwanda; Article 2: Requirements for registration as a seed producer A person who intends to register as a seed producer must: 1° apply in writing to the competent authority; 2° possess a proof of payment of the fees provided for in this Order; 3° have an adequate land and facilities as per specific standards. The competent authority must keep a list of recognized seed producers. Article 3: Requirements for registration as a seed conditioner A person who intends to register as a seed conditioner must: 1º register his/her factory to the competent authority; 2º have adequately trained personnel who are, knowledgeable in seed related matters and conversant with the Law governing seeds and plant varieties in Rwanda; Article 2: Conditions requises pour l’enregistrement en tant que producteur de semences Une personne souhaitant d’être enregistrée en tant que producteur de semences doit: 1º adresser une demande écrite à l’autorité compétente; 2º posséder une preuve de paiement des frais prévus dans le présent arrêté; 3º avoir des terres et autre infrastructure requises répondant aux normes requises. L’autorité compétente doit tenir une liste des producteurs de semences agréés. Article 3: Conditions requises pour l’enregistrement en tant que conditionneur de semences Une personne souhaitant d’être enregistrée en tant que conditionneur de semences doit: 1º faire enregistrer son usine à l’autorité compétente; 2º avoir du personnel bien formé ayant des compétences en matière de semences et des connaissances suffisante sur la loi régissant les semences et les variétés végétales au Rwanda; Official Gazette nᵒ 16 of 17/04/2017 112 3º kubisaba urwego rubifitiye ububasha kandi akishyura amafaranga ateganijwe mu ifishi no 2 iri ku mugereka wa II w’iri teka; 4º kuba afite ibikoresho byose bikenerwa mu gutunganya no kubika imbuto. Ingingo ya 4: Ibisabwa mu kwiyandikisha nk’umuntu ucuruza imbuto Umuntu wese wifuza kwandikwa nk’umucuruzi w’imbuto agomba: 1º kwandika abisaba urwego rubifitiye ububasha; 2º kuba afite inyubako abikamo imbuto n’ibindi byangombwa bisabwa mu bucuruzi bw’imbuto. Ingingo ya 5: Uburyo bwo kwiyandikisha Umuntu ushaka kwiyandikisha nk’umuntu utubura imbuto, utunganya imbuto cyangwa ucuruza imbuto abisaba urwego rubifitiye ububasha akuzuza ifishi nº 1 iri ku mugereka wa I w’iri teka. Ushaka kwiyandikisha, iyo amaze kwishyura, ahabwa icyemezo na nimero y’ubucuruzi nk’uko 3º apply to the competent authority and pay fees provided for in the form no 2 in annex II to this Order; 4º have all necessary equipment for seed conditioning and its storage. Article 4: Requirements for registration as a seed dealer Any person who intends to register as a seed dealer must: 1º apply to the competent authority for registration; 2º have appropriate storage facilities and other necessary requirements for seed trade. Article 5: Modalities for registration An applicant for registration as a seed producer, seed conditioner or dealer must apply to the competent authority by filling the appropriate form nº 1 in annex I of this Order. After the payment of the provided fees, the applicant must be given a certificate of 3º faire la demande à l’autorité compétente et payer les frais prévus au formulaire no 2 en annexe II du présent arrêté; 4º disposer tous les équipements nécessaires pour le conditionnement de semences et leur stockage. Article 4: Conditions requises pour l’enregistrement en tant que prestataire des services de semences Toute personne souhaitant d’être enregistré en tant que prestataire des services de semences doit: 1º faire la demande à l’autorité compétente pour l’enregistrement; 2º disposer les installations de stockage appropriées et d’autres exigences nécessaires pour le commerce des semences. Article 5: Modalités d’enregistrement Un requérant pour être enregistré comme producteur, conditionneur de semences ou prestataire des semences doit en faire une demande à l’autorité compétente, en remplissant le formulaire nº 1 en annexe I du présent arrêté. A registration certificate granted must be conspicuously displayed on the business premises of a registered seed dealer. Article 6: Repealing provision All prior provisions contrary to this Order are repealed.
