MINISTERIAL ORDER No 007/11.30 OF 11/04/2017 DETERMINING THE REQUIREMENTS FOR A PERSON TO BE GRANTED A LICENSE FOR IMPORTING AND EXPORTING SEEDS The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 005/2016 of 05/04/2016 governing seeds and plant varieties in Rwanda, especially in Article 13; After consideration and approval by the Cabinet, in its session of 03/02/2017; HEREBY ORDERS: Article One: Purpose of this Order This Order determines the requirements for a person to be granted a license for importing and exporting seeds. ARRETE MINISTERIEL No 007/11.30 DU 11/04/2017 DETERMINANT LES CONDITIONS REQUISES POUR QU’UNE PERSONNE SOIT OCTROYEE UNE LICENCE D’IMPORTATION ET D’EXPORTATION DE SEMENCES Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 121, 122 et 176; Vu la Loi n° 005/2016 du 05/04/2016 régissant les semences et les variétés végétales au Rwanda, spécialement en son article 13; Après examen et adoption par le conseil des Ministres, en sa séance du 03/02/2017; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté détermine les conditions requises pour qu’une personne soit octroyée une licence d’importation et d’exportation de semences. Official Gazette nᵒ 16 of 17/04/2017 98 Ingingo ya 2: Ibisabwa kugira ngo hinjizwe imbuto mu gihugu Umuntu wifuza gutumiza imbuto mu gihugu agomba kuba: 1º yanditse nk’umucuruzi w’imbuto; 2º yemeza ko imbuto ari iz’ubwoko bw’igihingwa buri ku rutonde rw’Igihugu rw’amoko y’ibihingwa; 3º yemeza ko imbuto zujuje ubuziranenge harimo ibijyanye n’ibikoresho byo gupfunyika imbuto, gufunga n’ibirango nk’uko biteganywa n’itegeko; 4º yasabye urwego rubifitiye ububasha agaragaza icyifuzo cyo kwinjiza izo mbuto kandi akaba yaremerewe afite n’uruhushya rwo kuzinjiza; 5º yemeza ko imbuto zinjiriye ku cyambu giteganyijwe; 6º kugaragaza uko imbuto zingana, inkomoko n’ubwoko bw’igihingwa bugiye kwinjizwa. Article 2: Requirements for importation of seeds A person who intends to import seeds must: 1º be registered as a seed dealer; 2º ensure that the seed is of a variety entered in the national plant variety list; 3º ensure that the seeds comply with the minimum seed standards including standards related to seed packaging materials, seals and labels set out in the law; 4º have applied to the competent authority declaring intention to import such seeds and has, with the approval of the competent authority, been issued with an import permit; 5º ensure that the seeds are imported through a specified port of entry; 6º specify the quantity, the species and the plant variety of the intended import. Article 2: Conditions requises pour l’importation de semences Une personne qui désire importer de semences doit: 1º être enregistré comme un commerçant de semences; 2º assurer que la semence est d’une variété inscrite dans le catalogue national des variétés végétales; 3º assurer que les semences sont conformes aux normes minimales de semences, y compris les normes relatives aux matériaux d’emballage des semences, scellés et les étiquettes énoncés dans la loi; 4º avoir présenté une demande à l’autorité compétente déclarant son intention d’importer ces semences et ayant son approbation et le permis d’importation; 5º assurer que la semence est importée via un port d’entrée prescrit; 6º préciser la quantité, les espèces et la variété végétale de l’importation envisagée. Official Gazette nᵒ 16 of 17/04/2017 99 Ingingo ya 3: Uburyo bwo kwinjiza imbuto mu gihugu Umuntu wifuza kwinjiza imbuto mu gihugu agomba kuzuza ifishi isaba kwinjiza imbuto yabugenewe itangwa n’urwego rubifitiye ububasha. Ubusabe kandi bugomba kuba buherekejwe n’inyandiko zikurikira: 1º icyemezo cy’ubuziranenge bw’ibimera gifite agaciro n’icyemezo cy’icunga cyangwa icyemezo cy’imbuto cya COMESA gitangwa n’urwego rubifitiye ububasha rw’igihugu imbuto ikomokamo cyangwa icyemezo cy’ubuziranenge cyo kongera kohereza hanze y’igihugu gitangwa n’igihugu imbuto yavuyemo; 2º kopi y’icyemezo cy’igeragezwa ry’imbuto gitangwa n’urwego rubifitiye ububasha; 3º icyemezo cyo guhungira cyangwa icyemezo cyerekana ibyakorewe imbuto mbere yo koherezwa. Icyemezo kigomba kwerekana ubwoko bw’umuti wakoreshejwe, itariki n’igihe icyo gikorwa cyamaze; 4º izindi nyandiko zose zisabwa ku ruhushya rwo kwinjiza imbuto mu gihugu. Article 3: Modalities for the importation of seeds Any person who intends to import seeds must fill an appropriate form provided by the competent authority requesting for importation of the seeds. The application must also be accompanied by the following documents: 1º a valid phytosanitary certificate and orange certificate or a COMESA seed certificate issued by a competent authority of the country of origin of the seeds or a re-export phytosanitary certificate from the exporting country; 2º a copy of seeds testing certificate issued by a competent authority; 3º a fumigation certificate or a certificate indicating the treatment given to the seeds before dispatch. The certificate must indicate the type of chemical used, the date and the duration of treatment; 4º all other required documents for the seeds import permit. Article 3: Modalités d’importation de semences Une personne qui désire importer les semences doit remplir un formulaire de demande fourni par l’autorité compétente requérant l’importation de semences. La demande doit aussi être accompagnée par les documents suivants: 1º un certificat phytosanitaire valide et le certificat orange ou le certificat de semence de COMESA délivré par l’autorité compétente du pays d’où proviennent les semences ou un certificat de réexportation phytosanitaire du pays exportateur; 2º une copie du certificat de test de semences délivré par une autorité compétente; 3º un certificat de fumigation ou un certificat indiquant le traitement donné aux semences avant l’expédition. Ce certificat doit indiquer le type de produit chimique utilisé, la date et la durée du traitement; 4º tous les autres documents requis sur le permis d’importation des semences dans le pays. Official Gazette nᵒ 16 of 17/04/2017 100 Ingingo ya 4: Ibisabwa kugira ngo imbuto zoherezwe hanze y’igihugu Umuntu wohereza imbuto hanze y’igihugu agomba: 1º kuba afite uruhushya rwanditse rw’urwego rubifitiye ububasha; 2º kuzuza inyandiko itegetswe kandi akishyura amafaranga ategetswe hubahirijwe ibisabwa muri iri teka; 3º kumenya niba imbuto zujuje ubuziranenge bw’imbuto bwo mu karere; 4º kureba niba imbuto zagenzuwe n’urwego rubifitiye ububasha kugira ngo hubahirizwe ubuziranenge bw’imbuto n’ibimera; 5º gusaba urwego rubifitiye ububasha icyemezo cy’ubuziranenge bw’ibimera; 6º kureba niba imbuto zipfunyitse neza kandi zifite ikirango gikwiye. Nyuma yo gushyikirizwa ubusabe buvugwa mu gace ka 5o k’iyi ngingo, urwego rubifitiye ububasha rukora igenzura ry’imbuto kandi rukanafata ibipimongero nk’uko biteganywa n’amategeko abigenga kugira ngo bisuzumwe na laboratwari yemewe. Article 4: Requirements for export of seeds Any person exporting seeds must: 1º possess a written authorisation from the competent authority; 2º fill the prescribed form and pay the prescribed fees in accordance with the conditions specified in this Order; 3º ensure that the seeds conform to the standards of regional seeds; 4º ensure that the seeds are inspected by the competent authority in accordance with phytosanitary standards; 5º apply to the competent authority for a phytosanitary certificate; 6º ensure that seeds are properly packaged and labeled. The competent authority, after receiving the application mentioned in point 5o of this law, inspects seeds and takes samples in accordance with relevant laws in order to test such samples in a recognised laboratory. Article 4: Conditions requises pour l’exportation de semences Une personne exportant les semences doit: 1º posséder une autorisation écrite de l’autorité compétente; 2º remplir le formulaire prescrit et payer les frais prescrits conformément aux conditions spécifiées dans le présent arrêté; 3º veiller à ce que les semences soient conformes aux normes standards de semences régionales; 4º veiller à ce que les semences soient inspectées par l’autorité compétente conformément aux normes phytosanitaires; 5º faire la demande d’un certificat phytosanitaire à l’autorité compétente; 6º veiller à ce que les semences soient bien emballées et étiquetées. Après la réception de la demande visée au point 5o du présent article, l’autorité compétente entreprend l’inspection de semences et prélève des échantillons conformément aux lois en la matière, afin de les tester dans le laboratoire agrée. Official Gazette nᵒ 16 of 17/04/2017 101 Ingingo ya 5: Uburyo bwo kohereza imbuto hanze y’u Rwanda Umuntu ushaka kohereza imbuto hanze y’igihugu agomba : 1º kuzuza ifishi isaba icyemezo cy’ubuziranenge bw’ibimera itangwa n’urwego rubifitiye ububasha; 2º gutanga inyandiko ziherekeza ubusabe zisabwa n’urwego rubifitiye ububasha zikurikira: a) icyemezo cy’imbuto gifite agaciro gitangwa n’urwego rubifiye ububasha kigaragaza ko izo mbuto zubahirije amabwiriza y’ubuziranenge y’akarere; b) kopi y’icyemezo cy’ihungira ry’imbuto cyangwa kopi y’icyemezo cy’ibyakorewe imbuto hagamijwe kuzifata neza, aho bishoboka; c) iyindi nyandiko yose yasabwa n’urwego rubifitiye ububasha. Ingingo ya 6: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. Article 5: Modalities for exportation of seeds A person who intends to export seeds must: 1º fill an application form provided by the competent authority requesting for a phytosanitary certificate; 2º provide the following accompanying documents requested by the competent authority: a) a valid seed certificate issued by the competent authority to ensure that the seeds comply to the relevant regional seed standards; b) a copy of a fumigation certificate of seeds or a copy of seeds treatment certificate, if applicable; c) any other document that may be required by the competent authority. Article 6: Repealing provision All prior provisions contrary to this Order are repealed. Article 5: Modalités d'exportation de semences Une personne qui a l’intention d’exporter des semences doit: 1º remplir un formulaire de demande fourni par l’autorité compétente pour demander un certificat phytosanitaire; 2º fournir en annexes les documents suivants requis par l’autorité compétente: a) un certificat de semences valide délivré par l’autorité compétente assurant que les semences sont conformes aux normes standards de semences régionales; b) une copie d’un certificat de fumigation de semences ou une copie de certificat de traitement de semences, le cas échéant; c) tout autre document qui peut être requis par l’autorité compétente. Article 6: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées. Article 7: Commencement This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda.
