MINISTERIAL ORDER No 005/11.30 OF 11/04/2017 DETERMINING THE CRITERIA FOR RECOGNIZING A SEED TESTING LABORATORY The Minister of Agriculture and Animal Resources; Pursuant to the Constitution of the Republic of Rwanda of 2003 revised in 2015, especially in Articles 121, 122 and 176; Pursuant to Law n° 005/2016 of 05/04/2016 governing seeds and plant varieties in Rwanda, especially in Article 19; After consideration and approval by the Cabinet, in its session of 03/02/2017; HEREBY ORDERS: Article One: Purpose of this Order This Order determines the criteria based on for recognizing a seed testing laboratory. ARRETE MINISTERIEL No 005/11.30 DU 11/04/2017 DETERMINANT LES CRITERES POUR L’AGREMENT D’UN LABORATOIRE D’ANALYSE DE SEMENCES Le Ministre de l’Agriculture et des Ressources Animales; Vu la Constitution de la République du Rwanda de 2003 révisée en 2015, spécialement en ses articles 121, 122 et 176; Vu la Loi n° 005/2016 du 05/04/2016 régissant les semences et les variétés végétales au Rwanda, spécialement en son article 19; Après examen et adoption par le Conseil des Ministres, en sa séance du 03/02/2017; ARRETE: Article premier: Objet du présent arrêté Le présent arrêté détermine les critères pour l’agrément d’un laboratoire d’analyse de semences. Article 2: Criteria for recognizing a seed testing laboratory In order to be recognized, a seed testing laboratory must: 1º be legally recognized; 2º have a management system which leads to delivery of efficient work; 3º have a well-defined organisation and management structure; 4º be able to demonstrate its reliability in relation to sampling and testing activities; 5º demonstrate that staff members and samplers are not subjected to undue pressure or inducement that might influence their judgment or testing results; 6º be able to demonstrate that the results of the examinations and tests reflect high level of independence and professionalism; 7º provide a list of species and analyses for which it has competence; 8º have policies and procedures to ensure the protection of its clients’ Article 2: Critères pour l’agrément d’un laboratoire d’analyse de semences Pour être agréé, un laboratoire d’analyse de semences doit: 1º être légalement reconnu; 2º disposer d’un système de gestion menant à la livraison d’un travail efficace; 3º avoir une organisation et une structure de gestion bien définies; 4º être en mesure de démontrer sa fiabilité en matière d’échantillonnage et d’activités d’analyse; 5º démontrer que les membres du personnel et les échantillonneurs ne sont pas soumis à des pressions indues ou d’incitation susceptibles d’influencer leur jugement ou les résultats d’analyse; 6º être en mesure de démontrer que les résultats des examens et analyse révèlent un niveau élevé d’indépendance et de professionnalisme; 7º fournir une liste des espèces et des analyses dont il est compétent; 8º avoir des politiques et procédures visant à assurer la protection des renseignements Official Gazette nᵒ 16 of 17/04/2017 48 9º kugira umuyobozi wa tekiniki ushinzwe ibikorwa byose bya tekiniki byo muri laboratwari; 15º kugira uburyo busobanutse bwerekana uko hakoreshwa, hitabwaho, hashyirwa ku murongo kandi hakurikiranwa ibikoresho byifashishwa mu gufata ibipimo no gusuzuma; confidential information and proprietary rights; 9º have a technical manager who has overall responsibility for the technical operations of the laboratory; 10º provide adequate supervision of testing staff and samplers; 11º have laboratory staff and samplers who have and maintain required qualification, training, technical knowledge and who demonstrate skills and experience for their assigned functions; 12º have clear job description for each laboratory staff member and samplers; 13º have the equipment and energy sources needed for the testing; 14º have equipments used appropriately by authorized staff; 15º have a well-documented procedures for operating, maintaining, calibrating and monitoring of sampling and testing equipment; confidentiels de ses clients et des droits de propriété; 9º avoir un directeur technique qui a la responsabilité globale des opérations techniques du laboratoire; 10º fournir une supervision adéquate des analystes de semences et d’échantillonneurs; 11º avoir un personnel de laboratoire et des échantillonneurs qui ont et maintiennent les qualifications requises, la formation, les connaissances techniques et qui font preuve de compétences et d’expérience nécessaires pour les fonctions qui leur sont attribuées; 12º avoir une description de tâches qui est claire pour chaque membre du personnel de laboratoire et d’échantillonneur; 13º avoir des équipements et des sources d’énergie nécessaires pour les analyses; 14º avoir les équipements utilisés de manière appropriée par le personnel autorisé; 15º avoir des procédures documentées pour l’exploitation, l’entretien, l’étalonnage et la surveillance des équipements d’échantillonnage et d’analyse; 17º gutanga raporo ihuje n’ukuri, yumvikana, idateye urujijo, kandi itabogamye ku bisubizo bya buri suzuma cyangwa uruhererekane rw’amazuzuma yakozwe na laboratwari, hashingiwe ku mabwiriza ya COMESA cyangwa ibindi bipimo ngenderwaho byemewe ku rwego mpuzamahanga. Ingingo ya 3: Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanyweho. Ingingo ya 4: Igihe iri teka ritangira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda. 16º have samplers and laboratory staff who adhere to the methods and procedures of sampling and testing as per COMESA seed regulations or other internationally recognized seed standards; 17º provide an accurate, clear, unambiguous and objective report on the results of each test or series of tests carried out by the laboratory in accordance with COMESA seed regulations or other internationally recognized seed standards. Article 3: Repealing provision All prior provisions contrary to this Order are repealed. Article 4: Commencement This Order comes into force on the date of its publication in the Official Gazette of the Republic of Rwanda. 16º avoir des échantillonneurs et du personnel de laboratoire qui adhèrent aux méthodes et procédures d'échantillonnage et d'analyse conformément aux règlements de semences de COMESA ou d'autres normes de semences internationalement reconnues; 17º fournir le rapport précis, clair, sans ambiguïté et objectif des résultats de chaque analyse ou d’une série d’analyses effectuées par le laboratoire conformément aux règlements de semences de COMESA ou d'autres normes de semences internationalement reconnues. Article 3: Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées. Article 4: Entrée en vigueur Le présent arrêté entre en vigueur le jour de sa publication au Journal Officiel de la République du Rwanda.
