Ingingo ya 2: Ibisabwa umuntu usaba uruhushya Umuntu wese ku giti cye cyangwa ishyirahamwe rifite ubuzimagatozi basaba uruhushya bagomba kuba bafite abakozi bafite nibura imwe mu mpamyabushobozi zukurikira: 1.impamyabushobozi ihanitse mu by’ubutabire, cyangwa ihwanye na yo, cyane cyane mu miti cyangwa ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi,; 2. impamyabushobozi ihanitse mu by’ubuhinzi cyangwa ihwanye na yo; 3.impamyabushobozi iciriritse mu by’ubuhinzi cyangwa ihwanye na yo. Article One: Purpose of this Order This Order determines requirements to be fulfilled by any person applying for the business license of agrochemicals, referred to hereinafter as “license”. Article 2: Requirements for obtaining the license Any natural person or legal entity applying for the business license must have personnel who holds at least one of the following degrees: 1. a bachelors degree in chemistry or its equivalent, especially in agrochemicals; 2. a bachelors degree in agronomy or its equivalent; 3. a technical diploma in agriculture or its equivalent. Article premier: Objet du présent arrêté Le présent arrêté détermine les conditions requises pour toute personne qui demande une licence pour la commercialisation des produits agrochimiques, ci-après dénommé « licence ». Article 2: Conditions requises pour l’obtention de licence Toute personne physique ou morale qui demande une licence doit avoir des agents détenteurs d’au moins un des diplômes suivants: 1. diplôme de licence en chimie ou son équivalent, de préférence en produits agrochimiques; 2. diplôme de licence en agronomie ou son équivalent; 3. diplôme de technicien A2 en agronomie ou son équivalent. Official Gazette nº 9 of 04 March 2013 48 Ingingo ya 3: Usabwa uruhushya Usaba uruhushya ashyikiriza ikifuzo cye Umwanditsi w’imiti n’imfumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi. Ingingo ya 4: Kwamburwa uruhushya Umugenzuzi w’imiti n’ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi ashobora kwambura uruhushya uwaruhawe, iyo aragagaje ko ubucuruzi bw’imiti n’ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi bukorwa mu buryo butubahirije amategeko. Ingingo ya 5 : Ivanwaho ry’ingingo zinyuranyije n’iri teka Ingingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo zivanweho. Ingingo ya 6: Igihe iteka ritangirira gukurikizwa Iri teka ritangira gukurikizwa ku munsi ritangarijweho mu Igazeti ya Leta ya Repubulika y’u Rwanda Kigali, kuwa 15/02/2013 Article 3: Person to whom the request of license is submitted The applicant of license submits the request to the Registrar of Agrochemicals. Article 4: Withdrawal of the license The Inspector of agrochemicals may withdraw the license if he/she proves that the owner conducts the business of agrochemicals in contradiction with the Law. Article 5 : Repealing provision All prior provisions contrary to this Order are hereby repealed. Article 5 : Commencement This Order shall come into force on the date of its publication in the Official Gazette of the Republic of Rwanda. Kigali, on 15/02/2013 Article 3: Personne à laquelle la demande de licence est adressée Le demandeur de licence adresse sa demande au Registraire des Produits Agrochimiques. Article 4: Retrait de la licence L’Inspecteur des produits agrochimiques peut retirer la licence lorsqu’il prouve que son détenteur fait le commerce des produits agrochimiques en contradiction avec la loi. Article 5 : Disposition abrogatoire Toutes les dispositions antérieures contraires au présent arrêté sont abrogées. Article 5: Entrée en vigueur.
