2° to require, examine and photocopy licenses, registers of agrochemicals, certificates and seek any other information and documents relating to the application of legal provisions governing agrochemicals; 3° vérifier tout produit agrochimique, toute étiquette ou tout autre élément en rapport avec des produits agrochimiques ainsi que prendre et conserver leurs échantillons, et soumettre ses échantillons aux essais et analyses; 5° to visit and inspect farmers' fields and agricultural premises to ensure that only registered agrochemicals are used appropriately; 6° to seize any equipment, product or agrochemical, document, or any other thing which he/she believes has been used in, or which appears as an evidence of non-compliance with legal provisions governing agrochemicals; Ingingo ya 3: Ivanwaho ry’iteka n’ingingo zinyuranyije n’iri teka Iteka rya Minisitiri nº 002/11.30 ryo ku wa 15/02/2013 rishyiraho ububasha n’inshingano use of agrochemicals in order to conduct any necessary investigations without prejudice to the powers of officials of the criminal investigation. No person shall claim for compensation for any agrochemical taken as a sample in accordance with provisions of point 3° of Paragraph One of this Article. Inspectors of Agrochemicals must produce their identification and evidence of their position when exercising powers or executing responsibilities as provided for by this Article. Inspection is carried out within official working hours. However, if there is probable cause of entry outside official working hours, the inspector must be accompanied by a person with judicial powers. Article 3: Repealing provision Ministerial Order nº002/11.30 of 15/02/2013 determining powers and Responsibilities of des produits agrochimiques, afin de mener des enquêtes nécessaires, sans porter préjudice aux pouvoirs de la police judiciaire. Personne ne peut réclamer une compensation d’un produit agrochimique prélevé comme échantillon en application des dispositions du point 3° de l’alinéa premier du présent article. Les Inspecteurs des produits agrochimiques doivent décliner leur identité et montrer la preuve de leurs fonctions lors de l’exercice des pouvoirs ou l’exécution des attributions prévues par le présent article. L’inspection est faite durant les heures officielles de travail. Cependant, lorsqu’il y a une cause probable d’entrer en dehors des heures officielles de travail, l’Inspecteur doit être accompagné d’une personne ayant la qualité d’officier de police judicaire. Article 3 : Disposition abrogatoire L’Arrêté Ministériel nº002/11.30 du 15/02/2013 déterminant les pouvoirs et les Official Gazette n°02 of 09/01/2017 8 by’Abagenzuzi b’imiti n’ifumbire mvaruganda bikoreshwa mu buhinzi n’ubworozi n’izindi ngingo zose z’amateka abanziriza iri kandi zinyuranyije na ryo bivanyweho. Ingingo ya 4: Igihe iri iteka ritangira gukurikizwa Iri teka ritangira gukurikizwa ku munsi rishyiriweho umukono. Agaciro karyo gahera ku wa 13/09/2016. Inspectors of Agrochemicals and all prior provisions contrary to this Order are repealed. Article 4: Commencement This Order comes into force on the date of its signature.
