Notice on the request to register a water use (GN. 212 of 2000)

EnviroLeg cc NATIONAL WATER Reg p 1 GN. 212 GG20946 10 March 2000 DEPARTMENT OF WATER AFFAIRS AND FORESTRY REQUEST TO REGISTER A WATER USE In terms of regulation 3(b) of Regulation 1352 dated 12 November 1999 a person who uses water as contemplated in section 21 of the National Water Act, 1998 (Act No. 36 of 1998) must, when called upon by the responsible authority to do so, register the water use. I, Stefanus Christoffel Vogel in my capacity as Regional Director: North West duly delegated by the Minister of Water Affairs and Forestry hereby request that all persons who use water as set out below must register their water use. 1. WATER USE The following water uses must be registered: * section 21 (a) taking water from a water resource * section 21 (b) storing water * section 21 (c) impeding or diverting flow * section 21 (d) stream flow reduction * section 21 (e) engaging in a controlled activity: irrigating with waste or water containing waste generated through any industrial activity or by a water works * section 21 (f) discharging waste or water containing waste into a water resource through a pipe, canal, sewer, sea outfall or other conduit * section 21 (g) disposing of waste in a manner which may detrimentally impact on a water resource * section 21 (h) disposing in any way of waste that has been heated through a power generation activity * section 21 (i) altering the bed, banks, course or characteristics of a watercourse * section 21 (j) removing water from underground if it is necessary for the continuation of an activity or for safety of people 2. EXCLUSIONS The following water uses are excluded from registering in terms of this Notice* Schedule 1 uses in terms of the National Water Act, 1998; * water use by members of an Irrigation Board, Water User Association and Government Water Scheme in a distribution system where they are supplied by the Board or Association or Scheme; * the taking of water from a bulk supplier. 3. AREA OF APPLICABILITY This Notice is applicable to all water use set out in paragraph one above that takes place in; EnviroLeg cc NATIONAL WATER Reg p 2 * the catchment area of the Buffelspoort dam comprising all subdivisions of the following farms: Rietfontein 348JQ Kromrivier 347JQ Grootfontein 346JQ Buffelsfontein 344JQ Tonquani 351JQ * all properties included in the Buffelspoort Government Water Scheme. 4. REGISTRATION FORMS (1) Only official registration forms may be used. Oegema (2) A water user must submit the completed registration forms to: The Area Manager: Hartbeespoort Department of Water Affairs and Forestry Hartbeespoort Dam Old Rustenburg Road or The Water Control Officer Buffelspoort Dam Department of Water Affairs and Forestry Buffelspoort Dam Officials will be available at the offices of the Department of Water Affairs and Forestry at Buffelspoort Dam from 28 March 2000 to 31 March 2000 from 08:00 to 16:00 each day to assist with the registration and receive completed registration forms. 5. TIME PERIOD FOR REGISTERING EnviroLeg cc NATIONAL WATER Reg p 3 Water users must submit their completed registration forms to the addresses set out above before 14 April 2000. 6. FAILURE TO REGISTER Any person who fails to comply with this Notice is guilty of an offence.
