ACT To amend the Liquor Products Act, 1989, to provide for the appointment, as members of the Wine and Spirit Board, of two persons nominated by the Agricultural Research Council, instead of two officers; to sanction the production and sale of an alcoholic beverage obtained by the alcoholic fermentation of honey; and to abolish the requirement that specimens of labels amxed to containers be file~ with the administering officer; and to · p~ovide for matters connected therewith. BE IT ENACTED by the State President and the Parliament of the Republic of South Africa, as follows:- . · Amendment of section 2 of Act 60 of 1989 1. Section 2 of the Liquor Products Act, 1989 (hereinafter referred to as the principal Act), is hereby amended- · . . . . . . .. . 5 · · (a) by the· substitution for subparagraph (iv) of paragraph (a) of subsection (2) of the following subparagraph: "(iv) not more than two [officers appointed] persons nominated by the Agricultural Research Council by virtue of their involve ment in oenological and viticultural research; and"; 10 (b) by the substitution for paragraph (d) of thesaid subsection (2) of the following paragraph: ·· ·· · · · · · · ·' " (d) Whenever it becomes necessary, the Director-General shall • request the bodies mentioned in subparagraphs (i), (ii) and (iv) of paragraph (a) [(i) and (ii)] in writing to submit the applicable 15 nominations to him in· writing 'within the period specified in the request."; and . . . . . . (c) . by the substitution for subparagraph. (iv) of paragraph '(a) of subsection ' (5) of the following subparagraph: · ' · · "(iv) if, in the case of a member or an alternate member nominated 20 by a body specified in subsection (2)(a)(i), [or] (ii) or (iv), the body concerned notifies the Director-General in writing that such member or alternate member shall no longer serve on the board as nominee of that body.". 4 No. 14628 GOVERNMENT GAZETIE, 10 MARCH 1993 Act No. 11, 1993 LIQUOR PRODUCfS AMENDMENT ACf, 1993 Amendment of section 10 of Act 60 ofJ989 · 2. Section lO. of the principal Act is hereby amended ( a) by the substitution for paragraphs (a) and (b) of subsection (1) of the following paragraphs: ' . . . "(a) may sell, or produce. for sale, for drinking purposes, ·a 5 sacramental beverage specified in such notice [for drinking purpose; or]; (b) may sell, or produce for sale, for drinking purposes, an alcoholic beverage obtained by the alcoholic fermentation of the juice of oranges together with cane sugar [for drinking 10 purposes] or;"; (b) by the addition to the said subsection (1) of the following paragraph: "(c) may sell, or produce for sale, for drinking purposes, an alcoholic beverage obtained by the alcoholic fermentation of honey."; and , . 15 (c) by the substitution for the· words preceding subparagraph (i) in paragraph (a) of subsection (3) of the following words: "shall, in the case of an alcoholic beverage referred to in subsection . (1)(b) or (c).be granted only if-"~. Repeai of section 13 of ·Act 60 of ·1989. .· . ' ~ . 3. Section 13 of the principal Act is hereby repealed. Amendment of.section 23 of Act 60 of 1989 4. Section 23 of the principal Act is hereby amended by the substitution for paragraph (b) of subsection (1) of the following paragraph: 20 "(b) contravenes or fails to comply with a provision of seCtion 5(3)(b), 25 6(3)(b), 7(3)(b), 8(3)(b), 9(3)(b) [13(1), 13(1) as applied by 13(4)] or 20(4);".' . . . . · . . .. Short title 5. This Act shall be called the Liquor Products Amendment Act, 1993.
