REPUBLIC OF VANUATU PLANT PROTECTION ACT [CAP 239) Penalty Notice Regulation Order No. ISIr of2014 In exercise of the powers conferred on me by subsection 23A(7) of the Plant Protection Act [CAP 239].1, the Honourable DA VID TOSUL, Minister of Agriculture, Livestock, Forestry, Fisheries and Biosecurity, make the following Order. 1 Interpretation In this Regulation: Act means the Plant Protection Act [CAP 239]. 2 Prescribed amounts for penalty notices For the purposes of subsection 23A(7) of the Act, the prescribed amount in respect of an offence committed under a subsection of the Act listed in Column 2 of the Penalty Notice Table, is the amount set out in Column 3 of that Table: PENAL TV NOTICE TABLE Column 1 Column 2 Column 3 Items Provisions of the Plant Prescribed amount for the Protection Act ICAP 2391 offence (VT) I 22(a) - contravenes any IO,500VT requirement or fails to observe and perform any duty or obligation a requirement may . place on him 2 22(b) - imports any goods 33,500VT presenting a risk or a potential risk, or exports any plant produce, otherwise than in accordance with requirements Penalty Notice Regulation Order No. 1 3~ 0/1014 3 22(c) - knowingly receives any 30,500VT unauthorized import 4 35,OOOVT 22(d) - without reasonably excuse, fails to comply with a reason direct ion or request from an officer 5 8,500VT 22(e) - withholds relevant information, or provides an officer with false or misleading information 6 50,OOOVT 22(f) - threatens, assaults, obstructs. or hinders any officer in the exercise or performance of his functions, powers, or duties 7 50,OOOVT 22(g) - removes any seized good from the control of an officer Commencement This Order commences on the day on which it is made.
