Interpretatio n 2.In these Regulations,unless the context otherwiserequires- ActNo.5of 2019 Cap.331 "Act"means the WaterSupplyand Sanitation Act 2019; “Basin WaterBoard”means the Basin WaterBoard established under the Water Resources ManagementAct; “care taker” means a person appointed under regulation23tomanageandoperatethewater supply scheme and provide water supply services; “certificateofregistration”meansacertificateissued tothecommunityorganisationbyRegistrarpursuant totheseregulations; “cluster”meansmergingoftwoormorecommunity organisationsintoonecommunityorganisation toachieveefficiencyandeconomiesofscaleof watersupplyandsanitationservices; “community”meansagroupofhouseholds,avillage oragroupofvillageswhoreceivetheirwater WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 7 supplyfrom acommonsource,oroneormore waterpointsorawaterworks; ActNo.5of 2019 "communityorganisation"meansacommunitybased watersupply organization established under theAct; "consumer"meansanypersonorbodyofpersons supplied orapplying to be supplied with or using water from waterworks or receiving sanitationservicesorwhoisliableforpayment ofanyfeesorotherchargesforthesupplyor useofwaterorsanitationservices; ActNo.5of 2019 "DirectorGeneral"meansDirectorGeneralofRUWASA appointedundertheAct; "holder of a certificate" means any community organisation which has been issued with a certificate of registration pursuant to these Regulations; “Minister”meanstheMinisterresponsibleforwater; Cap.288 “Mtaa”shallhavethemeaningascribedtoitunderthe LocalGovernment(UrbanAuthorities)Act; "Registrar"meansa person appointed underthese Regulationsfor purposes of registering communityorganisations; "register"meansaledgermaintainedbyRUWASAfor keeping information relating to community organisations; ActNo.5of 2019 “RUWASA” means the Rural Water Supply and SanitationAgencyestablishedundersection42 oftheAct; “servicearea”meansthejurisdictionwithinwhicha communityorganisationorawaterauthority provideswatersupplyandsanitationservices; “serviceprovider”meansapersonengagedbythe communityorganisation to provide wateror sanitationservicestoagivencommunity; “tariff”meansanycharge,fee,priceorratecharged forprovisionofwaterorsanitationservicesas shallbeapprovedbyRUWASA; ActNo.5of 2019 “Water Authority” means a Water Supply and SanitationAuthorityestablishedundersection 9oftheAct;and “wayleave”meanstherightofwayforwaterworks. WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 8 PARTIIESTABLISHMENTANDREGISTRATIONOFCOMMUNITY ORGANISATIONS Establishme ntof community organisation 3.-(1) Pursuanttosection32 of the Act, there shall be established aCommunityBased Water Supply Organisation for the purpose of effectivemanagementandoperationofwatersupply andsanitationservicesinitsareaofjurisdiction. (2) Community Organisation established pursuanttosubregulation(1),maybeintheform of- (a)waterconsumerassociation; (b)watertrust; (c)cooperativesociety; (d)aNon-governmentOrganisation; Cap.212 (e)acompanyincorporatedundertheCompanies Act;or (f)anyotherbodyasapprovedbytheMinister. ActNo.5of 2019 (3) Community organisation shallform its CommunityWaterCommitteeandCommunityWater ManagementTeam inaccordancewiththeActandits constitutionormemorandum ofagreement. ActNo.5of 2019 (4) Where a community organization is established underany otherwritten law,itshall prepare its constitution or memorandum of agreementintheform setoutintheSecondSchedule totheActandsubmitstotheRegistrarforregistration afterbeing incorporated orregistered pursuantto suchwrittenlaw. Procedurefor establishment ofcommunity organisation 4.-(1) RUWASA in collaboration with local government authority shall convene a meeting betweentheVillageCouncilleaders,Wardexecutive officer and respective Councillor to initiate the process of establishment of a community organisation. (2)TheVillageCouncilincollaborationwiththe local government authority and RUWASA shall conveneVillageGeneralAssemblytodeliberateon establishmentofcommunityorganisation. WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 9 (3)Uponacceptanceoftheestablishmentof community organization, the Village General Assembly shall,in collaboration with the local government authority and RUWASA,appoint an interim committeeforpreparationofaconstitutionor memorandum ofagreementand undertake other relevantmattersnecessaryforestablishmentofsuch communityorganisation. (4)Forcommunityorganizationinurbanareas, Mtaauponpriorconsultationwithawaterauthority andRUWASAshallundertakemeasurestoestablish community organization pursuant to these Regulations. Composition ofInterim Committee 5.-(1) The Interim Committee appointed under subregulation 4(3)shallcomprise ofthe followingmembersappointedbygeneralassembly: (a)chairman; (b)secretary; (c)treasurer;and (d)onemember. (2)subjectto subregulation (1)where the communityorganizationintendstoprovidewaterand sanitationservicesacrossmorethanonevillage,the interim committeeshallcompriseofnotmorethan two members from each village appointed by respectivegeneralassemblies. Appointment ofCommunity Water Management Team 6.-(1)TheCommunityWaterCommitteeshall, pursuanttoparagraph4oftheSecondScheduleof theAct,recruitCommunityWaterManagementTeam on competitive basis on such terms as the organizationdetermines. (2)Whereacommunitywatermanagementteam has not yet been appointed by the community organization, RUWASA may appoint an interim supervisor,treasurerandanyofficerasdeem fittoact asacommunitywatermanagementteam. Community Water Committeein multivillage 7.-(1) Where a community organization established underthe SecondScheduleoftheAct comprises ofmore than one village,Community WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 10 waterscheme Water Committee shallbe elected amongstthe names proposed by the respective general assemblies in the meeting convened by local governmentauthorityinCollaborationwithRUWASA. (2)Members ofthe meeting convened in accordancewithsub-regulation(1)shallcompriseof- (a)chairmanfrom eachvillage; (b)villageexecutiveofficersfrom eachvillage; (c)wardexecutiveofficersfrom eachward; (d)councillorfrom eachward;and (e)twomembersofeachwaterandsanitation committeefrom eachvillagecouncils. (3) In appointing members under sub- regulation(1),theappointingauthorityshalltakeinto accountcompositionofcommunitywatercommittee underSecondScheduleandensurethateachvillageis represented. Preparation of constitution or memorandum ofagreement 8.-(1)Theinterim committeeappointedunder sub-regulation4(3) shallprepareamemorandum of agreementorconstitution in consultation with the villagecouncilandtheRegistrar. ActNo.5of 2019 (2)Thepreparedconstitutionormemorandum ofagreementshallbesubstantivelyintheform setout intheSecondScheduleoftheAct. (3)Thedraftconstitutionormemorandum of agreementshallbedeliberatedandapprovedbythe generalassemblyorfoundermembersasthecase maybe. (4) The constitution or memorandum of agreementofthe communityorganisationshall be submitted to RUWASA for approval subject to consultation of the relevant local government authority. (5) RUWASA shallcollaborate with relevant localgovernmentauthoritytopromoteandsensitize thecommunitytoform acommunityorganisationin order to manage and operate water supply and sanitationservices. Registration requirement 9.-(1)Acommunityorganisationestablishedfor WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 11 purposes ofmanaging and operating watersupply schemeshallberegisterwiththeRegistrarpursuantto theprovisionsoftheActandtheseRegulations. (2) Any community organisation registered beforecoming into operationofthese regulations pursuant to the provisions of the Water Supply andSanitationActshall,withintheperiodoftwoyears from the date ofcoming into operation ofthese Regulations,berequiredtosubmittheircertificatesof registration to the Registrarforre-registration and amend their constitutions or memorandum of agreementstoconform withtherequirementsofthe ActandtheseRegulations. Application procedures 10.-(1)Acommunityorganizationthatintends toapplyforregistrationofacommunityorganisation shallsubmitanapplicationtotheRegistrar inthe prescribedForm Number1setoutintheScheduleto theseRegulations. (2)An application forregistration shallbe submittedtotheRegistrarbyoneormorefounder membersofthecommunityorganisationandshallbe accompaniedwith- (a)acopyofconstitutionormemorandum of agreementofthecommunityorganisation; (b)personalparticulars including curriculum vitae (CV) of the members of the community water committee and communitywatermanagementteam; (c)addressandphysicallocationofthehead officeofthecommunityorganisation; (d)Minutes ofthe village assemblymeeting with signed list of participants who acceptedestablishmentofthecommunity basedorganisation orminutes containing full names and signature offounder members; (e)paymentreceiptofapplicationfee;and (f)any other particulars or information as mayberequiredbytheRegistrar. (3)Apersonwhosubmitsfalse information WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 12 forthe purpose of acquiring registration of communityorganization,commits an offence and uponconvictionshallbepunishabletoafineofnot less than fifty thousand shillings or to imprisonmentnotlessthanonemonth. Registration Fees 11.Thereshallbearegistrationfeechargeable and payable in respectofany application for registration ofa community organisation as may bedeterminedbytheBoardofRUWASA. Registrar 12.-(1) EveryDistrictManager of RUWASA shallbetheRegistrarofcommunityorganisationin therespectiveDistrict. (2)Withoutprejudicetotheprovisionofsub- regulation(1),theDistrictManager may designate such other officer of RUWASA to perform the powersandfunctionsvestedtotheRegistrar. (3) The Director Generalmay appoint or designateapersontoperform thefunctionsofthe RegistrarinanareawhichhasnoDistrictManagerof RUWASA. Functionsof Registrar 13.FunctionsoftheRegistrarshallincludeto- (a)approve constitution ormemorandum of agreement submitted by a proposed communityorganisations; (b)registercommunityorganisations; (c)keepandmaintain register ofcommunity organisations; (d)keep records and reports regarding communityorganisations; (e)causetobepublishedintheGazzetteall registered and cancelled community organisationsineverysixmonths; (f)enquire into any matterregarding the performance ofactivitiesandmanagement ofcommunityorganisations;and (g)perform such otherfunctions asmaybe assignedbytheDirectorGeneral. WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 13 Determination for application 14.-(1)The Registrarshallwithin thirtydays upon receiving the application determine the application. (2)Subjecttosub-regulation(1),theRegistrar may,registerorrefuse to registera community organisationandnotifytheApplicantaccordingly. Refusalof registration 15.-(1)TheRegistrarmayrefusetoregistera communityorganisationifheissatisfiedthat- (a)theactivitiesoftheproposedcommunity organisation are not for the public interestorarecontraryto anywritten law; (b)the applicant has given false or misleading information in anymaterial particular; (c)the area underwhich the community organisationisintendingtooperate,is serviced by another community organisationorawaterauthority;or (d)anyotherreasonastheRegistrarmay deem appropriate. (2)WheretheRegistrarhasrefusedtoregistera communityorganisation,heshallnotifytheapplicant inwritingandprovidesthereasonsforsuchrefusal. Registration andissuance ofcertificate ActNo.5of 2019 16.-(1) The Registrar shall register the communityorganisation,afterbeing satisfied that theapplication meets therequirement oftheAct andtheseRegulations. (2) Upon registration of a community organisation pursuant to sub-regulation (1),the Registrarshallissueacertificateofregistrationtothe registeredcommunityorganisationinaprescribedForm Number2setoutintheScheduletotheseRegulations. Effectof registration 17.ACertificateofregistrationissuedpursuant totheseRegulationsshallbeaconclusiveevidenceof acommunityorganisationhavingauthoritytoprovide watersupplyandsanitationservicespursuanttothe WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 14 Act. Register ActNo.5of 2019 18.-(1)Thereshallbeestablished and kepta register of community organisation in which informationrelatingtothecommunityorganisations registeredundertheActshallbeentered. (2) Theregisterofcommunity organisation referred to under sub-regulation (1),shallbe maintained atthe district,regionaland national levels. (3)Theregistermaintainedatthedistrictlevel shallcontaininformationrelatingtothecommunity organisationsinrespectofsuchparticulardistrict. (4)Theregistermaintainedattheregionallevel shallcontainconsolidatedinformationrelatingtothe communityorganisationsfrom thedistrictsofsuch particularregion. (5)Theregistermaintainedatthenationallevel shallcontainconsolidatedinformationrelatingtothe communityorganisationsfrom theregions. PARTIII REVIEW ANDAPPEAL Reviewbythe Registrar 19.-(1)Whereanapplicantisnotsatisfiedwith thedecisionoftheRegistrarmadepursuanttothese Regulations,maywithinthirtydaysfrom thedateof notificationofthedecisionoftheRegistrarapplyto theRegistrarforreview ofhisearlierdecisionina prescribedForm Number3setoutintheScheduleto theseRegulations. (2) The Registrar shall determine the applicationforreview andissuehisdecisionwithin fourteen (14) days from the date of receiptof applicationforreview. Appeals 20.-(l)Whereanapplicantisnotsatisfiedwith thedecisionoftheRegistrarundertheseRegulations, maywithinthirtydaysfrom thedateofthedecision appealtotheDirectorGeneralinaprescribedForm Number 4 set out in the Schedule to these Regulations. WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 15 (2)Uponreceiptoftheappeal,theDirectorGeneral may: (a)uphold,quash,orvarythedecision of theRegistrar; (b)requiretheRegistrartoreviseorreview hisdecision;or (c)require the Registrar to inquire specific information from the appellant and make further considerationoftheapplication. PARTIV SUSPENSIONANDCANCELLATIONOFCERTIFICATE Suspension or Cancellation ofCertificate 21.-(1)TheRegistrarmaysuspendorcancela certificateofregistrationifheissatisfiedthat- (a)theterms orconditions prescribed in the certificatehavebeenviolated; (b)thecommunityorganisationhasceasedto exist; (c)the community organisation operates in variancetoitsconstitutions; (d)memberofthecommunityorganisationor publichavesubmittedtothesatisfactionof the Registrar, recommendation for its suspensionorcancellation; (e)community organisation has been clustered;or (f)awaterauthorityhasbeenestablishedor extended services in the area under jurisdictionofthecommunityorganisation. (2)Where the certificate ofregistration has beensuspendedorcancelled,theRegistrarshall,ina prescribedForm Number5setoutintheScheduleto theseRegulations- (a)notifytherelevantcommunityorganisation; (b)ordersuchcommunityorganisationtostop itsoperations;and (c)removethe name ofsuch community organisationfrom theregister. WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 16 (3) A person who without reasonable justificationrefusestocomplytowithorderofthe Registrarunderthisregulation,commitsanoffence. Procedures for suspensionor cancellation 22.-(1) Where a community organisation holdingacertificateisindefaultofthetermsand conditionsinrespectofwhichthecertificatewas issued,the Registrarmay serve the community organisationadefaultnoticeinwritingspecifying- (a)thenatureofthedefaultbysuchcommunity organisation;and (b)timewithinwhichthedefaultshallbe rectified. (2)Wherethe community organisation fails to remedy orrectify thedefaultwithinthetime specified in thedefaultnoticeorhasnotmadea representationtothesatisfactionoftheRegistrar,the Registrarshallsuspendorcancelthecertificate. Appointment ofcaretaker 23.-(1)Whereacertificateofregistrationofa community organisation has been suspended or cancelled inaccordancewiththeseRegulations,or wherethecommunityorganisation has failed to provideservices,the DirectorGeneralshallappointa caretakertomanageandoperatethewatersupply schemeandprovidewatersupplyservicesforaperiod notexceedingsixmonths. (2)ThecaretakerappointedbytheDirector Generalmaybeacommittee,awaterauthorityorany otherbodycorporate. PARTV OBLIGATIONOFCOMMUNITYORGANISATION Management andoperation ofWaterand Sanitation Schemes 24.-(1) A community organisation shallbe responsible forthe provision ofwatersupplyand sanitationservicesbymanagingandoperatingWater andSanitationSchemeswithinitsservicearea. (2)Theserviceareaofcommunityorganisation WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 17 undersubsection (1)shallbe as prescribed bythe certificate of registration issued under these Regulations. (3) The community organisation shall,in collaborationwiththeBasinWaterBoards,engagein interventionsforprotectionandconservationofwater sourcesforsustainablewatersupply. Wayleavefor waterworks ActNo.5of 2019 25.-(1)Withoutprejudicetosection22ofthe Act,communityorganisationshallhavemandateto assumecontrolofthewayleaveoftwometerswith regardtowaterdistributionpipesofsizeoflessthan 150mm,beingonemeterfrom thecentreofthepipe. (2)Upon assuming controlofthe wayleave undersub-regulation(1),theCommunityOrganisation shalldemarcatesuchareabyinstallingvisiblesigns ontheouterboundaryofthewayleave. (3)A communityorganisationshallacquirea titleinrespectofalllandedpropertyincludingareas where water sources, water storage facilities, buildings, domestic water points and other infrastructureforthewatersystemsarelocated. Tariffsetting bycommunity organisation 26.-(1) The community organisation shall proposewatertariffandotherchargesinaccordance withtheguidelinesfortariffsetting developed by RUWASA. (2)Watertarrifsandotherchargesshallbeapproved bytheBoardofRUWASA. Submission ofreports 27.-(1) Communityorganisationshallprepare andsubmitto RUWASAquarterly,semi-annualand annualreports showing performance of service provisioninsuch given durations oranyother reportasRUWASA mayrequire. ActNo.5of 2019 (2) Subject to section 34(5) of the Act, CommunityWaterManagementTeam shallsubmit reports to RUWASA after the approvalof the CommunityWaterCommittee. (3)CommunityWaterManagementTeam shall present to the community quarterly operational performancereportsapprovedbyCommunityWater WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 18 Committee. PARTVI MONITORINGANDREGULATIONOFCOMMUNITY ORGANISATIONBYRUWASA Monitoring and regulationof community organisation 28.-(1)RUWASAshalldevelop guidelinesfor monitoringandregulationofcommunityorganisation. (2) In monitoring and regulating community organisation,RUWASA shallprepare annualreport showing the performance levelsofthe Community OrganisationandsubmitthereporttotheMinister. Categorizatio nof community organizations 29.-(1) RUWASA shall classify Community Organisationinto categoriesbasedonperformance levels with the view ofdetermining the extentof support required to improve operational and managementstatus. (2)Thecategorizationofcommunity organizationundertheseRegulationsshallbe determinedbyanyofthefollowingcriteria: (a)number of population to be served by communityorganization; (b)totalvillagesortotalschemenetworkinthe communityorganizationservicearea; (c)investment and complexity levelof the scheme; (d)capacityofthecommunityorganizationto generaterevenue; (e)collectionefficiency;and (f)capacity of community organization to meetoperationandmaintenancecosts. (3)RUWASA shalldevelopguidelinesto determinelevelofsupportrequiredbyacommunity organisationsbasedonthecategoryundersub- regulation(2). Arrangement between community 30.-(1)In approving arrangementbetween a community organisation and a service provider, WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 19 organizations andservice provider Cap.103 RUWASA shalltakeintoaccountprovisionsofthe PublicPrivatePartnershipActonSmallScalePublic PrivatePartnershipprojects. Submission ofreports 31. RUWASA shallsubmitto the Minister quarterly, semi-annual and annual performance reportsandanyotherreportasmayberequiredbythe Minister. PARTVII CLUSTERINGOFCOMMUNITYORGANISATIONS Powerto cluster community organisations 32. Forthepurposeofachievingefficiency and economies of scale, RUWASA may, in consultation with the relevantLocalGovernment Authorities,clustercommunity organisations into onecommunityorganization. Criteriafor clustering community organisations 33.-(1) In determining clustering of the communityorganisations,RUWASA shalltakeinto accountthefollowings, (a)geographicalproximitybetweencommunity organisations; (b)accessanduseofcommonwatersource; and (c)performancelevelofacommunity organisation. (2)Pursuantto subregulation (1),RUWASA shall develop guidelines for purpose of operationalising clustering of community organisations. Constitution andnameof clustered community organisation 34.-(1)The constitution ormemorandum of agreementofa clustered communityorganisation shallbepreparedbyajointcommitteecomposedof members representing each of the clustered community organisations in collaboration with WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 20 RUWASA. (2)The name ofthe clustered community organisation shallbe decided by RUWASA upon recommendation of the clustered community organisations. Registration and Commencem entof clustered community organisation 35.-(1)Theclusteredcommunityorganisation shallberegisteredpursuanttotheseRegulations. (2)Theclusteredcommunityorganisationshall commenceitsoperationsuponbeingregisteredbythe Registrar pursuant to these Regulations, and compositionofitsCommunityWaterCommitteeand CommunityWaterManagementTeam. (3) Upon commencement of the clustered community organisation,the clustered community organisationsshallautomaticallyceasetooperateand theircertificate ofregistration be cancelled bythe Registrar. Composition of community water committee and community water management team ActNo.5of 2019 36.-(1)TheCommunityWaterCommitteeofa clustered community organisation shall be composed ofmembersprescribed in theSecond ScheduletotheActbytakingintoaccountthateach ofthevillagesorcommunityorganisationsasthe casemaybe,isrepresented. (2) The Community Water Committee shall establishtheCommunityWaterManagementTeam of the clustered community organisation upon consultationwithRUWASA. Powers and function of clustered communi ty 37. Theclustered communityorganisation shallexercise such powers and perform such functions as any community organisation is mandated pursuant to the Act and these Regulations. Where RUWASA clusters community organisations, assets and liabilities of the clustered community organisations shall be vestedtotheclusteredcommunityorganisation. Referenceof disagreemen ttoMinister 39.Where there is disagreement between RUWASAand communityorganisationonclustering, anyaggrieved partymayreferthe matterto the Ministerforresolution. PARTVIII GENERALPROVISIONS Servicearea of community organization 40.-(1) The service area of a community organizationshallbeasprovidedintheconstitution ormemorandum ofagreementandasdefinedinthe CertificateofRegistration. (2) Subject to sub-regulation (1), no community organization shallbe established and registered to provide watersupply and sanitation serviceswithintheserviceareaofawaterauthority exceptwherethewaterauthorityhasnotextendedthe servicesto thearea and such area isknown and approvedbythewaterauthority. Inspectionof documents 41. Subject to prescribed procedures, a memberofthepublichastheright,uponpaymentof feesasshallbeprescribedbytheRegistrar,toinspect documents related to operations of community organisationattheofficeoftheRegistrar. Restrictions foroperating 42. A community organisation shallnot manage and operate watersupplyand sanitation services withouta valid certificate ofregistration issuedpursuanttotheseRegulations. Cessationof community 43.Acommunityorganisation shallcease to own,manage,operateandprovidethewatersupply WaterSupplyandSanitation(RegistrationandOperationsof CommunityBasedWaterSupplyOrganisations) GN.NO.829(Contd.) 22 organisation andsanitationservicesupon: (a)establishment of water authority in its servicearea; (b)extension ofarea ofservice ofexisting waterauthoritytoincludetheareaserviced bythecommunityorganisation; (c)clusteringofcommunityorganisations; (d)certificate of registration of the community organisation has been suspendedorcancelled;or (e)area under which the community organisation is operating is in the jurisdiction ofa waterauthorityand the waterauthorityhasextended servicesin the area operated by community organisation. Offences and penalties 44.-(1)A personwhocontravenesanyofthe provisionsoftheseRegulationscommitsanoffence. (2) Any offence committed against these regulationsforwhichnospecificpenaltyisexpressly provided forin the Actshall,upon conviction,be punishabletoafineofnotlessthanfiftythousand shillingsortoimprisonmentofnotlessthanonemonth orboth.
