Application 2.-(1)These Regulationsshallapplyto any areadesignatedanddeclaredtobeawaterauthority, clusteredwaterauthority,ortoanypersonproviding orusingwatersupplyandsanitationservices. (2)Wherethecircumstancesnecessitatethe provisions of these Regulations to apply to a communityorganization orprivateowned system, anyreferencetoanywaterauthorityshallbedeemed toincludecommunityorganizationorprivateowned system. Interpretation 3.IntheseRegulationsunlessthecontext otherwiserequires- “abattoir” includes a slaughtering slab and any premisesorplacehabitually used forslaughter ofanimalforhumanconsumption; WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 4 ActNo.5of 2019 “Act”meanstheWaterSupplyandSanitationAct; “Authority”meansthelocalgovernmentauthority; “authorized officer”meansanyofficer,servantor agentoranypersonacting on behalf of the waterauthority,orAuthorityoranyauthorized environmentalinspector; ActNo.5of 2019 “community organization” means a community basedwatersupplyorganisation established under section32oftheAct; “inspection chamber”means a cavityconstructed betweensewerlinestoallow forinspection and cleansing; “occupier”includesanypersoninactualoccupation oflandorpremises; “owner”withregardstoimmovablepropertyincludes anypersonreceivingor accepting any considerationinrespectofrentorprofitsfrom any tenantoroccupierthereoforwhowouldreceiverent andprofitsifthe premiseswereletwhetheronhis ownaccountorasagentforanyother person; "public sewer" means any sewer vested in or constructedbyoronbehalfoforunder the control ofthewaterauthority; Cap.414 “Regulator”means the Energyand WaterUtilities RegulatoryAuthority established under the EnergyandWaterUtilitiesRegulatoryAct; “sewage” means liquid waste ofa excremental naturebutdoesnotinclude wastewater and storm water; “sewer”meansanypipeorconduitotherthanadrain used,orforuse,forthe conveyanceofsewage; “storm water”means a surface runoff(flow on surface)asaresultofrainfall precipitation; “trap”meansachamberedequipmentconstructed onasewerordrainfortheinterception and removal ofsandandgrit,sealsmellsorfumes,ora type ofgullychamberconstructedfortheretentionand removalof grease, petroleum spirit or similar matterfrom wastewateroran appliance for WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 5 receivingwastewaterorsurfacewaterandpassingit tothedrain through a chamber or a chamber insertedintherunandatthetop ofthelateraldrain; “wastewaterdisposalworks”means allgathering groundsincludingoff-takes, tunnels, ponds, filter beds,conduits,aqueducts,sewers,pipes, wetland, septic tank,soak way pit,lagoons, pumps,primemovers,cesspit emptiesvans and allstructuresandappliancesusedorconstructedfor the storage,conveyance,measurement or regulationofsewageand wastewater, which are usedorhavebeenconstructedbyoronbehalfof awaterauthority,privateorcommunityorganization; “wastewater”meansliquidwasteofnon-excremental naturebutdoesnotincludestorm water; “water authority” means a water supply and sanitationauthorityestablished undersection9of theAct. PARTII PROVISIONOFSEWAGEANDWASTEWATER FACILITIES Provisionof sanitation 4.-(1)A waterauthority shalldevelop and maintainsanitationworkswithinitsjurisdiction. (2)Sanitation worksto beprovided bythe water authority shall involve infrastructure for collection,conveyanceandtreatmentofwastewater aswellasdisposalofeffluent. Protectionof publicsewers 5.-(1)Apersonwhoexcavateorcausetobe excavatedortocarryoutanyactivitywithintheway leave ofa public sewerorsanitation works or disposalworksshallobtainawrittenconsentfrom thewaterauthority. (2)Subjecttosubregulation(1),thewayleave shallbetenmetersofsuchlandbeingfivemeters from edgeofeachsideofthemainsewerandfour metersbeingtwometersfrom theedgeofeachside WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 6 ofthesecondarysewerandonemeterbeinghalfa meterfrom theedgeofeachsideoftertiarysewer. (3)Whereapersondamagessanitationworks andfailtorepairthedamage,thewaterauthoritymay makegoodanyexcavations,damageoralterations, demolishorotherwisedealwithanyworkbuildingor structure carried outorcreated contrary to this regulationasitmaydeem fitandmayrecoverthe expensesincurredinsodoingasacivildebtagainst suchperson. PARTIII CONNECTIONWITHPUBLICSEWER Connection withpublic sewer 6.-(1)Theowneroroccupierofanypremises ortheownerofprivatesewersituatedwithinthirty meterswhereapublicsewercrosses,shallconnect topublicsewer. (2)Apersonwhoownsaprivatesewerina mannerprescribedundersubregulation(1)andfails toconnectwithpublicsewershallberequiredtopay forthewastewaterservice. (3)Withoutprejudicetosubregulation(1),a personshallnot- (a)dischargedirectlyorindirectlyintopublic sewer anymatterfrom amanufacturing processorafactory,otherthandomestic sewage,exceptbyawrittentradewaste agreement with the water authority warranted by an inspection certificate issuedbytherelevantauthority; (b)connectstorm watertothepublicsewer; (c)connect with public sewer where that sewerissituatedinexcessofthirtymetres ofthe curtilage ofthe premises,unless otherwisepermitted; (d)connectwithpublicsewerwherethewater authoritydeterminesthatthelocationof WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 7 the premises orground levelmakes it impracticableunlesswastewaterbooster pumpsoranyothertechnology permitted bythewaterauthority;or (e)dischargeanymatterwhichisprohibited undertheActoranyotherwrittenlaw. Cap.99 (4)Apersonwhodeemedtohaveaccessto publicsewerundersection94(2)ofthePublicHealth Actshallbeconnectedtothepublicsewer. PARTIV PROVISIONOFSANITATIONSERVICES Applicationfor sewer connection 7.-(1)A person who intends to connecta private sewerinto public sewershallmake an applicationinaprescribedform setoutintheFirst ScheduletotheseRegulations. (2)Thewaterauthorityshall,withinfourteen daysuponreceiptoftheapplicationtogetherwiththe payment of sewer connection fee,connect the applicantpremiseswithsewerservices. Restrictions onpublic sewer 8.-(1)Apersonshallnotlay,alter,removeor extendanycustomer’sserviceunlessheappliedfor andobtainedpermissioninwritingfrom thewater authority. (2)Thewaterauthoritymay,ingrantingthe permissiontolay,alter,remove,orextendtheservice; approve the place,fittings and arrangements for laying,removing,alteringorextendingtheservice. Sample analysis 9.-(1)Uponreceiptofanapplicationforsewer connectionservice,thewaterauthoritymayrequire samplesofwastewaterandsewageconveyedorto beconveyedtosuchsewertobetakenandanalyzed bydesignatedlaboratory,whichshalldelivertothe waterauthoritytrueanalysesofsuchsamples. WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 8 (2)Thecostsandexpensesrelatedtotaking andanalyzingofsamplesshallbeincurredbythe customerorperson applying forconnection to a publicsewer. (3) Where the results ofsample analysis satisfythewaterauthoritythatthewastewateror sewageislikelytocausenuisanceordangerousor injurious to the environmentornegatively affect functioningofthewastewatertreatmentplant,itmay requireinstallationofsuitablepre-treatmentatthe costoftheapplicantbeforetheyareconnectedto thepublicsewer. (4)Withoutprejudice to sub regulation (3), installation ofpre-treatmentplant,forwastewater and sewage from industrialactivities,shallbe mandatorypursuanttoEnvironmentalManagement Actandotherrelevantlegislation. (5)Waterauthoritymayissueguidelinefor monitoring wastewaterin accordance with these Regulations. Tradewaste agreement 10.-(1)Thewaterauthoritymayenterintoa tradewasteagreementwithaprivateoperatorto discharge sewage orwastewaterinto wastewater disposalworks,orfortreatmentofsewage or wastewater;suchagreementmayincludesuchterms andconditionsasthewaterauthoritymaydetermine. (2)The trade waste agreementstipulated undersub-regulation(1)maybeenteredbetweena waterauthority and private operatorforsucking, transportinganddisposingwastewaterandsewage towastewaterdisposalworks,orwithapersonwho isconnectedorapplyingtobeconnectedwithpublic sewerasmaybedeterminedbythewaterauthority. (3)Withoutprejudicetosubregulation(1),the termsandconditionsoftradewasteagreementshall include- (a)provisionsontherateofdischargeof sewageandwastewater; WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 9 (b)takingofsamplesandcheckingthe complianceofsewageandwastewater beforedischargetowastewaterdisposal works; (c)prescriptionofthenatureofthesewage andwastewater; (d)provisiononthedetailsofwastewater disposalworks; (e)prescriptionofthefees,tariff,andcharges andshowupthesource; (f)provision of technical support to the privateoperatorwherenecessary;and (g)maintenance of equipments to the standardsrequiredbytheAuthority. (4) In executing an agreement under sub regulation (1),the waterauthority shallcause a privateoperatortofillinaprescribedform setoutin the Second Schedule to these Regulations for dischargeofsewageorwastewater. (5)Wherethesewageorwastewaterdoesnot meettherequiredstandardorcannotbetreated,the waterauthorityshalldirectthatpersontothe Authority. Eligibilityto enterinto tradewaste agreement 11.Anypersonseekingtoenterintoatrade wasteagreementwithwaterauthorityshallpossess a permitto carryoutactivities ofemptying and transporting sewageorwastewaterissued bythe Authority. Permitfor carryingand transporting wastewater 12.Priortograntofthepermitforcarryingand transportingsewageandwastewater,theAuthority shallensurethatthevessel- (a)hasacontainmentmechanism toconceal the contents exceptduring loading and unloading; (b)is waterand airtightmanufactured to preventleakage and facilitate thorough cleaning; WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 10 (c)has self-sucking and off loading mechanisms;and (d)hasbeenvisiblymarkedasstrictlycarrying andtransportingwastewaterandsewage only. Chamberfor taking samples 13.-(1)Thewaterauthoritymayrequirethe owneroroccupierofanypremisefrom whichthe wastewaterorsewageisconveyedortobeconveyed toconstructaninspectionchamberofthesizenot lessinhorizontalinternaldimensionsthan90cm x 75cm or of such form as the authority may determine. (2) Subjectto sub regulation (1),a duly authorizedofficerofthewaterauthorityshallatall timehaveaccesstosuchchamberandmayexamine thequalityofdischargefrom suchchamber. Installationof publicsewer 14.There shallbe onlyone tertiarysewer connecting a building orseveralbuildings in the samecartilagetothepublicsewer,unless,inthe opinion of the waterauthority,there is special circumstancewarrantingotherwise. Privatesewer onprivate lands 15.-(1)Whereapersonintendstoconstructor repairprivateseweronlandnotownedoroccupied byhim andnotformingpartofastreetthereof,shall obtainpermissioninwritingfrom theownerofsuch land. (2) Nothing in this regulation shall be construed to impose any liability on the water authorityforanydamagearisingfrom thecarrying outofsuchrepairorconstruction. PublicSewer onprivate lands 16.Withoutprejudicetosection21(b)oftheAct, the waterauthority may,aftergiving reasonable notice,enterinto a private land to carryoutany activityrelatingtosewageandwastewaterservices. WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 11 Cesspoolsand septictanks todischarge intosewers 17.A personshallnotcauseorpermitany dischargeoroverflowfrom anycesspool,septictank oranylikereceptacleofsewagetoconnecttoa public sewerwithoutthe consentofthe water authority. Responsibility tomaintain privatesewer 18.-(1)Theowneroroccupierofanypremises shallathisownexpense,maintainallprivatesewer, fittingsand appurtenancesinconnectionwiththe collectionanddisposalofsewageandwastewater constructed upon or in connection with such premisesinanefficientandcleanconditionandina properstateofrepairandfreefrom obstructionto thesatisfactionofthewaterauthority. (2)Inallcaseswheretwoormorebuildings owned oroccupied by more than one owneror occupieraredrained incombinationbyaprivate sewer,suchownersoroccupiersshalljointlyand severallyberesponsibleforthedutyofandforany costsand expensesincidentalto maintaining and repairingsuchprivatesewer. Repairof blockedor damaged publicsewer 19.-(1)Thewaterauthorityshall,uponreceipt ofinformation ofblockage ordamage ofpublic sewer,repairsuchblockageordamage. (2) Where the blockage or damage is establishedtobenegligentlyormaliciouslycaused bytheowneroroccupier,thewaterauthorityshall repairthe blockage ordamage and shallrecover expensesinconnectionwithsuchrepairfrom the owneroroccupier. (3)Notwithstanding sub regulation (2),the waterauthoritymayincludethecostsofrepairofthe defectsintothemonthlybillofthedefaultingowner oroccupier. Trafficways overpublic sewers 20.A person shallnot,withoutthe written permissionofthewaterauthority,alterorconstruct anytrafficwaywhereanypartofsuchtrafficway WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 12 passesorisintendedtocrossoveranypublicsewer. Specifications forprivate sewers 21.Apersonwhointendstoconstructa privatesewershallensure- (a)sewersnotexceeding150mm indiameter conform to the requirements of these Regulationsrelatingtowastewatersewer; and (b)sewersexceeding150mm indiameterare constructed in accordance with specification approved by the water authorityandtestedinsuchamanneras thewaterauthoritymayrequire. Sewerworks license 22.Apersonshallnotconstructorcarryout anysewerworksunlesssuchpersonisinlawful possessionofalicenseobtainedfrom therelevant authority. Inspection chambers 23.A personshallnotsealorallow to be sealed the coverofthe inspection chamberin a mannerlikelytodistortaccessibility. Dischargeof certainwaste prohibited 24.-(1)Apersonshallnotdischargegaseous, liquidorsolidwastewhichcontainsanyfat,grease, oil,petroleum spirit,abattoirwaste,hospitalwaste, sand,detritusorsimilarmattersintoasewerwhich connectswithapublicsewer. (2)Subjecttosubregulation(1)thedischarge ofsuch waste shallonly be allowed where an approvedtrapbythewaterauthorityisinstalledand maintainedregularlybythepersondischargingsuch matters. (3)The waterauthorityshallmake regular inspectionsofthetraptoensurecomplianceandany observationoftracesofprohibitedwastesunderthis regulationbeyondthetrapconnectionisprimafacie evidencethatthefacilityisnotwellmaintainedthen shallbedisconnectedfrom publicsewer. WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 13 Reconnection ofsewer 25.-(1)Whereapersonwhoisdisconnected from publicsewerunderregulation24undertakesthe remedialmeasuresasrequiredbythewaterauthority mayapplyforreconnectioninaprescribedform set outintheThirdScheduletotheseRegulationsand shallpaythereconnectionfeesandchargestothe waterauthority. (2)The waterauthorityshall,within seven days from date of full payment of required reconnectionfeesandcharges,reconnecttheservice tothecustomer. Specialtrap andremovalof prohibited matters 26.-(1)A trapasrequiredbysub-regulation 24(2)shallhave a suitable non-corrosive trayor basketorotherapprovedarrangementbymeansof whichprohibitedmattermayberemovedcompletely from suchtrap. (2)Removalofprohibited matters shallbe carried out at least once daily or as may be determinedbythewaterauthorityanditshallbethe responsibility of the occupier or owner of the premises (3)The trap underthis regulation shallbe installedinamannertoensureefficientremovaland disposalofprohibitedmatters. PARTV OFFENCESANDPENALTIES Damageof sanitation works ActNo.5of 2015 27.Any person who destroys or causes damageordestructanysanitationworkscommitsan offence and shall,upon conviction,be liable to penaltiesasprovidedundertheAct. Obstructionof authorized officer 28.A person who interferestheauthorized officerintheexecutionofhisdutiesorobstructing from enteringtoapremiseforsewerlineinspection and sampling commits an offence, and upon WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 14 conviction,shallbeliabletoafineofnotlessthan onehundredthousandshillingsandnotmorethan twomillionshillingsortoimprisonmentforaterm of notlesstwomonthsortoboth. Tempering withpublic sewers 29.Apersonwhoremovetrap,gritchamber, manhole cover or destroy any appurtenances installedforsuitableoperationofthesystem orother approvedarrangementbymeansofwhichprohibit trappingofunwantedmatter,commitsoffence,and uponconvictionshallbeliabletoafineofnotless thanonemillionshillingsand notmorethantwo millionshillingsortoimprisonmentforaterm not exceedingthreemonthsortoboth. Failureto comply 30.A personwhooperateaprivatecesspit emptiesandfailtocomplywithoperationconditions prescribed underthese Regulations commits an offence,anduponconvictionshallbeliabletoafine ofnotlessthanfivehundredthousandshillingsand not more than one million shillings or to imprisonmentforaterm notexceedingthreemonths ortoboth. General Penalty 31.Apersonwhocontravenestheprovisions oftheseregulations,whereno specificpenaltyis provided,commits an offence and shall,upon conviction,beliabletothepenaltyprescribedinthe Act. PARTVI GENERALPROVISIONS Inspection 32.Anauthorizedpersonmay,forpurposeof implementation and ensuring compliance with provisionsoftheseRegulations,enterandinspect any premises or activity regulated under these Regulations. WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 15 Feesand charges 33.-(1)Thewaterauthorityshallchargeand collecttariffs,feesorotherchargesforwastewater and sewage services rendered to customers in accordancewithratesasmay,from timetotime,be authorizedbytheRegulator. (2)Whereacustomerisdisconnectedfrom watersupplybutcontinuestodischargeswastewater intoapublicsewer,thewaterauthorityshallcharge feewhichisanaverageoflatestpastthreemonths billsorsuchotherfeesasmaybeapprovedbythe Regulator. Disconnection ofsewer 34.-(1)Thewaterauthoritymaydisconnecta seweragefrom anypremisesorprivatesewerdueto thefollowingcircumstances: (a)whereanychargesinconnectionwiththe sewerage services are notpaid within ninetydaysafternotificationbythewater authority; (b)whereaprivatesewerdischargeswaste prohibitedundertheseregulations; (c)wherethewaterauthorityneedtorepairor re-adjustanypublicsewer; (d)whereacustomerrefusesanauthorized officer to enter into his premises for purposeofinspecting,examining,testing ordischarginganyofhisduties; (e)whereacustomerconnectsintoapublic sewer without consent of the water authority;and (f)anyotherreason asthewaterauthority maydeem fit. (2)Wherethewaterauthoritydisconnectthe servicetocustomerpursuanttosub-regulation(1) (c),analternativemeansofdisposalofwasteshall beprovidedbyit. (3)Asewagebillinrespectofpaymentofany rateorchargeissuedbythewaterauthoritywhich bearsthewords“thebillisanotice”shallbedeemed WaterSupplyandSanitation(ProvisionandManagementofSewageand WastewaterServices) GN.NO.827(Contd.) 16 asadulynoticeunderthisregulation. (4)Where the disconnection ofsewerage services is because of reason otherthan non- paymentofbill,thewaterauthorityshallservea noticeofdisconnectiontothecustomerspecifying thereasonforintendeddisconnectionandtimeto takeremedialmeasure. (5)Notwithstanding the provisions ofthis regulation,nothingshallbeconstruedtoprohibita water authority to disconnect service from the customer without serving a notice where the dischargesfrom thecustomerareharmfultopublic sewerandtheenvironment.
