Decree No. 308-12 of the Supreme Soviet putting into effect Land Code

The Law of Turkmenistan on adoption and implementation of the Land Code of Turkmenistan Article 1 To approve the Land Code of Turkmenistan Article 2 To put the Land Code of Turkmenistan into force on 1 November 2004 Article 3 To declare invalid: The Land Code of the Turkmen SSR and Resolution of the Turkmen SSR Supreme Soviet on “Implementation of the Land Code of the Turkmen SSR”, adopted by the Turkmen SSR Supreme Soviet on 12 October 1990 (a bulletin of the Turkmen SSR Supreme Soviet, 1990, № 19-20, p 201,222) The Law of Turkmen SSR on “Introduction of Changes and Amendments to the Land Code of the Turkmen SSR” adopted by the Turkmen SSR Supreme Soviet on 30 May 1991(a bulletin of the Turkmen SSR Supreme Soviet, 1991, № 9-10, p 106) The Law of Turkmenistan on “Rent of Land by Foreign States” adopted by Mejlis of Turkmenistan on 24 November 1995 (a bulletin of Mejlis of Turkmenistan, 1995, № 3, p 43) The Law of Turkmenistan on “Transfer of Land in Ownership to Citizens Engaged in Commodity Agricultural Production” adopted by Mejlis of Turkmenistan on 20 December 1996 (a bulletin of Mejlis of Turkmenistan, 1996, № 4, p 63) from 1 November 2004 Article 4 The Land Code of Turkmenistan shall extend on legal relationship established after putting the Land Code of Turkmenistan into force. Legal relationship established before putting the Land Code of Turkmenistan into force the regulations of the Land Code of Turkmenistan shall be adapted to the rights and duties established after 1 November 2004. Article 5 Until adjusting standard legal acts of Turkmenistan in accordance with the Land Code of Turkmenistan, standard legal acts of Turkmenistan shall be implemented only so far they are not contrary to the unified Law of Turkmenistan on Land. Standard legal acts on the issues that, according to the Land Code of Turkmenistan, can be regulated only by laws shall be in force until the corresponding laws are adopted and put into force. Article 6 The Cabinet of Ministers of Turkmenistan is to adjust standard legal acts of the Cabinet of Ministers of Turkmenistan and other governmental organs authorised to approve standard legal acts in accordance with the Land Code of Turkmenistan. Article 7 The Ministry of Justice of Turkmenistan is to work out and submit proposals on introduction changes and amendments to the legislation of Turkmenistan implied in the Land Code of Turkmenistan for consideration to Mejlis of Turkmenistan within a month. Article 8 The Cabinet of Ministers of Turkmenistan, ministries and departments of Turkmenistan, local executive authorities and institutions of local government are to carry out a complex of arrangements aimed at implementing the Land Code of Turkmenistan and fulfilling its requirements.
