Notification of Ministry of Agriculture and Cooperatives On Advance Data Reporting, and Determining Ports for Non-Thai fishing vessel wishing to enter the Kingdom B.E. 2560 (A.D. 2017)

Unofficial translation – Notification of Ministry of Agriculture and Cooperatives On Advance Data Reporting, and Determining Ports for Non-Thai fishing vessel wishing to enter the Kingdom B.E. 2560 (A.D. 2017) In accordance with the Notification of Ministry of Agriculture and Cooperatives on Advance Data Reporting, and Determining Ports for non-Thai fishing vessel wishing to land aquatic animals or aquatic animal products into the Kingdom B.E. 2559 (A.D. 2016) and the amendment by virtue of section 95 of Royal Ordinance on Fisheries B.E. 2558 (A.D. 2015). As section 29 of the Royal Ordinance on Fisheries (No.2) B.E. 2560 (A.D. 2017) repeals section 95 of the Royal Ordinance on Fisheries B.E. 2558 (A.D. 2015) and be substituted by section 29 under the Royal Ordinance on Fisheries (No.2) B.E. 2560 (A.D. 2017). In addition, to increase the efficiency of non-Thai fishing vessel inspection and correspond to the current situation, this notification shall be notified to follow legal provision of the Royal Ordinance on Fisheries (No.2) B.E. 2560 (A.D. 2017). By virtue of the provisions under section 95 of Royal Ordinance on Fisheries No. 2 B.E. 2558 (A.D. 2015) which is amended by the Royal Ordinance on Fisheries (No.2) B.E. 2560 (A.D. 2017), the Minister of Agriculture and Cooperatives has hereby issued the following clauses: Clause 1: The following Notifications shall be repealed (1) Notification of Ministry of Agriculture and Cooperatives on Advance Data Reporting, and Determining Ports for non-Thai fishing vessel wishing to land aquatic animals or aquatic animal products into the Kingdom B.E. 2559 (A.D. 2016) dated January 8th, 2016. (2) Notification of Ministry of Agriculture and Cooperatives on Advance Data Reporting, and Determining Ports for non-Thai fishing vessel wishing to land aquatic animals or aquatic animal products into the Kingdom (No.2) B.E. 2559 (A.D. 2016) dated March 7th, 2016. (3) Notification of Ministry of Agriculture and Cooperatives on Advance Data Reporting, and Determining Ports for non-Thai fishing vessel wishing to land aquatic animals or aquatic animal products into the Kingdom (No.3) B.E. 2560 (A.D. 2017) on March 23rd, 2017. Clause 2: Any person wishing to bring a non-Thai fishing vessel into the Kingdom shall report data in Form of the request for port entry of foreign vessel and submit required documents specified in the annex attached hereto to the competent officers. (1) Fishing vessel with Cambodia flag and Malaysia flag shall report data in Form of the request for port entry of foreign vessel and submit required documents to the competent officers at least three hours before the vessel arrives at port, however, must request for port entry before the vessel enter the Kingdom. The competent officers shall verify the data and notify the vessel master or vessel agent within one hour after receiving the request for a berthing or before the vessel will enter the Kingdom, whichever is earlier. (2) Fishing vessel with Myanmar flag shall report data in Form of the request for port entry of foreign vessel and submit required documents to the competent officers at least six hours before the vessel arrives at port, however, must request for port entry before the vessel enter the Kingdom. The competent officers shall verify the data and notify the vessel master or vessel agent within three hours after receiving the request for a berthing or before the vessel will enter the Kingdom, whichever is earlier. (3) Fishing vessel with Indonesia flag shall report data in Form of the request for port entry of foreign vessel and submit required documents to the competent officers at least twelve hours before the vessel arrives at port, however, must request for port entry before the vessel enter the Kingdom. The competent officers shall verify the data and notify the vessel master or vessel agent within six hours after receiving the request for a berthing or before the vessel enter the Kingdom, whichever is earlier. (4) Fishing vessel with flag(s) apart from flags mentioned in (1) (2) and (3) shall report data in Form of the request for port entry of foreign vessel and submit required documents to the competent officers at least seventy-two hours before the vessel arrives at port, however, must request for port entry before the vessel enter the Kingdom. The competent officers shall verify the data and notify the vessel master of vessel agent within twenty-four hours after receiving the request for a berthing or before the vessel enters the Kingdom, whichever is earlier. Clause 3: Authorized fishing vessel shall enter a port which is in the list attached herewith this notification. (1) Cambodia-flagged Fishing vessel, Malaysia-flagged Fishing vessel, Myanmar-flagged Fishing vessel, and Indonesia-flagged Fishing vessel of which wishing to land aquatic animals or aquatic animal products into the Kingdom shall enter ports for inspection at ports in the list attached herewith this notification. After inspection by the competent officers, vessels shall be authorized to offload aquatic animals or aquatic animal products at ports which are registered under the Royal Ordinance on Fisheries B.E. 2558 (A.D. 2015). (2) A non-Thai fishing vessel which do not wish to land aquatic animals or aquatic animal products into the Kingdom shall enter ports for inspection at ports in the list attached herewith this notification. After, inspection by the competent officers, vessels are authorized to proceed requested activities at ports which are registered under the Royal Ordinance on Fisheries B.E. 2558 (A.D. 2015) or at any shipyard, repairing dock for vessel reparation. (3) Fishing vessel that is not in (1) wishing to land aquatic animals or aquatic animal products into the Kingdom shall enter ports for inspection and offloading at ports specified in the list attached with this notification only. Vessels for fishing operation in the authorized fishing area of a Flag State or a coastal State, or High seas or of RFMOs shall submit the following documents: 1. Copy of the valid vessel registration granted by the flag State, issued by the respective government agency. 2. Copy of the valid fishing license from flag State, and/or coastal State covering the respective fishing area where the fish was caught. 3. Copy of the stowage plan, containing details of the species and volume stowed and assigned hold number. 4. Copy of the port clearance form of the last port call of the fishing vessel, issued by the competent authority including information, such as the port’s name, port State, and departure date. 5. Copy of vessel master card and/or other legal documents identifying the captain or master or vessel operator, issued by the respective government authority. 6. In case of importation of CITES listed species, copy of the permission document of CITES species importation. Category II: Bulk Cargo Vessel Bulk cargo vessels containing fish received by transshipment at sea or at authorized ports, which fish has been transshipped directly from catching vessel to carrier and have not been landed at port, species sorted, packed, weighted in another state previously, and for which the exact weight per species has not been established. Following documents are requiring for submission: 1. Copy of the valid vessel registration granted by the flag State, issued by the respective government agency. 2. Copy of a valid transshipment license from flag State and/or coastal State and/or Regional Fisheries Management Organizations (RFMOs) and/or related organizations covering the transport area. 3. Copy of the transshipment declaration, containing the name of the carrier vessel and the name of the donor vessel, the transshipment area, species and volume of fish transshipped, and the transshipment period, fully authorized by the government or certified by government authority and/or by the authority of RFMOs. In case of transshipment at sea, it must be documented by observer on board. The transshipment document has to comply with the regulations of the relevant States and has to be in compliance with requirements of the respective fisheries management organization. 4. Copy of the stowage plan, containing details of the species and volume stowed by the name of donor vessel and assigned hold number 5. Copy of the port clearance form of the last port call of the carrier vessel, including information issued by the competent authority, such as the port’s name, port State, and departure date 6. Copy of vessel master card and/or other legal documents identifying the captain or master or vessel operator, issued by the respective government 7. In case of importation of CITES listed species, copy of the permission document of CITES species importation. 8. Copy of the valid donor vessel registration certificate from the flag State, issued by the respective government agency. 9. Copy of the valid fishing license of donor vessel from flag State, and/or coastal State covering the fishing area. Category III: Carrier vessels that are flagged of Cambodia, Malaysia, Myanmar or Indonesia Carrier vessels which are flagged of Cambodia, Malaysia, Myanmar or Indonesia transshipped with a donor fishing vessel that are from the same flag State, which fishes were caught in flag States waters, authorized coastal States or high seas or RFMOs. Following documents are requiring for submission: 1. Copy of the valid vessel registration certificate of carrier vessels, issued by the respective government agency of flag State 2. Copy of the valid transshipment license from the flag State (if have) 3. Submit either one of these documents: 3.1 Copy of the transshipment declaration specify carrier vessel’s name, donor vessel’s name, transshipment area, quantity and species, and transshipment duration, issued by the respective government agency. In case of transshipment at high sea, observer must be on board. Also, copy of the valid vessels registration certificate and copy of fishing license of all donor vessels that donate fish to carrier vessels, issued by the respective government agency shall be submitted. 3.2 Document to verify fish on board which is specified carrier vessel’s name and fishing vessel’s name, vessel registration certificate, fishing license, fishing area, fishing period, quantity and species of aquatic animals of all donor vessels that donate fish to carrier vessels, issued by the respective government agency such as catch certificate, etc. 4. Copy of the stowage plan, containing details of the species and volume stowed by the name of donor vessel and assigned hold number. 5. Copy of the port clearance form of the last port call issued by the competent authority, including information, such as the port’s name, port State, and departure date 6. Copy of vessel master card and/or other legal documents identifying the captain or master or vessel operator, issued by the respective government 7.
