Legislative Decree No. 91 of 2005 establishing the Fund for Financing the National Project for Shifting to Modern Irrigation

Legislative Decree No: 91 President of the Republic Based on Constitution's Rules Article 1. The Ministry: The Minister: The Fund: The following is decided In applying this decree, the following words express the meanings as described. Ministry of Agriculture and Agrarian Reform. Director of fund fimu~cing the national project on shifting to modem irrigation. Directorate of the national project on shifting to modem irrigation. National project on shifting to modem irrigation. Any one invests in agriculture, whether he is an owner, a beneficial, a tenant or a farmer. A fund should be established within the Ministry called: fund of financing national project on shifting to modem irrigation, to be connected to the Minister. The capital of the fund is defmed to be fifty two milliard and two hundred million Syrian Lira, to be paid within ten years. A) A current account to bt: opened c/o the agricultural cooperative bank especially for the fund, to which the fund's money is deposited for achieving the project objectives. B) The sources of financing the fund will be: The sums earmarked in the general budget of the country. Sums reimbursed by the beneficiaries. Support, grants and volunteering monies provided to the fund in accordance with the prevailing rules and systems. 1 Article 5. Article 6. Article 7. Article 8. Late payment interests and charges on loans paid by beneficiaries to the fund. Interests on fund current accounts c/o the agricultural cooperative bank, in line with its rules. The Minister is the orderer of payment from the fund, and he may delegate this to the director. The expenditure required to secure the fund's operations are released by payment orderer based on request from the body in charge of managing and implementing the tasks of the fund. These expenditures are spent and registered in fund's account. The fund is managed by: 1. Board of directors 2. Director A) The board of directors consists of: The Minister Chairman The concerned assistant minister Vice-Chairman Director-General, general organization Member of scientific agricultural research Director-General, agricultural cooperative Member bank. Representative from Ministry of Irrigation Member of a director, rank. Representative from Ministry of Finance Member of a director's rank. Representative from the general associate Member of farmers. Three central directors from the Ministry Members selected by the Minister. Director of the directorate. Member Director of the fund. Member B) The board holds meetings upon chairman's request. Its meetings become legal by attendance of the chairman or vice chairman and majority of members. Decisions are adopted by majority and in case of equal voting, the side includes the chairman prevails. C) The board of directors performs the following duties: 1. Defining the basis and percentage of the fund's contribution in financing the beneficiaries of the project and the granting provisions. 2 Article 9. Article 10. Article 11. Article 12. Article 13. Article 14. 2. Adopting the work plan of the fund. 3. Accepting grants, voluntary and support monies according to ongoing rules and systems. 4. Endorsing the fund's accounts. 5. Allocating the annual budget of the fund. 6.Endorsing the quarterly reports submitted by the directorate in regard to the fund's operations. The project's directorate performs the tasks entrusted to it by the board of directors and supported by a ministerial decree. A) The director is assigned by the minister on the basis of proposal from the board of directors. B) The director will have an assistant named by a decree from the minister, proposed by the director. The director performs the management of the fund's affairs and implementing the decisions of the board of directors and specially carries out the following: a) Representing the fund in its relations with others and before the court, and he may delegate his assistant for that. b) Implementing the general policy adopted by the board of directors to realize the fund's tasks. c) Implementing the work plan of the fund. d) Preparing the draft annual budget of the fund. e) Preparing the accounts of the fund. f) Preparing quarterly reports about the fund's operations showing difficulties constraining the work. g) Issuing decisions for defining and granting the final amount of each loan and the percentage of fund's contribution to the loan. h) Issuance of decisions related to personnel affairs in line with the ongoing rules and systems. Both the tenant and grower can benefit from the fund after approval of land lord. The procedures of collecting the loans installments and action to be taken in case of late payment, are defined by a ministerial decree. The agricultural cooperative bank could be entrusted to collect loans which were not paid in due dates. 3 Article 15. Article 16. Article 17. Article 18. Article 19. Article 20. Article 21. Damascus: 29/9/2005 The cabinet can decide the postponement of collecting loans as extraordinary action, in case of natural disasters which cause difficulties in installments payment. A decree from the minister would define the land areas to benefit from the fund and its contribution according to different agricultural crops. The personnel and other contributors will be granted encouragement incentives, to be defined on basis of a ministerial decree in line with ongoing rules and systems. Without jeopardizing the mandate of both the central organization for monitoring and investigation and the central office for fmancial monitoring, the fund's accounts are subject to auditing by a legal auditor of accounts. The unified accounting rules for organization of administrative nature, are applied on whatever not mentioned in this legislative decree. The Minister will issue the executive instructions of this decree and the accounting instructions for the fund.
