Law on the State Administration for the Environment

the Law of the Slovak National Council from the 17th December 1990 on the State Administration for the Environment The Slovak National Council passed this bill: 17 December 1991 ยง 1 Authorities of the State Administration for the Environment /1/ The state administration in the area of the environmental creation and protection / further only "the care of environment" / by the Slovak Commission for Environment; environmental offices, the Slovak Environmental Inspection and municipalities as well /2/ The environmental offices are represented by: /a/ regional environmental offices b/ local environmental offices /3/ The care of environment, according to this law, is: a/ the nature protection b/ the water protection from the point of view of the water quality and water quantity, and the rational utilization of water c/ air protection d/ land planning and the building order e/ question of conception on the manipulation the solid municipal waste ยง 2 The Slovak Commission for the Environment The Slovak Commission for the Environment as a central authority of the state administration for the care of environment a/ elaborates the conception of the environmental creation and protection b/ manges the state administration in environmental questions c/ performs the state administration in the sphere which is given by special regulations d/ manages the regional environmental offices and the Slovak Environmental Inspection e/ provides the united information system on environment, including countryside monitoring at the territory of the Slovak Republik f/ performs the major state environmental supervision g/ establishes the special professional organizations for the fulfilment of its tests h/ provides the professional education training for workers in the regional and local offices and the Slovak Environmental Inspection in co-operation with other ministies, as well, and the verification of their professional capability Environmental Offices § 3 Seats and Territorial Districts /1/ Seats and territorial districts of regional and local environmental offices are equal to seats and territorial disticts of regional and local offices /2/ Th Slovak Commission for the Environment, except the state administration in the area of nature protection and in the area of land planning and building order that the care of environment will be performed by one regional environmental office within two or more districts /§ 1, Part 3/. The statement of this fact is required from relevant regional and local offices /3/ The regional environmental office can decide on items of thecare of environment /§ 1, Part 3/ being performed by one local environmental office in two or more localities. The statement to this fact is required from the relevant local offices § 4 Regional Environmental Office /1/ The regional environmental office performs the state administration in the range being mentioned in annexes A and B of this law and it represents the State at the discussions on land plans of municipalities /2/ The regional environmental office manages the local environmental offices /3/ The regional environmental office is an appealing body as far as concerned those items in which the local environmental office or a municipality decided in the first stage of administration proceeding /4/ The head is leading the regional environmental office. He is appointed by the Minister of the Slovak Commission for Environment § 5 Local Environmental Office /1/ The local environmental office performs the state administration in the range being expressed in C and D annexes of this law /2/ the head of the local environmental office is appointed by the head of the regional environmental office § 6 Environmental offices co-pperate with other bodies of state administration and municipalities. They can also co-operate with non-governmental organizations and citize's iniciatives for environmental protection The Slovak Environmental Inspection § 7 /1/ The Slovak Environmental Inspection /further only "Inspection"/ is the professional control body by means of which the Slovak Commission for Environment performs the state supervision in question of the environmental care /2/ The Inspectipn consists of Inspection Centre /"Centre"/ and subordinated inspectorates /3/ The head of Inspection is director being appointed by the Minister of the Slovak Commision for Environment /4/ The head of Inspectorate is appointed by the director of Inspection /5/ The detailes on the Inspection organization are settled by the statute which is poblicized by the Minister of the Slovak Commission for Environment § 8 /1/ The Inspection performs the control activity in the range and under the conditions according to special regulations /2/ Details on the Inspection activity will be adjusted by a decree of the Slovak Commission for Environment § 9 Penalties /1/ The Inspection assesses a penalty for the infraction of legislative duties passed by generally obligatory legislative regulations which were determined by control activity /2/ The relevant inspectorate is responsible for a penalty assessment. The Centre decides on an appeal against the penalty assessment /3/ The dealings on a penalty assessment perform that body which began the penalty assessment like the first one. If, at the same time; both the environmental office and The Inspection begin the penalty assessment and they won't agree with that fact who will perform the dealings; the relevant environmental office is responsible for further dealings /4/ The regulations on administrative dealings are valid for the dealings on a penalty assessment, if this law doesn't determine it in a different way /5/ Penalties being assessed by the Inspection represent an income into the state fund of water management or the state fund of air protection § 10 The Inspection co-operates with other bodies of state admnistration and municipalities; as well as with non-governmental organizations and citizen's iniciatives for environmental protection § 11 Municipalities The municipalities care of environment in the range are determined by special regulations § 12 Temporary enactements The day of establishment of environmental offices means that the working places from up-to date bodies of national councils performing in the area of environmental state administration are transformed into the environmental offices § 13 1/ activities of regional national councils given in Annex A of this law are transformed into the regional environmental offices /2/ activities of local national councils given in Annex B of this law are coming to the local environmental offices /3/ activities of local national councils given in Annex C of this law are coming to municipal environmental offices /4/ activities of municipal national councils given in Annex D of this law are coming to the local /5/ activities of regional national councils given in Annex E of this law are coming to the Slovak Commision for Environment § 14 Till the regional and local environmental offices will be established; their tasks are fulfilled by the departments of up-to-date national councils of respective levels and types in accordance with this law /§ 13, Part 1,2,3,4/ § 15 Final Enactement /1/ § 12 of Law passed by the Slovak National Council No.135/1974 on state administration in water management is abolished /2/ The words "land plans of municipalities and" are omitted in § 5; Part 3;let. a/ in the Law bythe Slovak National Council No.472/1990 § 16 This law aquires the effect on the day of declaration
