Regulation on conditions for issuing veterinary certificates for export

Na podlagi petega odstavka 41. člena Zakona o veterinarskih merilih skladnosti (Uradni list RS, št. 93/05) izdaja ministrica za kmetijstvo, gozdarstvo in prehrano Pursuant to paragraph five of Article 41 of the Veterinary Compliance Criteria Act (Official Gazette of the Republic of Slovenia [Uradni list RS], No. 93/05), the Minister of Agriculture, Forestry and Food issues the following P R A V I L N I K R U L E S o postopku izdaje veterinarskih spričeval za izvoz on the procedure for issuing veterinary export certificates 1. člen Article 1 (vsebina) (Subject) Ta pravilnik določa postopke naročanja, priprave in izdaje veterinarskih spričeval, ki pri izvozu spremljajo pošiljke živali in živalskih proizvodov. These Rules lay down the procedures for ordering, drawing up and issuing veterinary certificates accompanying consignments of animals and animal products upon export. 2. člen Article 2 (pogoji) (Conditions) (1) Veterinarski pogoji (v nadaljnjem besedilu: pogoji) so pogoji namembne tretje države za sprejem pošiljke in so določeni s predpisi oziroma z uvoznimi dovoljenji te države ali so dogovorjeni s to tretjo državo in določeni v veterinarskih spričevalih, katerih obrazci so objavljeni na spletni strani Veterinarske uprave Republike Slovenije (v nadaljnjem besedilu: VURS) http://www.vurs.gov.si. (1) Veterinary conditions (hereinafter: conditions) shall mean the conditions of a third country of destination for the receipt of consignments and shall be laid down by the regulations or import permits of such a country or agreed upon with such third country and specified in veterinary certificates, the forms of which shall be published on the website of the Veterinary Administration of the Republic of Slovenia (hereinafter: VARS) http://www.vurs.gov.si. (2) Izvoznik mora pred izvozom iz dokumentov iz prejšnjega odstavka pridobiti informacije glede morebitnih testov in preiskav, ki jih je treba izvesti zaradi preverjanja jamstev in izjav na spričevalu, in preveriti na spletni strani VURS oziroma na VURS, ali že obstaja obrazec veterinarskega spričevala. (2) Prior to export, the exporter must obtain information from the documents referred to in the preceding paragraph on possible tests and examinations that must be conducted for the purposes of verification of the guarantees and statements on the certificate, and check on the VARS website or at the VARS whether the veterinary certificate form already exists. (3) O izvedbi testov in preiskav iz prejšnjega odstavka izvoznik pridobi informacije na območnem uradu VURS (v nadaljnjem besedilu: OU VURS). (3) The exporter shall obtain information on the tests and examinations referred to in the preceding paragraph at the VARS's regional office (hereinafter: VARS RO). 3. člen Article 3 (najava) (Notification) (1) Ko so izvedeni morebitni testi in preiskave iz prejšnjega člena in če je obrazec veterinarskega spričevala objavljen na spletni strani VURS, mora izvoznik pošiljko najmanj tri delovne dni pred odpremo najaviti pristojnemu OU VURS. (1) When the possible tests and examinations referred to in the preceding Article have been conducted and if the veterinarian certificate form has been published on the VARS website, the exporter must notify the consignment to a competent VARS RO at least three working days before dispatch. (2) Najavo se odda na obrazcu, ki je kot priloga sestavni del tega pravilnika in je objavljen tudi na spletni strani VURS. Obrazec se odda elektronsko, lahko pa tudi pisno pristojnemu OU VURS. (2) The notification shall be submitted on the form which, as an Annex to these Rules, shall form an integral part thereof and be published on the VARS website. The form shall be submitted in electronic or written form to the competent VARS RO. 4. člen Article 4 (priprava veterinarskega spričevala) (Drawing up veterinarian certificates) (1) Če izvoznik ugotovi, da je obrazec spričevala iz 2. člena tega pravilnika treba spremeniti ali da obrazec spričevala ni objavljen na spletni strani VURS, sam pripravi obrazec veterinarskega spričevala v pravilnem in strokovno ustreznem jeziku po pridobitvi pogojev namembne tretje države. Navodila za pripravo veterinarskih spričeval so objavljena na spletni strani VURS. (1) If an exporter ascertains that the certificate form referred to in Article 2 of these Rules needs to be modified or that the certificate form is not published on the VARS website, it shall draw up the veterinarian certificate form on its own, in a correct and professionally appropriate language after the conditions required by the third country of destination have been obtained. Instructions for drawing up veterinary certificates shall be published on the VARS website. (2) Izvoznik najavo odda v skladu z drugim odstavkom (2) Exporters shall submit the notification in accordance with prejšnjega člena, obrazec spričevala pa pošlje v elektronski obliki na pristojni OU VURS. paragraph two of the preceding Article, while they shall send the certificate form electronically to the competent VARS RO. 5. člen Article 5 (izdaja spričevala) (Issuance of certificates) OU VURS v povezavi z glavnim uradom VURS preveri, ali se lahko pogoji, zahtevani v spričevalu iz tega pravilnika, potrdijo. Če se zahtevani pogoji lahko potrdijo, glavni urad VURS natisne originalno spričevalo ter ga dostavi na OU VURS. OU VURS mora stranko obvestiti o pripravljenem obrazcu spričevala. Together with the VARS main office, the VARS RO shall verify whether the conditions required in the certificate referred to in these Rules can be confirmed. If the required conditions can be confirmed, the VARS main office shall print the authentic certificate and deliver it to the VARS RO. The VARS RO must notify the applicant of the prepared certificate form. 6. člen Article 6 (prehodna določba) (Transitional provision) Do vzpostavitve Centralnega informacijskega sistema VURS, ki bo omogočal elektronsko poslovanje, se najava iz tega pravilnika dostavlja pisno pristojnemu OU VURS. Until the establishment of the VARS Central Information System, which will enable electronic operation, the notifications referred to in these Rules shall be delivered in written form to the competent VARS RO. 7. člen Article 7 (prenehanje veljavnosti) (End of validity) Z dnem začetka uporabe tega pravilnika preneha veljati Pravilnik o pogojih za izdajo veterinarskih spričeval (Uradni list RS, št. 75/05). Upon the date of the application of these Rules, the Rules on procedures for issuing veterinary certificates (Official Gazette of the Republic of Slovenia [Uradni list RS], No. 75/05) shall cease to be in force. 8. člen Article 8 (končna določba) (Final provision) Ta pravilnik začne veljati osmi dan po objavi v Uradnem listu Republike Slovenije, uporabljati pa se začne šest mesecev po njegovi uveljavitvi. Statement: I hereby declare that I am aware of the following facts and that I understand and accept them: • the certificate was drawn up on the basis of information submitted during the drawing-up of the certificate; • it was my obligation to verify whether the certificate form was in accordance with the conditions stated in the import permit or regulations of the country of destination; • the VARS shall take no responsibility for the consequences if the certificate fails to comply with the requirements of the country of destination; • in the event of an outbreak of certain diseases representing a serious threat to human and animal health in the territory of the Republic of Slovenia, the VARS may revoke the certificate after issuing it; • I allow the use of data from this certificate for the purposes of using and processing data in the VARS Central Information System.
