XXIV-1972) 8 .t.LUCitiSTAN STAT'JTl!S 33 BALUCHISTAN SEA FISHERIES RULES. 1971 [Gazette or Baluchistan, Extraordinary, 12th Ju ly 1971] No. SOA (IV) 26/70 Fish.-ln exercise of the powers conferred by section 17 of the Baluchistan Sea Fisheries Ordinance, 1971 (Baluchistan Ordinance No. IX of 1971), the Governor of Baluchistan is pleased t o make the following rnles, namely : 1. Short title and comme11cement.-(l) These rules may be called the Baluchistan Sea Fisheries Rules, 1971. (2) These rules shall come into force at once. 2. Definitions.-(!) In these rules unless the context otherwise requires the following expressic,ns shall have the meaning hereby assigned to them that is to say : (a) "Application form" means the application form appended to these rules; (b) " Fee" means a fee prescribed under these rules ; (c) ''Licence" means a licence granted under those rules ; (d) "Offence" means an offence punishable under the Ordinance ; (e) "Ordinance" means the Baluchistan Sea Fisheries Ordinance, 1971' ( f) "Section" means a section of the Ordinance; (2) Expressions not defined herein shall have t he same meaning a, assigned to t. .,m by the Baluchistan Sea Fisheries Ordinance, 197 1. 3. Prohibition and Licensing of fishing.-(1) Any person desirous of operating a fishing craft in .Baluchistan Waters shall apply for a licence, to lhe Licensing Authority in the form appended to these rules; (2) The Licensing Authori ty may grant a lice.ace io the form apper.dcd to these rules. The licence shall be granted within one week or submitting the application unless the Licensing Authority, for sufficient cause in writing, refuses to grant it. 4. Fee for a /icence.-Fee for a licence shall be chargeable as given iu the Schedule I annexed to these rules. 5. Duration of Validity of a /icence.-A licence shall be valid for tho calendar year in which le is Issued, lrrcapecdvc of the date of issuo. NOTIFICATIONS [l'. L. 1), 6. Produ,•tion of Licence for ln ipection.- A holder of a licence shall on demand, produce the sumo for ia, pection by a Fishery Olli cer. 8, Duplicate Li,:ence.- The Licensing Authority may is~ue a duplicate copy of a Licence on payment of a fee of one rupee if the original li;;ell..:(I i,e lost or damaged. 9. Protection of fish in selected water.-A licence granted under theie rules docs not authorise the licensee to fish within a distance of three rniles of the sea coasts in bays of S0nmia11i, Ormara, Kalmat, Pasni, J iwaui a n.! Gwadar, except by special permission of the Fishery Officer. 10. Catching Devlce.- No licence-bolder shall employ any device for catching shrimps under 2i· size a nd lobsters under 7" size. Further that no female lobsters loaded with eg3s shall be laoded. 11. Prote,·lian of r1ets used by small ftsherman.- No owner of a fishing cr:ifl or any other person employed in this behalf, shall dijmage, wilfully or otherwise any net set by any other fisherman, or cause disruption lo fish ing by such fisherman . 12. Furnishing of ftshi11g data.-The licence-holders of fishing craft, shall furnisb, when called upon to do so by the Licensing Authority, or any flshery Officer factual date regarding the a re& fished out, gear usej and the type and quality of fish caught, for the catch being landed. 13. Beheading shrimps a11d care in transil.- The fishermen catching shrimps by trawlers or otherwise on the authority of a licence granted under the!e rules and awaiting transportation over short or long distance for processing shall immediately behead the catch and preserve it hygienicaJly under shade io case of sail boats and in ice fish holds in the case of trawlers and mechanised boats. 14. aegist,ation of Curing Yards and Plants.-AII privately owned fish Curing Yards and fish processing plants operating on commercial basis on Baluchistan coast shall be registered with the Licensing Authority. 15. Curing of fi~h at places other than a regirlered curing i}'ard an ojfence.-Curing of fish at places other than a registered curing yard shall be an offc•1ce under the Ordinance. 16. Conditions for operating curing yards. - A Fish Curing Yard shall be registered oo application in the form in Schedule HI appended to these rules, If the foJlowiog conditions are satisfied : (I) Prescribed fee has been duly deposited ; (ii) Raised pla tforms are provided for drying the fish ; (iii) Sufficient water is provided for fish washing ; (iv} Fisb curing tanks are cons tructed above ground level and aN internally cement plastered ; (v) Drainage i, provided from the curing tanks and the fish wasbiog points, to soak pits outside the curing yard or to the drainage system of the local area ; if provided; and (vl) Ventilated covered storage space is avalliblc (or the dried fish. Withdrawal of registration if provisio11s of R ult 16 ni,t c<'1np/11d, (I) The Licensing Authority may withdraw the registratlon of a ftah curlna yard if it ceases to operate in accordance with all or any of the condhlon1 taid down in rule 16 : Provided that no order of withdrawal of registration ahall bo laauod under this rule, unless the owner or operator of such curlna yard h11 been called upon through a month's notice in writing to comply with the conditions laid down lo rule 16. (2) This rule shall come Into force artcr the expiry or 90 days of the coming Into force of these rules. 18. Fee on.finished Product.- The Lina! product of a fish curing yard ~ball be liable to payment of fee prescribed in Schedule JI annexed to these rules. Proviso : Provided that this rule shall be applicable from such date r11 the Government by official Notilication, ai;>points in this behalf. 19. Opcrario11 of mech(lnical proces.,ing plants.-The mechanical pro CtSsing plants shall be operated according to the conditions la id down by the Licensing Authority. 20. Appeal. - Appeal shall lie against all orders passed under the Ordinance and these rules to the Secretary , Agriculture Dei:,artment, Goverument of Baluchistan.
