Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2007 Anand Satyanand, Governor-General Order in Council At Wellington this 27th day of August 2007 Present: His Excellency the Governor-General in Council Pursuant to section 297 of the Fisheries Act 1996, His Excellency the Governor-General, acting on the advice and with the consent of the Executive Council, makes the following regulations. Contents 1 Title 2 Commencement 3 Principal regulations amended 4 New regulation 3F inserted 3F Unattended set nets in East Otago taiapure 5 Trawling prohibited in certain seamount areas 6 Offences Regulations 1 Title These regulations are the Fisheries (South-East Area Commercial Fishing) Amendment Regulations 2007. 2 Commencement These regulations come into force on 1 October 2007. 3 Principal regulations amended These regulations amend the Fisheries (South-East Area Commercial Fishing) Regulations 1986. 4 New regulation 3F inserted The following regulation is inserted after regulation 3E: "3F Unattended set nets in East Otago taiapure "(1) A commercial fisher who uses a set net in East Otago taiapure must, at all times, remain in the immediate vicinity of the set net. "(2) In this regulation, East Otago taiapure means the area described in the Schedule to the Fisheries (East Otago Taiapure) Order 1999." 5 Trawling prohibited in certain seamount areas Regulation 4C(2)(d) is revoked and the following paragraph substituted: "(d) the area located in fisheries management area 4 that is bounded by "(i) the latitudes 44o11'S and 44o07'S; and "(ii) the longitudes 174o48'W and 174o39'W:". 6 Offences Regulation 12(1) is amended by inserting "3F," after "3E,".
