Dated -th Julv 198i Shivapuri Watershed and wildlife Reserve Develooment Board (Formation) order. 1984 His ;Vlajesty's Government (HMG) has issued the following order in accordance to the authority provided by section 3 under Development Comm itt e e Act. 1956 . 1. Nomenalature and Implementat ion (i) The nomenc l a t u r e of this order is Shivapuri Watershed and Wildlife Reserve Development Board (Formation) order. 1984. (iii) HMO can alter increase or decrease the members of the board through gazette notification if deemed necessary. (iv) Any national or international expert may attend the meeting as an adviser upon the request of the board. Duties. Responsibilitv and Authoritv of the Board (i) The duty of the board shall be to increase the supply and quality of the drinking water through conservation and development of shivapuri watershed and wildlife reserve and to implement the project in order to develop the area for recreational purposes, (ii) in order to fulfil the responsibility ment ioned in subsect ion (i) the board can undertake the following activities: a) to carry out forest demarcation in the area b) to fence the area c) to Construct c he ckdams , embankment, roads and scenic spots within the area 140 d ) to plant trees. horticulture and grass to construct terraces and implement siol conservation program e) to recruit necessary staff for the project f) to launch other necessary activities 5. Formation of subcommittee (i) The committee may create the following subcommittees ~o execute the project activities: a) Protection subcommittee Project Chief Survey Officer. Project Representative. Royal Nepalese Army Forest Officer. Project b} Rehabilitation subcommittee Joint zonal commissioner Survey Officer. Project Chairman. Related village Development committee c) Plantation subcommittee Director General. Department of Soil Consevation and Watershed Management Forest Officer. Project Representative. Department of National Parks and Wildlife conseration Coordinator Member )1ember Member Coordinator :~1embe r Member Coordinator Member Member d) Village Develooment and Public Relations subcommittee Joint Zonal commissioner Chairman Village Development Committee Sundarijal Forest Officer, Project Coordinator Member Member (iii) The duties and responsibilities of the subcommittees constituted under subsection (i) will be as assigned by the board. 141 6. Board ~eeting and its discussions (1) The Board meeting will be held according to the decision of the Chairman. (iil The Board meet i ng can be conducted if 50 percent of the tOtal board members including the Chairman and the member s~cretary are p r e s e n r . (,"I The board will de~~rmine itself other procedures to be adopted in the me e t i ng , Subcommitt;:e meeting and its decision (il The subcommittee meeting will be held accoding to the decision of the subcommittee coordinator. (iii The subcommittee meeting may be held in the presence of the coordinator and the member in addition to another member. (iii) The dicision of the subcommittee will be based on the majority votes and if the votes are equally divided the coordinator can cast a decisive vote, (iv) The subcommittee decisions will be testified by the coordinat~r. (v) The subcommittee will determine itself other procedures to adopted in the subcommittee meeting. S. Board Fund (i) The board fund wi 11 be compr i s ed of fo llowing financial resources and all the expenditures of the board will be met by the fund : a) Resources obtained from HMG b) Resources obtained from foreign government oa international institution through HMG c) Resources obtained by the Board from any other source ~ (ii) The operation of the Board fund will be according to the rules formulated by the Board. 9. Autiting (1) The a c cou t s of income and expenditure of the board shall be maintained according to HMG procedures, (ii) The auditing of the board will be performed on accordance to the prevalent Nepalese Act, (iii) HMG can check or get the Board account checked any moment if so desired. 142 10. Delegation of the authoritv authority to any member or subcommittee or any personnel The board can delegete its member secretary of members of the project as necessary. II. Rules formula:ion The board can formulate necessary rules for execution of the activities with the permission from His ~ajesty's Government. 1:2. Coordination with HMG The Board will coordinate with HMG through ~inistry of Forests and Soil Conservation. 1.3. The Office of :::he Board The office of the board wi 11 setup in Kathmandu. 1 ·1~.
