(3) Animal Feed Premix having a shelf life not exceeding 18 months shall carry the date of minimum durability with the phrase 44keep until. ... " (4) The phrase '1Not for human consumption" or a statement substantially similar to it shall appear in a prominent position on the label. (5) The pictorial and thQ physiological status of the target animal shall be specified on the product lubcl. 4. {I) The label on animal feed premix shall be conspicuous to indicate the name of animal feed premix, manufacturing location, address of the manufacturer and the nmne of the holder of Certificate of Registration. (2) Where animal feed premix is manufactured under a contract manufacturing agreement, tho name and address of the manufacturing location shall be indicated hy a phrase that reveals the connection with the entity uch as ''Manufactured by ... for ... "., "Manufactured for ... by ... '', or any other in formation that expresses the facts. O) The site location address of the manufacturer of animal feed premix shall be written on tho label of any packaging components uch as primary, secondary and tertiary. (4) The name and address of the manufacturer, packer, distributor, importer or vendor oflhc animal feed premix shall be declared on the product label. (S) Where an animal focd premix undergoes processing in a country, which changes its chemical or physical nature, the country in which the processing is performed shal I be considered to be the country of origin for the purposes of labeling. 5.-( I) The primary, secondary and tertiary package of an animal feed premi. hall bear the name and indicate the accurate nature of the animal feed prem i:. (2) Where a common name or statement of identity has been established for the animal feed premix, it shall be used in conjunction with the brand name of uch animal feed premix. (3) Where no common name or statement of identity exists for an animal feed premix. an appropriate descriptive name shall be affixed to it. (4) Where a coined or fanciful name is used for the animal feed premix the name shall be accompanied with an appropriate descriptive term and not be misleading. 8 1007 Product Identity 6.--( I) A complete list of ingredient used in preparing the animal feed I ist of premix product shat I be declared on the label in decreasing order of prominence. ingredients (2) The declaration of the ingredients shall be prominent, readable and understood under normal conditions of purchase. 7.--( I) The accurate net content of an animal feed premix shall be Net content declared on the label in the metric system. (2) The declaration of the net content or an animal feed premix shall be required to be made in the case of- (a) liquid animal feed premix in volume: (b) solid animal feed premix by weight and number or count, where applicable: and (c) semi- solid or viscous animal feed premi, by weight or volume. (3) The declaration referred to in subregulation (2) of this regulation shalt accurately reveal the quantity of animal feed premix in a package exclusive of bags and other material packed with it. 8. -(I) Animal feed premix label shall specify and legibly display the day, month and year of manufacture and expiration. (2) The day and year shall be declared by un-coded number ith the year to be denoted by two or four digit and the month declared in word or number. (3) Date inscription shalt be combined in accordance with ubregulations (I) and (2) of thi regulation and introduced with the word ''Date of Manufacture" and "Date of Expiry". ( 4) Where evcral item are included in the outer package, which during usage by the con umer may be discarded, the marking of date shall al o appear on the package that is likely to be retained by the consumer until consumption. marking and Rutch number B 1008 (5) The batch number of animal feed premix shall be indicated on the inner and outer label. Animal Feed Premi. hall b clearly labelled con picuously with the following precautionary statement - (a) for animal use only~ and (b) keep out of reach of children. 14. The label of an animal feed premix hall not refer or lay claim to an endor ement directl)' or indirectly, to a professional body or association. e cept a pre cribed by the Agency. Prohibition 15. A person shall not manufacture, import, e port, di tribute. ad erti e. di play for sale, offer for ale, sell, or u e nimal Feed Premi unle s it i labelled in accordance with the provisions of these Regulations. PART Ill - 0Ft l·NCL AND PEN LTIES Offences and 16.-{ I) A person who contravenes any of the pro is ions of these Penaltie Regulations commits an offence and is liable on conviction, in the case of- (a) an individual, to imprisonment for a term not exceeding one year or to a fine not exceeding N-800,000 or both; and (h) a body corporate, to a fine not exceeding NS,000,000. (2) Where an offence under these Regulations is committed by a body corporate, firm or any other association of individuals, evcry- (a) director, manager, secretary or other similar officer of the body corporate; (h) partner or officer of the firm; (c) trustee of the body concerned; (d) person concerned in the management of the affairs of the association: or (e) person who purports to act in a capacity referred to in paragraphs (a) to (d) of this regulation, is liable to be proceeded against and be puni hed for the offence and in the same manner as if the person committed the offence, unless the person proves that the act or omission constituting the offence took place without his knowledge, consent or connivance. 17.-{ I) A person convicted of an offence under these Regulations shall forfeit to the Federal Government - (a) any asset or property constituting proceeds derived from or obtained, directly or indirectly, from the offence; and ( h) any of the person's property or instruments used in any manner to commit or to facilitate the commission of the offence. (2) Jn this section, "proceeds" means any property derived or obtarned, directly or indirectly. through the commission of the ofTence. PARI IV Mrscn LAN1•011s 18. The Agency is exclusively responsible for the enforcement of these Regulations. 19. Jn the e regulation , unless the context otherwise requires - ''Address'' means a place where the bu incss of manufacture, ale, distribution, storage and display of animal teed premix is carried out which includes the house number, plot numb r, street name, town or city, state, country; ~ Agency" means National Agency for f·ood and Drug Administration and Control; "Animal Feed'' means any single or multiple materials, whether processed, semi processed or raw, which i intended to feed directly to animals; 8 1009 I orfo,turc aflcr <.:onv1ction l nfon.:emcnt of thc~e Regulation lnterpn.'tlltion B 1010 Citation "Batch number or Lot" means the number or a combination of numbers and letters specifically given to animal feed premix product which is linked to the manufacturing history of the product; "Expiry date" means any date after which a product is not recommended for use; "'Field trial" means a scientific evaluation conducted by an approved research institution on an Animal Feed Premix; "Ingredient" means any substance used in the manufacture or preparation of an Animal Feed Premix and present in the final product although possibly in a modified form; "'Labef' means any tag, brand, mark, pictorial or other descriptive matter. written, printed, stencilled, marked, embossed, impressed on, or attached to the packaging or the container of animal feed premix; "Labelling" means all labels and other written, printed, or graphic matter ( 1) upon any article or any of its containers or wrappers, or (2) accompanying the animal feed premix; "Premix" means a uniform mixture of one or more micro ingredient or additives with a diluents and carrier to facilitate their even distribution in a larger mix. 20.
