ACT To amend the Prevention of Undesirable Residue in Meat Act, 1991, so as to extend the definition of "Group III substance"; to amend the provisions relating to with drawal times; and to provide for incidental matters. (Signed by the President on 10 September 1994) BE IT ENACTED by the Parliament of the Republic of Namibia, as follows: Amendment of section I of Acl21 of 1991. 1. Section 1 of the Prevention of Undesirable Residue in Meat Act, 1991 (hereinafter referred to as the principal Act), is hereby amended (a) by the substitution for the definition of "Group II 1 substance" of the following definition: " 'Group III substance' means a an roduct referred to in sub ara ra hs (i) and (ii) of paragraph (a) of section 2( 1) to which a withdrawal time has been assigned during registration under the laws referred to in those subparagraphs, but excluding any such product which is a prohibited or Group I or Group II substance; (b) any other product declared as a Group II I substance under that section [2];"; (b) by the substitution for the definition of "with drawal time" of the following definition: No. 923 Act No. II, 1994 Amendment of section 2 of Act 21 of 1991. Short title and com mencement. Government Gazette 21 September 1994 3 PREVENTION OF UNDESIRABI..E RESIDUE IN MEAT AMENDMENT ACT, 1994 " 'withdrawal time', in relation to a Group 11 or Group III substance, means the appropriate withdrawal time [prescribed under] referred to in section 2.". 2. Section 2 of the principal Act is hereby amended (a) by the substitution for the words preceding paragraph (a) of subsection (1) of the following words: "Subject to the provisions of subsections (3) and (4), the Minister may by notice in the Gazette, for the purposes of this Act -"; (b) by the addition of the following subsections: "(3 The Minister rna for the ur ose of prescribing the withdrawal time of any substance referred to in subparagraphs (i) and (ii) of para graph (a) of su bsection (I), accept the withdrawal time assigned to such substance during regi stration under the laws referred to in those subparagraphs. (4) Notwithstanding subsection (l)(c), the withdrawal time referred to in paragraph (a) of the definition of "Group III substance" in section I shall until (a) a product referred to in that paragraph is declared as a prohibited or Group I or Group II substance; or (b) such withdrawal time is amended by means of any notice contemplated in that subsection, be the withdrawal time in respect of such pro duct. ". 3. This Act shall be called the Prevention of Un desirable Residue in Meat Amendment Act, 1994, and shall come into operation on the date of commencement of the principal Act.
