(2) These Regulations s-hall (a) in respect of fishing and fisheries in maritime waterl, come iuto force on the date immediately following the date of publication of these Regulations; lnd (b) in respect of fuhing and fishetic:.1 in estuarine waters, come into force on a date or dates as :the Minister may, with the con• currence of the State Government, appoint by notification in the Gazette and dit!er<:nt dates may be appointed for different areas of Sarawak. PRELIMINARY 2. In these Regulations, unless the context othcrwi,e requires- I.atcrprc "Fishery Offic.:r'' has the same meaning assigned to it in the btioo. LICENCES 3. (1) No person shall within territorial waters adjacent to coast of ~nwu. Authoriu.• tioo to u.se other appliance, a.nduemp• don from iu.. 4. {I) Application for a licence in respect of fishing stakes nnd appliancc:,s shall be made in writing to the Fishery Officer who may issue a licence afore:.aid or reject the application: anti every applicatiQo ,hall contain such partfoulars as the Fishery Officer may requ1Ie. (5) No fuhlug stakes or appliitnces shall be operated in such manner or at such plae¢ as to obstruct navigation or withiu such distance of any island as sp~i"fied in the Turtles (Prevention of Di~t'urbance) Rule~ 1962. (6) Any person who contravenes any o! the conditions of the aforesaid licence and permit shall be deemed to hav:! acted contrary to the prov'.sions of thes: Regulations. 5. There shall be payable in respect of fohing appliances and fishing stakes &pecified in the first column in the Soccnd Sch~ulc hereto the fees specified in the second column of the said Schedule. 6. Where any person is licensed in re.spect of trawl nets, the Fishery Officer may, by endor.:ement ori such liceuce, authorize such person {O usi, other nshing appliances: Provided that where such authori:z.ation by endorsement is made on such licence, such person shall he exempted frorn paying the tees specified in the corresponding second column of tJ1c Second Schedule. 7. The Director-General of Fisheries may determine the number of Number of licences which may be issued in any year in respect of fishing stakes ice~r.:J.0 and fishing appliances. 9. Subject to the provisions of the Sixth Schedule no person shall operate or permit or cause to be operated any fishing appliances within a distance of two hundred fathoms of any fishing stakes licensed under these Regulations. (1) Any person wishing to set up any fishing stakes may ma'l::e an AppU~tion application in writing io. that behalf to the Fishery Officer. specifying t,t an 1s.;sue in such application the type and site of the fishing stakes proposed to ~tr:;rut to be set up and, if so required by the Fishery Officer, furnishing the plan fi1hini of the said site. stak'.es. (2) On an application being made as aforesaid the Fishery Officer may survey the site specified in th,! application or in the plan furnished, if any, and may. if he is satisfied that the setting up of the fishing stakes aforesaid will not contravene any of the provisions of thesG Regulations. issue a permit, and. in any other case rcj~t the application. (3) Before a permit under this regulation i:; iss~e<l in respect of the fishing stakes specified in the first column in the Third Schedule hereto the applicant shall be required to make with th~ Fishery Officer the deposits specified in the corresponding second column in the said Schedule which shall be paid to the Treasury. Provided that the Director-Ge~ral may in any case where it would be fair or just so to do allow an applicant to make '-mly part of the amount prescribed: and in every such case the applicant may in lieu of making the full deposit furnish a bank guarantee or execute a bond with or without sureties as may be approved by the Director-General. Where, by tho <r"~ratiou of any fi.s-hing appliance licensed under these Regulations, any fishing litakes or other fishing appliance.s are damaged, the licensee o! tbe fishlng appliance first mentioned shall forfeit so much of the deposit {if eny) made in respect cf that appliance a.'i equals the claim :mad~ iu respect of the fishing stakes of appliances damaged u aforesa.id : Provided tlu~t where the cfaLrn made in respect of the fishing stakes or appliances damaged e;,cc.e<l~ the amouut of such deposits the balance sh.all be recoverable from the p~rson or persons in whose name the deposit was made. AI.I BIN HAn AHMAD, Ministry of Agricultuu Non?: For the purpose of these Regulatioos, the breadth of the territorial waters adjacent to the ccast cf Sarawak, construed in accordance with the provisions of the Emergency (Essaitial Powers) Ordinance, No. 7 1969, is twelve nautical miles.
