The Second Amending Rules of the Rules for the Pr ot ection of Far mer ’s Right s and Enh ancement of their Benefits (2020) (၂ ၀၂ ၀ ) 44 Government of the Republic of the Union of Myanmar Ministry of Agriculture, Livestock and Irrigation Notification No.306/2020 The 11 st Waxing Day of Second Waso, 1382 M.E. (30 July, 2020) The Ministry of Agriculture, Livestock and Irrigation hereby issues the following rules in the exercise of the power conferred by subsection (a) of section 29 of the Protection of Farmer’s Rights and Enhancement of their Benefits Law with the approval of the Union Government. 1. These rules shall be called the Second Amending Rules of the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits. 2. The expressions “the Ministry of Agriculture and Irrigation” and “the Union Government” contained in the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits shall be substituted by the expressions “the Ministry of Agriculture , Livestock and Irrigation” and “the Government” respectively. 45 3. The expression “qualified seeds” contained in subrule (c) of rule 6 of the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits shall be substituted by the expression “qualified seedlings, seeds, breeds, offspring”. 4. Subrule (i) of rule 6 of the Rules for the Protection of Farmer’s Rights and Enhancement of their benefits shall be substituted as follow: “(i) cooperating and coordinating with the relevant departments and organizations to have legal right to use the land for the businesses relating to livestock farms, fish farms on the farmland, vacant, fallow and virgin land, pasture, forest land or others land in accordance with the existing laws.” 46 5. After subrule (j) of rule 6 of the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits, subrule (j-1) shall be inserted as follow: “(j-1) Coordinating with Livestock Breeding and Veterinary Department (LBVD) and Department of Fisheries to ensure that a person who has the legal right to use the land for livestock breeding including aquaculture has the following rights under the existing laws; (i) right to possess the land that has been granted permission to carry out livestock breeding including aquaculture, right to carry out livestock breeding and right to enjoy the benefits arising from this right; 47 (ii) right to sell, mortgage, lease, exchange and gift the whole or part of the land that has been granted permission to carry out livestock breeding including the aquaculture under the Farmland Law; (iii) right to accept the decision of the relevant court in accordance with the existing laws if a dispute arises relating to the inheritance of the land that has been granted permission to carry out livestock breeding; (iv) right to use the land so far as the stipulated terms and conditions are not violated; (v) right to take part in the development of livestock breeding with the investment of village cooperative or with private investors based on shared interest; 48 (vi) right to carry out livestock breeding in accordance with the Foreign Investment Law of the Republic of the Union of Myanmar in cooperation with a foreigner or organization involving a foreigner based on shared interest.” 6. The expression “seed, offspring” contained in rules 17, 18 and 19 of the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits shall be substituted by the expression “seedling, seed, breed, offspring”. 7. The expression “year” contained in rule 21 and subrule (b) of rule 21 of the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits shall be substituted by the expression “annual”. 49 8. The expression “each farmer to have two guarantors” contained in rule 23 of the Rules for the Protection of Farmer’s rights and Enhancement of their Benefits shall be substituted by the expression “each farmer who mortgages their Form (7) of Permission to carry out the farmland to the bank by self-insure system”. 9. The expression “by March 31, the end of financial year” contained in rules 41 and 42 of the Rules for the Protection of Farmer’s Rights and Enhancement of their Benefits shall be substituted by the expression “by September 30, the end of Financial year”.
