( 15 July 2019 ) In exercise of the power conferred under subsection (a) of section 56 of the Irrigation Law, the Ministry of Agriculture, Livestock and Irrigation hereby issues the following rules with the approval of the Union Government. Chapter I Title and Definitions 1. These rules shall be called the Irrigation Rules. 2. The following expressions contained in these rules shall have the meanings as defined in the Irrigation Law. In addition, the following expressions shall have the meanings given below: (a) Law means the Irrigation Law; (b) Canal bank means the bank on both sides of the Canal, Irrigation Canal, Diversion Canal and Drainage. ၂ မ ဆ သည ။ ယင စ ရပ တ င ရ ဘ ယ ရ တ ပ င မ လည ပ ဝ င သည ။ (ဂ) ဆ သည မ ဆည ရ သ ပ မ ည လ ပ င န မ သ ရ ရ ရ စ ရ န သယ ဆ င ပ သည ရ မ င ဆ သည ။ (ဃ) ဆ သည မ ရ လ င တမ သ မဟ တ ရလ ဆည သ မဟ တ မစ ရတင လ ပ ငန ဖင ရ တ ရယ ပ ရစ ပမ ဏ မ ဆ သယ ယ စ ဆင င သ ဆ ရ ပ မ င ဆ သည ။ (င) ဆ သည မ မ င မ မ ထ ရ ရ ယ ပ မ င မ ရ စ ပ မ ဏ လ န ည သ ရ ပ မ င ဆ သည ။ (စ) ဆ သည မ မ င မ သ မဟ တ မ င မ မ ထ ရ ရယ ပ မ င မ ရစ န ပမ ဏ လ နည သ ရ ပ မ င ဆ သည ။ (ဆ) ဆ သည မ လ တ မ င မ ထ ရ ရယ ပ ဝ သ ရ ပ မ င ဆ သည ။ (ဇ) ဆ သည မ ရ ပ မ င တ စ မ ဆည ရ ထ တ ယ သ စ ရန တ တ ပ ဆင ထ သည ရ ပ န ဆ သည ။ 2 This expression also includes the Levee/ Embankment; (c) Irrigation Canal means the canal that carries water to the irrigation works; (d) Main Canal means the largest irrigation canal that can flow water with the maximum flow rate, and carry water directly through a dam or diversion dam or river pumping operation; (e) The Branch Canal means a canal diverted from the main canal and carries water below the flow rate of the Main Canal; (f) The Distributary means a canal diverted from the main canal or branch canal and carries water below the flow rate of the branch canal; (g) The Tertiary/ Minor means a canal that is diverted from the distributary and carries water below the flow rate of the distributary; (h) Pipe Outlet means a tube fitted to use irrigation water from any irrigation canal; ၃ (ဈ) ဆ သည မ ဆည မ င သ မဟ တ လယ မ င တ မ ပ ဝ သ ရ ဆ သည ။ (ည) ဆ သည မ မ င မ ၊ လ တ မ င ၊ လ တ မ င င ရ ပ ပ န မ လ တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ င ယ မ စ ပ င ဖ စ ည ထ သည ဖ ဆ သည ။ (ဋ) ဆ သည မ လယ မ င တစ င လ ဆည ရ သ ပ သ တ င သ မ လ ဖင ဖ စည ထ သည ဖ ဆ သည ။ (ဌ) ဆ သ ည မ စ မ င တ စ မ မ သ ပ ဖစ စ၊ မ န မ မင သဘ ဝ လ ဖစ စ၊ လ လ ဖစ စ မ ပ ရ င မ ရ မ ရ ယ သ ပ သ လ ပ င န ဆ သည ။ (၂) ၃။ ဝ န ဌ န သည ပ ဆည မ င တ ည ဆ င လ ပ င န မ ဆ င ရ ရ န လ ပ ပ ပ ဒပ ဒ မ ၄ ရ မ န င စ ထ တ ပ န ရမ ည 3 (i) Irrigation water means water supplied by irrigation or watercourse; (j) Farmers Water User Association (WUA) means a collective group of Farmers' Water User Group (WUG) by the Branch Canal, the Distributary, Tertiary/ Minor and the Pipe Outlet; (k) The Farmer Water User Group (WUG) means a team of farmers who use irrigation water by each watercourse; (l) Irrigation and Groundwater Work means the consumption of the surface and groundwater by using some kind of energy or the consumption of them naturally or automatically depending on the terrain. Chapter II Construction of Irrigation Facilities 3. The Ministry shall issue a notification under Section 4 of the Law if it is required to construct: ၄ ( ) ရ ပ ဝ ရ န င ရ သ လ င ရန တ ဆည မ င င ဆ စ ပ ဆ မ တ ည ဆ င လ ပ င န ၊ ( ) ရ ၊ ရ န စ ၊ ရ န င မ တ ရ တ မ င မ တ ဖ င လ ပ င န ၊ (ဂ) စ ပ မ မ ရ တ ရ သ လ င င ရန ရငန တ တမ ၊ ရ ဘ ယ ရ တ တ မ င ရ တ တ ည ဆ င လ ပ င န ။ ၄။ ဝန ဌ န မ န င စ ထ တ ပန သည န မ စ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ သ မဟ တ ယင တ ဝ န ပ ပ င ရ သ စ ဌ န ရ ရ သည ( ) တ င စ စ မ လ လ တ င တ င လ ပ င န မ ဆ င ရ ရ တ င ပ လ ပ င န မ ဆ င ရ ရမ ည (၁) လ ပ ငန တည နရ န စပ ဆ ၁ လ မ = ၁ မ င မပ ပ တ င ဖ ပ စ စ မ လ လ င ၊ (၂) မ လဝ သ င ဇလ ဗ ဒဆ င ရ လ မ န မ န တ င ၊ (၃) မ ပ င တ င တ မ လ ပ င န မ ဆ င ရ င ၊ (၄) သ ဆ င ရ လ မ ၊ စ ပ ရ လ ပ မ င ရ သ သ ရ လ ပ မ မ လ လ င ။ 4 (a) construction of irrigation canal and related facilities for water supply and storage; (b) drainage for flood, submerged, and deep areas; (c) salt-water prevention embankment, flood-protected embankment, and sluice gate to store freshwater for agriculture and livestock. 4. The Region or State Irrigation officer or the delegated officer from the department, from the date of issuance of the notification by the Ministry: (a) shall conduct a feasibility study of land and boundary survey for canals construction as follow: (i) feasibility study of the site location on 1 inch = 1 mile map; (ii) estimation of meteorological and hydrological data; (iii) conducting the land survey; (iv) study of cropping pattern, water requirement, and rural drinking water requirement. ၅ ( ) ထ ပ ဒ ( ) ပ တင စ စမ လ လ င လ ပ ငန မ မ ရရ သ လ မ ရ ဖ စ မ င စ မ စ ရင စ ရ ဆ ပ စ တ င ဆ င ရ သည န မ စ ရ ပ င ၉ ၀ တ င စ ဌ န သ တ င ပ ရ မ ည ။ (ဂ) ဖစ မ င စ မ စ ရင စ ရ ဆည မ င တည ဆ င လ ပ ငန မ ဆ င ရ င သည န ရ ပ ပ ဒပ ဒ မ ၅ ၊ ပ ဒ မ ( ) ပ ဆည မ င တ ည ဆ မ ည န ယ န မ တ လ ထ င လ ပ င န ဆ လ ဆ င ရ င ရ န တ ဖ စ မ င စ မ စ ရင စ စ ဌ န သ တ င ပ င ရ န ပ လ ပ င န မ ဆ င ရ ရ မ ည (၁) တ င သ လယ သမ မ င သ ဆ င သ စ ပ သ င လ ရ စ မ စ သည လ မ စ ဆ င င ၊ (၂) သဘ ဝပတ ဝန င ဂဟစနစ င လ မ စ ပ ဆ င ရ ထ မ ရ မရ လ လ ဆန စ စ င ၊ (၃) စ ပ ရ တ မ ဆ င ရ လ လ ဆန စ စ င ၊ (၄) ဇ လ ဗ ဒ င ဘ မ ဗ ဒ ဆ င ရ စ စ မ လ လ င င မ ပ င သ စ တ တ င တ င လ ပ င န မ ဆ င ရ င ၊ 5 (b) shall submit a pre-feasibility study report based on data from a Preliminary investigation in subrule (a) mentioned above to the Department within 90 days from the date of commencement of work. (c) shall conduct the followings to be able to submit the feasibility report to the Department in order to proceed with the demarcation of the boundary for canal construction under, subsection (a) of section 5 of the law if canal can be constructed according to a pre feasibility study report: (i) collection of data on farmers' crops and current acreage; (ii) Environmental and Socio-Economic Impact Assessment; (iii) Economic feasibility analysis; (iv) Hydrological and geological investigation and detailed land survey; ၆ (၅) မ ဆ လ စ မ သပ မ မ ဆ င ရ င ၊ (၆) ရ ပ ဝ င မ င မ ဆ လ မ စ န ပ မ တ ည သ ပ စ မ ရ ဆ င ။ ၅ ။ စ ဌ န သည သ ဆ င ရ ဆည မ င ရ ရ တ င ပ လ သ ဖ စ မ င စ မ စ ရင စ သ သပ င တ ဝ န ဌ န သ ဆ လ တ င ပ ရ မ ည ။ ၆ ။ ဝ န ဌ န သည စ ဌ န တ င ပ လ ပ စ စ စ ဆည မ င တ ည ဆ င လ ပ င န မ ဆ င ရ ရ န သင တ သည ဟ ထင မ င ယ ဆပ လ ပ သည မ သ မ ဆည င လ ပ င န ပ ဒ ပ ဒ မ ၅ ၊ ပ ဒ မ ( ) ရ တ ည ဆ ပ ဒမ င ည ဆ င ရ ရ မ ည ။ ၇ ။ ဆည မ င တ ည ဆ င လ ပ င န မ ဆ င ရ ရ တ င မ ယ သ မ ယ င င ပ ပ လ သ ဆ စ ပ သည ပ စ ဆ န စ န သ သည င ပ ပ ရ မ ထ တ ည ဆ ပ ဒမ င ည လ တ င င သည ။ ၈။ ( ) င ပ ပ ရ မ သည လ သတ မ တ သ ဆ င ရ လ တ င သ ထ င ပ မ တ တစ စ င ဆည မ င င ရ သ မ စ မ န ရ စ ဌ နသ ပ ပ ရမည ။ 6 (v) Soil testing; (vi) designing cropping pattern depending on water supply and soil type. 5. The Department shall continue to submit the Feasibility Study Report submitted by the relevant Irrigation Officer with its review to the Ministry. 6. The Ministry shall review the report submitted by the Department and make the land acquisition for construction in accordance with the existing laws under subsection (a) of section 5 of the Law if it thinks that it is appropriate to construct irrigation canal. 7. In carrying out irrigation construction works, a person who suffers the related damage caused by land acquisition may claim compensation from the District Administrator in accordance with the existing laws. 8. (a) The District Administrator shall notify the claimant of the determination of compensation and send a copy of it to the Irrigation and Water Utilization Management Department. ၇ ( ) စ ဌ နသည နည ပ ဒ ( ) ရ ပ ပ သည င စ လ ရရ သည န မ ၁၄ ရ တ င လ တ င သ ယ ဝင ရ င ရ မရ စ င ဆ င ရမည ။ (ဂ) သတ မ တ လ န ဆ န ထ လ တ င သ ယ ဝင ရ င မရ လ င ဖစ စ၊ ယ ဝင ရ သည ပ တ င ဒသ စ ရ သ မဟ တ ပည နယ စ ရ ဖ သ မဟ တ န ပည တ င စ တည ပ သည လ င င လ င ဖစ စ လ င ပ င ရန စ ဌ နသည သ ဆ င ရ ဘ ရ စ လ ရ ဆ သည ဘ င ရ သ န မ န င စ ရင တ င ထည သ င လ ထ တ င င ရန ဝန ဌ နသ တင ပရမည ။ (ဃ) ဝန ဌ န န ဆ ဘ ရ စ တ င ဝ ထ သည လ င မ ဘ င ရရ သည န မ ရ ပ င ၆၀ တ င လ တ င သ ထ ပ ရမည ။ ၉။ လ ပ သည စ ရပ မ ပ ပတ သည င ဆည မ င ရ ရ သည ဆည မ င နယ န မ တ သတ မ တ တ င မ စ ထ ဆည မ င တည ဆ င လ ပ ငန မ စတင ဆ င ရ ရမ ည ။ 7 (b) The Department shall wait for 14 days from the date of receipt of the notice sent under subrule (a) whether the claimant files an appeal. (c) If the claimant does not file an appeal until the expiry of the specified period, or if the Government of the Region or State or the Nay Pyi Taw Council approves the claim for compensation, the Department shall state the set compensation in the budget for the relevant financial year and submit it to the Ministry. (d) Compensation allocated by the Ministry in the nearest financial year shall be paid to the claimant within 60 days of receipt of the budget. 9. Once the compensation claim is settled, the district Irrigation Officer shall set up the irrigation boundary posts and begin the construction of the irrigation facilities. ၈ (၃) ၁၀။ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ ၊ င ဆည မ င ရ ရ င မ နယ ဆည မ င ရ ရ တ တ ည ဆ ပ စ သ ဆည မ င လ ပ င န တ စ င လ ပ ပ င ထ န သ မ င လ ပ င န မ ဆ င ရ ရ န န ယ န မ တ သ တ မ တ တ င ပ လ သည စ ဌ န သည ဆည မ င န ယ န မ တ သတ မ တ င ပ စ - ၁ ဖ င မ န င စ ထ တ ပ န ရမ ည ။ ၁၁။ တ ဝန ပ ပ င ရ သ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ ၊ င ဆည မ င ရ ရ င မ နယ ဆည မ င ရ ရ တ သည မ မ တ ပ ပ မ ရ ရ လ င တ မ င ဆ စ ပ ဆ မ ပ ပ င ထ န သ မ င င စ ပ လ ဉ ( ) ပ မ န ထ န သ မ င င ရ ပ လ ပ င န မ ဆ င ရ င ရ တ ရ လ င တ မ ဝ င လမ ၊ ထ လမ မ ပ မ န ပ ပ င ထ န သ မ ရ မ ည ။ ( ) ရ လ င တ မ ပ င ဘ ဆင လ င မ န ည ဆ ပ ၁၀ ၀ န ထ မ ရ င လင င လ ပ င န ပ မ န ဆ င ရ ရ မ ည ။ (ဂ) ရ လ င တမ ထ ပ င ဆင င လ ဘ မ ရ ရ မ င ငယ မ ပ တ ဆ မ မရ စရန ရ င လင ဆ င ရ ရမ ည ။ 8 Chapter III Maintenance of Irrigation Facilities 10. When the State or Region Irrigation Officer, the District Irrigation Officer, and the Township Irrigation Officer submit the matter on demarcation for each completed irrigation work, the Department shall issue a notification in Form-1 for the demarcation of the Irrigation Boundary. 11. With regard to the maintenance of the dam and related facilities under their administration, the assigned Region or State Irrigation Officer, the District Irrigation Officer, and the Township Irrigation Officer shall: (a) repair and maintain regularly the access roads of the dam for regular maintenance and emergency services; (b) clear regular vegetative growth at least 100 feet from the toe of the dam, and downstream slope; (c) clear small drains at the crest of the dam and beside the slope of the dam to prevent blockage; ၉ (ဃ) ရ လ င တ မ င ဆ စ ပ တ ည ဆ ထ သ န တ မ ထ ပ မ ပ င န မ န ပ ရ ပ ပ စ မ ဖ စ င သ ဖ င န မ န င ရ မ ရ ထ စ စ ဆ ရ မ ည ။ (င) ရ လ င တ မ ရ ဝ ရ လ ရ ယ တ င သစ ၊ ဝ မ တ ရ မ ဝ င ထ တ ယ သယ ဆ င မ င တမ ယ ထည ထ ပ စ င သ ဖင ထ တ မစ ရမည ။ (စ) ရ ထ န မ စ င ရ ရ ထ တ ပ သ မဟ တ ရ ထ တ မ င တ င သစ တ ၊ မ မ ပ တ ဆ မ မရ စ ရ န ပ မ န စ င ည ပ တ ဆ မ ရ ပ င ဖ ယ ရ ရမ ည ။ (ဆ) ရထ န မ စင တ င ဒဏ ဖ သ ရ မ မရ စရန ရဘ သ မဟ တ ရထ န တ ဖ င ထ န ရ ပ င င ည ရ သ င ထ ရ မ ည ။ (ဇ) ရ သ င ၊ ရ ထ တ ၊ ရ တ ဖ င ၊ ပ တ လ ပ င န မ မ ယ င ၊ လ မ မ ရ စ ရ န တ ရ သည ဝ န ထမ မ ရ ယ တ ဝန ပ ရ မ ည ။ 9 (d) check the surface particularly if the settlement occurs crest of the dam and its saddle dam, it shall overtopping caused by water spilling over the dam crest; (e) prohibit strictly illegal extraction of bamboo and wood within the catchment area of the dam that can damage the body of the main dam; (f) monitor regularly the outlet pipe or tunnel in the intake tower for blockage of logs and grass and remove them immediately if there is a blockage; (g) open gate valve or guard gate to be equal with the impounding water level to prevent the impact pressure in the intake tower; (h) select the experienced staff to ensure that there is no mistake in the Inlet, Outlet, and opening and closing the gate; ၁၀ (စ ) ရထ န မ စင ရ ရသ င ၊ ရထ တ တ မ ဆ ထည င ၊ ရတ ရ မ လ ယ စ ဖ င င ပ တ င င ရ မ ရ တ င စ စ ဆ င ၊ လ ပ ပ ရ သ င ရ ထ တ တ မ င ရ တ ရ မ တ ပ ပ င င ဆ င ရ ရ မ ည ။ ဆ ပ ရတ ဖ င ၊ ပ တ လ ပ ငန မ တ င လ ပ စစ ဓ တ သ စနစ မ ပ ဝင ပ လ ပ စစ ဂ န န ရတ င ဘ ထရ မ ၊ စ သ ဆ ဆင သင ရ မရ စစ ဆ င ၊ မရ ပ ဆင သင ရ န စရန ဆ င ရ ရမည ။ (ည) ရ လ င တမ ထ ပ မ ပင စဉ မ ည င ပ ပင ထ န သ မ ရ န င စ ဌ န မ လ ပ င န စ စ ဆ သ မ တ ယ ဉ င ယ မ ပ ယ ဉ မ ဖ တ သန င စ စ စ ပ မ တ ထ န သ မ ရ မ ည ။ (ဋ) ရ ပ လ ရ ဝ င လ မ င င ရ ဆ င လ မ င တ စ လ သ စ ပ င ၊ သ စ တ ၊ ဝ ၊ မ စ သ ည မ င ရ စ ရ လ ပ တ ဆ မ မ ရ စ ရ န ပ မ န စ င ည င ၊ ရ စ ရ လ ပ တ ဆ မ ရ ပ ဖ ယ ရ င တ ဆ င ရ ရ မ ည ။ (ဌ) ရ ပ လ မ ထ လ သ ရ မ င ရ ပ လ န ရ စ မ င မ ပ ပ စ င ရ မ ရ စ စ ဆ ရ မ ည ။ ရ ပ ပ ပ င င လ ပ င န ဆ င ရ ရမ ည ။ 10 (i) lubricate the outlet and inlet gate of the intake tower, check the shetter in advance whether it can be opened or closed easily and repair the outlet and inlet gate if necessary, and check and manage the generator, batteries, and fuel to ensure that they are ready if electric system is involved in opening and closing of the shutter; (j) ensure that the crest level of the dam is even, and supervise all vehicles except inspecting vehicle from the Department in order that they do not pass through; (k) monitor regularly to prevent blockage along the leading Channel and the waterway of the Spillway due to logs, trees, bamboo, and vegetative growth and remove if there is a blockage; (l) check the concrete floor under the spillway whether it is damaged due to outflow from the spillway and repair it if any; ၁၁ (ဍ) ရ လ င တ မ တ င တ င ပ မ ၊ တ င မ င ထ ပ မ ရ မ ရ စစ ဆ ရ မည ။ ရ ပ င ပ ပ င ရမ ည ။ (ဎ) မ စ ရ တ ရ လ င တ မ ရ မ င န သည ရ လ င တ မ ဆင လ င မ ရ စ မ ယ င ရ မ ရ စ စ ဆ ရ မ ည ။ တ ရ ပ င ရ ပ ပ ပ င ရ မ ည ။ (ဏ) တ မ မ ဘ င လ မ မ မ င ရ စ င ည သည ရ လ င တ မ စ စ ဆ မ စ ရင စ (Dam Surveillance Report) ပ စ စ ဆ ရ မ ည လ ပ င န စ ဉ မ တ င ပ မ န ပ မ တ စ စ ဆ စ ဌ န သ တ င ပ ရ မ ည ။ ၁၂။ တ ဝန ပ ပ င ရ သ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ ၊ င ဆည မ င ရ ရ င မ နယ ဆည မ င ရ ရ တ သည မ မ တ ပ ပ မ ရ ရ လ ဆည င ဆ စ ပ ဆ မ ပ ပ င ထ န သ မ င င စ ပ လ ဉ ( ) မ ရ သ န ဆ ပ ရ လ ဆ ည ပ င မ င မ ရ တ စ မ ရ မ ရ တ င တ စ စ ဆ ရ မ ည ။ 11 (m) check the dam whether there is termite hill, rat burrow, and sinkhole in it and repair it immediately if any; (n) check the slope and bottom of the dam whether they leak when the dam water level rises due to the inflow of river water and repair immediately if it is found; (o) monitor regularly the safety of dams in accordance with the procedures included in the dam surveillance report, and report it to the department. 12. The assigned Region or State Irrigation Officer, the District Irrigation Officer, and the Township Irrigation Officer with regard to the maintenance of the weir and related facilities under their administration, shall: (a) check the downstream channel floor of weir whether it is eroded or not at the end of the rainy season; ၁၂ ( ) မ လသတ မ တ သည မ ပ င မ ပ င မ င ပ ထ လ န ည န မ မ ရ ပ မ ပင ဖတ ပ င ပ စ ဖင တ င တ စစ ဆ ပ လ ပ သ စ တ ပ င မ မ လသတ မ တ ဒ ဇ င ပ စ တ င မ င ပ ရ ရ စ ရ န ပ န လည ပ ပ င ဆ င ရ ရမ ည ။ (ဂ) ရလ ဆည ထ ပ မ မ င တစ လ မ ရ သ ရ မ င ဖစ ပ လ သ န မ င ၊ ရ စ မ ယ င ၊ ရ မ လ င မ ရ မ ရ စ စ ဆ လ ပ ပ ပ ပ င ရမ ည ။ (ဃ) ရ လ ဆည ထ ဘ င ဘ ဝ ၊ ယ ရ ထ န တ တ စ လ န ရ မ ၊ မ င မ မ စ ရ တ စ ရ ပ စ ပ ပ ပ င ရမ ည ။ (င) သ ထ တ ရတ ရ ပ င မ ထ ရ သ ရ င ရ တ စ င သည ဆ ပ သ ထ တ ရ တ င ပ လ ရ ထ န တ ပ င ရ မ င င တ ပ င တစ လ ရတ စ မ မ ရ မရ စစ ဆ ပ တ ရ ပ ပ င ရမ ည ။ (စ) ရလ ဆည ထ ပ င ရ ပ မ င ထ ပ ရတ ဂ ယ စ တ ပ င ၊ ရတ ရ ၊ သ ထ တ ရ တ င မ င ထ ပ ရ တ မ ရ တ စ မ င ယ င မ ရ ပ ပ င ရမ ည ။ 12 (b) measure the original bed level of the channel according to the floor cross-section if the channel bed is below the original set level and repair the required parts to reach the original design level; (c) check whether there is cracking and settlement, seepage and leakage along the weir crest to channel floor due to flooding in the rainy season, and repair them if necessary; (d) repair side walls and floors along left and right guide bund of upstream and downstream of weir if they are damaged due to river erosion; (e) check whether there is any water erosion on the floor below the water retaining dam and along the dam due to the pressure of water that comes out of an under sluice which may cause erosion if there is an under sluice, and repair them if water erosion is occurring; (f) repair the Gear part of Head regulator, Shutter, Under Sluice, and floor of the head regulator at weir upstream if they are damaged due to erosion; ၁၃ (ဆ) ရလ ဆည ထ ပ င တ င ပ မ န ထ ရစ န လ နည ပ သ န မ ပ ပ ရစ ရလ င ယ ဖစ စ င သ ဖင ရစ ရလ င ယ င မ ဖစ စရန သ န တ ဖ င လ ပ င န ပ မ န ဆ င ရ ရ မ ည ။ (ဇ) ရ မ တ တ င မ ပ ပ င ထ န သ မ ရ တ င (၁) ရ လ ဆည င ရ ပ မ င န တ ပ ဆင ထ သ ထ ရ မ တ တ င င ဘ ရ ရ မ တ တ င စ စ ဉ သတ မ တ န မ ၊ မ င ပ ရ မ ရ တ င တ ရ ရ ယ ဖ င စ စ ဆ ရ မ ည ။ (၂) ရ မ တ တ င မ တ သ မ သစ ဖ စ စ ရ န စ စ ဉ ဆ သ တ ရမ ည ။ (၃) သစ သ ရ မ တ တ င မ ဆ မ န ပ သစ လ လ ယ ရမ ည ။ ၁၃။ မ န ယ ဆည မ င ရ ရ သည ရ ပ မ င မ ၊ ရ တ င လ ပ င န မ ၊ မ ရ ရ ရ ရ လ ပ င န မ င ဆ စ ပ ရ ပ ဆ မ ပ ပ င ထ န သ မ င လ ပ င န မ ပ တ င ဆ င ရ ရ မ ည 13 (g) carry out a regular desilting to avoid disturbing the flow of water if the water flow is lower than normal in the weir upstream because sand residue can disrupt the flow of water; (h) In maintaining water level staff gauge: (i) check the upstream water level staff gauge and downstream water level staff gauge installed near the diversion weir and irrigation canal with a measuring device to determine whether they reach the high and low water level prescribed annually; (ii) paint annually the water level staff gauge marks to be new; (iii) replace wooden water levels staff gauges with the new ones if they are decayed. 13. In order to maintain the irrigation canal, pumping irrigation, groundwater supply and related Water Irrigation facilities, the Township Irrigation officer shall: ၁၄ ( ) ရ ပ မ င တ င တ င လ ပ ငန င စပ လ ဉ (၁) မ မ ပ ပ မ ရ ရ ပ တ မ င မ ယ ၊ ရ ပ င သ မင ၊ ရမ တ တ င မ မ ပင ရမ တ ၊ ရ ပ မ င ၊ ရစ န ပ မ ဏ လ မ ဌ န ဆ င ရ တ ရ ဝ င ထ တ ပ ထ သ မ တ စ စ ပ တ င ရ သ င ထ န သ မ ထ ရ မ ည ။ (၂) ရ ပ မ င လ မ ရ သ တ င ရ ပည ရမ တ ထ ရ ပ ဝသည သတ မ တ မ င ပ ထ လ န ည န မ မ ရ သ ဝ ၊ ယ ရ မ င ပ င တ င တ မ မ တ စ စ ပ တ င ရ သ ထ ရမ ည ။ (၃) ရ ပ ရ သ န သည ရ ပ မ င တ စ လ သ န မ ပ မ ရ မ ရ ၊ ရ ပ မ င တ စ မ ရ မ ရ စ စ ဆ ရ မ ည ။ ရ ပ ရ ပ မ င တ စ လ င ဝ ၊ ယ ဘ င မ တ င တ ရ ရ ယ ဖ င တ င တ င င ဖ တ ပ င ပ လ လ ပ စ မ ထ တ ရ ဆ ရ မ ည ။ (၄) ထ ပ ဒ (၃) ပ စစ ဆ မ မ န ဆ သတ မ တ ထ သ ဒ ဇ င ပ စ မ ဖ င တ ဆ င စ စ ဆ ရ မ ည ။ 14 (a) With regard to measuring of irrigation canal: (i) keep the information under their administration such as the bed width of the irrigation canals, the depth of water levels(∆), zero of gauge of water level staff gauge, irrigation canal, the flow rate in a notebook issued by the Department; (ii) write in notebook,the measurement below the original/ authorized level of the canal bank on each side of the canal when the canal is running at full supply level in the rainy season; (iii) check whether there is erosion and sedimentation along the canal bed at the end of irrigation season, if it is found, measure along with the irrigation canal and both sides of canal banks with a measuring device, and draw longitudinal cross-section; (iv) check the erosion and sedimentation along the canal bed at the end of irrigation season mentioned above against the latest design specifications. ၁၅ ( ) ရ ပ ရ သ မ တ င မ ရ ပ မ င မ ပ ပ င ထ န သ မ င ဆ င ရ ရ တ င တ င တ ရ ရ သ ဖ တ ပ င ပ စ ရ တ မ င န င ဒ ဇ င ပ စ င ယ ဉ စ စ ဆ (၁) သတ မ တ ရ လ တ တ ပ င န မ န ပ ဝ ၊ ယ မ င ပ င ဆင င လ ပ င န ဆ င ရ ရ မ ည ။ (၂) သတ မ တ မ င ယ မရ ပ ယ ထ င င လ ပ င န ဆ င ရ ရမ ည ။ (၃) ရ ပ မ င တစ လ ရစ ရလ င မ န စရန သ န မ တ ဖ င ၊ ဒ ၊ မ မ ဖ ယ ရ င ဆ င ရ ရ မ ည ။ (၄) မ င ပ င ဖတ တည ဆ ထ သ တ တ ၊ ရထ န ဆ င လ တ မ င ထ ပ ရ တ မ သည မ လသတ မ တ ပ စ တ င မ ရ ပ ပ င ဆ င ရ ရ မ ည ။ (ဂ) ရ ပ ပ န မ ပ ပ င င င စ ပ လ ဉ (၁) မ င မ ၊ လ တ မ င ၊ လ တ မ င မ ဘ င မ ဖတ တ ည ဆ ထ သ ရ ပ ပ န မ ရ စ မ ယ မ ရ မ ရ ၊ မ လ န ရ မ ရ စ စ ဉ စ စ ဆ ရ မ ည ။ 15 (b) In the event of maintaining irrigation canal before the irrigation season, compare the condition of the canal with the design against the measured cross section and: (i) raise both sides of the canal if the specified freeboard is low; (ii) enlarge the bed width if it is not met with specified; (iii) do unsilting, cleaning weeding and debris to increase the water flow along the canal; (iv) repair a bridge built across the canal bank, water control structure, and distributary head regulator if they are not in accordance with the original specifications. (d) carry out the maintenance of artesial wells, artesial flow, lift irrigation works using any energy in accordance with the instructions issued by the department regarding the maintenance of Lift irrigation and Ground water irrigation. 14. With regard to setting up the water level staff gauge in the irrigation canal under their administration of the assigned Region or State Irrigation Officer, the District Irrigation Officer, and the township Irrigation shall: (a) set up the water level staff gauge at zero of gauge at the canal bed according to the specified design, where there is the outlet of the head regulator on the Main Canal and the water surface is usually stable; (b) set up the water level staff gauge at zero of gauge at the canal bed where there is a Tertiary/ Minor of the Main Canal; (c) set up the water level staff gauge at a distributary where the water flow is stable; ၁၇ (ဃ) ရ ပ မ င မ ၊ မ င မ ၊ လ တ မ င ၊ ရထ န င ရ ရ ထ ဘ င ဘ န ရ မ တ င ရ မ တ တ င စ ထ ရ မ ည ။ (င) ရ ပ မ င ဖ တ တ ည ဆ ထ သ ရ င ပ ပ န ထ ဘ င ဘ န ရ မ တ င ရ မ တ တ င စ ထ ရ မ ည ။ (စ) မ သ မ င တ တ ရ သ န ရ မ တ င ရ မ တ တ င စ ထ ရ မ ည ။ (ဆ) ရ ပ မ င မ ၊ မ င မ ၊ လ တ မ င ဖ တ င ရ ရ မ ရ မ ရ သ ရ င ရ န ရ မ တ တ င စ ထ ရ မ ည ။ (ဇ) င ၊ လ ၊ င မ န မ ပ င ဖ တ တ ည ဆ ထ သ ရ တ လ ဝင ပ င င ထ ပ င ရတည င မ သ နရ မ တ င ရမ တ တ င စ ထ ရမည ။ ရ တ လ ထ ပ င န ရ တ င သ န စ ပ င ၊ ရ တ စ င ဖ စ ပ ပ ဖ ယ ရ ပ ပ င ပ မ သ ရ မ တ တ င စ ထ ရ မ ည ။ ၁၅။ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ ၊ င ဆည မ င ရ ရ င မ နယ ဆည မ င ရ ရ တ တည ဆ ပ ဆည မ င င ဆ စပ သ ဆ မ ပ ပင ထ န သ မ င လ ပ င န မ ဆ င ရ င ရန တ င ပ လ သည စ ဌ န သည ပ စ -၃ 17 (d) set up the water level staff gauge at the Main canal, Tertiary/ Minor, Distributary, Check structure and the upstream and downstream of the Fall; (e) set up the water level staff gauge at the upstream and downstream of the Syphon constructed across the irrigation canal; (f) set up the water level staff gauge at the place where there is a large bridge; (g) set up the water level staff gauge at the head portion of the Main Canal, Tertiary/ Minor and Distributary to know the water condition; (h) set up the water level staff gauge at inlet and outlet of Flume which is built across creeks, ravines, rivulet, and lowlands where the water flow is stable and if there is any erosion and sand sedimentation at the flume outlet, set up the water level only after removal and repair of it. 15. In carrying out the irrigation repair and maintenance works under section 11 of the Law, the work level shall be set as follows: (a) annual maintenance work is ordinary maintenance; (b) the occasional raising the canal banks and unsilting is the special repair work; (c) work with high cost and that cannot be done as the above ordinary and special repair work is major repair work. The person who wants to construct, repair, or divert a watercourse for water consumption from irrigation may apply to the relevant Township Irrigation Officer with the following facts: (a) location and type of work; ၁၉ ( ) လ ပ င န ပ မ ဏ င န မ န န စ ရ တ ၊ (ဂ) စ ဌ န ဆ ဖ တ သ န စ ရ တ ပ မ ည န ည လမ င ပ မ ည တ ပ ၊ (ဃ) လယ မ င ဖ တ သန ရ န လ ပ သည မ ရ မ ရ ၊ (င) ဌ န လ ပ သည ဟ ယ ဆသည သတ မ တ မ ။ ၁၈ ။ မ န ယ ဆည မ င ရ ရ သည န ည ပ ဒ ၁၇ ရ လ ထ လ ရ ရ သည ပ မ စ စစ ပ မ မ သ ဘ ထ မ တ င တ ဆ ယ သ တ င သ လယ သမ မ သ ဘ ထ မ တ မ စ စ ည ဖ ပ င ဆည မ င ရ ရ ထ ဆ ဖ တ ပ င ရ န တ င ပ ရ မ ည ( ) လယ မ င ဖ လ ပ င သ မဟ တ ပ ပ င မ မ မ င သည သ ဝ င င သ မဟ တ လ ပ င ရ မ ရ ၊ ( ) လ ရ လ ယ မ င လ ပ င ရ ယ င သ ည ပ မ င မ န သ ရ စ မ န မ ရ ရ င င ရ မ ရ ၊ (ဂ) လ လ ပ လ မ သည မ န န မ ရ မ ရ ၊ (ဃ) လယ မ င ဖ တ သန သည တ န ထ င ရ မ ရ ။ 19 (b) workload and estimated cost; (c) payment method and commitment to pay the cost determined by the department; (d) whether there is any land required for the watercourse to cross over; (e) specifications that the Department deems necessary. 18. When the Township Irrigation Officer receives the application under rule 17, he shall consider and scrutinize the following facts and submit it, with his remark and remarks of farmers concerned, to the District Irrigation Officers: (a) Whether watercourse construction or repairing is useful or necessary; (b) Whether it leads to better water management by diverting the current watercourse; (c) Whether the information in the application is correct; (d) Whether there is any objection to construction of the watercourse across the land. ၂၀ ၁၉ ။ င ဆည မ င ရ ရ သည န ည ပ ဒ ၁၈ ရ မ န ယ ဆည မ င ရ ရ တ င ပ လ သည လယ မ င ဖ လ ပ င သ မဟ တ ပ ပ င မ မ မ င လ ထ စ စ စ ပ င ပ င သ မဟ တ င င ပ ယ င ပ င သည ။ သ သ ပ စ ရပ မ စ စ စ တ ရ ပ င မ ပ ရ ။ ( ) လယ မ င လ သည မ င ရင ရဝင ပ မ မ ထ မ ဉ ဖ င တ င စ မ င ထ ပ ရ ည န င ၊ ( ) ဆည မ င သ မဟ တ လယ မ င မ ပ ဝ သည ရ ပ ည ဝ ရ ယ ပ ဖ စ သ စ ပ မ မ တ န ထပ လယ မ င ဖ လ ပ င ။ ၂၀ ။ လယ မ င သ မဟ တ လယ မ င ဖ တ သန ရ တ စ ဘ တ စ ရ မ င သ ဆ င သ သည လယ မ င သစ တ ဖ ဖ လ ပ င သ မဟ တ လ ပ င င င စပ လ ဉ န လ ပ ပ မ ဖ ပ ရ ပ င ၃၀ တ င င ပ ပ ရ မ ထ တ င ပ င သည ( ) လယ မ င ဖ တ သန င ပ လ သည မ န ရ ပ င ဖ ပ န င ၊ ( ) လယ မ င ဖ တ သန သည မ န ရ ပ မ တ ည ထ ည ဝ င လ သည င ပ မ ဏမ င ၊ န ည င ၊ 20 19. The District Irrigation Officer may permit or deny to construct, or to repair or to divert the watercourse after scrutinizing the submission of the Township Irrigation Officer under rule 18. However, if the following issues are found, he shall not permit to do so: (a) the length of the watercourse is more than two miles in a straight line from the inlet at the base of the canal to the plot; (b) construction of additional watercourse for farmland that has already fully received water supplied by irrigation or watercourse. 20. Regarding the construction or diversion of a new watercourse, if the person concerned with the land benefits on either side of the watercourse wants to object, he/she may file a complaint to the District Administrator within 30 days stating the following: (a) objection with reasonable description to the land on which the watercourse is allowed to pass through; (b) more or less amount of money to contribute proportionally that depends on the land on which the watercourse is allowed to pass through; ၂၁ (ဂ) လ စ င င စပ လ ဉ နပ မ မရ ပ င ဖ ပ န င ။ ၂၁။ ရ သ တ င သ လည င ၊ င တစ ရပ ရပ င သ လည င ဝ န ဌ န စ မ န သ ဆည မ င သ မဟ တ တ င ဒသ သ မဟ တ ပ ည န ယ စ မ န သ ဆည မ င မ ပ ဝ သ ရပမ ဏသည ရ သ လ စ ပ သည သ မ တ လ လ မ မ ရ ပ ဆည မ င ရ ရ သည ပ န ည လမ မ ဖ င ဆ င ရ ရ မ ည ( ) မ ပ င န ထ ရ ရ ရ ရ ရန သ သည စ ပ မ မ စ ပ ဆည ရ ရ ယ သ စ စ င ၊ ( ) မ င ထ ပ မ မ င ဆ ထ ရ ရ ရ န သ မ င ပ င ရ သ ည လယ ယ မမ တ ရလ ည ဇယ ရ ဆ လ ည ရ ပ ဝ စ င ။ (၅) ၂၂။ ဝန ဌ န သ မဟ တ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ သည ပ င တ စ ရ ပ ရ ပ သ မ ဟ တ တ စ ရ ပ ထ ပ သ င မ ပ ပ လ ပ င ဆည မ င ရ ရ ဆည မ င မ ရ ပ ဝ မ ရ ပ ဆ င ရ န န င သည 21 (c) objection with reasonable description of dissatisfaction to compensation. 21. Due to the weather or any other reason, if the amount of irrigation water managed by the Ministry of Region or State is not sufficient for seasonal crops, the Irrigation Officer shall: (a) prioritize farmland which is assured that it will have access to water according to ground condition; (b) create a water supply rotation system and provide water on a rotating basis for upland farmland where water is difficult to reach from canal head to tail portion. Chapter V Interruption of Water Supply 22. The Ministry of Region or State Irrigation Officer may instruct the District Irrigation Officer to interrupt the water supply from the irrigation if: ၂၂ ( ) တ ပ န ယ န မ တ သ မဟ တ စ ည ပ င သ ယ ရ န ယ န မ တ တ င ရ သ သ ဆည ရ သ ရ ယ ရ ပ ဝ င င စပ လ ဉ သ ဆ င ရ တပ သ မဟ တ စ ည ပ င သ ယ ရ မ တ ရ ပ ဝ မ ရ ပ ဆ င ပ ရန င လ သ င ဖင တင ပလ င ၊ ( ) လ ပ ငန တစ ဆ င ရ ရန လ ပ သည လ တ င ရ ပ ဝမ ရပ ဆ င ပ ရန ဌ န၊ ဖ စည မ မ င လ င ။ ၂၃။ င ဆည မ င ရ ရ သည ပ ဒပ ဒ မ ၂၆ ၊ ပ ဒ မ (ဂ)ပ ရ ပ ဝ မ ရ ပ ဆ င င င စ ပ လ ဉ ( ) ပ င မ လယ မ င မ ရ လယ င သ သ ယ ယ ရန ရ မ င င ယ မ သင မ ဖ စ သ င စ စ ဆ တ ရ ရ ပ ဆ ပ လ ယ င သ ရ ပ ဝ မ ထ န ထ င သ မဟ တ ရ ပ ဆ င င ပ င သည ။ ( ) လ ည စနစ င ရ ပ ဝမ င သ သည ရထ ပ မ လ ည ပ တ ရ ပ ဝမ ရ ပ ဆ င င သည ။ 22 (a) the relevant army or development committee submits with valid reasons to interrupt water supply to irrigation area that fell within the boundaries of the army or development zone; (b) other departments or organizations request to interrupt the water supply during the specified period to carry out any work. 23. Regarding interruption of water supply under the subsection(c) of section 26 of the law, the District Irrigation Officer: (a) may maintain or interrupt the water supply to the field if it is found that the field ditches are not ready yet to carry water from the main watercourse into the field; (b) may interrupt the water supply by shutting off the water outlets when creating a rotating water supply system; ၂၃ (ဂ) လ ရ စ ပ ရ တ သ စ နသည ရပမ ဏ မထ ပ ရ မ သ င ၊ သ သ ရ ဖ စ သ စ ရန မ င မ ၊ လ တ မ င သ မဟ တ လ တ မ င မ ဆည ရမ ရ န မ တ င ရ ဖည သ င င သ လည စ ပ ရ သ စ ရ ပ မ ဏ လ န ည စ ပ န တ င ရ ပ ဝ မ ရ ပ ဆ င င သည ။ (ဃ) ရ ပ ဝ မ ထ န သ မ င န ဖ င စ ပ မ ရ ယ ရ ပ ည င ရ ပ ဝ ပ ပ ရ ထ ပ မ ယ ယ ပ တ ရ ပ ဝ မ ရ ပ ဆ င ရ မ ည ။ (င) မ စ ရ မ င ရ လ ဆည ၊ ရ တ မ ပ တ သည ရ ပ ဝ မ ရ ပ ဆ င ရ မ ည ။ (စ) သဘ ဝ စ မ စ မ ရ င ရ လ တ င မ င တ စ ရပ ရ ပ င ရ ထ ရ မ လ န ည လ သည ရ ပ ဝ မ ရ ပ ဆ င င သည ။ (ဆ) ရ တ င င လ ပ င န င မ ရ လ ပ င န မ မ စ မ င တ စ မ မ ဖင ဆည ရ ပ ဝ သ ည စ မ င လ လ စ မ ရ ရ င င ဖစ စ ၊ စ မ င လည ပ တ ရန စ ယ ရ မ ယ င င င ဖစ စ ရ ပ ဝ မ ရ ပ ဆ င င သည ။ (ဇ) တ စ စ တ စ သ င င ရ ပ မ င မ ပ စ မ ဖ စ ပ ပ ရ ပ ဝ မ ရ ပ ဆ င င သည ။ 23 (c) may interrupt the water supply to the village tank if the amount of consumption water for agriculture is reduced, but if it does not affect the amount of water currently consumed for agriculture, irrigation water from the main canal, tertiary/minor distributary can be used to fill into the village tank for domestic use and cattle drinking water; (d) shall temporarily close the water outlets and interrupt the water supply once the entire irrigated area is fully supplied water in order to maintain the water supply; (e) shall interrupt the water supply when the weir and sluice gates are closed due to flooding; (f) may interrupt the water supply when decreasing the quantity of water being extracted from artesian flow and wells for any reason; (g) may interrupt the water supply due to insufficiency of energy or engine malfunction when water is supplied using any energy from pimp station and groundwater station; (h) may interrupt the water supply if the irrigation canal is damaged for any reason. ၂၄ ၂၄။ ( ) င ဆည မ င ရ ရ သည မည သည ရ ပ မ င သ မဟ တ လယ မ င မဆ စ မ န ရ ၊ ပ ပင ရ င ထ န သ မ ရ လ ပ ငန မ ဆ င ရ ရန တစ ဆ တည ၁၀ ရ ထ မပ သ လ တ င ရ ပ ဝမ ရပ ဆ င င သည ။ ဆ ပ လထ ပ ရပ ဆ င ရန လ ပ ပ င ဖ ပ င တ တ င ဒသ သ မဟ တ ပ ည န ယ ဆည မ င ရ ရ ထ တ င ပ င ပ ယ ရ မ ည ။ ( ) န ည ပ ဒ ( ) ရ င ဆည မ င ရ ရ သည ရ ပ ဝ မ ရပ ဆ င ရ တ င မ နယ ဆည မ င ရ ရ မ တစ ဆင သ ဆ င ရ ရပ သ မဟ တ ရ ပ စ ပ ပ ရ မ င ရ သ စ သ မ ထ န ည ဆ သ ရ တ င သ ပ ရ မ ည ။ ၂၅။ င ဆည မ င ရ ရ သည ပ ဒပ ဒ မ ၁၆ ရ လယ မ င မ ပ တ င သ မဟ တ စ ထ ပ င ဆင င လ ပ င န မ ဆ င ရ ရ န လ ပ ပ လယ မ င တ စ သ မဟ တ တစ ထ ပ သ လယ မ င မ မ ရ ပ ဝမ ဆ ပ လ ပ ငန မ ဆ င ရ ပ သည ထ ရပ ဆ င မည ဖစ င သ ဆ င ရ ဆည ရ သ ပ သ တ င သ လယ သမ မ သ နည ဆ သ ရ တင သ ပ ရမည ။ 24 24. (a) The District Irrigation Officer may interrupt the water supply for not more than 10 consecutive days to manage and maintain any irrigation or watercourse. If it needs to interrupt more than that period, he shall submit with the reasons to the Region or State Irrigation Officer for approval. (b) When the District Irrigation Officer interrupt the water supply under subrule (a), he shall notify the relevant ward or village tract administer and irrigation water users of the interruption at least three days in advance through the Township Irrigation Officer. 25. If the District Irrigation Officer requires to carry out inter connection the watercourse or replacement works under section 16 of the law, he shall notify the relevant irrigation water user farmers at least three days in advance that water supply from one or more watercourses will interrupted until the completion of that work. ၂၅ (၆) ၂၆။ ဆည မ င ရ သ စ သ မ သည စ ပ ရ ၊ မ မ ရ င ရသ စ မ မ တ ဆည ရ ရယ လ ပ တ ည ဆ ရ န င တ တ မ န ပ ဒပ ရ န ရ န ထ မ တ င ပ ဆ င ရ ယ သ စ င သည ။ ၂ ၇ ။ ပ ဒ ပ ဒ မ ၃ ၀ ပ ပ န ရ ဆ ည ရ ရ ထ ရ စ သ စ င ရ န င တ င သ လယ သမ မ ထ န သ မ ရမည လယ မ င ပ ပင င ၊ ရ ပ ဝ င ၊ ငင ပ င စ ရပ မ ပ ရန စ ဌ န သည တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ င ဖ င ယ မ ပ တ င ဖ စ ည ပ ရ မ ည ( ) တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ မ င မ ၊ လ တ မ င ၊ လ တ မ င င ရ ပ ပန မ လ တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ င ယ မ င ဆ င မ င င တ စ စ ပ ဝ င ဖ စ ည ရ န င ဆ ပ ဖ င ဆ င င ဒ တ ယ င ဆ င ဖ ဝင မ င င မ စ သ ဘ ဆ ဖင ရ ယ ရန ၊ ( ) တ င သ မ စ ပ ရရယ သ စ ရ ဖ ငယ လယ မ င တစ င လ ဆ ည ရ သ ပ သ တ င သ မ လ ပ ဝ င ဖ စ ည ရ န င ဆ ပ ဖ င ယ တစ ဖ စ တ င ဖ င ဆ င မ င င တစ စ မ စ သ ဘ ဆ ဖင ရ ယ ရ န ၊ 25 Chapter VI Rights and Duties of Irrigation Water Users 26. If the irrigation water users want to get irrigation water for agriculture and livestock breeding, and other purpose, they shall pay the water tax in accordance with the existing Water Tax and Embankment Tax Law to get irrigation water. 27. In order to utilize irrigation water effectively under the provision of section 30 and to oversee and deal with the repairing watercourses to be maintained by the farmers, water supply and disputes, the Department shall: (a) establish Water User Group (WUG)/ Water User Association (WUA), according to main, distributary, tertiary/minor canal and pipe outlet, comprising Heads of each watercourse user subgroup (called as Myaung Gaung), and elect the leader and co-leader of Water User Group (WUG) by a majority of member of Water User Group; (b) establish Water User Subgroup (WUG) for each watercourse comprising all farmers who use irrigation water, and elect Head of Watercourse (called as Myaung Gaung) by a majority of members; ၂၆ (ဂ) န ည ပ ဒ ( ) ရ တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ တ င ပ ဝ င သ ဖ င ဆ င င ဒ တ ယ င ဆ င မည ၊ ရ ပ စ ၊ ရ င မ င မ ၊ လ တ မ င ၊ လ တ မ င င ရ ပ ပ န မ ည တ င စ ဌ န မ တ ပ တ င စ ပ တ င စ ရ င ရ သ င ထ ရ န ၊ (ဃ) နည ပ ဒ ( ) ရ တ င သ မ စ ပ ရရယ သ စ ရ ဖ ငယ တ င ပ ဝင သ မ င င မ ည ၊ ရ ပ စ ၊ ရ င မ င မ ည တ င စ ဌ န မ တ ပ တ င စ ပ တ င စ ရ င ရ သ င ထ ရ န ။ ၂ ၈ ။ တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ င ဖ င ယ တ သည ဆ ည ရ စ မ န င င ရ ဖန ဝစနစ မ ပ ပင ထ န သ မ င တ င စပ လ ဉ စ ဌ န ပ ဒ င ည ထ တ ပန သ မ န င န မ လ န ဆ င ရ ရ မ ည ။ (၇) ၂၉ ။ ရ ဆည မ င ၊ တ တ မ င ရ ရ တ မ င လ ပ င န င ယ မ တ ည ဆ င င ထ ပင ဆင င လ ပ င န မ န ည ပ ည လ ပ ရ ရ လ ထ လ ပ ဖင ဆ င ရ င မ ပ င သ ဖင င ပ ပ ရ မ မ ည တ င လ လ င င ဆည မ င ရ ရ န ည ပည ပ င ရ ဆ င ရ ပ ရ မ ည ။ 26 (c) according to subrule (a), record the name of the leader and co-leader of Farmers Water User Group (WUG)/ Water User Association (WUA), village tract, village, branch canal, tertiary/ minor, distributary and pipe outlet in the registration book of the District Department; (d) a cco rdin g to su bru le (b), re co rd th e n am e o f “ h ea d o f the wa te rco u rse” of Water u ser Gro u p (WU G), village tract, village, and branch canal in the registration book of the District Department. 28. Regarding irrigation management and maintenance of water supply system, Farmers Water User Association (WUA)/ Water User Group (WUG) shall comply with the orders and directives issued by the Department. Chapter VII Village Irrigation and Drainage Works 29. The District Irrigation Officer shall provide technical assistance when the district administrator requests the assistance if the Village Irrigation, embankment and Village Drainage construction and special repair work cannot be carried out by the villagers due to technical requirements. ၂၇ ၃၀ ။ င ဆည မ င ရ ရ သည န ည ပ ဒ ၂၉ ပ လ ပ င န မ သ ဆ င ရ တ င ဒသ စ ရ ဖ သ မဟ တ ပ ည န ယ စ ရ ဖ သ မဟ တ န ပ ည တ င စ င ပ င င ပ သည ဘ ရန ပ င ဖင သတ မ တ စ ပ လ ပ င န လ ဆ င ရ င သည ။ ၃၁။ င ဆည မ င ရ ရ သည န ည ပ ဒ ၂၉ ပ လ ပ င န မ ဆ င ရ ပ ပ ဆ ပ ရ ဆည မ င ၊ တ တမ င ရ ရ တ မ င မ ဆ လ လည ပတ ၊ ပ ပ င ၊ ထ န သ မ င ဆ င ရ င ရ န င ပ ပ ရ မ သ မဟ တ တ င သ မ စ ပ ရ ရ ယ သ စ ရ ဖ ထ သ စ ရ င ဇယ င တ လ ပ င ပ ရ မ ည ။ (၈) ၊ ၃ ၂ ။ ( ) ဝ န ဌ န သ ည မ စ ၊ င ၊ င င သ မ ဟ တ ရ မ င တ စ တ င ပ နမ င ရစ ရလ တ ဆ ပ တ ဆ င ဖစ ပ မ ပည သ န မ ရ ၊ သ လ ရ ၊ လယ ယ မ မ ပ စ မ သ မဟ တ မ ပ ည သ တ စ ထ န စ န င သည ဟ ယ ဆလ င ဆ ပ မ စ ၊ င ၊ င င သ မဟ တ ရ မ င မ ည သည စ တ ပ င သည ရ တ မ င ဖ စ င ပ ဒ ပ ဒ မ ၃ ၂ ရ မ န 27 30. The District Irrigation Officer may carry out the activities under rule 29 of the law according to priority, with the budget approved by the relevant Region Government or the State Government or the Nay Pyi Taw Council. 31. When the activities mentioned in the rule 29 is completed, the District Irrigation Officer shall hand over them to the district administrator and the Farmers Water User Association (WUA)/ Water User Group (WUG) in order to continue to operate, repair and maintain the village irrigation, embankment, and village drainage. Chapter VIII Declaring as a Drainage Canal, Removing Obstacles and Compensation 32. (a) The Ministry shall assign the task to the Department in order to verify and submit the conditions to be able to issue the notifications of which part is a drainage canal under section 32 of the law if it presumes that any river, stream, lake, or drain is obstructed and that can affect the public health, transportation, farmland and the public interest due ၂၈ င စ ထ တ ပ န င ရ တ စ စ စ တ င ပ ရ န စ ဌ န တ ဝ န ပ ပ င သည (၁) သဘ ဝ ဘ ရ ယ င ရတ စ မ တစ လ ရ ဒ ၊ မ ၊ ယ ၊ သ စ ပ င င သ န မ သ ည မ စ ၊ င ၊ င င သ မ ဟ တ ရ မ င တ င စ ပ န သ ဖ င ရ စ ရ လ တ ဆ ပ တ ဆ င ၊ (၂) ရ တ မ င ဖ စ သတ မ တ မ ည န ရ တ စ လ ရ န န တ င န ထ င သ မ မ ဆ ပ မ စ ၊ င ၊ င င သ မဟ တ ရ မ င ဖတ ယ ယ ရတ တမ ပ လ ပ ပ င ဖ မ င ၊ ပ တ န င ဖမ င ၊ တ တ င ၊ ယင လ ပ ဖ င ထ င င သ မဟ တ တ စ န ည န ည ဖ င ရ စ ရ လ တ ဆ ပ တ ဆ င ။ ( ) ထ ပ ဒ ( ) ရ မ န င စ ထ တ ပ န ရ တ င ပ မ ပ ဝင စ ရ မ ည (၁) ရ တ မ င ဖ စ င င ရ သည င ရ ဖ ပ ၊ (၂) မ စ ၊ င ၊ င င သ မဟ တ ရ မ င တ ည ရ ရ င ၊ မ န ယ ၊ ရ ပ စ မ ည ၊ 28 to the following conditions: (i) Obstruction of water flow as garbage, bushes, weeds, trees, and sands along the bank by natural disasters are heaped in rivers, streams, lakes, or canals blocking the flow of water; (ii) fishing with bushes, fishing with nets, trapping, fishing with bamboo blinds by building temporary ring bunds across the said rivers, streams, lakes, or canals or blocking the flow of water by any other means by the residents in the vicinity of the designated drainage area. When the District Irrigation Officer or the person authorized by the Ministry for this purpose receives the notification issued in accordance with rule 32, he shall issue the order including the following provisions to remove the obstruction: (a) to remove any obstacle in the drainage canal within 30 days from the date of issuance of the order; (b) in case of removing obstructions in the Drainage Canal: (i) regarding the obstructions of water flow caused by subrule (a) (i) of rule 32, the department shall arrange to repair rivers, streams, lakes, drains to be the original condition; ၃၀ (၂) န ည ပ ဒ ၃၂၊ န ည ပ ဒ ( ) (၂) ရ ဖ စ ပ လ သ ရ စ ရ လ ပ တ ဆ မ မ င စ ပ လ ဉ ယ ယ ပ တ ဆ ထ သည ပ ဂ လ သ မဟ တ ဖ စည စ စဉ ဖင ရ တ မ င ဖ စ သတ မ တ လ သည စ တ ပ င မ လပ စ တ င လ မ ည မ ရ သ မ တ င မ ပ ပ န လည ပ ပ င စ ရ န ။ ၃၄ ။ ပ ဒပ ဒ မ ၃၃၊ ပ ဒ မ ( ) ရ တ ဆ ပ တ ဆ န သ ရ ဖ ယ ရ င ၊ ပ ပ င င သ မဟ တ ဆ ပ လ ပ င န မ ဆ င ရ ရ တ င န စ ရ တ မ င စ ပ လ ဉ ( ) သဘ ဝ ဘ ရ ယ င ဖ စ ပ လ သည ရ စ ရ လ ပ တ ဆ င တ သ ဆ င ရ ဆ ည မ င ရ ရ သ ည ပ ည ထ င စ ဘ ရ န ပ င သ မ ဟ တ တ င ဒသ သ မဟ တ ပ ည န ယ ဘ ရ န ပ င ဖ င ဆ င ရ င သည ။ ( ) နည ပ ဒ ၃၃၊ နည ပ ဒ ( ) (၂) ရ မ န မ တ င ရသ သည သတ မ တ လ တ င ဆ င ရ ရန ပ မ န ထ တ သ ယ တ င တ ဆ မ ဖယ ရ င သ မဟ တ ပ ပင င တ ဆ င ရ ရ တ င ယင ပ ပင င တ န စရ တ မ တ င သည မ န ထ တ ပန င ရသ ပ ဆ င ရမည ။ 30 (ii) regarding the obstructions of water flow caused by subrule (a) (ii) of rule 32, the person or the Department that temporarily blocked the flow of water shall arrange to restore completely the part designated as drainage to its original state before the next rainy season. 34. Regarding the cost of repairing and removal of obstruction under subsection (b) of section 33 of the law or carrying out such activities: (a) the relevant Irrigation Officer may act with Union Budget or Region or State Budget for blockage of the flow of water caused natural disasters; (b) in case of the person being ordered under subrule (b) (ii) of rule 33 fails to act within the prescribed period, and the person who issues the order removes or repairs the obstacles by himself, the person being ordered shall pay the cost of such repairs upon request; ၃၁ (ဂ) န ည ပ ဒ ( ) ပ မ န ထ တ ပ န င ရ သ ပ ဆ င င မ ပ လ င ဆ ပ န စရ တ ထ သ ထ မ လည င ၊ သ ဆ င သ ထ မ လည င မ န ထ တ ပ န သ မ န မ ပ န င ဖ စ ဘ သ သ င သည ။ ၃၅ ။ ( ) န ည ပ ဒ ၃၃ ရ ထ တ ပ န သည မ န လ န လ တ ဆ ပ တ ဆ န သည ရ တစ ဖယ ရ င ၊ ပ ပင င သ မဟ တ ဆ ပ လ ပ ငန မ ဆ င ရ င င န စ န ဆ မ င စ ပ လ ဉ လ တ င ဆ လ သ သည င ပ ပ ရ မ ထ (၁) သ ဆ င ရ မ န ယ ပ ပ ရ မ တ စ ဆင တ င ဆ င သည ။ (၂) လ တ င ဆ မ သည နစ န ဆ မ ဖစ ပ သည မ စ တစ စ တ င တ င ဆ င သည ။ (၃) ထ လ တ င တ င ဆ င မ ပ ပ လ လ သ င ပ င လ စ တ င ပ တ င ဆ င သည ။ ( ) န ည ပ ဒ ၃၃ ၊ န ည ပ ဒ ( ) ၊ န ည ပ ဒ င ယ (၁) ရ စ ဌ န ဆ င ရ သည စ ရပ င စ ပ လ ဉ လ စ ဌ န ပ လ ရ မ ည ။ 31 (c) if the person being ordered under subrule (b) does not pay it, the person who issues the order may collect the cost from such person or the person concerned as if it were of land revenue. 35. (a) The person who wishes to claim compensation for loss and damage caused by the removal or repairing of any obstruction or carrying out such work in accordance with the order issued under rule 33 may: (i) claim it to the District Administrator through the relevant township administrator; (ii) claim within one year within one year from the date of loss and damage; (iii) claim it with the valid reason if the claim is not made within that period; (b) Regarding the performance of the Department under subrule (b) (i) of rule 33, the department shall pay the compensation. ၃၂ (ဂ) န ည ပ ဒ ၃၃၊ န ည ပ ဒ ( )၊ န ည ပ ဒ င ယ (၂) ရ ဖ ယ ရ င င စ ပ လ ဉ လ သ ဆ င ရ ပ ဂ လ သ မဟ တ ဖ စ ည ပ လ ရ မ ည ။ (ဃ) သဘ ဝ ဘ ရ ယ င ဖ စ ပ လ သည ရ စ ရ လ ပ တ ဆ မ ဖ ယ ရ င င ပ ပ င င တ တ လ ပ ရ န မ လ ပ ။ ၃၆ ။ င ဆည မ င ရ ရ သ မဟ တ ဝ န ဌ န င ဏ ပ င င ရ သ သည ဆ ပ ရ တ မ င င ဆ စ ပ သည လယ ယ မ မ တ တ င မ န ရ ၊ စ ပ ရ ၊ ရ ဘ ယ ရ ၊ ရမ စ င န င သ မဟ တ ရ င မ ယ ရ တ ရ တ မ င လ ပ င န ပ ပ င ဆ င ရ ရ န လ ပ ပ စ စ ဉ တ စ ရပ ရ ဆ သ ဆ င ရ တ င ဒသ သ မဟ တ ပ ည န ယ ဆည မ င ရ ရ တ စ ဆင ဝ န ဌ န သ တ င ပ င သည ။ (၉) ၃၇။ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ ၊ င ဆည မ င ရ ရ င မ နယ ဆည မ င ရ ရ တ သည ပ ဒပ ဒ မ ၃၅ ပ သဘ ဝ ဘ ရ ယ ယ ရ လ ပ င န မ ဆ င ရ ရ တ င 32 (c) Regarding the removal under subrule (b) (ii) of rule 33, the relevant person or organization shall pay the compensation. (d) There is no need to compensate for the removal and repair of blockage of the flow of water caused by natural disaster. 36. If the District Irrigation Officer or the person authorized by the Ministry for this purpose needs to repair the drainage in order to prevent flooding, to supply irrigation water for agriculture, water pooling and to repair the farmland related to the drainage, he shall draw up a plan and submit it to the Ministry through the relevant Region or State Irrigation Officer. Chapter IX Measures to be taken for prevention of natural disaster 37. In case of carrying out natural disaster prevention measures under section 35 of the Law by the Region or State Irrigation Officer, District Irrigation Officer, and Township Irrigation Officer: ၃၃ ( ) သဘ ဝ ဘ ရ ယ င ဖ စ ပ လ သည မ ပ ည သ သ မ ၊ ပစ ည မ ပ စ ဆ င ၊ သဘ ဝပတ ဝန င င လ မ စ ပ ရ ဆ မ ပ စ င ၊ ဆ မ လ နည စ ရ တ ပ လ ပ ငန စဉ မ တ င စ မ ရ ဆ ဆ င ရ ရ မ ည (၁) သဘ ဝ ဘ ရ ယ မ ရ မ တ င ပ င ဆင င င ဘ ရ ယ လ ပ ရ ၊ တ င ယ ရ လ ပ င န မ ၊ (၂) သဘ ဝ ဘ ရ ယ ရ သည န င တ စ ပ ည ရ ပ တ ပ န ဆ င ရ င လ ပ င န မ ၊ (၃) သဘ ဝ ဘ ရ ယ ရ ပ န ထ ပ စ မ လ ပ သ သ စ ရ လ ပ င န မ ။ ( ) ထ ပ ဒ ( )ပ စ မ မ တစ စ လ င နည ဆ စ မ စ ဌ နသ တ င ပ ရ မ ည ဖ စ ပ လ ပ ပ စ ဌ န ည ရ ယ ဆ င ရ င သည ။ 33 (a) shall take the following measures in advance to reduce the impact of natural disaster on public life and property, environment and socio-economic structures; (i) preparedness measures for natural disasters, disaster risk reduction, and preventive measures; (ii) emergency responses measures when natural disasters strike; (iii) damage mitigation measures after natural disasters. (b) shall submit projects in subrule (a) above to the Department at least twice a year and, if necessary, may obtain the assistance of the Department. ၃၄ ၃၈။ တ င ဒသ သ မဟ တ ပည နယ ဆည မ င ရ ရ ၊ င ဆည မ င ရ ရ င မ နယ ဆည မ င ရ ရ တ သည ( ) သဘ ဝ ဘ ရ ယ ရ မည တင န မ န သ ရ င ပ ဘ ရ ယ မလ တ င င သ ဆည မ င ၊ တ တမ ရ ယ န ပတ ဝန င တ င နထ င သ မ သ တ စ န ရ လ င တ စ မ တ င သတ ပ ရ မ ည ။ ( ) သဘ ဝ ဘ ရ ယ ရ လ ပါ တည ဆ ပ ဆည မ င မ ပ စ ဆ မ လ ပ စ ရ တ ဆ င ရ ရ တ င လ ပ သ ည ပ ပ မ မ ရရ ရန သ ဆ င ရ ဒ သ ဏ ပ င ဖ စ ည မ ၊ ဌ န ဆ င ရ မ ၊ သ ဘ ဝ ဘ ရ ယ ဆ င ရ စ မ န မ ဖ မ င လ ပ သလ ပ င စပ ည င ဆ င ရ ရမည ။ (၁၀) ၃၉။ ဖ ပပ န တစ ရပ ရပ ဖစ ပ ပ ဆည မ င သ မဟ တ ရ တ မ င တစ ပ ပ စ မ ရ ယ ရ င သည ရ ပ လ ပ ငန မ ဖစ သတ မ တ ရမည ( ) ရ လ င တ မ မ င ဆ ရ သ လ င င သည ရ မ တ ရ ရ ရ လ င တ မ ဘ ပတ လည င မသ ထ စပ သ နရ မ တ င ရစ မ ယ မ ဖစ ပ င ၊ 34 38. Region or State Irrigation Officer, District Irrigation Officer and Township Irrigation Officer shall: (a) notify residents in the vicinity of unsafe area of the dam and embankment of the natural disaster in advance every hour if it may forecast the natural disasters; (b) coordinate with the relevant local authorities, Department, and disaster management teams as needed to obtain the necessary assistance in the mitigation of damage to constructed irrigation when natural disasters strike. Chapter X Emergency Services for Irrigation and Drainage Canals 39. If any of the following situations occurs, it shall be considered as an emergency service for Irrigation or Drainage that could be at risk of any damage: (a) water leakage occurs around the reservoir and the ground contact area as the storage capacity reaches the maximum level; ၃၅ ( ) ရ လ ဆည ဘ ပ င သည ရ တ စ မ င ပ ပ စ မ ဖ စ ပ င ၊ (ဂ) င တစ ရပ ရပ င ရ ပ မ င သ မဟ တ ရ တ မ င ပ င ပ င ၊ (ဃ) တည ဆ ထ န သ မ ထ သ ဆည မ င မ ရ ရ ဒသတ င မစ ရ င ၊ ရ ဆင ရ ယ မ တ င ထ မ ရ န မ ရ သ န င င ရ ပ လ ပ တ င တ မ င ဆ ရ မ တ သ ရ ရ င ။ ၄ ၀ ။ န ည ပ ဒ ၃ ၉ ပ ရ ပ န တ စ ရ ပ ရ ပ ရ လ င သ ဆ င ရ င ဆည မ င ရ ရ သည စ ဌ န သ င တ င ပ လ ပ သည ပ ပ မ မ ရ ရ ရ ဆ င ရ ရ မ ည ပ င ဝ န ဌ န ၊ တ င ဒသ စ ရ ဖ သ မဟ တ ပ ည န ယ စ ရ ဖ သ မဟ တ န ပ ည တ င စ သ င သတ င ပ တ င ပ ရ မ ည ။ ၄ ၁။ ရ ပ သ မဟ တ ရ ပ စ ပ ပ ရ မ သည ပ ဒ ပ ဒ မ ၃၆ ၊ ပ ဒ မ ( ) ရ ရ ပ ရ ယ ရ သည သ မဟ တ ရ ယ ရ င သည ရ ပ သ မဟ တ ရ မ တ ရ ပ လ ပ သ စ ရင ပ စ ရ တ င စ ပ ရ လ ပ ငန လ ပ င သ ဖစ စ၊ မလ ပ င သ ဖစ စ န မ သန စ မ လ ပ ပ င သ လ စ ရင ရမည ။ သ ရ တ င ပ ပ ဂ လ မ ရ ပ လ ပ သ စ ရ င ယ င မ င လ တ င ပ ရ မ ည 35 (b) the downstream part of the diversion weir is damaged by erosion; (c) the bank of Irrigation canal or drainage canal is broken due to any reason; (d) the areas where canals are built and maintained are flooded, catchment areas receive excessive rainfall and water level reaches the maximum high flood level on the Spillway. 40. In the event of an emergency under rule 39, the relevant District Irrigation Officer shall immediately report to the Department to obtain the necessary support, and report immediately to the Ministry, Region or State Government, or Nay Pyi Taw Council. 41. In case of preparing a list of emergency workers by the ward or village tract administrator for wards or villages that are at risk or likely to be at risk under subsection (b) of section 36, he shall enumerate a list of all those who are healthy and able to volunteer, whether they are agriculture workers or not. However, the following persons shall be exempted from the enumeration of emergency workers: ၃၆ ( ) မ သမ မ လ ၊ ( ) သ (၁၈) စ လ သ င ယ မ လ ၊ (ဂ) သ (၆ ၀) စ င ထ မ သ မ လ ၊ (ဃ) ရ ပ စ ပ ပ ရ မ မ ၊ (င) ဗ ဒ ဘ သ ဝ င ရ ဟန သ ဃ တ မ ၊ ဘ သ ရ စ ရပ မ ဆ င ရ န သ ဘ သ ဝ င ပ ဂ လ မ ။ ၄၂။ ( ) သ ဆ င ရ ရပ သ မဟ တ ရ ပ ပ ရ မ သည နည ပ ဒ ၄၁ ရ ရရ သည ရ ပ လ ပ သ စ ရင သ ဆ င ရ မ နယ ပ ပ ရ မ မ တစ ဆင င ပ ပ ရ မ ထ တင ပရမည ။ ( ) သ ဆ င ရ င ပ ပ ရ မ သည နည ပ ဒ ( ) ရ လ ရရ သည ရ ပ လ ပ သ စ ရင သ ဆ င ရ င ဆည မ င ရ ရ ထ ပ ပ ရမည ။ (ဂ) သ ဆ င ရ င ဆည မ င ရ ရ သည နည ပ ဒ ( ) ရ လ ရရ သည ရ ပ လ ပ သ စ ရင ပ လ ပ သ မ ရရ ရ တ သ ဆ င ရ ရပ သ မဟ တ ရ ပ ပ ရ မ ပ ပ စရန တ ဝန ပ ပ ရမည ။ 36 (a) all women; (b) all children under 18 years of age; (c) all men at the age of 60 and above; (d) village tract administrators; (e) buddhist monks, other religious perons engaged in religious affairs. 42. (a) The relevant ward or village administrator shall submit the list of emergency workers collected under rule 41 to the district administrator through the relevant township administrator. (b) The relevant district administrator shall send the list of emergency workers received under subrule (a) to the relevant District Irrigation Officer. (c) The relevant District Irrigation Officer shall assign the relevant ward or village administrator to send the workers included in the list of emergency workers received under subrule (b). ၃၇ (ဃ) နည ပ ဒ (ဂ) ရ ပ ပ သည ရ ပ လ ပ သ မ ဆ င ရ ရမည လ ပ ငန မ င ဆည မ င ရ ရ သတ မ တ ပ ပ ရ ပ လ ပ သ မ လ ပ ငန ဆ င ရ မ မ မ နယ ဆည မ င ရ ရ သ မဟ တ တ ဝန ရ သ န ပ ပ လမ န ရမည ။ ၄ ၃။ င ဆည မ င ရ ရ သည န ည ပ ဒ ၄ ၂ ရ ရ ပ လ ပ င န ဆ င ရ သည ရ ပ လ ပ သ မ တ လ ပ မ ပ င ရ န ပ တ သတ မ တ ရမည ( ) ရ ပ သ မဟ တ ရ ပ စ မ ည စ ရ င ၊ ( ) လ ပ သ ရ တ ၊ (ဂ) ရ ပ လ ပ မ ည လ ၊ (ဃ) လ ပ သ မ တ လ ပ စ န ။ ၄ ၄ ။ င ဆည မ င ရ ရ သ မဟ တ ယင တ ဝ န ပ င ရ သ မ န ယ ဆည မ င ရ ရ သည ဆည မ င င ရ တ မ င ရ ပ လ ပ င န မ ဆ င ရ ရ တ င မ တ တ ဆ ထ မ ဖ စ ပ လ င ဖ စ စ ၊ င ပ င ဆင ရန လ ပ သည မ သ ပ စ ဆ မ ဖ စ ပ လ င ဖ စ စ လ ပ သ ပ စ ည မ င သယ ယ ရန ယ ဉ တ န ဆ ရ မ ရ ယ သ ပ ရ မ ည ။ 37 (d) The District Irrigation Officer shall define the duties of the emergency workers dispatched under subrule (c) and the Township Irrigation Officer or officer in charge shall closely supervise and direct the activities of emergency workers. 43. The District Irrigation Officer shall set the following for the payment of wages for emergency workers who perform emergency work under rule 42: (a) list of ward or village tract; (b) number of workers; (c) emergency period; (d) wages for workers. 44. In the event of an accident or major damage that requires immediate repair while the District Irrigation Officer or Township Irrigation Officer assigned by him is performing irrigation and drainage canal emergency operations, necessary supplies and the vehicles shall be obtained from the nearest village. ၃၈ ၄ ၅ ။ င ဆည မ င ရ ရ သည ပ ဒပ ဒ မ ၃၈ ၊ ပ ဒ မ ( ) ရ သ ပ သ ရ ပ လ ပ သ မ ၊ ပ စ ည ရ ယ မ ၊ သယ ယ စ ရ တ မ င ပ စ ည မ ဖ ယ ရ ရ တ င ပ စ ဆ မ မ လ တ န စ ရ တ တ င ပ ပ ရ မ တ စ ဆ င သ ဆ င သ မ ထ သ ရ ပ င ၃၀ တ င ထ တ ပ ရ မ ည ။ (၁၁) ၄ ၆ ။ ပ ဒ န (၁၂)ပ တ မစ တ စ ရပ ရပ ဖစ စ ၊ တ စ ရပ ထ ပ သ တ မစ မ ဖစ စ ဖ ဖ လ န င သတ င ပ ပ လ ရ ရ လ င သ လည င ၊ မ မ ယ တ င သ ရ လ င သ လည င သ ဆ င ရ ဆည မ င ရ ရ သ မဟ တ ထ င ရ သ သ မ ည သ မ ဆ သ ည ဖ ဖ လ န သ ပ ဒပ ဒ မ ၅ ၀ သ မဟ တ ပ ဒ မ ၅ ၁ ရ ရ ယ င ရ တ သ ဆ င ရ ရ စ န တ င ပ ထမ သတ င ပ တ င တ န ရ ဖ င တ ရ စ ဆ ရမ ည ။ ၄၇။ စ ဌ နသည ရ သ တ ဖ ပန ပ င လ မ င ဖစ စ၊ မ မ မ န င သည င တ စ ရပ ရပ င ဖစ စ ဆည မ င လ ပ င န မ ပ စ ဆ မ ဖ စ ပ လ ပ လ ပ သ စ စမ လ လ တ င တ င ၊ ပန လည တည ဆ င င ဆင မင ပ ပင ထ န သ မ င လ ပ ငန မ ဝ န ဌ န င ပ ဖ င ဆ င ရ င သည ။ 38 45. The District Irrigation Officer shall calculate all payments for emergency workers, requirement, transportation charges and all damage occurred in removing items under subsection (a) of section 38 and pay it to the concerned persons through the district administrator within 30 days. Chapter XI Miscellaneous 46. If the related Irrigation Officer or any other person receives any information or knows that any person violates one or more prohibitions in Chapter XII of the Law, he shall file a first Information Report with the relevant police station so that action shall be taken against the person under section 50 or 51 of the Law. 47.
