Article 2- The Project 2.1 The Project aims at supporting the development of a network of Marine Protected Areas (MPAs) and an associated monitoring program to evaluate the effectiveness of its management. Moreover, the project will assist the Ministry of Environment experts, local communities and relevant actors in designing and managing marine protected areas, restoring impacted marine habitats and species in Lebanon as well as improving knowledge relevant to management of marine resources. 2.2 The key outputs of the project, separated in three sub-objectives, will be the following: a. Identification and selection of potential MPAs for declaration or sensitive marine areas for conservation including the preparation of: Maps of significant or sensitive marine habitats of Lebanon; Maps of marine based human activities and resource interactions; A strategy on priority areas to protect, manage or rehabilitate. b. Selection of 2 or 3 potential MPAs sites and preparation of: A zoning scheme and delineation of proposed boundaries of candidate MPAs; A monitoring manual based on the results of marine biodiversity assessments including monitoring indicators and survey or sampling methodologies. c. Reinforcing the capacity of the MoE Staff in marine expertise through: Identification of training needs and of national institutions and experts that can support and sustain monitoring; Training sessions on MPA design, management, monitoring, effectiveness and GIS decision support; Identification of options for funding training and related equipment; Secondment to the MoE of an IUCN marine expert. The draft initial action plan already developed is found as an annex to this memorandum. This draft action plan is to be revisited and fine-tuned after the issuance of the endorsement decree. 2.3 The financial support for project activities is estimated at 89,000 euros. This funding was provided to IUCN-Med by the Spanish Agency for International Cooperation and Development (AECID) and the Organismo Autonomo de Parques Nacionales of Spain (OAPN). IUCN-Med will directly implement this programme and IUCN experts will provide technical support to the MoE on matters relating to MPA planning and management and marine monitoring design throughout the period of the project. 2.4 The budget will be made available for the implementation of the three objectives of section 2.2 above of the project as per the following budget allocation: Objective a:€ 30,000 (Thirty thousand euros) Objective b: € 32,000 (Thirty two thousand euros) Objective c: € 27,000 (Twenty seven thousand euros) A budget re-allocation among the different objectives will be allowed up to a maximum level of 10%. IUCN-Med, in coordination with MoE, will make its best effort to involve all relevant agencies, experts and partners at the national level in this project to ensure its sustainability. 2.6 IUCN-Med, in mutual agreement wit'1 . MoE, will identify the most adequate capacity development priorities and the target groups to benefit from that. 2.7 IUCN-Med will second an expert to MoE for part of the duration of this project to deal directly with its implementation, deciding on that in close collaboration with MoE. Article 3 - Roles and Responsibilities of the Parties 3.1 To ensure the success of the Project, IUCN-Med and the MoE will have specific roles and responsibilities listed in this MOU. 3.2 IUCN-Med, throughout the implementation period of this project within the three identified sub-objectives, will be responsible for: a. Identification and selection of potential MPAs for declaration or sensitive marine areas for conseNation. The identification and assessment of the sites will depend primarily on the possibility to access the sites for undertaking the survey. When the conditions of safety, security and logistical accessibility are provided, the process of identification and selection will include: The collection and review of relevant information and data relatl ng to the Lebanese marine environment; Provision of technical assistance In the identification of significant or sensitive marine habitats of Lebanon; Supporting the preparation of ecosystem/hab itat maps as well as the validation of satellite images and habitats maps; The preparation of a strategy paper on how to protect, manage or rehabilitate priority areas b. Based on the previous point and after validation by the MoE and selection of 2 or 3 potential MPAs sites, the preparation of: A zoning scheme and delineation of proposed boundaries of candidate MPAs; A consultation process (participatory approach) with the communities and experts on the selected areas and the proposed zoning, including providing support to MoE in the preparation of legal and administrative documents for the designation of the protected areas: A monitoring programme based on the results of marine biodiversity assessments including the identification of monitoring indicators and the survey or sampling methodology. c. Reinforcement of the capacity of the MoE Staff in marine expertise through: The identification of gaps and capacity development needs of national institutions and experts that can support and sustain monitoring; Training sessions on MPA design, management, monitoring and effectiveness; The development of a public awareness and environmental education program for marine conservation in general and the benefits of MPAs in particular; The identification of options for funding training and related equipment; The secondment to the MoE of an IUCN marine expert. In addition, IUCN will: a) Provide the MOE with periodic progress reports; b) Provide required insurance to relevant project staff and ensure that any incident affecting project staff in performing their duties is not the responsibility of the Ministry of Environment; b) Provide MOE with a detailed final report that is inclusive of technical and financial aspects of the work undertaken; c) Emphasize the positioning of the MoE logo on all products and outputs related to this project d) Co-operate with the MoE in the development, resource mobilization and implementation of a Phase II of this project or potential linkages to the GEF mechanism or other funding opportunities, 3.3 MOE, to the best of its ability and in the limit of its legal and administrative prerogatives, will: a) Designate MoE representatives to be involved with the Project implementation, who will: Facilitate close communications and cooperation of all concerned MoE units, GOL Ministries and other GOL agencies as well as municipalities, experts and relevant partners for all Project activities; Contribute to GIS support relevant to collating and managing the digital data and creating habitat and sensitivity maps; Monitor that the implementation of this project responds to MoE priorities and needs. b) Ensure to the best of its ability that IUCN experts have unhindered access to all Project work sites and help with commuting to project areas; c) Provide the IUCN-Med seconded expert with office space for facilitating the implementation of project activities; d) Identify, after receipt of the progress and final reports, follow-up work needed after completion of the first phase. e) Jointly with IUCN-Med, develop Phase II of this project, undertake resource mobilization, identify potential linkages to the GEF mechanism or other funding opportunities and carry out its implementation; f) Emphasize the contribution of IUCN as well as Spanish Agency for International Cooperation and Development (AECID). and the Organismo Aut6nomo de Parques Nacionales 1>f Spain (OAPN), through the positioning of their logos, on the equipment and on all documents and in all activities related to this project. 3.4 W~hout prejudice to the rights of any Party, both Parties will coordinate on the release of joint press releases concerning the work carried out under this MoU. Article 4 - General Provisions 4.1 This MOU shall enter into full force upon the date of issuance of the endorsement decree and remain in force for a period of 2 years and will be only be extended upon the written approval by the duly authorized representatives of both Parties. 4.2 Either Party may terminate or suspend this MOU by giving 30 (thirty) days written notice to the other Party. Termination of this MOU will terminate all responsibilities of the Parties on and after the date of termination. Neither Party obligates or commits, or promises to obli9ate or commit, any funding to any Party of this MOU or any other party by signing this MOU. Nevertheless, it is the intention of the Parties, subject to availability of their respective funding for this· purpose, to carry out, in good faith, their roles and responsibilities as described in this MOU. 4.4 The Parties to this MOU will take all appropriate steps to ensure that no organization or individual participating in the Project will seek, accept, or get promises directly or indirectly for themselves or for another party for, a gift or benefit which or could be construed as an illegal or corrupt practice under any applicable law. IN WITNESS WHEREOF, the Parties, acting through their duly authorized representatives, have caused this MOU to be signed in their names below.
