Decree No. 155/PM on Natural resource for medicines (Pharmaceutical Natural resource)

Lao People Democratic Republic Peace Independence Democracy Unity Prosperity Prime Minister’s office No. 155/PM Decree on Natural resource for medicines (Pharmaceutical Natural resource) Reference to:  The Law on Government of Lao PDR Ref no 01/95/NA, dated 8 March 1995;  Law on Forestry Ref no 01/96, dated 11 October 1996;  Law on Drug and medical products Ref no 01/NA, dated 8 April 2000.  Request of the Minister of Ministry of Health. The Prime Minister hereby issues this decree Section I General Provisions Article 1. Objective This decree aims to set out requirements, principles, measures on the promotion, control, delve, production, plantation, nurture and the use of pharmaceutical natural resources in order to protect pharmaceutical natural resource, prosperity of nature and to ensure the sustainability of pharmaceutical natural resources. Article 2. Definitions of medicinal natural resource Medicinal natural resources are the medicinal natural material (Material Medical Pharmacognosy/matiere medicale) or any material which is sourced from natural sources such as: plant, animal and minerals that can be used as raw materials for traditional or modern medicines production. Article 3. The obligation to promote, manage and protect pharmaceutical natural resources All related public organizations at all levels have a duty to supervise, direct, manage, promote the protection of pharmaceutical natural resources, plant medicinal plants and animal husbandry for medicine through information dissemination, educating citizen to perceive the importance and value of pharmaceutical natural resources in the healthcare of the population and the national economic development and benefits that the citizen will receive from paying attention to the protection and management of pharmaceutical natural resources. Lao citizen, aliens, non-citizen and foreigner residing in Lao PDR, who are permitted to conduct business and produce medicines from pharmaceutical natural resources, have an obligation to protect the aforementioned natural resources, and have a duty to plant and nurture supplementary ones to compensate the utilized ones in order to ensure sustainability. Article 4. Basic principles for promoting the use, management, protection and plantation\husbandry of pharmaceutical natural resources Basic principles to promote, manage, and protect pharmaceutical natural resources are as follows: 1. Regard management and protection of pharmaceutical natural resources as main function, and take the plantation and husbandry to supplement the use up as an important work. 2. The exploitation of medicinal natural resources shall be correlated with research work; the production of traditional and modern medicines shall have an administrative and protective plan. 3. Individuals, organizations in Lao PDR and beneficiaries from the use of pharmaceutical natural resources have a duty to protect national medicinal natural resources, 4. Any individual or organization who causes damage to medicinal natural resources and pharmaceutical resources shall be accountable to the law; 5. The medicinal natural resources shall be used effectively and according to the plan for a sustainable development of biodiversity. Article 5. International coordination and cooperation The state widely welcomes and supports international cooperation in terms of investment, exchange of experiences, human resources development and others based on government policy on implementing protection and management of natural resources for medicines. Section II Management, Protection, Exploration and Use of Medical Natural Resources Article 6. Exploration of the medicinal natural resources The exploration, post-harvest of medicinal natural resources, should have proper method and technique. Also the exploration should be conducted in the right season that has least impact on the expansion of plant and animal breed for sustainability of the medicinal natural resources. Article 7. Category and type of medicinal national resources Medicinal natural resources are divided into the following categories and types: 1. Medicinal plants, animals and minerals that are not easily discovered in nature and are likely to be extinct are classified in the list of group I; 2. Medicinal plant, animal and minerals that have economic potential and could be used to produce goods for domestic consumption and export are classified in the list of group II; 3. Medicinal plant, animal and minerals that are widespread in nature are classified in the list of group III; 4. Drug Regulatory Authorities in manufacturing or exporting countries shall be controlled by Food and Drug Department of the Ministry of Health. Article 8. Control and permit of the medicinal natural resources’ exploration Individuals or organizations who explore, hunt medicinal animals, transport, operate storage, process and make use of medicinal natural resources shall be authorized by the relevant authorities and be strictly compliant with the Law on drug and medical products, Law on Forestry, Law on environment protection and other related regulations: 1. Harvest, exploration of medicinal plant and hunting of medicinal animals classified in the list of group I shall be permitted by Ministry of Health and related agencies; 2. Harvest, exploration of medicinal plant and hunting of medicinal animal classified in the list of group II shall be covered by a harvesting plan and substitute planting plan that shall be authorized by the Ministry of Health and related agencies; 3. Harvest, exploration of medicinal plant and hunting medicinal animal classified in the list of group III shall be conducted according to the principles and requirements of the Ministry of Health and related agencies; 4. Any import and export of medicinal seed, animal, insect, microorganism and minerals shall be strictly compliant with the requirements and measures related to the management of pharmaceutical resources; 5. The Government encourages Lao citizens to invest in planting and raising medicinal plants and animal respectively to become economic goods for domestic consumption or export. That aims to replace opium planting and slash-and-burn; 6. The government protects intellectual property of all types of the medicinal natural resources and traditional knowledge including successful outcomes of scientific researches toward such matters both within the country and abroad. Article 9. The obligation medicinal natural resources’ exploration Individuals and organizations who obtain a permit to explore or harvest medicinal plants and hunt medicinal animals to be used in the production and distribution within the country and abroad shall implement obligations in accordance to a decision of the approved authorities in order to contribute in the maintenance and restoration of the ecology system. Section III Administrative and Protective Authority of Medicinal Natural Resources Article 10. The administrative and protective authority of medicinal natural resources The administrative and protective authority of the medicinal natural resources comprises central and local authorities: a. The administrative authority at the central level is the ministry of Health that has the following duties: 1. Develop legislations and measures to administer, explore, use and protect the medicinal natural resources; 2. Control the exploration and use of medicinal natural resources; 3. Supervise a survey of the medicinal natural resources to improve or add to the list of medicinal natural resources that need to be recorded in the list for a conservation and protection of the aforementioned resources; 4. Organize scientific research continuously, search for medical substance for the development and use, and production of drugs treated diseases. 5. Provide comments to competent authorities for issuing investment permits to explore and administer medicinal natural resources; 6. International cooperation on management, exploration and protection of the medicinal natural resources; 7. Coordinate and cooperate with the Ministry of agriculture in administering, exploring and protecting medicinal natural resources. 8. Coordinate with the ministry of finance and other related agencies to control the expiration of medicinal resources which are banned, and prohibited for export; b. The administrative and protective authorities at local level in provincial, Capital and special area are health authorities that have the following rights and duties: 1. Identify, classify the type of medicinal natural resources that are not easily discovered, have economic value and are widespread to protect, develop and expand medicinal natural resources; 2. Control the exploration, use and conservation of medicinal natural resources in their own area; 3. Conduct a survey about the medicinal natural resources especially the medicinal plants that are available in local area, and pay attention to species that are likely extinct or harvested in a significant quantity. They shall be added to the list of the medicinal plant for conservation; 4. Implement the requirements and measures identified by the central administrative and protective authority of medicinal natural resources; 5. Provide advice to provincial, Vientiane capital and special zone authorities on the management, exploitation, exploration and protection of medicinal natural resources; 6. Cooperate with the provincial, Vientiane Capital, special zone office of agriculture and forestry in the activities of management, exploitation, exploration, and protection of medicinal natural resources; 7. Report about the management, exploitation, exploration and protection of medicinal natural resources to the central administrative and protective authority of the medicinal natural resources regularly; 8. Implement other functions as being assigned. Section IV Incentive and sanction Article 11. Incentive Individuals or organizations that are outstanding in contributing to the protection of medicinal natural resources shall be commended or given incentives appropriately. Article 12. Sanction for infringers Individuals or organizations that violate this Degree shall be educated, fined or prosecuted based on the law depending on whether the case is serious or not including a compensation for damages occurred from such infringement. Section IV Final Provision Article 13. Implementation The Ministry of Health, related agencies and local authority shall be responsible for strict implementation of these regulations Article 14. Effectiveness The decree on medicinal natural resources is effective from the date of signature. The regulation, directive and provisions that are contradicted with this decree shall be cancelled.
